NOTE ON THE CONSTITUTION AND ACTIVITIES OF TIRUPATI URBAN DEVELOPMENT AUTHORITY.

The Tirupati Urban Development Authority is constituted under the A.P. Urban Areas Development Act 1975. in G.O. Ms.No. 1178, M.A. Dated 6.11.1981, the Government declared Tirupati town and 89 villages as Development area for the T.U.D.A. The object of the authority is to promote and secure orderly development of all or any of the areas comprised in the development area according to plan. The Government in G.O.Ms.No.520 M.A & U.D Department dated 29.7.2008 have included Srikalahasri Puttoor towns and surrounding 69 villages in addition to the Tirupati and 89 surrounding villages in the Jurisdiction of Tilrupati Urban Development Authority. The development area extend to about 1211.51 sq.kms. covering Tirupati Municipal Corporation, the holy pilgrim area of Tirumala Hills, important railway junction of Renigunta, historical place of Chandragiri, Sri Kalahasti, Puttur and 160 villages. Tirupati, a holy town which attracts a huge number of pilgrims and there is a rapid growth of population, area, density. In view of the above reason there is a heavy stress on existing road network and transportation. Infrastructure and on existing physical infrastructure like water supply, sewerage, solid waste management and environment. For carrying out the day-to-day functions of the Authority, the office of the Urban Development Authority is headed by the Vice-Chairman as the Chief Executive. The Secretary is the overall supervising head of entire office, which has been delegated by the Vice-Chairman. The office is supported by the following sections.

The Government have sanctioned certain posts to this authority for running the administration in the following Government orders.

1. G.O.Ms.No. 344, M.A.., dated 7.4.1982. . 2. G.O.Ms.No. 73, M.A., dated 3.2.1984. 3. G.O. Ms.No. 79, M.A. dated 21.2.1985. 4. G.O.Ms.No. 278, M.A., dated 11.6.1986. 5. G.O.Ms.No. 279, M.A, dated 11.6.1986. 6. G.O. Rt. No. 1114, M.A., dated 26.7.1986. (Secretary post on regular basis) 7. G.O.Ms.No. 1682 M.A., dated 30.8.1986. 8. G.O.Ms.No. 601, M.A., dated 6.5.1991. 9. G.O.Ms.No. 209, M.A., dated 16.2.1993.

The total number of posts sanctioned in the above G.O’s are 87. Including the post of Secretary which is sanctioned on regular basis, all the 86 posts are being renewed every year. The last renewal of posts is upto 28.2.2016. The posts sanctioned to this authority, no. filled and vacancy position is annexed to this report.

The Government in their Memo No. 789/B1/85-2, M.A. Dated 24.4.1986 have imposed ban on recruitment and directed not to make

any appointment or promote to the posts sanctioned without prior permission of the Government as there is proposal to create common cadre of the Urban Development Authorities in the State. Further the Government in their letter No. 818/B1/92-1, M.A. dated 18-05-92 have permitted the Vice-Chairman, T.U.D.A. to make promotions by considering the eligible and suitable candidates to the available vacancies while lifting up the ban imposed.

The Government in G.O. Ms.No. 368, M.A dated 31.7.1985 have directed to adopt the Hyderabad Staff (Recruitment and Service)

Regulations, 1979 to the staff working in Tirupati Urban Development Authority. The Government in G.O.Ms.No. 332 M.A. & UD Department, dated 17.8.2004 have issued orders that all the Government

Rules/Regulations and Service conditions as issued by the State Government from time to time as applicable to Hyderabad Urban Development Authority are also applicable to Tirupati Urban Development Authority.

The Government in G.O.Ms. N. 424, M.A. dated 4.8.1994 have informed that the proposal for issue of unified service regulations for

the persons in all the Urban Development Authorities may take some more time and decided that the A.P. Ministerial Service Rules which are now applicable to the State Government employees shall be adopted to the Staff working in all the Urban Development Authorities.

Since the Common Unified Service Rules for all the Urban Development Authorities is not yet formed, there are no transfers among

the staff working in all the Urban Development Authorities in the State.

Read the following:-

1. Whereas, in the notification issued in G. O. Ms. No.1178, M.A., dated 06-11-1981, Government have declared the areas consisting of Tirupati Town and 89 villages falling in the erstwhile Chandragiri Taluq of Chittoor district under clause(o) of Section 2 of the Andhra Pradesh Urban Areas (Development) Act, 1975 (Act I of 1975) as Tirupati Urban Development Authority area. 2. And whereas, in view of the rapid urbanization with the spurt in the economic development all around the Tirupati Urban Development Authority area there is immediate need to include the villages mentioned in the schedule appended to this order in the jurisdiction of Tirupati Urban Development Authority area as these villages are abutting the national highway and major district roads. It is essential to include these villages for better planning and contiguous development along the national highway and major roads.

3. In the above context, Government have decided that the present jurisdiction of Tirupati Urban Development Authority shall be extended under the provisions of the existing Andhra Pradesh Urban Areas (Development) Act, 1975.

26 4. Therefore, the following notification shall be published in the extraordinary issue of the Andhra Pradesh Gazette dated 1-8-2008. The Commissioner, Printing, Stationary and Stores Purchase, Andhra Pradesh is requested to arrange for publication of the Notification and supply 100 copies to the Government.

In the circumstances explained by the Vice-Chairman, Tirupati Urban Development Authority in the references 4th &

6th read above, Government decided to delegate the powers conferred on them under sections 13, 14, 27, 40 to 46 and 48 to 51 of the Andhra Pradesh Urban Areas (Development) Act, 1975 to all Panchayat Secretaries under the jurisdiction of Tirupati Urban Development Authority. The list of the villages is annexed to this order.

2. The following notification shall be published in the Andhra Pradesh Gazette.

NOTIFICATION In exercise of the powers conferred under sub-section (2) of Section 56 of the Andhra Pradesh Urban Areas (Development) Act, 1975 (Andhra Pradesh Act.No.1 of 1975), Government hereby delegate the powers conferred on them under sections 13, 14, 27, 40 to 46 and 48 to 51 of the said Act to all Panchayat Secretaries of the villages specified in the annexure under the jurisdiction of Tirupati Urban Development Auhority with the following powers, namely:-

(1) Grant of residential building permissions only for G+2 floors in layouts approved by Tirupati

Urban Development Authority subject to the conditions that the height of the building does not exceed 10 Mtrs., including parking floor from road level & plot area is below 1,000 Sq.mts.

(2) Residential Building permissions in village settlement areas (subject to the condition that the

Panchayats shall get the plan for extended village settlement area approved by Urban Development Authority)

(3) Row-type shopping (however they should be limited to settlement areas and on roads of 40 feet

& below) subject to Urban Development Authority regulations Plot sub- division permissions in the approved layouts (As per the rules for layouts).

(4) These provisions i.e., from 1 to 3 shall be exercised by the Panchayats for the areas beyond

200 Mtrs. from State & National Highways & 100 Mtrs., from 30 Mtrs., and above roads.

(5) Levy of penalties and to take action against unauthorized & illegal constructions and developments as per the provisions of the Andhra Pradesh Urban Areas (Development) Act, 1975.

(6) To Levy & get the development charges paid directly in the Urban Development Authority account

in the designated branches of banks, as per the rates prescribed by the Government from time to time wherever the Panchayat Secretary gives building permission as per the delegation.

(7) To take action on all constructions either made in deviation to approved plan or unauthorizedly.

The Urban Development Authority issues only Technical sanction in respect of all other cases and the local authority is the “Enforcement Authority” in all other cases irrespective of delegation.

3. The above delegation of powers to the Panchayat Secretaries under the jurisdiction of Tirupati Urban Development Authority shall be subject to the fulfillment of the following conditions, namely :-

(1) The Panchayats shall maintain a Register showing the details of building permission accorded in the following form :

(3) The above delegated powers are subject to overall conformity with the provisions of Master

Plan / Zonal Development Plan and uses, Zoning Regulations, building rules issued by the Government from time to time.

(4) The officers of the Tirupati Urban Development Authority shall conduct periodical

inspections of the Gram Panchayats to give necessary guidelines for disposal of cases as well as to check the permissions.

(5) The Officers of the Tirupati Urban Development Authority shall have powers of surprise

inspection of Panchayat Offices for verification of records pertaining to development control and the buildings under construction and also other areas along with the Panchayat Secretaries of the concerned Gram Panchayats.

(6) The Panchayat Secretary shall send a copy of approved plan to Urban Development Authority immediately after approval and a list of cases with amount of Development Charges paid to Urban Development Authority every month.

. The above delegation of powers shall be strictly adhered by the Panchayat Secretaries and if any irregularity / deviation noticed / reported, this delegation of powers shall stand withdrawn forthwith.

In the circumstances explained by the Vice-Chairman, Tirupati Urban Development

Authority in the reference 5th read above, Government decided to delegate the powers conferred on them under sections 13, 14, 27, 40 to 46 and 48 to 51 of the Andhra Pradesh Urban Areas (Development) Act, 1975 to all Panchayat Secretaries under the jurisdiction of Tirupati Urban Development Authority (extended area). The list of the villages is annexed to this order.

2. The following notification shall be published in the Andhra Pradesh Gazette.

N O T I F I C A T I O N

In exercise of the powers conferred under sub-section (2) of section 56 of the Andhra Pradesh Urban Areas (Development) Act, 1975 (Andhra Pradesh Act.No.1 of 1975), Government hereby delegate the powers conferred on them under sections 13, 14, 27, 40 to 46 and 48 to 51 of the said Act to all Panchayat Secretaries of the villages specified in the Annexure under the jurisdiction of Tirupati Urban Development Authority (extended area) with the following powers, namely:-

(1) Grant of residential building permissions only for G+2 floors in layouts

approved by Tiruapti Urban Development Authority subject to the conditions that the height of the building does not exceed 10 m. including parking floor from road level & plot area is below 1,000Sq.mts.

(2) Residential Building permissions in village settlement areas (subject to the condition that the panchayats shall get the plan for extended village settlement area approved by Urban Development Authority)

(3) Row-type shopping (however they should be limited to settlement areas and

on roads of 40 feet & below) subject to Urban Development Authority regulations.

(4) Plot sub-division permissions in the approved layouts (As per the rules for

layouts).

These provisions i.e., from 1 to 4 shall be exercised by the Panchayats for the areas beyond 200mtrs from State & National Highways & 100mtrs from 30mtrs and above roads.

(5) Levy of penalties and to take action against unauthorized & illegal constructions

and developments as per the provisions of the Andhra Pradesh Urban Areas (Development) Act, 1975.

(6) Levy & get the development charges paid directly in the Urban Development

Authority account in the designated branches of banks, as per the rates prescribed by the Government from time to time wherever the Panchayat Secretary gives building permission as per the delegation.

(7) To take action on all constructions either made in deviation to approved plan or unauthorizedly.

The Urban Development Authority issues only Technical sanction in respect of all other cases and the local authority is the “Enforcement Authority” in all cases irrespective of delegation.

3. The above delegation of powers to the Panchayat Secretaries under the jurisdiction of Tirupati Urban Development Authority shall be subject to the fulfillment of the following conditions, namely:-

(1) The Panchayats shall maintain a Register showing the details of building permission accorded in the

(3) The above delegated powers are subject to overall conformity with the provisions of Master Plan / Zonal Development Plan and uses, Zoning Regulations, building rules issued by the Government from time to time.

(4) The officers of the Tirupati Urban Development Authority shall conduct periodical inspections of the Gram Panchayats to give necessary guidelines for disposal of cases as well as to check the permissions.

(5) The Officers of the Tirupati Urban Development Authority shall have powers of surprise inspection of Panchayat Offices for verification of records pertaining to development control and the buildings under construction and also other areas along with the Panchayat Secretaries of the concerned Gram Panchayats.

(6) The Panchayat Secretary shall send a copy of approved plan to Urban Development Authority immediately after approval and a list of cases with amount of Development Charges paid to Urban Development Authority every month.

4. The above delegation of powers shall be strictly adhered by the Panchayat Secretaries and if any irregularity / deviation noticed / reported, this delegation of powers shall stand withdrawn forthwith.
