Statistical Year Summary ofTransfer of Cases Under 28 U.S.C. § 1407

During the twelve-month period ending September 30, 2017, 33,232 civil actions weresubjected to coordinated or consolidated proceedings established by the United States JudicialPanel on Multidistrict Litigation, pursuant to 28 U.S.C. § 1407. Specifically, the Paneltransferred 3,620 cases that were pending in 91 district courts to 39 transferee districts forinclusion in a multidistrict litigation docket. Another 29,612 actions were filed directly intransferee districts.

The Panel centralized 23 new multidistrict litigation dockets in the twelve months endingSeptember 30, 2017. Fourteen products liability dockets comprised nearly two-thirds of thesenew MDLs, while three data security breach and three sales practices MDLs comprised just overa quarter of the transferred dockets. The remaining three MDLs transferred were amiscellaneous docket involving an alleged automobile defect, an antitrust docket, and asecurities docket.

Additionally, the Panel declined to transfer a total of 239 actions that were the subject of 36new motions for centralization.

Since the creation of the Panel in 1968, there have been 626,938 civil actions centralized forpretrial proceedings. As of September 30, 2017, a total of 16,600 actions had been remandedfor trial and 486,136 actions had been terminated in the transferee court. At the end of thisstatistical year, there were 124,202 actions pending in 51 transferee district courts.
