1. Minutes of the Executive Committee held on 2nd September, 2003 – Confirmation of.

The minutes of the meeting of the Executive Committee held on 2nd September, 2003 were circulated to all the members of the Executive Committee and Adhoc Committee. The suggestions were received from the members on the minutes. The suggestions have been incorporated in the minutes and shown in the bold letters.

The minutes of the meeting of the Executive Committee held on 2nd Sept.,2003 were approved and confirmed in today’s meeting after incorporating the suggestions.

2. Minutes of the last meetings of the Executive Committee – Action taken thereon.

The members of the Adhoc Committee appointed by the Hon’ble Supreme Court and of the Executive Committee of the Council noted the action taken by the office on the various items included in the minutes of the meetings held on 23rd August,2003 and 2nd September, 2003 with following modifications/corrections/amendments:-

23.08.2003 1. On page 13, item No. 14 Khaja Banda Nawaz Instt. of Medical Sciences, Gulbarga –

renewal of permission – reg., the action taken in the matter was recorded as under:-

“Information from the college authorities, CET Cell, Rajiv Gandhi University of Health Sciences regarding status of the students admitted for the academic session 2002-2003 as per the court orders has not been received. Meanwhile the college has submitted letter dated 1.9.2003 for neutralization formula of reducing management seat i.e. 5 students each for the next 10 yrs. copy is attached herewith.” The action taken in the matter be read amended as under:-

“Information from the college authorities, CET Cell, Rajiv Gandhi University of Health Sciences regarding status of the students admitted for the academic session 2002-2003 as per the court orders has not been received. Meanwhile the college has submitted letter dated 1.9.2003 for neutralization formula of reducing management seat i.e. 5 students each for the next 10 yrs. copy is attached herewith. Appeal filed before Division Bench of Hon’ble Karnataka High Court by the Council office.”

02.09.2003 The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council noted the action taken by the office on the items included in the minutes of the meeting held on 2nd Sept.,2003. 3. Establishment of Medical College, Midnapore by Govt. of West Bengal u/s 10A of

the IMC Act, 1956.

Read : The compliance verification inspection report (10th September, 2003) for establishment of medical college, Midnapore by Govt. of West Bengal.

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of

the Executive Committee of the Council considered the compliance verification inspection report (10th Sept., 2003) and noted as under:- 1) Hostel for Boys & Girls

The immediate present arrangement is as under:- Boys Hostel: A private building about half km. from the Medical College & Hospitals is taken on lease (2nd & 3rd floor) at a monthly rent of Rs. 40,000/- per month for 13 months.

3Girl Hostel- As a temporary measure some rooms have been provided in Nursing Hostel for 24 girls.

2) Hostel for House Surgeons

There are now 2 quarters which can accommodate 12 Jr. Residents and there are another 10 quarters for RMOs/Sr. Residents. This accommodation is not sufficient for the required no. of Jr./Sr. Residents at inception.

3) Central Clinical Lab

The Histopathology and Cytopathology work is still going on in the Cancer Detection clinic in a separate building away from Central Lab and Pathology department, though now the teaching faculty of pathology department is also involved in the reporting of histopathology and cytopathology slides. However, this arrangement needs to be shifted to the central lab/department of pathology. The space of central lab continues to be the same.

4) Teaching Hospital

The three storied building is under construction and the construction has been speeded up and it is likely that these additional two new floors are ready by March, 2004. In these two additional floors the following facilities will be provided.

280 indoor beds Clinical department offices and staff room Bed side labs. Seminar-cum-library rooms

5) Extension of academic block building is also in progress and the following facilities

will be located in this building

Burns Beds CT scan Part of Radio-Diagnosis department Central Diagnostic lab. This is likely to be completed by March 2004.

6) OPD block and casualty block is also under construction and is likely to be completed

by Dec. 2003/March 2004. 7) Still in all the clinical departments the space availability is grossly inadequate for

various facilities/requirements to be accommodated. Some of the facilities will be located in the newly coming up academic block (Annexe block) which is likely to be completed by March 2004.

8) Still there is too much overcrowding in all the wards. This will be eased out only when

the additional space is available by March, 2004 9) OPD space in general for various departments and waiting area is grossly inadequate

This will be provided when the new building of OPD and Academic teaching block are ready by March 2004.

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of

the Executive Committee of the Council also perused the copy of the communication dated 27.08.2003 sent by the MCI to all concerned including the Central Govt. In that letter, the following relevant portion of the Constitution Bench judgement of the Hon'ble Supreme Court in Islamic Academy of Education dated 14.08.2003 is reproduced as under:-

"…….. So far as the year 2003-04 is concerned, time is running out as the outer time limit

for admission is fast approaching or has gone. To meet the urgent situation without going into the issues involved in the various petitions/applications, we direct that the seats be filled up by the institution and the State Governments in

4the ratio 50 : 50. However, if by any interim order, this Court has permitted any institution to fill up a higher percentage of seats and the seats have been filled up accordingly, the same shall not be disturbed. It is made clear that due to the time constraint this arrangement has been made, without deciding the contentious issue involved in various pending cases……" It is stated that by an office order dated 14.05.2003, the Central Govt. has also approved

the time schedule for completion of the admission process for medical and dental colleges which was placed before the Hon'ble Supreme Court by the Central Govt., whereafter the above-mentioned judgement of the Constitution Bench was passed on 14.08.2003. The MCI had recommended to the Central Govt. the complete time schedule for the admissions of candidates in the MBBS course wherein it has been approved that the last date for admission of all students against vacancies in the MBBS course shall be 30.09.2003.

In view of the above, the members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council decided to recommend to the Central Govt. to issue Letter of Intent for establishment of Medical College, Midnapore by Govt. of West Bengal u/s 10A of the I.M.C. Act,1956 with an annual intake of 100(Hundred) students for the academic session 2004-05. It is clarified that as per the statutory Regulations of the MCI, the issuance of LOI does not entitle the applicant to make any admission in the proposed college. As the prescribed time limit for admissions for academic year 2003-2004 i.e. 30th September, 2003 - would be over by the time compliance from the institute is received, verification inspection is carried out and the report is considered by the Executive Committee and thus academic year 2003-04 would be over by the time the application is finally processed for Letter of Permission. It is only after the issuance of Letter of Permission when issued by the Central Government that an applicant then becomes entitled to make admission of 1st batch of students in the first year of the MBBS course. 4. Establishment of Medical College at Postgraduate Instt. of Medical Education &

Research, Kolkatta.

Read : The compliance verification inspection report (11th September, 2003) for establishment of medical college at Postgraduate Instt. of Medical Education & Research, Kolkatta.

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council considered the compliance verification inspection report (11th Sept.,2003) and noted as under:-

1) Hostels: Temporary arrangements made for the hostels Girls Hostels- A 12 beds facility has been created in three rooms (5+5+2). There is over crowding. There are no arrangements for kitchen and dining. Their food will come from outside.

Another 12 beds capacity has been made in Nursing Suptd. Quarter in 2 rooms. There is a dinning space. However, their meal arrangement is the nursing mess near by. Boys Hostels- A building has been renovated within the hospital campus with 6 dormitories which will accommodate 30 students. Dinning facility is available. However, the food arrangement is from a nearby canteen. There are no cupboards. Another facility for 18 boys in 5 rooms is under renovation in the House Surgeon Quarter in front of the hospital building outside proposed college campus premises. So far, no kitchen and mess facility has been created. Most of the rooms are dormitory type which is not desirable for medical college students. Many rooms are short of basic facilities and furniture. Moreover, the total accommodation available is inadequate for 100 students at this stage.

2) OPD

Status remains the same as regarding the overcrowding in OPDs.

Karimnagar. Read : The compliance verification inspection report (8th Sept., 2003) for establishment of Medical College at Karimnagar by Arihant Educational Society, Karimnagar.

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council considered the compliance verification inspection report (8th Sept.,2003) and decided to recommend to the Central Govt. to issue Letter of Permission for establishment of Medical College at Karimnagar by Arihant Educational Society, Karimnagar u/s 10A of the I.M.C. Act,1956 with an annual intake of 150(Hundred Fifty) students for the academic session 2003-04.

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council also perused the copy of the communication dated 27.08.2003 sent by the MCI to all concerned including the Central Govt. In that letter, the following relevant portion of the Constitution Bench judgement of the Hon'ble Supreme Court in Islamic Academy of Education dated 14.08.2003 is reproduced as under:-

"…….. So far as the year 2003-04 is concerned, time is running out as the outer time limit

for admission is fast approaching or has gone. To meet the urgent situation without going into the issues involved in the various petitions/applications, we direct that the seats be filled up by the institution and the State Governments in the ratio 50 : 50. However, if by any interim order, this Court has permitted any

6institution to fill up a higher percentage of seats and the seats have been filled up accordingly, the same shall not be disturbed. It is made clear that due to the time constraint this arrangement has been made, without deciding the contentious issue involved in various pending cases……"

It is stated that by an office order dated 14.05.2003, the Central Govt. has also approved the time schedule for completion of the admission process for medical and dental colleges which was placed before the Hon'ble Supreme Court by the Central Govt., whereafter the above-mentioned judgement of the Constitution Bench was passed on 14.08.2003. The MCI had recommended to the Central Govt. the complete time schedule for the admissions of candidates in the MBBS course wherein it has been approved that the last date for admission of all students against vacancies in the MBBS course shall be 30.09.2003.

6. Establishment of medical college at Warangal by Medicare Educational Trust,Warangal.

Read : The compliance verification inspection report (6th Sept., 2003) for establishment

of Medical College at Warangal by Medicare Educational Trust, Warangal. The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council considered the compliance verification inspection report (6th Sept.,2003) and noted the following:- 1. The staff shortage is more than 25%. The details are as under -

Professor -1 (Biochemistry) Associate Professors – 7: (Anatomy-2, Physiology-1, Biochemistry -1, Pharmacology-1,

Microbiology-1,Paediatric-1). Assistant Professors –8: (Anatomy-3,Physiology-2,Pathology-1,For.Med.-1,

Community Med.- 1). Tutors / Sr.Residents –14: (Anatomy-2, Physiology-2, Pharmacology-1, Forensic

Med.-1, General Med.-4, General Surgery-4).

2. The clinical material quantitatively needs enhancement. The bed occupancy on the day of inspection is 81% as per record submitted by the institution. However, it is found that there is a difference between the record submitted and the actual observation to the extent of about 50% and the available clinical material is 50% of what is claimed.

2. OPD attendance on the day of inspection was 239. The average outdoor attendance is 189 per day.

4. Though the records and the statements show the number of investigations in Central Pathology are 200-300 per day, it was observed that on the day of inspection only 6 samples were received for Microbiology, 22 for Biochemistry and 17 for Pathology on verification, it was found that the number of x-ray investigations per day was 40-50 is also grossly inadequate.

5. The technical hospital staff does not follow properly universal precautions for infection control.

6. BARC personnel monitoring system in the department of Radiology is not available.

7. The number of deliveries are only 1-2 per day.

8. Hospital waste is not being segregated in colour coded containers as per the norms.

9. Incinerator is not yet available.

10. Other observations/deficiencies pointed out in the inspection report.

In view of above, the members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council decided to reiterate its earlier decision taken at its meeting held on 28th July,2003 recommending to the Central Govt. to disapprove the scheme for establishment of Medical College at Warangal by Medicare Educational Trust, Warangal. 7. Katuri Medical College, Guntur - renewal of permission for admission of 2nd batch

of students. Read : The compliance verification inspection report (8th Sept., 2003) for renewal of

permission for admission of 2nd batch of students at Katuri Medical College, Guntur. The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of

the Executive Committee of the Council considered the compliance verification inspection report (8th Sept.,2003) and decided to recommend to the Central Govt. to renew the permission for admission of 2nd batch of 100 students at Katuri Medical College, Guntur for the academic session 2003-04.

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council also perused the copy of the communication dated 27.08.2003 sent by the MCI to all concerned including the Central Govt. 88. MNR Medical College, Sangareddy - renewal of permission for admission of 3rd

batch of students. Read : The compliance verification inspection report (4th Sept., 2003) for renewal of permission for admission of 3rd batch of students at MNR Medical College, Sangareddy.

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of

the Executive Committee of the Council considered the compliance verification inspection report (4th Sept.,2003) along with the declaration forms submitted by the college at the time of inspection and it was observed as under:-

1. Teachers shown as faculty at this institution were shown as faculty in other colleges as

shown below. This was viewed seriously as it amounts to misleading the Council. Sl.No. Name of teacher Department Also found working at 1. Dr. Palavelli

Medical Sciences, Karimnagar. 2. The number of surgeries performed –5 (major & minor combined) – is inadequate. 3. Daily average number of deliveries is 1-2. However, total deliveries during the period

January-August 2003 is only 266 which is inadequate. 4. X-ray & laboratory investigations are inadequate. Histopathology and Cytopathology

investigations are also inadequate. This deficiency remains the same as it was in the previous inspection.

5. Other observations/deficiencies pointed out in the inspection report.

In view of above, the members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council decided to recommend to the Central Govt. not to renew the permission for admission of 3rd batch of 100 students at M.N.R. Medical College, Sangareddy for the academic session 2003-04.

99. Mediciti Instt. of Medical Sciences, Ghanpur – renewal of permission for

admission of 2nd batch of students.

Read : The compliance verification inspection report (4th Sept., 2003) for renewal of permission for admission of 2nd batch of students at Mediciti Instt. of Medical Sciences, Ghanpur.

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council considered the compliance verification inspection report (4th Sept.,2003) along with the declaration forms submitted by the college at the time of inspection, it was observed as under:-

1. Teachers shown as faculty at this institution were shown as faculty in other colleges as

It should be noted that while arriving at this shortage the Assistant Professors who were not having adequate teaching experience as Residents/Tutors have not been considered as teaching faculty.

3. Clinical material has shown improvement but needs further enhancement. The college has shown total OPD attendance of 798 and average bed occupancy of 89%. Physical verification of manual records maintained indicate approximately 600-650 OPD attendance. However the serial numbers were not given and handwriting was monotonous.

Daily average number of deliveries is 3 per day. The major and minor surgeries are 7–13 per day. However, it is observed that the number of investigations carried out is not corroborative with work load shown and is inadequate. The number of investigations carried out are as under:-

Microbiology - 48-50 per day Biochemistry - 90 per day X-ray - 48 per day

Ultrasonography - 10-15 per day This shows that number of laboratory investigations and x-rays is grossly inadequate.

Biochemistry investigations as per the statement claimed by the college are 90 per day.

However, on the day of inspection only 20-22 samples were collected till 12.00 noon. 4. There is over crowding in the wards and inadequate nursing supervision. The wards are

divided in small cubical lodging 4-5 beds each resulting in overcrowding and inadequate nursing services.

5. Permission for medico-legal postmortems is not yet received. The college has not made

any arrangement for teaching postmortems to the students so far. 6. BARC personnel monitoring/surveillance is not available for the staff working in

Radiology department.

107. Other observations/deficiencies pointed out in the inspection report.

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council also perused the copy of the communication dated 27.08.2003 sent by the MCI to all concerned including the Central Govt. In that letter, the following relevant portion of the Constitution Bench judgement of the Hon'ble Supreme Court in Islamic Academy of Education dated 14.08.2003 is reproduced as under:-

"…….. So far as the year 2003-04 is concerned, time is running out as the outer time limit

for admission is fast approaching or has gone. To meet the urgent situation without going into the issues involved in the various petitions/applications, we direct that the seats be filled up by the institution and the State Governments in the ratio 50 : 50. However, if by any interim order, this Court has permitted any institution to fill up a higher percentage of seats and the seats have been filled up accordingly, the same shall not be disturbed. It is made clear that due to the time constraint this arrangement has been made, without deciding the contentious issue involved in various pending cases……" It is stated that by an office order dated 14.05.2003, the Central Govt. has also approved

the time schedule for completion of the admission process for medical and dental colleges which was placed before the Hon'ble Supreme Court by the Central Govt., whereafter the above-mentioned judgement of the Constitution Bench was passed on 14.08.2003. The MCI had recommended to the Central Govt. the complete time schedule for the admissions of candidates in the MBBS course wherein it has been approved that the last date for admission of all students against vacancies in the MBBS course shall be 30.09.2003.

In view of above, the members of the Adhoc Committee appointed by the Hon'ble

Supreme Court and of the Executive Committee of the Council decided to recommend to the Central Govt. not to renew the permission for admission of 2nd batch of 100 students at Mediciti Instt. of Medical Sciences, Ghanpur for the academic session 2003-04.

10. Navodaya Medical College, Raichur - renewal of permission for admission of 2nd

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council considered the compliance verification inspection report (5th & 6th Sept.,2003) and decided to recommend to the Central Govt. to issue Letter of Permission for increase of seats in first MBBS course from 107 to 150 at S.C.B. Medical College, Cuttack u/s 10A of the I.M.C. Act,1956 for the academic session 2003-04.

Medical Education – KAP Viswanatham Government Medical College, Trichy,

Permanent MCI Recognition Tamil Nadu State Medical Council Registration – Reg. Read : The letter dated 27th August, 2003 received from the DME, Chennai requesting

to issue permanent recognition to KAP Vishwanathan Govt. Medical College, Trichy. The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of

the Executive Committee of the Council considered the letter dated 27th August,2003 received from the DME, Chennai requesting to issue permanent recognition to KAP Vishwanathan Govt. Medical College, Trichy and noted that the members of the Adhoc Committee and the Executive Committee in the meeting held on 30th June,2003 have already decided to recommend approval of KAP Vishwanathan Govt. Medical College, Trichy for the award of MBBS degree granted by Dr. M.G.R.Medical University, Chennai with an annual intake of 100 students. This decision is being placed before the General Body of the Council scheduled to be held on 20th & 21st October,2003.

13. Admissions for the academic year 2003-2004 in the MBBS course at (1) M.R.

Medical College, Gulbarga, (2) Dr. B.R. Ambedkar Medical College, Bangalore and (3) Adichunchanagiri Medical College, Bellur. Read : The letter dated 28th August, 2003 received from the Registrar, Rajiv Gandhi

University of Health Sciences in response to the decision of the Executive Committee dated 23rd August, 2003 communicated on 25th August, 2003 not to make admissions in the Ist year of MBBS course for the academic year 2003-2004.

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of

the Executive Committee of the Council noted that they at their meeting held on 28.7.2003 considered the inspection reports (09.08.2003) carried out in respect of M.R.Medical College, Gulbarga; Dr. B.R.Ambedkar Medical College, Bangalore and Adichunchanagiri Medical College, Bellur and in view of the gross deficiencies pointd out in the inspection report in terms of teaching staff, clinical material etc., it was decided that the State Govt. be advised not to make admissions in the 1st year of MBBS course for the academic year 2003-04. It was also decided that if the deficiencies are not removed the necessary action under section 19 of the I.M.C. Act be initiated by the MCI for recommending to the Central Govt. for derecognition.

The Committee also noted that regarding M.R.Medical College, Gulbarga an Enquiry

Committee was constituted to look into the irregularities pointed out in the inspection report.

13 The decision of the Committee was informed to the Central Govt. with the request to

issue necessary orders/instructions to the concerned officers of the State for ensuring that no admissions in the 1st year of MBBS course for the academic session 2003-04 are made in the above mentioned medical colleges with copy marked to the Registrar, Rajiv Gandhi University of Health Sciences; Officer-in-charge, CET Cell, Rajiv Gandhi University of Health Sciences; DME, Govt. of Karnataka and Deans/Principals of the concerned medical colleges for information and necessary action.

The Committee also noted that in response to Council letter 25.8.2003, a letter dated

28.8.2003 has been received from the Registrar, Rajiv Gandhi University of Health Sciences, Bangalore stating therein that as per the orders of the Govt. of Karnataka, the Common Entrance Test Cell, Karnataka has conducted counselling for selection of candidates for admission to 1st MBBS course for the academic year 2003-04. He further stated that candidates have been allotted to different medical colleges including these colleges. As the admission process has completed as per Seat Matrix, students have already joined the course. Hence, the students admissions are already over, the Registrar stated that the recognition for the academic session 2003-04 in respect of above mentioned medical colleges may be renewed and necessary action may be taken to restrict the admission for the next academic year. The Registrar also sought clarification with respect of increase of seats from 100 to 150 at M.R. Medical College, Gulbarga.

The Committee also noted that on the recommendations of the Council, the Central

Govt. had renewed the permission for admission of 3rd batch of students against the increased intake i.e. from 100 to 150 at M.R.Medical College, Gulbarga for the academic session 2003-04.

Taking into consideration the above facts, the Committee decided as under:-

1. No admissions shall be made by the colleges for the academic session 2004-05 without

prior approval of the Council/Govt. of India. 2. The Postgraduate Committee of the Council be requested to look into the matter.

14. Graduate Medical Education Regulations – 1997 – Amendment issued by the

Central Govt. in regulation 7, under sub-regulation (3) pertaining to number of chances to appear in the Ist MBBS examination. Read : The matter with regard to issue of notification regarding amendment in the

regulation Under Clause 7(3) pertaining to number of chances to appear in the Ist MBBS examination as approved by the Central Govt.

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of

the Executive Committee of the Council noted that the Central Govt. vide MCI letter dated 28.03.2003 was requested to issue necessary amendments in the Graduate Medical Education Regulations, 1997 by deleting the following three lines from clause 7(3) of the Regulations pertaining to grant of additional attempts over & above 4 attempts to clear the 1st MBBS examination:-

…………..for which he will be permitted not more than four chances (actual examination), provided four chances are completed in three years from the date of enrollment.

The Committee further noted that the Central Govt. vide its letter dated 14.8.2003 approved the deletion of above three lines from clause 7(3) of the Regulations along with other amendments as proposed by the MCI. The Committee also noted that it at its meeting held on 23.8.2003 noted that the Central Govt. while approving the amendments had modified the amendments to regulation 14 as proposed by the Council and certain amendments have not been approved by the Central Govt. It was decided to seek clarification from the Central Govt. and further decided that the matter

14be discussed in the General Body of the Council. The reply from the Central Govt. in this regard is still awaited.

In view of various requests and representations received from the candidates and universities with regard to the clause of number of attempts, the Committee decided that the notification pertaining to additional attempts be issued by sending it to the Gazette.

15. Press Clipping with regard to ‘Law Panel for execution by Lethal injection’

published in the Times of India dated 6/2/2003, New Delhi Edition (F.No.144/2003). Read : The recommendation of the Ethical Committee with regard to law panel for

execution by Lethal injection published in the Times of India dated 6/2/2003. The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of

the Executive Committee of the Council considered the recommendation of the Ethical Committee with regard to law panel for execution by Lethal injection and decided that this matter does not come under the purview of the Council.

16. Child Survival & Safe Motherhood (CCSM) as well as the Reproductive & Child

Health (RCH) Programme. Read : The letter received from Directorate General Health Services, Nirman Bhawan

seeking comments of the Council with regard to training to MBBS doctors in life saving Anaesthetic skills for Emergency Obstetrics Care.

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of

the Executive Committee of the Council considered the letter received from Directorate General Health Services, Nirman Bhawan seeking comments of the Council with regard to training to MBBS doctors in life saving Anaesthetic skills for Emergency Obstetrics Care. The Committee was of the opinion that legally any MBBS doctor working in Primary Health Centre can give anaethesia in case of emergency. He/she should do whatever the best is possible to save the life of patient. It is advisable that the Govt. shall take all necessary steps to improve the skills of such doctors.

17. Grace Marks in MBBS course.

Read : The letter received from the Vice-Chancellor, Pondicherry University with

regard to grace marks in MBBS course. The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of

the Executive Committee of the Council considered the letter received from the Vice-Chancellor, Pondicherry University with regard to grace marks in MBBS course and decided that the Universities should follow the regulations prescribed in this regard in the Graduate Medical Education Regulations, 1997 that “the Grace marks upto a maximum of the FIVE marks may be awarded at the discretion of the University to a student who has failed only in one subject and passed in all other subjects”.

18. To approve the minutes of the Registration and Equivalence Committee held on

28th July, 2003.

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council noted and approved the minutes of the meeting of the Registration and Equivalence Committee held on 28.7.2003. 19. Review Petition 1635/2002 in Civil Writ Petition NO.3175/2002 filed by Dr.

Birender Singh Thind Vs. Union of India and others regarding registration of additional qualification under section 26 of the IMC Act, 1956 in respect of his Ph.D. qualification obtained in the year 2001 from Russia. The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of

the Executive Committee of the Council considered the matter and decided that the Regulations of the Council be followed.

15 20. Registration of Ph.D as an additional qualification as obtained by Dr. Mujeeb-U-

Rehman Parrey from erstwhile USSR – Reg.

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council considered the matter and decided that the Regulations of the Council be followed. 21. Fixation of Pay of Secretary, ( Lt Col. Dr. ARN Setalvad ) (Retd.), MCI in the scale

of Rs. 18400-500-22400 w.e.f. 2/6/2003. The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council while noting the pay of Secretary of the Council decided that the pay should be fixed as per rules.

22. Cadre review for different posts in the Council office – Regarding. The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council decided to defer the consideration of the matter. 23. Fixing of date of implementation of Revised Recruitment Rules in respect of Head

Clerks, Stenographer Grade II & Hindi Translator. The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council decided to implement the revised pay scale for the posts of Head Clerks, Stenographer Grade II & Hindi Translator with effect from the date the scales were approved by the Central Govt. vide letter No.V.11025/69/98-ME(UG), dated 29.11.2000. 24. To consider and approve the Annual Report of the MCI for the year 2002-2003.

It is clarified that as per the statutory Regulations of the MCI, the issuance of LOI does not entitle the applicant to make any admission in the proposed college. As the prescribed time limit for admissions for academic year 2003-2004 i.e. 30th September, 2003 - would be over by the time compliance from the institute is received, verification inspection is carried out and the report is considered by the Executive Committee and thus academic year 2003-04 would be over by the time the application is finally processed for Letter of Permission. It is only after the issuance of Letter of Permission when issued by the Central Government that an applicant then becomes entitled to make admission of 1st batch of students in the first year of the MBBS course. 26. In that letter, the following relevant portion of the Constitution Bench judgement of the Hon'ble Supreme Court in Islamic Academy of Education dated 14.08.2003 is reproduced as under:-

As the prescribed time limit for admissions for academic year 2003-2004 i.e. 30th September, 2003 - would be over by the time compliance from the institute is received, verification inspection is carried out and the report is considered by the Executive Committee and thus academic year 2003-04 would be over by the time the application is finally processed for Letter of Permission. It is only after the issuance of Letter of Permission when issued by the Central Government that an applicant then becomes entitled to make admission of 1st batch of students in the first year of the MBBS course. 28. 1. Staff deficiencies:- The shortage of teaching faculty is more than 10% as under:-

2. In the department of Anatomy, cold storage facilities not installed yet. Lockers still not moved outside the dissection hall. Storage tank room and dissection hall not provided with exhaust fans. Research lab. is still not furnished and equipped. Histology lab. is not yet provided with seating arrangement for 60. Articulated skeletons-only one provided against requirement of 5. Adequate number of charts need to be provided. No embryology models are available in the museum. Departmental library has less number of books.

203. In the department of Physiology, clinical physiology practical lab does not have a single

examination couch. Research lab is not properly furnished & equipped. Equipment in different practical labs is not properly assigned but dumped in a common place.

4. In the department of Biochemistry, laboratory equipped was just being brought in and therefore not properly arranged.

5. Toilets in the pre-clinical block need adequate number of basins and WCs. 6. Academic offices in the pre-clinical block did not have adequate furniture for the staff. 7. Casualty ward does not maintain a regular admission register. 8. Demonstration rooms in OPD and wards in some specialties are still not provided with

X ray viewing boxes. 9. No X-ray viewing or trolley is provided in demonstration room. 10. Audiometry room is not air-conditioned. 11. O.T. registers shows only the list of surgeries and no other details like surgeon,

Anaesthesist and description of surgery is provided. 12. The Resident doctor’s hostel is across the road but it is not in use by residents. It does

not have dining room and other ancillary facilities. 13. Last month’s salary statement and TDS for teaching staff have not been provided even

though specifically asked for. 14. Intercom facility should be strengthened for efficient functioning. 15. Boy’s hostel does not have furniture and storage cupboards for each inmate. In the girl’s

hostel some are 4 and 6 seated rooms. Number of bathrooms & toilets are grossly inadequate.

16. Principal’s office is still temporarily located in the old administrative block. 17. Animal house is not provided with air-conditioner. 18. Two lecture theatres have been provided having 100 seats each instead of 120 as

required. 19. Dark rooms in Photography unit is not functional. 20. Other observations/deficiencies pointed out in the inspection report.

3. The senior residents in clinical departments are not having postgraduate qualification.

234. Clinical material is inadequate-quantitatively as well as qualitatively. Overall bed

occupancy was around 60%. The patients admitted in the ward had definite diagnosis which was not confirmed on physical examination. Patients in casualty ward were not admitted from surrounding villages but were transferred from various wards. Of all patients registered in Casualty, only one patient had some investigations. No records of any investigations or drug prescription were found for the other patients.

5. The number of surgeries performed is only 4-8 per day (including major and minor) which

is inadequate. The number of x-rays performed per day is 44 per day which also is inadequate.

6. Diagnosis register is not maintained in any OPD. 7. There is no minor OT. 8. In the injection room, the register indicated that every day around 60 injections were being

given. However, the doctors categorically denied prescribing any injection on OPD basis. Emergency tray is not available in the injection room.

9. Central Pathology: The registers had 2 to 3 blank pages after every days entries which was

about 30 per day. The relevance of leaving blank pages could not be explained. Some of the pages were stapled or pasted, the significance of which could not be explained. Even after repeated requests, xerox of several parts of various record registers were not given despite multiple reminders till the writing of the report.

10. Inpatients in Surgery, Obst.Gynae, Pulmonology, Orthopaedics and Medicine wards: There

were no consent forms signed by patient or relative. No operation notes were found. The resident in charge of the ward did not know the diagnosis of any patient. Prescriptions were not signed by the doctors. Some of the orders were not followed by the nurses. Patients with frivolous complaints were admitted for example G.Venkateshwara (Reg.No. 380369) was admitted as patient of Inguinal hernia on 10.9.03. On examination, he had no hernia-same is the case with M Isthani (Reg.No.380126) admitted on 10.9.03 with diagnosis of hydrocele which was not corroborated by examination, 4 patients were being managed as acute appendicitis who had no findings. Lumbar pain, pain abdomen, headache were some of the diagnosis for which patients were admitted. Reasons for admission could not be explained. In the Gynae. ward, patients were shown as admitted in records but were not physically present and neither doctors nor nurses knew about them. In Pulmonology ward all patients were cold and asymptomatic. In Medicine wards patients labeled as COPD had no symptoms. In Orthopaedic ward there were predominantly patients without obvious reasons for admission for example, vague joint pains and in one male medical ward, patients were fighting with each other indicating absence of any serious illness in any of the above patients.

11. The Heads of the department were unable to identify or give information on their

departmental faculty. 12. The resident doctors had no knowledge about the cases admitted in any of the wards as if

they were outsiders. 13. Other observations/deficiencies pointed out in the inspection report.

teaching faculty i.e. more than 50% as under :-

2. Adequate teaching areas are not available in the OPD and indoor wards.

3. Adequate furniture like chairs, blackboard, x-ray view boxes, etc. are not yet provided in the all the teaching areas.

4. The beds in different wards are not demarcated into units and are not yet numbered. 5. Separate treatment room and injection areas are not provided for medical and surgical

OPD. The audiometry room should be made functional. Audiometrist is not available. There is no accommodation available for nurses.

6. Disposable syringes are being sterilized and reused which is an unethical practice and it

must be stopped immediately.

267. Casualty ward has only 3 beds which is much less than the number of beds required as

per norms. 8. Essential life saving equipments like defibrillator, pulse oxymeter, cardiac monitor,

ventilator are not available. 9. In the central laboratory, in the Biochemistry lab auto analyzer is not provided. The

number of investigations are inadequate in comparison to the number of patients attended.

10. Microbiological services are very rudimentary and only 10 investigations are done

daily. 11. The number of clinical pathology investigations are very little. 12. There is no separate chamber for FNAC. 13. Histopathology services are not provided because of lac of equipments and staining

process. 14. There is a common ICU & ICCU in which the essential life saving equipment is not

provided for each bed. The equipment available is less in comparison with the number of beds available.

15. Separate ICCU is not provided. 16. Separate surgical ICU is not provided. However, only 5 beds combined with post

operative ward are available without any other infrastructural support. Emergency equipment is shared with common ICU.

17. In the Paediatric ICU only 8 beds are provided with no other infrastructural facilities. 18. Out patient registration is being done manually. No computer is available in the out

patient registration area. 19. BARC regulations are not followed in the Radiology department for the present work.

The department is not approved by BARC. Adequate protection from the nearby wards is to be provided.

20. C-arm is not available in the college. 21. The number of investigations are also less (35-40 routine x-rays, 12-14 Ultra sound and

5 CT scan daily). Number of special investigations 6-7 per month. 22. In the OTs there are only 2 major and 2 minor OTs which are functional. There is no

viewing gallery and no CCTV arrangement for the students to watch is available. 23. No proper preoperative anaesthetic area is available. 24. Separate post operative beds are not available in the OT complex. 25. The post operative recovery beds are shared with ICU. 26. There is no CSSD available. Only 2 vertical sterilizers are placed in a room which is

grossly inadequate for covering to the requirement of the hospital. 27. No intercom available for the entire hospital including the intensive care wards. 28. Dietician is not available in the central kitchen.

2729. The entire kitchen area remains unclean and totally unhygienic. There are no food

trolleys available. Patient attenders are doing private cooking using firewood and coal, which makes the place dirty.

30. No canteen is available. 31. The drier in the laundry is not functioning. No staff nurses posted in the laundry. 32. There is no incinerator available. 33. The mortuary is functioning in the old building with no air-conditioning, and no

ventilation and no exhaust available. The entire area is stinking and full of flies. The mortuary table is full of Stain and totally unclean.

34. Supporting para medical staff is inadequate in several departments like Medicine,

Radiology and Pharmacology. 35. The number of staff nurses available are only 80 on regular basis and 30 contractual

workers. Thus the shortage of nursing staff for teaching hospital of 400 beds is more than 25%.

36. There is no functional Medical Education Unit. 37. Statistical unit is not yet functional. 38. There is no artist cum photographic unit in the department of Anatomy. 39. UHC & RHC are yet to be made functional. They are not yet attached to the medical

college.

40. The required number of staff is not posted at these two centers. 41. The number of rooms provided for resident doctors is inadequate. 42. In the hostels for boys and girls rooms are not properly furnished. More number of

chairs and tables are to be provided. 43. In the infra structure of various departments, the following deficiencies are observed :-

A) Research laboratory in the department of Physiology is not properly equipped. B) The number of specimens available in the museum of Physiology department is

much less and no catalogue is available. C) The special laboratory services in the Microbiology department are not yet

functional. D) Research laboratory in the Microbiology department is not yet functional. E) In the museum of Microbiology department, the specimens are not displayed

properly. F) Books in the departmental library is also not adequate.

44. Other observations/deficiencies pointed out in the inspection report.

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of

the Executive Committee of the Council also perused the copy of the communication dated 27.08.2003 sent by the MCI to all concerned including the Central Govt. In that letter, the following relevant portion of the Constitution Bench judgement of the Hon'ble Supreme Court in Islamic Academy of Education dated 14.08.2003 is reproduced as under:-

"…….. So far as the year 2003-04 is concerned, time is running out as the outer time limit

for admission is fast approaching or has gone. To meet the urgent situation without going into the issues involved in the various petitions/applications, we direct that the seats be filled up by the institution and the State Governments in the ratio 50 : 50. However, if by any interim order, this Court has permitted any institution to fill up a higher percentage of seats and the seats have been filled up accordingly, the same shall not be disturbed. It is made clear that due to the

28time constraint this arrangement has been made, without deciding the contentious issue involved in various pending cases……" It is stated that by an office order dated 14.05.2003, the Central Govt. has also approved

the time schedule for completion of the admission process for medical and dental colleges which was placed before the Hon'ble Supreme Court by the Central Govt., whereafter the above-mentioned judgement of the Constitution Bench was passed on 14.08.2003. The MCI had recommended to the Central Govt. the complete time schedule for the admissions of candidates in the MBBS course wherein it has been approved that the last date for admission of all students against vacancies in the MBBS course shall be 30.09.2003.

The Committee also noted that the Central Govt. vide its letter dated 16th August,2003

has issued the orders for renewal of permission for admission of 3rd batch of students for the academic session 2003-04 at Govt. Medical College, Anantapur.

In view of above, the members of the Adhoc Committee appointed by the Hon'ble

Supreme Court and of the Executive Committee of the Council decided to recommend to the Central Govt. to recall the above mentioned letter dated 16.8.2003 issued by the Govt. of India regarding renewal of permission for admission of 3rd batch of students for the academic session 2003-04 issued by it on 16th August,2003 in respect of Govt. Medical College, Anantapur, since the preconditions imposed by it vide the conditional letter dated 16.8.2003 making it obligatory for the college authorities for compliance of all the requirements under the MCI regulations and removal of all the deficiencies pointed out by the MCI in the last inspection report and further that the Govt. of Andhra Pradesh shall sort out the pending issue of illegal admissions made in this college during the year 2002-03, have not been fulfilled.

It was further decided to recommend to the Central Govt. for issuance of appropriate

instructions by the Central Govt. to the college authorities not to proceed with any fresh admissions in the academic session 2003-2004, since they have failed to fulfill the condition for compliance with all requirement as per MCI Regulations and norms and have failed to remove all the deficiencies pointed out in the last inspection report. 36. Dr. Rajendera Prasad Govt. Medical College, Tanda - renewal of permission for

admission of 5th batch of students during the academic session 2003-2004. Read: the inspection report (15th September, 2003) of Dr. Rajendra Prasad Govt.

Medical College, Tanda for renewal of permission for admission of 5th batch of students during the academic year 2003-2004 for which the permission has already been granted by the Central Govt.

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council considered the inspection report(15th Sept.,2003) and noted the following :- 1. The staff deficiency is as follows: (a) Faculty : 32 out of 73 i.e. 44% Professors - 10 Associate Profs. - 10 Assistant Profs. - 12 (b) Tutors/Residents : 34 out of 90 i.e. 38%

Tutors - 04 Senior Residents - 11 Junior Residents - 19 2. The department of Anatomy does not have cooling cabinets which are being procured.

3. Department of Microbiology does not have separate 7 laboratories for separate organisms as per recommendations.

4. Laminar Air Flow is not available in Microbiology.

295. The hospital has deficiency of total 87 beds. The deficiency in various departments is

as follows:

Surgery - 10 Paediatrics - 10 TB - 16 Skin & VD - 07 Psychiatry - 08 General Surg. - 24 Orthopaedics - 08 Ophthalmology - 02 ENT - 02

6. The OPD attendance is only 550 per day which is inadequate.

7. The problem of overcrowding still persists in the wards.

8. The number of laboratory investigations and x-ray investigations is grossly inadequate.

9. Surgical ICU, NICU, PICU facilities are not available.

10. TMT is non-functional yet.

11. View boxes are still not available in medical OPD and some other OPDs.

12. Teaching space for students in OPD is inadequate.

13. The Rural and Urban Health Training Centres are not yet under the control of the Dean.

14. The following nine senior faculty members who were verified to be present during the last inspection on 1st and 2nd July,2003 were not available:-

Physiology : 1. Dr. Urmil Gupta, 2. Dr. Anita Padam Obst. & Gynae.: Dr. H.K. Premi (Prof.) Dentistry : Dr.B.K. Gautam (Assoc.Prof.),Dr. Yogesh Bhardwaj(Asstt.Prof.) General Medicine : Dr. Dilip Gupta (Asstt.Prof.) Chest & TB : Dr. Surendra Kashyap (Prof.) Psychiatry : Dr. Ravi Chand Sharma (Prof.) Skin : Dr. Vivay Shankar (Asstt. Prof.)

During the present inspection the above mentioned teachers were not found. Their salary was never drawn. They had not given joining report.

15. Other observations/deficiencies pointed out in the inspection report.

issued the orders for renewal of permission for admission of 5th batch of students for the academic session 2003-04 at Dr. Rajendra Prasad Govt. Medical College, Tanda.

In view of above, the members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council decided to recommend to the Central Govt. to recall the abovementioned letter dated 3.9.2003 issued by the Government of India regarding renewal of permission for admission of 5th batch of students for the academic session 2003-04 issued by it on 03.09.2003 in respect of Dr. Rajendra Prasad Govt. Medical College, Tanda since the preconditions imposed by it vide the conditional letter dated 3.9.2003 making it obligatory for the college authorities for compliance of all the requirements under the MCI Regulations and removal of all the deficiencies pointed out by the MCI in the last inspection report have not been fulfilled.

It was further decided to recommend to the Central Govt. for issuance of appropriate instructions by the Central Govt. to the college authorities not to proceed with any fresh admissions in the academic session 2003-2004, since they have failed to fulfill the condition for compliance with all requirement as per MCI Regulations and norms and have failed to remove all the deficiencies pointed out in the last inspection report. 37. Sikkim Manipal Instt. of Medical Sciences, Gangtok - renewal of permission for

admission of 3rd batch of students during the academic session 2003-2004. Read: the inspection report (15th September, 2003) of Sikkim Manipal Instt. of Medical

Sciences, Gangtok for renewal of permission for admission of 3rd batch of students during the academic session 2003-2004 for which the permission has already been granted by the Central Govt.

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council considered the inspection report(15th Sept.,2003) and noted the following:-

1. Shortage of staff is as follows:

(a) Faculty: 35 out of 79 i.e. 44%.

(b) Jr. Faculty: 63 out of 75 i.e. 89%.

Tutor/Sr.Residents: 26 Jr. Residents-37

(c) About 33 teaching staff members have left the institute in last 3 months and about 40 teaching staff members were on the leave on the day of inspection as certified by the Dean without submitting original leave report. The institute has also shown about 54 medical officers from STNM Medical Hospital who are actually the staff of Govt. of Sikkim.

(d) There is a severe shortage of teaching staff compared to the deficiency of last time. Even in this teaching staff doctors from STNM hospitals are included which was not a teaching hospital. These designated teachers of STNM are government employees are not under control of Dean. None of them can head the unit which is constructed at STNM hospital. Senior unit head from CRH cannot come at STNM and head the unit. Loking to this disparity there is likely to be more deficiency then what is shown above.

2. The position of deficiencies of non-teaching staff continues as it is in the departments of Anatomy, Microbiology, Pharmacology and Community Medicine.

3. In the central library appointment of required staff pointed out in the last report is not done. The staff is less than as required as per norms.

4. The position of the deficiency for the hostel of resident doctors remains the same what is pointed out in the last inspection report.

5. Residential Quarters: The situation remains the same. No new residential quarters are constructed. Audiometry Technician/Speech Therapist – still one person is working. They should have been appointed separately.

6. Ward side laboratories: Still individual ward is not provided with such laboratories.

7. Still one person is only working as audiometry technician and speech therapist. They should have been appointed separately. Deficiency still continued.

8. Workload in Radiology department is still inadequate.

10. The number of deliveries is grossly inadequate. The deficiency continues.

11. The position regarding PHCs in Urban & Rural areas remains the same. They are not under the control of the Dean and no posting of the students is done. No staff is earmarked.

12. The overall strength of the nursing staff is still grossly inadequate as only total 80 nurses are available against 159 required.

13. The construction of various buildings in a time frame manner is not being done and is running behind the schedule as per the Council requirements.

14. Other observations/deficiencies pointed out in the inspection report.

It was further decided to recommend to the Central Govt. for issuance of appropriate instructions by the Central Govt. to the college authorities not to proceed with any fresh admissions in the academic session 2003-2004, since they have failed to fulfill the condition for compliance with all requirement as per MCI Regulations and norms and have failed to remove all the deficiencies pointed out in the last inspection report.

38. Ruxmaniben Deepchand Gardi Medical College, Ujjain - renewal of permission for admission of 3rd batch of students during the academic session 2003-2004.

Read: the inspection report (15th September, 2003) of Ruxmaniben Deepchand Gardi Medical College, Ujjain for renewal of permission for admission of 3rd batch of students during the academic session 2003-2004 for which the permission has already been granted by the Central Govt.

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council considered the inspection report(15th Sept.,2003) and noted the following:-

1. Shortage of staff:

Professors – 3 (Microbiology-1, Forensic Medicine-1, Radio-Diagnosis-1) Associate Professors – 7 (Anatomy-1, Physiology-2, Biochemistry-1, Medicine-1, Obst.

& Gynae.-1, Anaesthesia-1) Asstt. Professors – 5 (Anatomy-2, Physiology-1,Biophysics-1,Community Medicine –1) Junior Residents – 7 (General Medicine-1, General Surgery-4, Ophthalmology-1, Obst.

& Gynae.-1).

2. C.R. Gardi Hospital, Surasa (new) –

(a) On the day of inspection, no senior faculty was present in the OPD and the work was handled by Junior Residents except in the Surgery OPD which was managed by one Associate Professor.

(b) There is only one operation theatre to carry out minor procedures under local anaesthesia. This theatre lacks piped oxygen suction and other necessary equipment and infrastructure to undertake surgery under general anaesthesia.

(c) The average work load in the x-ray department is 10 plain x-rays and equal number of ultrasonography. The special procedures like Barium studies and IVPs are carried out very infrequently.

(d) The wards consist of cubicles housing 6-8 patients each and thus not possible for the nurses at the nursing station to have a proper over view. The side labs in the wards are not equipped and furnished. Bed occupancy is hardly 10%. On the day of inspection in the male medical ward there was not a single patient.

(e) No Blood Bank, CSSD, laundry and kitchen. (f) No deliveries are conducted. (g) No surgeries are conducted at this hospital.

(h) The average OPD attendance is about 320. (i) Records are maintained manually

333. The status of Ujjain Charitable Hospital, Budwariya is same as reported during the

inspection of 24th & 25th July,2003.

4. No adequate furniture for the faculty members in the offices in the departments of Anatomy, Physiology, Biochemistry and Pharmacology.

5. The departmental libraries of Anatomy, Physiology, Pathology, Microbiology and Forensic Medicine departments do not have adequate number of books.

6. The departmental laboratories for Histopathology, Cytopathology and Research laboratory in the department of Pathology is not functional.

7. Special laboratories except for mycobacterium are not functional and required number of microscopes are not available in the practical laboratory in the department of Microbiology.

8. Other observations/deficiencies pointed out in the inspection report.

In view of above, the members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council decided to recommend to the Central Govt. to recall the abovementioned letter dated 26.8.2003 issued by the Govt. of India regarding renewal of permission for admission of 3rd batch of students for the academic session 2003-04 issued by it on 26.08.2003 in respect of Ruxmaniben Deepchand Gardi Medical College, Ujjain, since the preconditions imposed by it vide the conditional letter dated 26.8.2003 making it obligatory for the college authorities to adhere to the time schedule for completion of the college and hospital building as per time bound action programme and also attend to all other deficiencies pointed out by the Mci in the last inspection report, have not been fulfilled.

It was further decided to recommend to the Central Govt. for issuance of appropriate instructions by the Central Govt. to the college authorities not to proceed with any fresh admissions in the academic session 2003-2004, since they have failed to fulfill the condition for compliance with all requirement as per MCI Regulations and norms and have failed to remove all the deficiencies pointed out in the last inspection report.

3439. K.J.Somaiya Medical College, Mumbai- Renewal of permission for admission of

4th batch of students against the increased intake from 50 to 100 for the year 2003-2004.

of permission for admission of 4th batch of students against the increased intake from 50 to 100 at K.J. Somaiya Medical College, Mumbai.

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of

the Executive Committee of the Council considered the compliance verification inspection report (17th Sept.,2003) and noted as under:- 1. Shortage of teaching staff:-

Professor-Nil Assoc.Prof.-1 (Forensic Medicine) Asstt. Prof.-4 (Anatomy-1, Pharmacology-1, Lecturer in Statistics-1, Dentistry-1) Tutor/Sr.Resident-4 (Physiology-1, Pharmacology-2, Microbiology-1) Jr. Residents: Nil. Head of Biochemistry department is Assoc. Professor.

2. Accommodation in the hostels for students is grossly inadequate. Total accommodation for 100 students has been provided outside the campus which is inadequate.

3. Residential quarters for non-teaching staff and nursing staff are inadequate. 4. Accommodation is provided for total 90 residents which is inadequate. 5. There is no CT Scan in the hospital. 6. In OPD, the space provided is still inadequate. Space provided in the Orthopaedic OPD

is still inadequate for moving the trolley and stretcher. 7. There is still overcrowding in the casualty. Duty roster in the casualty shows the

posting of only one Junior Resident on rotation duty of 8 hrs. each, who are not regular CMOs. No person from Forensic Medicine is detailed for casualty posting for MLC cases.

8. The health centers of the college, Nareshvali, is 120 km. away from the college. Looking to the distance of the centers from the college, participation of the staff of the department of Community Medicine and students will be very difficult in the activities of health center.

9. No accommodation is provided for interns in the medical college complex. However, they have earmarked one floor on the 7th floor of the Information & Technology Instt. in the adjoining campus for the interns. There is no lift in the building.

10. No residential quarters are available for the teaching staff. 11. Kitchen does still not supply therapeutic/special diets. 12. In the department of Physiology, no separate Mammalian experimental laboratory and

amphibian experimental laboratory are established. Both the laboratories are combined. Each laboratory is having accommodation for 10-15 as against the requirement of 60.

13. In the department of Forensic Medicine there is no autopsy block. 14. Other observations/deficiencies pointed out in the inspection report.

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council also perused the copy of the communication dated 27.08.2003 sent by the MCI to all concerned including the Central Govt. In that letter, the following relevant portion of the Constitution Bench judgement of the Hon'ble Supreme Court in Islamic Academy of Education dated 14.08.2003 is reproduced as under:-

"…….. So far as the year 2003-04 is concerned, time is running out as the outer time limit

for admission is fast approaching or has gone. To meet the urgent situation without going into the issues involved in the various petitions/applications, we direct that the seats be filled up by the institution and the State Governments in the ratio 50 : 50. However, if by any interim order, this Court has permitted any institution to fill up a higher percentage of seats and the seats have been filled up accordingly, the same shall not be disturbed. It is made clear that due to the time constraint this arrangement has been made, without deciding the contentious issue involved in various pending cases……"

35It is stated that by an office order dated 14.05.2003, the Central Govt. has also approved

the time schedule for completion of the admission process for medical and dental colleges which was placed before the Hon'ble Supreme Court by the Central Govt., whereafter the above-mentioned judgement of the Constitution Bench was passed on 14.08.2003. The MCI had recommended to the Central Govt. the complete time schedule for the admissions of candidates in the MBBS course wherein it has been approved that the last date for admission of all students against vacancies in the MBBS course shall be 30.09.2003.

In view of the above, the members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council decided to recommend to the Central Govt. not to renew the permission for admission of 4th batch of students against the increased intake from 50 to 100 at K.J. Somaiya Medical College, Mumbai for the academic session 2003-04.

40. Increase of MBBS seats from 100 to 150 at D.Y. Patil Pratishthan’s Medical College, Pimpri, Pune – Grant of LOP

Read: the compliance report submitted by the authorities of D.Y. Patil Medical College, Pimpri, Pune for grant of letter of Permission for increase of MBBS seats from 100 to 150. The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council considered the compliance along with the inspection report (10th & 11th July,2003) and decided to recommend to the Central Govt. to issue Letter of Permission for increase of seats in first MBBS course from 100 to 150 at Padmashree Dr. D.Y.Patil Medical College, Pimpri, Pune u/s 10A of the I.M.C. Act,1956 for the academic session 2003-04.

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council also perused the copy of the communication dated 27.08.2003 sent by the MCI to all concerned including the Central Govt. In that letter, the following relevant portion of the Constitution Bench judgement of the Hon'ble Supreme Court in Islamic Academy of Education dated 14.08.2003 is reproduced as under:-

"…….. So far as the year 2003-04 is concerned, time is running out as the outer time limit for admission is fast approaching or has gone. To meet the urgent situation without going into the issues involved in the various petitions/applications, we direct that the seats be filled up by the institution and the State Governments in the ratio 50 : 50. However, if by any interim order, this Court has permitted any institution to fill up a higher percentage of seats and the seats have been filled up accordingly, the same shall not be disturbed. It is made clear that due to the time constraint this arrangement has been made, without deciding the contentious issue involved in various pending cases……"

It is stated that by an office order dated 14.05.2003, the Central Govt. has also approved the time schedule for completion of the admission process for medical and dental colleges which was placed before the Hon'ble Supreme Court by the Central Govt., whereafter the above-mentioned judgement of the Constitution Bench was passed on 14.08.2003. The MCI had recommended to the Central Govt. the complete time schedule for the admissions of candidates in the MBBS course wherein it has been approved that the last date for admission of all students against vacancies in the MBBS course shall be 30.09.2003.

41. To note the Letters issued by the Central Govt. for Renewal of permission for Establishment of new medical colleges and increase of seats.

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of

the Executive Committee of the Council considered the representation of Dr. Jagdish Prasad and did not agree to consider him as Principal of Vardhman Mahavir Medical College and Safdarjung Hospital, New Delhi since he does not have requisite experience to become eligible for the post of Principal as per the statutory regulations of the Council.

3744. Female feticides: Violation of Pre-Natal Diagnostic Techniques Act 1994/rules

1996. Read: the matter with regard to Female feticides: Violation of Pre-Natal Diagnostic

Techniques Act 1994/rules 1996.

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council approved the following recommendations of the Ethical Committee:-

“The Ethical Committee considered the matter and decided that Dr. Manju Goel was called upon to present before the Ethical Committee at 2pm on 12.8.2003. She did not report to the MCI till 6pm on 12.8.2003 and even did not inform earlier to the Council that she will not be able to attend the Council Office on the said date and time. It can be noted that Dr. Manju Goel was earlier called to appear before the Ethical Committee on 24.4.2003 when she promised to submit the training certificate of MTP and Ultrasound by registered post within 15 days to the Council office. She has also submitted in writing on the 24.4.2003 while submitting her deposition. However, one unsigned letter dated 5.8.2003 has been received by the Council office on 8.8.2003 without any required enclosures, as promised. It is also noted that Dr. Manju Goel was registered with this Council in the name of Miss Manju Gupta D/o M.C.Gupta on 5.3.1980 bearing registration No.1613. While deposing before the members of the Ethical Committee on 24.4.2003 she admitted in writing that she forget to change her maiden name to Mrs. Manju Goel although she is practicing in this name since 1990. The Members of the Ethical Committee waited for CD to be submitted by Dr. Manju Goel as well as all the relevant documents and paper and information gathered from them present before 7 representatives of the Distt. Appropriate Authority by the Ethical Committee on 18.06.2003 at 1pm. After taking into consideration all the documents, papers deposition of Dr. Manju Gupta and documents submitted by Distt. Appropriate Authority, Faridabad, Haryana, the Ethical Committee is of the opinion that Dr. Manju Gupta has grossly highlighted Act, 1994 Rules 1996 to the extent of female feticides and thus she has violated the Code of Medical Ethics. This cannot be considered as a mistake or a mere negligence but willful act. Under these circumstances, the Ethical Committee recommends to the Executive Committee and the General Body of the Council to erase her name permanently from the Indian Medical Register. If the recommendation of the Ethical Committee be approved by the General Body of the Council then the same be communicated to Dr. Manju Goel.”

45. Information with regard to Qualification as to Gestroenterologist. Read: the matter with regard to qualification as to Gestroenterologist. The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of

the Executive Committee of the Council and refer the matter to the General Body of the Council as the same requires larger discussion on the issue.

46. Removal of name of deceased person from Indian Medical Register. Read: the letter received from the Registrar, Rajasthan Medical Council dated 29th

August, 2003 intimating that Dr. Madhu Sudan Bhatnagar, (Registration No.2806, dated 3/3/1971) has expired on 27/8/2003 and his name has been erased from the register of Registered Medical Practitioners.

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council noted the letter dated 29th August,2003 received from the Registrar, Rajasthan Medical Council intimating that Dr. Madhu Sudan Bhatnagar (Regn.No.2806, dated 3.3.1971) has expired and his name has been erased from the register of Registered Medical Practitioners. The Committee decided to remove the name of above mentioned doctor from the Indian Medical Register and also to give intimation in this regard to all the State Medical Councils in the country.

3847. Selection of Deputy Secretary (Medical) in the Council office.

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council approved the recommendations of the Selection Committee which met on 18.9.2003 recommending the selection of Dr.Devender Kumar as Deputy Secretary in the Medical Council of India. 48. Promotion to the post of Asstt. Secretary in the Council office.

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council approved the recommendations of the Departmental Promotion Committee which met on 18.9.2003 recommending the promotion of Shri Ranvir Singh as Assistant Secretary in the Medical Council of India.

49. Promotion to the post of Administrative Officer in the Council office.

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of

the Executive Committee of the Council approved the recommendations of the Departmental Promotion Committee which met on 18.9.2003 recommending the promotion of Smt. Madhu Handa as Administrative Officer in the Medical Council of India. 50. Increase of MBBS seats from 50 to 100 at Santosh Medical College & Hospital,

Ghaziabad – Permission of Central Govt.-Regarding.

Establishment of medical college at Jaipur by Indian Medical Trust, Jaipur –

Permission of Central Govt.-Regarding.

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council considered the application received from the Indian Medical Trust. They also considered the letter dated 18.9.2003 received in the office of the Council on 19.9.2003 in which the bio-data of 6 candidates was enclosed. The Committee authorised the President (Acting) to constitute a Sub-Committee who will visit Jaipur and hold consultation for the selection to the post of Principal, National Instt. of Medical Sciences, Jaipur. 52. S. Nijalingappa Medical College, Bagalkot – Renewal of permission for admission

of 2nd batch of students.

The members of the Adhoc Committee appointed by the Hon'ble Supreme Court and of the Executive Committee of the Council considered the compliance report along with the additional information submitted by the authorities of Uttaranchal Forest Hospital Trust Medical College, Haldwani and decided to verify the same by way of an inspection and authorised President (Acting) to take the decision.

The members of the Executive Committee and of the Adhoc Committee also took

cognizance of the Central Government letter in which the deadline of 30th September was prescribed for the MCI to take the decisions on the question of granting/renewing the permissions. In view of the deadline so prescribed, the Secretary of the Council was asked by the members of the Executive Committee and of the Adhoc Committee, to convey the decisions taken in today’s meeting in respect of permissions/renewals of the medical colleges to the Central Government immediately.
