1. The requirement shown above is only approximate and the supply will be made as per actual requirement intimated by the Dietician/Matron/Kitchen in charge sister.

2. It is assumed that you will supply Bread of Cremica / Modern/ Britannia/ Samrat.

3. The Rates quoted should be inclusive of all sales tax. local tax etc and free delivery at Central Railway Hospital Kalyan.

4. The successful tenderer will have to deposit amount equivalent 5% of the total cost of the contract towards the security deposit and 5% the contract value as per performance Guarantee of Nationalize Bank. And to execute an agreement.

Agreement made on _________ between the President of India acting through CMS

Kalyan as Owner of administrating the Central Railway (herein after called “The

administration”) of the one part and _______________ Contractor/Supplier of the

other part.

Whereas the Contractor shall Supply Bread and Eggs to Central Railway Hospital, at

Kalyan on the terms and conditions mention here in after, The contractor will

deposited with the administration a sum equal of 10% of the total value of the

contract amounting Rs.____________- (Rupees _____________________ Only) as

security for the due and faithful performance of the contract and for the purpose

herein after mentioned Now it is hereby agreed by and between the said parties here

to as follows:-

All the above mention rates are Inclusive of all the taxes and cost of free delivery at

For the purpose of this agreement the administration will ordinarily will be

represented though Divisional Railway Manager Central Railway Mumbai C.S.T.M

(Hereinafter referred to as the controlling Officer) or any other authorized

subordinates and the contractor will receive all instruction in regards to the supply to

be made.

Unless otherwise agreed to between the Administration and the Contractor the

Contractor shall within 30 days from the date of acceptance of the tender deposit

with chief cashier Central Railway, Mumbai C.S.T. amount of Rs. ________/-

(Rupees __________________________ Only) Through cash or FDR S.G. of the

supply of detailed as per the scheduled as security fulfillment of the corn-act No

interest shall be payable on such deposit. It the contract is cancelled for any reason

what so even and security deposit will be forfeited. In case cancellation of contract,

the supplier shall not be entitled to claim any damage/loss from the Administration.

No firm order shall be placed until the supplier remit the security deposit and submit

the money receipt for the said amount so deposited to the Chief Medical

Superintendent, Central Railway Hospital.

1) Item should be delivered at C. Rly Hospital Kalyan in Contractor container

(Between 8.00 Am to 8.30 Am).

2) The daily actual requirement should be obtained from the Dietician/Steward of I/c

of the kitchen or the Authorised person

3) The rates quoted should be inclusive of the all Tax. Local Tax etc.

The Contractor has agreed to supply Bread and Eggs to Central Railway • Hospital.

Kalyan as against Tender No. KYN/ H/E./Tender Bread and Eggs 2018-20 dated

10/3/2018 floated by the Railway and the Railway Administration have accepted the

offer and both parties have agreed on the following terms and conditions. That the

supply of Bread and Eggs are meant for the patient in Railway Hospital and

contractor has agreed to supply the same of good quality during the period of

contract without any interruptions irrespective of any facts/ incident / dispute.

Tender for supply of Bread and Eggs is for C. Rly. Hospital Kalyan. Contract period

Total Value Rs.______________/- The Security deposit is liable to be forfeited either

in the part or in full at the discretion of the Administration in the event of the failure on

the part of the Contractor to comply. In the event of the failure on the part Supplier to

comply, with the Conditions of the contract in all or any respect or in the event of the

supply not being according to the specification as revealed by visual test or by

analysis of materials obtained from time to time. The security deposit shall also be

forfeited if the supply does not confirm to the standard prescribed by the

Administration for the purpose. The security deposits will be refunded without any

interest to the Contractor on satisfactory completion of the contract.

Subject to the right of the Administration for earlier termination of the agreement

hereinafter contained. the supplier shall for the period from on the Commencing at

00.00 hours on the _______ and ending at midnight on 05/04/2018 on each and

every day including Sunday and Public Holidays

supply to the Railway Hospital Kayan The required items at the rates shown therein

and on the terms and conditions as laid down. The supplier during the continuance

of this agreement shall supply the Central Railway Hospital, Kalyan the place

specified, fresh Materials as stated above as specified by the Matron/Sister Sister

I/c, Dietician or any other representative authorized by the Administration for the

purpose on the Indents placed by her/him. The Supplier shall obtain on indents In

the prescribed form on each occasion from the Matron/Sister I/c or any other

authorized person to be supplied. In case supplied material or any part thereof which

does not appear satisfactory, by visual or such other test the administration or any

authorised person on this behalf may consider reasonable in its absolute direction,

the supplier shall replace such rejected material and will supply fresh material of

specified quality within (two) 2 hours, failing which the material shall be purchase

from open market and difference of cost for said purchases shall be recovered from

the Supplier. The decision of the Matron/ Sister I/c or any authorized representative

in rejecting the supply under this clause shall be final.

No extension in schedule time as would be prescribed by the administration from

time to time for delivery of the materials under the contract will be permissible under

any circumstances.

Representation from either side will be entertained for increased or decrease

in the tender rates on plea of fluctuation in the market rates.

The whole order shall be executed in the most approved and workman like manner to the entire satisfaction of the Administration. In the event of the supplier's failure to supply the materials indented for or supplying defective and adulterated goods or he having failed to supply strictly according to the specification. The Administration shall without prejudice to any other right or remedy open to it be entitled to impose a penalty equal to cost of day’s supply on each occasion of default and shall also be entitled to purchase the recurred quantity on the account and at the risk of the supplier from open market and the Supplier shall be liable for any loss or damage which the administration may sustain by reason of such failure on his part, All such loss damages sustained by the administration of this account shall be recovered by the Administration from the Supplier.

The Chief Medical Superintendent /Divisional Medical Officer. Kalyan or his

authorized representative shall he entitled to inspect the raw ingredient of food

before delivery without notice,

The supplier shall at all times indemnify the Administration against all claims which

may be arise out of said contract for infringement of any right protected by patient,

Registration of design or trademark, provided always that in the event of any claim in

respect of an alleged breach of potent, Registered design or Trade mark being made

against the Administration, the administration shall notify the Soppier of the same

and supplier shall be at liberty, but at his own expense, the conduct negotiation for

settlement or any litigation that my arise there from.

The supplier shall not sublet or assign this contract or any part thereof or any interest therein without the written permission of the administration, In the event of the supplier's. Subletting or assigning. this contract or any interest therein or any part thereof without such written permission, the administration shall be entitled to cancel the contract forthwith and to purchase the required items or raw ingredients of food elsewhere on the Supplier's account and risk and the supplier shall be liable for any loss or damage which the administration any sustain consequence or arising out of such purchase.

When any of the items or raw ingredients of food delivered for inspection are rejected by the administration they shall be replaced at the supplier’s risk from the date of such rejection. If the material is not removed immediately after the administration or Its authorized representative shall have the right to dispose of such thing In the manner as the administration thanks fit at the supplier's risk

and cost on his account.

Payment will be made only for the quantity of supply accepted by the Chief Medical

Superintendent/ District Medical Officer/ Divisional Assistant medical Officer, Central

Railway Hospital, Kalyan or any other Railway Official so authorized to accept

monthly in triplicate and submitted to Medical Superintendent! District Medical Officer

/ Divisional Assistant Medical Officer, Central Railway, Kalyan who will scrutinize and

pass them after such deduction as may be necessary under The provision of this

agreement or any other provisions. Payment will be made by Cheques on the

Reserve Bank of India, Mumbai Bills are not negotiable and should not be made

Payable to a Bank, unless the Bank holds a valid Power of Attorney and suck Power

of Attorney has been registered with the administrate.

Any bribe, commission, gift or advantage given promised to be given on or after by

or on behalf of the supplier or agent or servant to representative of the administration

to obtain or in execution of this or any other contract with the administration, shall in

addition to any criminal liability which he may incur, subject the supplier cancellation

of this and all other contracts of the supplier with the administration and also to

payment of any loss of damages resulting from any such cancellation, and the

administration shall be entitle to deduct the amount so payable from any moneys

otherwise due to the supplier under this or any other contract. Any question or

dispute regarding the commission or otherwise of any offence by the supplier under

the present clause shall be determined by the Chief Medical Superintendent! District

Medical Officer / Divisional Assistant Medical Officer, Central Railway, Kalyan in

such Manner and on such evidence or information as he shall think fit and sufficient

and his decision in this respect shall be final and compulsively binding on the

supplier.

The administration shall have a lien and also reserves the right they retain and set

off against any sum which may, from time to time be due to and payable to the

contractors hereunder, any claim which the administration may have against the

contactor's hereunder. any claim which the administration may have against under

this or any other agreement.

The administration shall be at liberty at any time to suspend temporarily or terminate

permanently this contract on giving 24 hours' notice in writing to the contractors for

breach of any of the terms and conditions of this agreement or for bad / in-efficient

service or misconduct on part of the contractors his agent or servant as to which the

decision of the Medical Superintendent! Divisional Medical, Officer, Central Railway,

Kalyan shall be final and the Contractors shall not be entitled to any damage or

compensation by reason thereof.

Subject as otherwise, provided in this contract, all notice to be given on behalf of the

President of the Union of India and shall other action to be taken on his behalf may

be given or taken on his behalf by the Medical Superintendent. Central Railway,

Kalyan or any officer for the time being entrusted with the function and powers of the

said Chief Medical Superintendent, Central Railway Kalyan.

The Contractor shall not be entitled for any free passes. To cover the distance from

his office to Railway Hospital, Kalyan.

In the event of any question, dispute of difference what so ever at any time arising

under the condition of contract or in any other manner under this contract or in any

way reaching there to or as to the true meaning or interruption of any of the revision

thereof [except as to any matters for which the decision is specially provided for any

condition of the contract) the same shall be referred to for decision to a sole

Arbitrator who shall be the General Manager or a person a appointed by him in that

behalf and the decision of the Arbitrator shall be final and binding on both the

parties. It will be the sole discretion of the General Manager as to who should be the

Arbitrator it will be no objection that the Arbitrator is a Govt. Servant and that he had

to deal with the matters to which the contract relates

or that In the courses of his duties as a Govt. Servant he has expressed views on all

or any or the matters In question, dispute or difference.

In the event of the Arbitrator appointed by the General Manager neglecting or

refusing to act or being incapable or unable to act for any reason, what so ever, it

shall be lawful for the General Manager to appointed Arbitrator in place of the

outgoing Arbitrator in the manager aforesaid.

The arbitrator may from tune to time, with the consent of the parties to the contract

enlarge the time of making the award.

Subject as foresaid, the Indian Arbitration Act, and the rule where under and any

statutory modification thereof for the time being in force shall be deemed to the

arbitration proceedings under the clause.

All notices and references here under shall be deemed to have been duly served

and given to the contractors if delivered to the contractors or their authorized agent

or left at or sent by registered post to the address stated herein before and to the

administration if delivered to the Chief Medical Superintendent, Central Railway

Hospital, Kalyan or sent by registered post or / left at his office during office hours on

any working day.

In witness thereof, the Chief Medical Superintendent, Central Railway Hospital,

Kalyan for and on behalf of the president of the Union of India and the above name

contractor has herein to set their respective hands to day and year first above

written.

and damage with specific brand as mentioned In supply order dtd. ---------------------

2018 to be done, Failure on the part of supplier will invite penalty of Rs. 500/- on

each occasion and same will be deducted from the bill payable by the Rly

Administration for the Contract period from 06.04.2018 to 05.04.2020 total cost of

the Contract is Rs. 6,22,080/- (Rs. Six Lakh Twenty two Thousand Eighty only) .

In witness thereof. the Chief Medical Superintendent, Central Railway Hospital,

Kalyan for and on behalf of the president of the Union of India the above name

contractor have herein to set their respective hands to pay and year first above

written. Agreement will be executed as per the existing rules amended from time to

time
