2. Proposals relating to regularization of left out DRWs of following Departments were on agenda of the meeting:-

i. PHEjI&FC Department. ii. Forest Department. iii. Department of Rural Development & P.R. iv. Public Works (R&B) Department. v. Animal & Sheep Husbandry Department. vi. Science & Technology Department. vii. Agriculture Production Department. viii. Horticulture Department.

3. The Department of Rural Development & P.R had submitted proposals of left out DRWs as per following detail:

1. Fresh Cases: 1 II. Review cases: 3 III. Drop-out cases: 12

4. In addition proposal of the department with regard to withdrawal of condition of condonation of breaks in respect of 42 DRWs were enlisted for recommendations/decision.

5. Fresh case: 5.1 While examining case file of Late Mohd. Abdullah Dar in terms of provisions

contained in the Jammu and Kashmir Daily Rated Workers/Work Charged Employees (Regularization) Rules, 1994 notified vide SRO 64/1994 read

. with Government order No. 26-F of 1994 dated 31.01.1994, it was observed the deceased DRW was engaged in 04/1990 and paid wages from 04/1993 and there exist breaks in drawal of wages in different spells upto his date of death. The department has attributed the breaks to non­ availability of funds. The Committee decided that seven years shall be reckoned by way of computing eighty four months from the month wages have actually been paid as a period of mandatory service required for regularization subject to condition that payment of wages for the period is established with reference to records and the period of breaks shall not count for continuous service.

5.2 The Committee cleared and approved creation of 1 post of "Helper" in the pay scale of 2550-3200 (Pre-revised) for regularization of the deceased DRW posthumously from the date shown in below matrix:-

5.3 The above recommendations are subject to following conditions:- (i) The Department shall verify records/MRs of first ten months of

the deceased to establish genuineness of the claim. (ii) Genuineness of MRs/engagement orders is certified by the

concerned HoD. (iii) Continuous working from the date of initial engagement and

payment of wages whether in cash or kind quantity at notified rates shall be established/certified by the concerned HoD.

(iv) The department shall get breaks, other than those certified and verified by the department to be due to non-availability of budget, condoned from the Competent Authority and the beaks

subsequent to the date of regularization, if any, shall be seen and verified by the department and no arrears of salary shall be drawn for the period wages have not been paid.

(v) The incumbent is eligible for regularization and fulfilled all conditions as laid down in SRO 64/1994.

(vi) The Department shall verify the date of birth and Permanent Residence Certificate of the deceased, prior to issuance of regularization orders.

(vii) Relaxation of age/qualification, if any, shall be considered by the Department with prior approval of the Competent Authority.

(viii) Regularization order shall be issued by the concerned HOD after formal order for creation of post is issued by the Administrative Department.

(ix) The post shall cease to exist from the date following the date of death of the DRW.

(x) Arrears from date of regularization to the date of issue of regularization order shall be paid in five equal annual instalments after projecting the same under Annual Budget Estimates of the Department.

6. Review cases: 6.1 Cases of 3 DRWs which were deferred in previous meeting of Empowered

Committee held on 09.03.2017 due to some deficiencies and re-submitted by the department were placed before the Empowered Committee. The Committee observed that the department has removed the incompletions/ furnished required information and approved creation of 3 posts of "Helpers" in the pay scale of 2550-3200 (Pre-revised) for regularization of as much number of DRWs from the dates shown against each detailed in the below matrix. Seven years service has been reckoned from culmination of last break prior to 31.01.1994:-

(x) Arrears from date of regularization to the date of issue of regularization order shall be paid in five equal annual instalments after projecting the same under Annual Budget Estimates of the Department.

7. Drop-out cases: 7.1 Case detailed in below matrix has been found incomplete and decision of

8. Regularization of DRWs of District Rural Development Agencies shifted to Department Of Rural Development & P.R:

8.1 The Committee was informed that in pursuance of Cabinet Decision No. 169/13/2014 dated 10.10.2014, the department vide Government Order No. 233-RD&PR of 2015 dated 01.09.2015, accorded sanction to the:

a) Creation of 186 posts under various categories in the Department of Rural Development & PR for absorption of 184 employees of DRDA w.e.f 01.04.2005;

b) Absorption of 184 employees of DRDA to the Department of Rural Development & P.R against various posts;

c) Shifting of 32 DRWs of DRDA to the Department of Rural Development and P.R and subsequent placement of their cases for regularization with Empowered Committee (Finance Department), subject to condition that DRWs proposed to be shifted shall be

eligible for consideration for regularization only on fulfillment of all the conditions laid down under SRO 64 of 1994 and fall within the cut-off date fixed under the said SRO.

8.2 While examining 11 case files in terms of provrsions contained in the Jammu and Kashmir Daily Rated Workers/Work Charged Employees (Regularization) Rules, 1994 notified vide SRO 64/1994 read with Government order No. 26-F of 1994 dated 31.01.1994, the Committee cleared and approved creation of 4 posts of "Helpers" in the pay scale of 2550-3200 (Pre-revised) for regularization of the equal number of DRWs from the dates shown against each in below matrix. In respect of S. No 3, seven years have been computed from 04/1992 i.e culmination of last break prior to 31.01.1994:-

9. Waiver of condition of condonation of breaks:

9.1 Department vide OM No. RD&PR/Estt/ DRW/17/2018 dated 05.09.2018 has requested withdrawal of condition of condonation of breaks in favour of the following 42 DRWs who have been cleared by the Empowered Committee in its meeting held on 13.09.2017 on the grounds that wages have not drawn in their favour due to paucity of funds but they remained working continuously during the said break periods and the General Administration Department on similar issue has advised the department as under:-

"Upon examination of the proposet, it has been observed that the departmental notes give an impression that there have been no breaks in the services of these daily rated workers (DRWs) and simultaneously the breaks have been shown caused due to the non-availabIlity of funds. If these DRWs were working in the department continuously and there were actually no breaks/ therefore, the department would required to re-examine over wandrewe! of the condition of "breeks" after due verification with reference to records in consultation with the Finance Department. "
