I fear there does appear to be many Minute2.

Papers which cannot be found,and I venture to express

the opinion that there would seem to be something

wrong,in the proper recording or tho filing of those

papers.

I was at a loss to Know whether it was in-3-!tended to issue a license to Salveson for the season

1910-11,or only to acknowledge the receipt of the

sum of £100 which has been paid into tho Treasury,

for which receipt No.6931*is enclosed. Draft letter

H.E. the Governor,

These papers were considered in

Executive Council this morning. Council decided that in

the special circumstances of the case, the New Whaling

Company be permitted to employ a sixth steam whaler at

New Island during the remainder of the 1912-1913 whaling

season, i.e., until 30th. September next, without payment by them in respect of such permission. Coxincil desired

to point out that this is to be regarded as a special concession and not as a precedent.

is issued for the 1914-15 season it will be necessaryto bear in mind the contents of paragraph 3 of YourExcellency's despatch No. 92 of 6th July, contained

in M.P. Ho. 154/13 attached hereto.During the continuance of Messrs. Salvesen's2.

tenure of the inter-insular mail contract (whicby lapses

in November next) the Company have been permitted to

five whalers under a license the fee payable for which

has been £100.

Falkland Islands Transport Company, and the consequent cessation of the additional whaling facilities enjoyed

by Messrs Salvesen while this contract was held by them, it would appear that- they are only entitled to use such

whaling vessels, if any, as are provided for under theirThe grant of licenses for any additional

vessels desired would, I take it, be governed by Whaling

Regulations Nos. 4,6,7,8 & 9.

Sir,

I have the honour to acknowledge the receipt of your letter of the

2nd October 1912, referring to the License of this Whaling Station for

the season from October 1st 1912 till September 30th 1913, and beg to

state that I have written to the manager of the Falkland Islands Compy,

Ltd, to make arrangements for the payment of £*100 -0-0, ( One Hundred

Pounds,) to the Colonial Secretary, for the granting of a Whaling Lic­

ense for Messrs Chr Salvesen & Company, New Island Whale Station,

Falklands Islands, for the above stated season.

As regards the Whale Boats, at the present time there is only one

fishing for this Station, I have received no word from Messrs Chr Sal-

Vesen & Co, as to whether they intend to place any more boats on this

Station, but in the event of any more boats arriving, I shall at oBce

report them to you, the boat at present on this Station is S.S^Ranka'*

pWhaling Regulations.

In pursuance of the powers in him vested by section 3 of the “ Whale Fishery Ordinance, 1908”, His Excellency the Governor, by and with the advice of the Executive Council, is pleased to make the following Regulations:

The period for which Whaling Licences may be issued shall commence on the 1st October of each year and terminate on the 30th September of the succeeding year.

2. Licences will be issued in the name of the Company applying for them and not transferalile.

3. The fee payable for each Licence is £100 : this fee will not he refunded if foi any cause

4. Each Whaling Licence shall be applicable to one floating factory and two steam whalers and should permission be granted to any applicant by the Governor in Council to employ a third, steam whaler a special fee of £100 will he payable on this account.

5. On and after this date separate Whaling Licences shall be issued for:

(a) The South Shetlands and Graham’s Land,

(b) The South Orkneys,(c) The Ealkland Islands,(d) The South Sandwich Islands.

6 The number of Whaling Licences issued in any one year for the South Shetlands and Graham’s Land shall not exceed ten ; and in the case of the Falkland Islands, the South Orkneys or the Sandwich Islands the number shall not exceed seven.

7 Inv applicant for a Whaling Licence must send in his application so as to reach the Colonial Secretary,- Falkland Islands, not later than the 1st April, giving the name at the Company and the names of the vessels to be employed.

Each application for a Whaling Licence shall he registered when received in a register to be termed the Whaling Licence Register.

9 Every licensed vessel shall, at the end of the season’s whaling operations proceed direct to a Port of Entry in the Colony or its Dependencies and report the result of the catch to the Collector of Customs.

10. Licences will he issued on the condition that the licensees and their employees will not kill or capture seals (including all animals of the seal kind), penguins or birds in the Dependencies of the Colony or the waters thereof except when in actual need olthem for food.

11 Aiiv breach of these Regulations by the licensee or his employees will render the licensee liable to the immediate forfeiture of his Licence, as well as any claim to a

Whaling Licence in the future.

12 These Regulations shall have no application to South Georgia, and shall come into force on the 1st April, 1912, and shall then supersede the Regulations of the Governor in Council of the 6th February, 1911.

With reference to the refund of £100 to Messrs

Salvesen & Co for a whaling licences,mentioned in the 20th

paragraph of His Excellency the Administrators Message to

the Legislative Council introducing the Supplementary Appro­

priation Ordinance, 1914,of March last,I have the honour to

report that the One hundred pounds therein referred to, would

appear to be that refunded on Pay Voucher No. 16 of August 1913

Accounts, and would respectfully beg to state that in my humble

opinion it would appear, now that One hundred pounds has been

refunded to this Firm, that the New Island Whaling

Chr:

Company havebeen whaling in the waters of the Falkland IaLands since the

1st October 1913, and still whaling, on a Licence for which

the necessary Fee hast been paid, but has since

been refunded.2. In support of the above statement I would

give the folio wing facts:-

(a) That under the Whaling Regulations, the perior for which

a Licence may be issued, "shall commence on the 1st day

of October of each year, and terminate on the 30th day

of September of the succeeding year."

(b) That the New Island Whaling Co, commenced to whale in the

waters of the Falkland Islands, in the 1908-09 Season,

Firm:- 1909. Receipt 5845 for £100., 1910. Recpt:6627 for

£100., 1911. Recpt :6931 for £100., 1912.Recpt:4765 for

£100., 1912.Receipt 5398 for £100., and 1913 Recpt:

5537 for £100. Making a total sum of £600.

Six Seasons.

From the above facts it will be seen that xhe correct

amount of Fees /ad been paid by the New Island Whaling Company

in respect of the Whaling Licences issued to them, and had I not

been on leave when the sum of £100 was refunded to this Firm on

We "beg reference to our respects of the 16th of February in

which we asked you to be good enough to allow us to employ under

our whaling licence at New Island, any five of the following

steam whale fishing vessels namely:- the s. s. "Foula", MHankaM,

"Hema", ,#ScapaM, "Semla", "Silva" & "Sonja"

to learn from a wireless received this morning from our manager

at New Island, that the changing of fishing steamers proposed by

us has not been permitted by you.-

& we much regret

We presume that you have some well founded reason for not

obliging us, & it would interest us much to hear on what ground^

you have refused the permission asked for.- It seems to us that
