de Venecia initially expressed his gratitude to the House leadership for the unanimous approval of House Bill No. 10107 or the proposed Philippine Creative Industries Development Act, and to his colleagues for supporting the creative movement and being part of the Creative Industries Bloc of the 18th Congress. He then urged the Senate to act swiftly on the passage of said measure.

Thereafter, he talked about the different ways by which creativity can fuel local development and impact the local economy, and shared about his interactions with creative stakeholders during their creative caravan trip to different local government units (LGUs) across the country.

As he explained the distinction between the concept of culture and creativity, he informed the Body that the United Nations Educational, Scientific and Cultural Organization (UNESCO) has come up with a framework entitled “Cities, Culture, and Creativity” that would help LGUs jumpstart their economies through the employment of creativity and local strategies through six enablers or strategies.

Using the acronym UNESCO in discussing these six enablers, Representative de Venecia first explained that “uniqueness,” which represents the letter U, of the cultural assets of an LGU can be used as comparative advantage for the country. Moving on to letter N which stands for “network of institutions and partnerships,” he highlighted the importance of partnership efforts with different organizations to promote and support local creatives. For letter E, he next talked about “enabling public spaces” which he said may include the reuse of spaces that can potentially facilitate creative activities.

He then talked about “skills development,” representing the letter S, and shared with the Body the different trainings and workshops that were conducted to help local creatives; and “catalyzers,” representing the letter C, which encourages an environment where financial and technical support are made available for the local creatives. Lastly, for letter O which stands for “online environment,” he invited LGUs to maximize the benefits from digital spaces in supporting local creative businesses and activities.

Thereafter, he hoped that the presented strategies will inspire his colleagues and other local leaders in creating opportunities for sustainable development through creative solutions, and to be part of the Philippine Creative Cities Network (PCCN) which

is an avenue to exchange ideas and create programs in support of the creative industry. He added that members of PCCN will also get access to the Philippine Creative Cities Playbook which is a guide for cities in determining which among the UNESCO Creative Cities Network fields they are strongest.

After citing the supporting and guiding role of the Department of Trade and Industry in the creative endeavors of LGUs, he then pointed out that the creative industry can provide creative solutions to the pressing problems of the country.

Representative Brosas voted against House Bill No 10373. She stressed that Congress cannot tolerate inefficiency and incompetence in the use of public funds. She emphasized that the billions of pesos which remain undisbursed and unutilized while the fiscal year was about to end should have been used for financial assistance, hospitals and health services, and other urgent needs of the people who were suffering from the pandemic and economic crisis. She also asked whether the funds were not being used intentionally in order to be released the following year which was an election year.

EXTENSION OF PRIVILEGE HOUR

Before the Chair could act on the motion, Deputy Speaker Bondoc requested Representative Romualdo to make the proper motion first in extending the privilege hour.

PRIVILEGE SPEECH OF REPRESENTATIVE ZARATE

Commemorating the 158th birth anniversary of Gat Andres Bonifacio, Representative Zarate expressed belief that the latter, if he were alive today, might have started again or taken part in another revolution to liberate the Philippines from imperialist countries.

Representative Zarate then shared his observation that colonialism and foreign control are still very evident at present as he cited the many instances and cases of intrusion of China in the Philippine territory. Subsequently, he called out the Duterte administration for red-tagging and harassing those who fight for the country’s freedom and sovereignty.

In closing, he stated that the legacy of Bonifacio will continue to live on in every Filipino who continues to fight oppression.

REFERRAL OF PRIVILEGE SPEECH OF REPRESENTATIVE ZARATE

On motion of Representative Romualdo, there being no objection, the Body referred the privilege speech of Representative Zarate to the Committee on Rules.

Likewise, on motion of Representative Romualdo, the Chair next recognized Rep. France L. Castro for her privilege speech.

PRIVILEGE SPEECH OF REPRESENTATIVE CASTRO (F.L.)

Expressing alarm over a recent World Bank report which indicates that the country is suffering from learning poverty, Representative Castro hoped that said findings would serve as a wake-up call for the government to take appropriate action to address the poor quality of education in the country.

She next criticized the Duterte administration for its failure to allocate appropriate resources to support students and teachers who cannot afford online and modular learning; and its lack of commitment for the immunization, testing, and treatment of education stakeholders participating in the pilot face-to-face classes. She also lamented how the Department of Education (DepEd) had put pressure on the teachers during the pandemic year, and lacked concrete plans and policies to ensure the safe return to physical classes.

She then called on the Body to perform its oversight function over DepEd to resolve the issues in the education sector.

On motion of Representative Romualdo, there being no objection, the Body referred the privilege

PRIVILEGE SPEECH OF REPRESENTATIVE GAITE

Recognized by the Chair on motion of Representative Romualdo, Rep. Ferdinand R. Gaite, through Zoom, raised issues concerning job-order and contract-of-service (JOCOS) employees in various national government agencies and LGUs who have yet to receive their intended benefits and incentives.

Representative Gaite pointed out that despite their length of service, qualifications, and services offered especially during the pandemic, JOCOS workers remain to have no employer-employee relationship with their hiring agency and do not enjoy benefits, coverage, and allowances normally accorded to government employees.

Thus, he expressed support for the JOCOS workers’ call for a ₱10,000-gratuity pay before the year ends especially amidst the ongoing crisis and high inflation rate. He likewise urged the government to end all forms of contractualization in the country.

SPONSORSHIP SPEECH OF REPRESENTATIVE ABUEG-ZALDIVAR

As she initially sought the immediate passage of House Bill No. 9981, Representative Abueg-Zaldivar emphasized the need to secure the Philippine maritime domain as provided for in Article I of the 1987 Constitution which clearly defines the national territory of the country. She stated however that despite being a signatory and party to the 1982 United Nations Convention on the Law of the Sea (UNCLOS), the Philippines has long fought for international recognition of being an archipelagic State and has often been challenged by other countries.

At this juncture, Deputy Speaker Bondoc relinquished the Chair to Deputy Speaker Kristine Singson-Meehan.

She said that the Philippines had laid a cornerstone in securing its maritime territory and enhancing its security and territorial integrity through the enactment of Republic Act (R.A.) No. 9522 or the Philippine Archipelagic Baselines Law and that the proposed measure, once passed, would unequivocally proclaim the maritime entitlement of the country under UNCLOS and bolster the country’s quest for international recognition as an archipelagic State.

Citing the benefits of the proposed measure, she stated that establishing the Philippine maritime zones will promote the country’s territorial integrity, optimize the benefits of the blue economy, improve maritime governance and law enforcement, and negotiate with neighboring countries on the overlapping maritime boundaries. Lastly, she stressed that establishing the Philippine maritime zones will not only secure the country’s maritime territory but also the welfare of its citizens.

APPROVAL ON SECOND READING OF HOUSE BILL NO. 9981

SPONSORSHIP SPEECH OF REPRESENTATIVE VELOSO

Representative Veloso explained the provisions in each paragraph of Article 70 of the Revised Penal Code. Through a hypothetical comparison of imposed penalties vis-à-vis the severity of offenses, he pointed out that the deletion of paragraph 5 of the said article, specifically the 40-year maximum limit for a sentence, is consistent with Section 1 of the Bill of Rights, stating that no one shall be denied the equal protection of the law.

He then requested that the Explanatory Note of the Bill be adopted as part of his sponsorship speech.

Thereafter, on motion of Representative Bolilia, the Chair recognized Representative Zarate for his interpellation.

INTERPELLATION OF REPRESENTATIVE ZARATE

Citing the Bill’s objectives, Representative Zarate discussed with Representative Veloso the implications of the proposed deletion of paragraph 5 in relation to the reformative or retribution nature of the current justice system and the issue that it rather favors those who are more privileged. He added that the less fortunate offenders who could not afford the best legal defense relies on the 40-year maximum sentence limit for a possible earlier release.

Thereafter, Representative Zarate asked the Sponsor the principle behind the 40-year maximum limit despite the threefold rule stipulated in paragraph 4 of Section 70.

In the ensuing debate, Representative Veloso cited the following arguments: 1) existing laws already provide many concessions to would-be convicts and convicts such as the Revised Penal Code on preventive suspension and R.A. No.10592 on good conduct time allowance; 2) the Constitution provides that it is the prime duty of the government to serve and protect the people; 3) crimes that will be affected by the Bill are not crimes against the State as was his colleague’s concern; and 4) in murder and rape cases, the accuser is the people of the Philippines and not the State.

On the other hand, Representative Zarate asserted that 1) the principle of the criminal justice system aims to use the law to protect the accused

against the wide powers of the State; 2) paragraph 5 is a limitation on such extensive powers; 3) it is also the State’s duty to rehabilitate convicts and protect the rights of the minority and it is provided in the Constitution that one is presumed innocent until proven guilty; 4) if paragraph 5 was removed, all other crimes and offenses will be affected; and 5) the Bill is anti-people and would adversely affect convicts from the poor sector, some of whom were innocent or were convicted because of circumstances or trumped-up charges.
