Subject :—Subscription to Social Security Schemes, namely, PMJJBY andPMSBY.

Government of India has rolled out two Social Security Schemes, namelyPradhan Mantri Jeevan Jyoti Bima Yojana (PMJJBY) and Pradhan MantriSuraksha Bima Yojana (PMSBY) in the country with a view to financiallyempowering people and providing social security to them.

The salient features of the two schemes are indicated below :—
PMJJBY :
All saving bank holders in the age group of 18 to 25 years in theparticipating banks are entitled to join PMJJBY. In case of multiple savingbank accounts held by an individual in one or different banks, the person iseligible to join the scheme through only one savings bank account. Aadhar isthe primary KYC for the bank account. A sum of Rs. 2 lakhs is payable onmember's death due to any reason.
Under PMJJBY, the premium payable by a subscriber is Rs. 330/- perannum. The premium is deducted from the account holder's saving bankaccount through 'auto debit' facility in one instalment, as per the optiongiven under the scheme. The next annual renewal date is each successive1st of June in subsequent years.
PMSBY :
All saving bank Account holders in the age group of 18 to 25 years inthe participating banks are untitled to join PMSBY. In case of multiple savingbank accounts held by an individual in one or different banks, the person iseligible to join the Scheme through one savings bank account only. Aadharis the primary KYC for the bank account.
The scheme offers the following benefits :—

A subscriber has to pay a premium of Rs. 12/- per annum. The premiumis deducted from the account holder's saving bank account through 'autodebit' facility in one instalment under the scheme. The next annual renewaldate is each successive 1st of June in subsequent years.
All the employees are, as such, advised to consider subscription to theabove two schemes, if they have not done so already, by visiting/contactingthe Branch Managers of the banks in which they maintain their savingaccounts so as to secure the above financial security/insurance cover benefitsfor themselves under these schemes.

Whereas, the Collector, Land Acquisition (ACR), Ramban videNo. Acq/M/PMGSY/18/987-90 dated 18-19-2018 has reported that thenotification issued under section 4 (1) of the J&K State Land AcquisitionAct was served upon the interested persons for filing objections, if any, to theproposed acquisition, but no objection was received from the land owners/interested persons within the prescribed period as required under sections 5and 5-A of the Land Acquisition Act ;
Whereas, the report furnished by Collector, Land Acquisition (ACR),Ramban vide No. referred to above duly endorsed by Deputy Commissioner,Ramban vide No. DC/LA/Rbn/125-27 dated 14-11-2018, read withNo. DC/LA/Rbn/222-23 dated 15-07-2019, Divisional Commissioner,Revenue vide No. 502/3592/PMGSY/Demote/Rbn/19/2126 dated 04-09-2019 and by the Financial Commissioner, Revenue vide No. FC-LS/LA-4945/2019 dated 18-09-2019 has been examined and it has beenfound that the land owners did not file any objection to the proposedacquisition ;
Whereas, the Government is satisfied that the land particulars whereofare given above is required for public purpose viz. for construction ofMehar Neera Ganote Road situated in Village Demote, Tehsil and DistrictRamban under PMGSY.
Now, therefore, in pursuance of section 6 of the J&K State LandAcquisition Act, Samvat 1990, it is declared that land measuring18 Marlas, situated in Village Demote, Tehsil and District Ramban,particulars whereof are given above is required for public purpose viz. forconstruction of Mehar Neera Ganote Road situated in Village Demote,

Whereas, on the basis of an indent placed by Principal District andSession Ramban, a notification under section 4 (1) was issued by Collector,Land Acquisition (ACR), Ramban vide No. Acq/Gen/2018-19/182-89dated 19-09-2018 for land measuring 25 Kanals situated in VillageMaitra, Tehsil and District Ramban ;
Whereas, the Collector, Land Acquisition (ACR), Ramban videNo. Acq/Gen/19/386-87 dated 05-03-2019 has reported that the notificationissued under section 4 (1) of the J&K State Land Acquisition Act wasserved upon the interested persons for filing objections, if any, to the proposedacquisition and one Sh. Mohd Umar Nizami S/o Lt. Shams-ud-Din hasclaimed that he has stated a project for construction of Masjid and otherfacilities for the benefits of Muslim Community and also claimed that landmeasuring 48 Kanals and 15 Marlas has already been acquired by theGovernment for construction of New District Complex, Maitra, Ramban.Besides, some land owners have also filed objections which have beenproved baseless and have no merit as stated by the collector concerned ;

Whereas, on the basis of an indent placed by Project Director,NHAI, PIU, Jammu a notification under section 4 (1) was issued byCollector, Land Acquisition (ADC), Udhampur vide No. LA/ADC/332-40 dated 08-07-2017 for land measuring 39 Kanals and 04 Marlas situatedin Village Manda, Tehsil Chenani, District Udhampur ;
Whereas, the Collector, Land Acquisition (ADC), Udhampur videNo. LA/ADC/1693 dated 05-10-2019, has reported that the notificationissued under section 4 (1) of the J&K State Land Acquisition Actwas served upon the interested persons for filing objections, if any, tothe proposed acquisition, and some land owners/interested persons namelyOnkar Chand, Shankar Singh, Karnail Chand sons of Suran Chand andPrem Singh, Dharam Singh Sons of Jagat Ram R/o Lower Manda filedobjections to the proposed acquisition with the plea that they will be rendered

However, the Collectorconcerned after conducting enquiry in the matter has reported that the subjectland is already with IL & FS Transportation Limited since 2011 on rent basisand the land owners are getting rent from the said company. The Collectorhas further reported that the merits of acquisition are much more than theobjections filed by land owners/interested persons as they have other landalso in same village for cultivation of crops and has recommended the saidland for office complex of NHAI ;
Whereas, the report furnished by Collector, Land Acquisition (ADC),Udhampur vide No. referred to above duly endorsed by DeputyCommissioner, Udhampur vide No. LA/ADC/1697-99 dated 10-10-2019,Divisional Commissioner, Jammu vide No. 50/3794/NHAI-Office/Manda/Uder/19/2534 dated 19-10-2019 and by the Financial Commissioner,Revenue vide No. FC-LS/LA-5053/2019 dated 23-10-2019 has beenexamined and it has been found that the objections titled by some landowners are without any merits ;
Whereas, the Government is satisfied that the land particularswhereof are given in "Annexure-A" to this notification is required forpublic purpose viz. for establishment of NHAI, Office/Camp at TunnelLocation to Ensure Proper Maintenance, Monitoring and Security of theTunnel situated in Village Manda, Tehsil Chenani, District Udhampurunder PMGSY.
Now, therefore, in pursuance of section 6 of the J&K State LandAcquisition Act, Samvat 1990, it is declared that land measuring39 Kanals and 04 Marlas situated in Village Manda, Tehsil Chenani,District Udhampur particulars whereof are given in "Annexure-A" to thisnotification is required for public purposes viz. for establishment of NHAI,Office/Camp at Tunnel Location to Ensure Proper Maintenance, Monitoringand Security of the Tunnel situated in Village Manda, Tehsil Chenani,District Udhampur under PMGSY. Further, the Collector, Land Acquisition(ACR), Udhampur is directed under section 7 of the said Act to takeorder for acquisition of the said land after giving prescribed notice to theinterested person (s) as required under the Land Acquisition Act/Rules.

The case was referred to this Collectoratefor initiating land acquisition proceedings under the provisions of LandAcquisition Act 1990 Smvt. and rules made thereunder. The revenuepapers were got prepared through Tehsildar Pouni and also gotauthenticated by the indenting department.
Accordingly a notification under section 4(1) of Land AcquisitionAct No. X SMVT 1990 was issued by this Collectorate vide No. CLA/ACR/Rsi/2017-18/616-24 dated 02-03-2018 and was served upon theland owners/interested persons and indenting department, who wereasked to file their objections, if any, within 15 days from the date ofissuance of said notification. No objection was received by thisCollectorate in response to said notification. The case was submittedto the District Collector (Deputy Commissioner) Reasi vide No. CLA/ACR/Rsi/18-19/44 dated 02-05-2018 for obtaining declaration undersections 6 and 7 of the Land Acquisition Act 1990 Smvt. from thecompetent authority. Thereafter, the District Collector (DeputyCommissioner), Reasi requested Divisional Commissioner, Jammu videNo. DC/Rsi/18-19/1913-17/SQ dated 02-02-2019, for the issuance ofdeclaration under sections 6 and 7 of the Land Acquisition Act.Thereafter, Commissioner/Secretary to Government, Revenue Department,Civil Secretariat, Srinagar vide Notification No. 99-Rev (LAJ) of 2019dated 25-07-2019 issued declaration under sections 6 and 7 for the landmeasuring 02 Kanals 16 Marlas for the subject public purpose, withthe direction to the Collector Land Acquisition (Assistant Commissioner,Revenue), Reasi that he shall be personally responsible for identificationand proper title verification of all types of land involved in thecase and apportionment of compensation amongst all the interestedpersons/rightful claimants in accordance with the relevant laws/rules inforce, while making the award and directed this Collectorate undersection 7 of the said Act to take order for acquisition of the said landafter giving prescribed notice to the interested person(s) as requiredunder the Land Acquisition Act/Rules.
Then, a notification under sections 9 and 9A of the LandAcquisition Act was issued by this Collectorate vide No. CLA/ACR/Rsi/2019-20/179-187 dated 18-09-2019, and served upon the landowners/interested persons and indenting department asking them to filetheir objections regarding measurement, title and quantum ofcompensation within a stipulated period. In response to said notification,no objection was received from anyone concerned.

Principle of Compensation :
This land is located in Village Poura Jagir, located out of Municipallimits and is being acquired for PMGSY Department. The land comingunder the acquisition is agriculture as well as non-agriculture in nature.As per report of Tehsildar, Pouni vide No. 193/Teh/P/OQ dated12-8-2017, it is reported that no mutation under sale deed has beenattested during the last three years in village Poura Jagir and due towhich average sale deed rate couldn’t be worked out. The stamp dutyrates for the year 2019 notified by the District Collector, Reasivide No. DC/RSi/18-19/1529-57/SQ dated 31-12-2018 of Village PouraJagir, Tehsil Pouni, District Reasi are Rs. 1.96 (in lacs) for irrigated,Rs. 1.73 (in lacs) for unirrigated and Rs. 4.60 (in lacs) for small plots,per local kanal.
Therefore, keeping in view the report of field staff, location ofland under acquisition, notified Stamp duty rates for the year of 2019and other factors, this Collectorate proposed a rate of Rs. 2.50 lacsfor cultivable and Rs. 2.30 lacs for uncultivable land per local kanalfor the land under instant acquisition, and based on the proposed ratesof land compensation submitted a draft award to the District Collector(Deputy Commissioner), Reasi for determination of the rates in theCollectors meeting.
The instant case of the land acquisition was placed in the Collectorsmeeting on 04-10-2019 headed by District Collector, Reasi and ratesof land compensation proposed by this Collectorate were discussedthreadbare. The committee of Collectors found the rates ofland compensation proposed by this Collectorate to be reasonable andjustifiable and hence unanimously approved a rate of Rs. 2.50 lacs(Rupees two lacs and fifty thousand only) per local kanal, for Cultivableland (HB) and Rs. 2.30 lacs (Rupees two lacs and thirty thousandonly) per local kanal, for un-cultivable land (GM) under instantacquisition. The minutes of the said Collectors meeting have beencommunicated to this Collectorate vide No. DC/Rsi/2019-20/1181-87/SQ dated 11-10-2019. Thereafter, a revised draft award bearingNo. Col./Acr/Rsi/19-20/278 dated 28-10-2019 was submitted to theDistrict Collector, Reasi for the approval of rates of land compensationand sanction of awarded amount in the light of SRO-132 of 2019 dated25-02-2019. The District Collector (Deputy Commissioner) Reasi videNo. DC/Rsi/19-20/1500-03/SQ dated 28-10-2019 accorded the approvalof rates of land compensation and sanction of awarded amount.
Further, no structure, fruit bearing and non-fruit bearing trees arereported to be involved in the acquisition.

Whereas, the Arbitrator in terms of communication No. 146/ADJJdated 07-08-2019 has sought extension of time for completing theArbitration proceedings and giving his award ; and
Whereas, the matter has been examined and after consideration,it has been decided to accept the recommendation of the Arbitratorregarding grant of extension in time for making the award.
Now, therefore, in exercise of the powers conferred bysub-rule (1) of rule 10 of the Jammu and Kashmir Requisitioning andAcquisition of Immovable Property Rules, 1969, the Government herebydirect that the time for making the award is extended by a furtherperiod of four months w.e.f the date of issuance of this notification.

S.O.-31.–Whereas, on 28-09-2016, Police Station, Shopian receiveda DD extract from PP, Keegam to the effect that a reliable informationwas received by the PP that Constable Mohammad Abass No. 2465/S ofSecurity, Kashmir who was deployed as PSO with Ex-MLC (CPIM),Ab. Rehman Tukroo R/o Tukroo, Shopian had left his service rifle AK-47along with one Magazine and 30 live rounds unattended in the house of the

[No. 42-g–––––––––––––––––––––––––––––––––––––––––––––—–––—————––said MLC, which was stolen by one of the relative of the MLC namely,Waseem Ahmad Khanday S/o Ayoub Khanday R/o Takiabal, Zrakan Keller,District Shopian from the guard-cum-bedroom with the criminal intentionand the accused managed to steal the service weapon due to the negligenceand carelessness of the said PSO ; and
2. Whereas, a case FIR No. 319/2016, under section 380 RPC, 7/25A. Act, 30 Police Act r/w 3 PEPO was registered in Police Station, Shopianand investigation of the case was taken up ; and
3. Whereas, during investigation, it was found that accused namely,Waseem Ahmad Khanday along with other active terrorists of LeT andJeM namely, Zahid Ahmad Mir, Irfan Abdullah, Irfan-ul-Haq Sheikh andZeenat-ul-Islam hatched criminal conspiracy and stole away the serviceweapon of accused Mohammad Abass Lone No. 2465/S R/o Keegam,Shopian from the guard-cum-bedroom of the residence of Ex- MLC namely,Ab. Rahman Tukroo, Shopian during night hours and the other guard personnelfired upon the accused namely, Waseem Ahmad Khanday while jumpingout of the room but he managed to escape due to darkness and lateron hejoined the terrorists ranks. The accused managed to steal the weapon dueto carelessness and negligence of Constable Mohammad Abass LoneNo. 2465/S ; and
4. Whereas, the Investigating Officer on the basis of seizure memosand statement of witnesses recorded under relevant section of law hasestablished a prima facie case against the accused persons namely, WaseemAhmad Khanday S/o Ayoub Khanday R/o Takiabal, Zrakan Keller (Dead),2. Zahid Ahmad Mir S/o Shameem Ahmad Mir R/o Ganowpora, Shopian(Dead), 3. Irfan Abdullah S/o Mohammad Abdullah Ganie R/o Heff, Shirmal,Shopian (Dead) 4. Irfan-ul-Haq Sheikh S/o Gh. Mohammad Sheikh R/oMaldera, Shopian (Dead), 5 Zeenat-ul-Islam S/o Gh. Hassan Shah R/oMalnad Sugan, Shopian (Dead), for the commission of offences punishableunder sections 380, 120-B RPC, 7/25 A. Act and against the accusedConstable Mohammad Abass Lone No. 2465/S S/o Ghulam Mohi-ud-DinR/o Keegam, Shopian for the commission of offences under sections 30Police Act, 3 PEPO ; and

5. Whereas, the Government of Jammu and Kashmir is of the viewthat there is sufficient material and evidence available against the accusedpolice official for acording sanction as required under section 5 of the PEPOfor his prosecution under section 3 of PEPO and section 30 of PoliceAct ; and
6. Whereas, Government of Jammu and Kashmir after havingexamined the relevant records of the case is satisfied that prima facie acase under section 30 of Police Act, 1983 read with 03 PEPO is made outagainst the aforementioned accused police official on the basis of evidencecollected during the course of investigation.
Now, therefore, in exercise of powers conferred by section 5 of thePolice Enhanced Penalties Ordinance, the Government of Jammu andKashmir hereby accords sanction for launching prosecution against theaccused person namely, Mohammad Abass Lone No. 2465/S S/o GhulamMohi-ud-Din R/o Keegam, Shopian for commission of offences punishableunder section 30 of Police Act read with section 03 PEPO in FIRNo. 319/2016 of P/S, Shopian.

2. Whereas, a case FIR No. 72/2018 under section 7/25 Arms Act18, 19, 38, 39, UAPA was registered at Police Station, Yaripora andinvestigation taken up ; and
3. Whereas, during the course of investigation, site plan was prepared.Statement of witnesses acquainted with the facts and circumstances ofcase were recorded under relevent sections of law and placed on record.The arms ammunition including other increminating material recovered fromaccused has been preperly seized vide seizure memo dated 16-02-2018.Investigation conducted revealed that the accused Sajad Ahmad TantrayS/o Late Mohd Maqbool Tantray R/o Sherpora, Frisal is an OGW of bannedmilitant organization HM. The said OGW helps and facilitates terrorists byproviding logistic support, viz. arranging Arms and Ammunition,transportation/communication. The accused is also helping militants to attackon Police Stations and security establishments. Evidence collected duringthe course of investigation, prima facie established case under section 7/25 A Act, 13, 19, 38, 39, UAPA against him and investigation of case hasbeen concluded as proved ; and
4. Whereas, the Authority appointed by the State Government undersub-section (2) of section 45 of the Unlawful Activities' (Prevention) Act,1967, has independently scrutinized the Case Diary file and all the otherrelevant documents relating to the case and has come to a definite conclusionthat this is a fit case for accord of prosecution sanction against the saidaccused persons ; and
5. Whereas, after perusing the Case Diary, the relevant documentsand also taking into consideration the observations/views of the Authorityappointed under sub-section (2) of section 45 of the Unlawful Activities(Prevention) Act, 1967, the State Government is of the view that there issufficient material and evidence available against the accused persons fortheir prosecution under the aforesaid provision of law.
6. Now, therefore, in exercise of powers conferred bysub-section (2) of section 45 of the Unlawful Activities (Prevention) Act,1967, the State Government hereby accords sanction for launchingprosecution against the accused person namely Sajad Ahmad Tantray S/oLate Mohd Maqbool Tantray R/o Sherpora, Frisal for the commission of

[No. 42-b–––––––––––––––––––––––––––––––––––––––––––––—–––—————––In the meantime Hurriyat activists of “Geelani” Group namely, ShakeelAhmad Itoo, Mohd Yousuf Ganie @ Falaie, Shakir Mir, Nazir Ahmad Mantoo,Mohd Ashraf Sehraie, Mohd Amin Parray, Mohd Amin Ahanger and JavidAhmad Fallay organized a gathering at Jamia Masjid, Manihal and deliveredanti-national speeches. These separatists incited the people to protest againstthe State Government, flared up the sentiments of the people by spreadingfalse propaganda that the Dastageer Sahib RA, Shrine has been set ablazeby State machinery ; and
2. Whereas, a case FIR No. 57/2012 under sections 153-A RPC, 13ULA(P) Act, 1967 was registered at Police Station, Zainapora andinvestigation was taken up ; and
3. Whereas, during the course of investigation, statement of witnessesacquainted with facts and circumstances of the case were recorded underrelevant provisions of law. Besides statement of material witnesses wererecorded under section 164-A Cr. P. C. statement of witnesses so recordedwould inter alia reveal that above mentioned accused persons are affiliatedwith Hurriyat (Geelani) group, who organized a gathering at Jamia Masjid,Manihal and delivered anti-national speeches. These separatists incited thepeople to demonstrate and protest against the State Government, flared upthe sentiments of the people by spreading false propagande that the DastgeerSahib (RA), Shrine has been set ablaze by State machinery. The accusedpersons in their speech urged the people to continue struggle till J&K Stateis seceded/liberated from the India ; and
4. Whereas, during the course of investigation, the Investigating Officeron the basis of statement of witnesses recorded under relevant sections oflaw and other evidence, established a prima facie case against the accusedpersons namely, 01. Shakeel Ahmad Itoo S/o Gh. Nabi Itoo R/o Manihal,Shopian, 2. Mohammad Yousuf Ganai @ Falaie S/o Gh. Mohd R/o Muloo,Chitragam, 3. Shakir Ahmad Mir S/o Gh. Mohammad Mir R/o Zainapora,4. 2. Whereas, a case FIR No. 27/2019 under sections 302 RPC,7/27 A. Act has been registered in Police Station, Pantha Chowk andinvestigation of the case was taken up ; and
3. Whereas, during the course of investigation, site plan has beenprepared and statements of material witnesses have been recorded undersection 164-A Cr. PC which reveals that on 03-6-2019, Sameer AhmadWani along with Tassaduq Amin Shah (both affiliated with banned LeT)had come to meet Abdul Wahid Sofi (an OGW) at his residence. Duringmeeting they had arguments on some issue. While the two were leavingthe house of Abdul Wahid Sofi (OGW), Tassaduq fired on Sameer Ahmadby his illegally acquired Pistol due to which he got injured. The saidTassaduq fled away from the spot along with the illegal pistol. It hasalso surfaced that Sameer Ahmad Wani and Tassaduq Amin Shah wereaffiliated with terrorist organization LeT and Abdul Wahid Sofi wasproviding shelter/transportation and logistic support to them and he toowas working as OGW. On this, offences under sections 16, 18 UnlawfulActivities (Prevention) Act, have been invoked in the instant case.
4. Whereas, accused Abdul Wahid Sofi S/o Abdul Ahad SofiR/o Sofi Mohallah, Pantha Chowk, Srinagar was arrested in connectionwith the case on 17-09-2019. Call Detail Records (CDR) and Subscriberdetails of accused person Abdul Wahid and Sameer Ahmad have beenobtained and analyzed, it has surfaced that both accused persons weretogether in the house of the former on the day and date of incidentwhich has been corroborated by the statement of witnesses recordedduring the investigation.
5. Whereas, on the basis of evidence, oral and documentary,collected during investigation a prima facie case is established undersections 18, 19 Unlawful Activities (P) Act against accused namely AbdulWahid Sofi S/o Abdul Ahad Sofi R/o Sofi Mohalla, Pantha Chowk,Srinagar while the other two accused have died.

Whereas, the Authority appointed by the Government undersub-section (2) of section 45 of the Unlawful Activities (Prevention)Act, 1967 has independently scrutinized the Case Diary file and relevantdocuments relating to the case and has come to the conclusion thatprima facie case is made out for prosecution against the accused ; and

2. Whereas, a case FIR No. 03/2019 under sections 13, 39 ofUAP Act, 1967, 6(1) Wireless Telegraph Act, 1933 was registered atPolice Station, Kralgund and investigation was taken up ; and
3. Whereas, during course of investigation, statement of witnessesacquainted with facts and circumstances of case were recorded underrelevant provisions of law and placed on file. The accused was summonedto Police Station, Kralgund and questioned. During questioning accusedAshiq Hussain Khoja S/o Ab. Jabar Khoja R/o Kralgund disclosed thathe is working as OGW with terrorists since long and is facilitatingmovement of terrorists from one place to another. He is in contact withterrorists and other OGW’s through his personal Mobile Phone Samsungbearing No. 6005602332 and there are Whats-App messages and Whats-App voice clips available on the said mobile phone. The accused furtherdisclosed that he is providing every information to the terrorists regardingthe movement of Police/SF’s through his mobile phone and the terroristhave also provided him a wireless set for establishing contact with themwhich he has kept hidden in an orchard. Accordingly disclosure statementwas prepared and subsequent to his disclosure, accused was formallyarrested and cell phone recovered from his possession was seized aspiece of evidence. Subsequent to his disclosure, wireless set with antennamade in Japan was recovered from an orchard at Kralgund and recoverymemo/seizure memo was prepared ; and
4. Whereas, during further course of investigation incriminatingmaterial from seized mobile phone of the accused persons like WhatsApp Chat Screen Shots, Whats App Voice Notes and Whats App audioclip of the mobile phone has been extracted in presence of ExecutiveMagistrate, 1st Class and a separate CD has been prepared. The CDalong with seized mobile phone has been sent to CFSL, Chandigarh forexpert opinion which is still awaited. Evidence collected during investigationhas prima facie established offences punishable under sections 13, 39UAP Act, 1967 and 6(1) of Wireless Telegraph Act against accused AshiqHussain Khoja S/o Ab. Jabar Khoja R/o Kralgund and investigation ofcase has been concluded as proved against him ; and

2. Whereas, a case FIR No. 58 of 2016 under section 13 UA(P)Act, 1967 was registered at Police Station, Sumbal and investigation wastaken up ; and
3. Whereas, during the course of investigation site plan of placeof occurrence was prepared and from the place of occurrence onePakistani Flag was recovered and seized as piece of evidence for whichseizure memo was prepared. Statements of witnesses acquaintedwith facts and circumstances of the case were recorded undersection 161 Cr. P. C. and statement of material witnesses were alsorecorded under section 164-A Cr. P. C. Statement of witnesses sorecorded would inter alia reveal that accused Ghulam-u-Din War, AshiqHussain Dar and Reyaz Ahamd all residents of Naidkhai, Sumbal hoisteda Pakistani flag on mobile tower and also raised Anti-National slogansthereby causing threat to the Integrity and Sovereignty of Country.Evidence collected has prima facie established commission of offencespunishable under section 13 UAP Act against accused01. 5. Whereas, after perusing the Case Diary, the relevant documentsand also taking into consideration the observations/views of the authorityappointed under sub-section (2) of section 45 of the Unlawful Activities(Prevention) Act, 1967, the State Government is of the view that thereis sufficient material and evidence available against the accused personsfor their prosecution under the aforesaid provisions of law.

Ahmad Lone R/o Badana,Awantipora who is a close relative of the subject’s wife and has keptthese arms/ammunition for committing unlawful activities in the Valleyespecially South Kashmir. Rasool Bhat R/o Check,Cholina under sections 364, 120-B RPC, 16 of the Unlawful Activities(Prevention) Act, 1967 whileas A-2. Ishfaq Ahmad Thoker A-3. Gayas UlIslam Thoker, A-4 Abass Ahmad Bhat, A-5. Nos. 02 to 06 stands eliminated in different encounters withsecurity forces at different places against whom proceedings would beabated, however, accused figuring at S. No. 1 is presently under JudicialCustody as Special Jail, Pulwama ; and

Whereas, the Authority appointed by the State Government undersub-section (2) of section 45 of the Unlawful Activities (Prevention) Act,1967, has independently scrutinized the Case Diary file and all the otherrelevant documents relating to the case and has come to a definite conclusionthat this is a fit case for accord of prosecution sanction against the saidaccused person ; and

(2) Every person of whom any question is asked undersub-section (1) shall be legally bound to answer such questionto the best of his knowledge or belief :
Provided that no person shall be bound to state the name ofany female member of his household and no women shall bebound to state the name of her husband or deceased husbandor of any other person whose name she is forbidden bycustom to mention.
(ii) Section 9 : Every person occupying any house, enclosure,vessel or other place shall allow census-officer such accessthereto as they may require for the purposes of census andas, having regard to the customs of the country, may bereasonable, and shall allow them to paint on, or affix to, theplace such letters, marks or numbers as may be necessaryfor the purpose of the census.
(iii) Section 10 : (1) Subject to such orders as the CensusCommissioner may issue in this behalf, a census-officer may,within the local area for which he is appointed, leave orcause to be left a schedule at any dwelling-house or with themanager or any officer of any commercial or industrialestablishment, for the purpose of its being filled up by theoccupier of such or of any specified part thereof or by suchmanager or officer with such particulars as CensusCommissioner may direct regarding the inmates of such houseor part thereof, or the persons employed under such manager,as the case may be at the time of the taking of the census.
(2) When such schedule has been so left, the said occupier,manager or officer, as the case may be, shall fill it up orcause it to be filled up to the best of his knowledge or beliefso far as regards the inmates of such house or part thereofor the persons employed under him, as the case may be, atthe time aforesaid, and shall sign his name thereto and, whenso required, shall deliver the schedule so filled up and signedto the census-officer or to such person as the census-officermay direct.

Section 11 (1)-(a) Any census-officer or any person lawfully requiredto give assistance towards the taking of census who refusesto perform any duty imposed upon him by this Act or any rulemade thereunder, or any person who hinders or obstructsanother person in performing any such duty ; or
(aa) any census-officer or any person lawfully required to giveassistance toward the taking of a census who neglects to usereasonable diligence in performing any duty imposed uponhim or in obeying any order issued to him in accordance withthis Act or any rule made thereunder, or any person whohinders or obstructs another person in performing any suchduty or obeying any such order, or ;
(d) any person who intentionally gives a false answer to, orrefuses to answer to the best of his knowledge or belief, anyquestion asked of him by a census-officer which he is legallybound by section 8 to answer ; or
(e) Any person occupying any house, enclosure, vessel or otherplace who refuses to allow a census-officer such a reasonableaccess thereto as he is required by section 9 to allow ; or
(f) Any person who removes, obliterates, alters, or damages anyletters, marks or numbers which have been painted or affixedfor the purposes of the census ; or
(g) Any person who, having been required under section 10 to fillup a schedule, knowingly and without sufficient cause fails tocomply with the provisions of that section, or makes any falsereturn thereunder ; or
(h) Any person who trespasses into a census office, shall bepunishable with fine which may extend to one thousand rupeesand in case of a conviction under Part (a) shall also bepunishable with imprisonment which may extend to threeyears.
(2) Whoever abets any offence under sub-section (1) shallbe punishable with fine which may extend to one thousandrupees.

(v) Section 15 : No person shall have a right to inspect anybook, register or record made by a census-officer in thedischarge of his duty as such, or any schedule deliveredunder section 10, and notwithstanding anything to the contraryin the Indian Evidence Act, 1872 (1 of 1872), no entry in anysuch book, register, record or schedule shall be admissible asevidence in any civil proceeding whatsoever or in any criminalproceeding other than a prosecution under this Act or anyother law for any act or omission which constitutes an offenceunder this Act.
