The Judge Advocate General (JAG) Department, the judicial and

legal wing of the Army responsible for dispensation of justice to all ranks celebrated its 32nd Corps Day in New Delhi on December 21, 2015. It was on this day in 1949 wherein the Bill for the Army Act was introduced in the Parliament.

The Corps Day celebration commenced with wreath laying by the Adjutant General, Lt Gen Rakesh Sharma and Judge Advocate General Maj Gen Rajinder Kumar at the Amar Jawan Jyoti, India Gate.

A Symposium on “The Military Justice Conundrum - Justice or Discipline” was organised by JAG’s Department at South Block wherein the Supreme Court Judge Justice AK Sikri gave a very elucidating and thought provoking address which focused on the need of discipline in the Military as well as the inevitability of dispensation of quick and fair justice. He stressed that justice demands discipline though not at the cost of discipline. He prescribed that procedures have to be followed, adding that the fairness of the action taken by Military Courtswas however open to Judicial Scrutiny.

JAG Department Celebrates 32nd Corps Day

The symposium was also addressed by Gen Dalbir Singh, the Chief of Army Staff, who deliberated on the difference in Civil and Military Judicial systems while highlighting the need to realize that the powers vested in commanders need to be exercised judiciously while ensuring trust and fairness for subordinates. The Symposium was also attended by Lt Gen MMS Rai, the VCOAS, Lt Gen Rakesh Sharma, the Adjutant General who is also Colonel Commandant of JAG Department and other senior Military Officers

and civilian dignitaries.

In the message on the occasion, the Chief Justice of India,Hon’ble Justice TS Thakur appreciated the role of the Army in preserving high standards of discipline and observed that the Nation reposes great faith in the Armed Forces. He exhorted the Department to rededicate themselves to their motto “Nayaya Eva Dharma”, (Justice alone is Supreme Duty). On the occasion, Gen Dalbir Singh, the Chief of Army Staff, also lauded their contribution to the cause of justice and extended his good wishes.

The JAG Department, which deals with disciplinary and litigation cases is handling varied legal issues of the Army. This Dept is actively involved in assisting all ranks in observing Human Rights and the rule of law. Pertinently, the origin and evolution of JAG Department is closely linked with the evolution of Military Law in England and traces its history to British “Article of War-1385”. Its origin in India goes back to 1841. Brig (Justice) DM Sen (Retd) was the first Indian JAG after independence.

The Sixty Seventh anniversary of liberation of Kargil by the Indian

Army from the Pakistani Army was celebrated with gaiety and fervor at Kargil on November 23, and December 21, 2015. Aptly named as the “Kargil Yom-E-Fateh”or “Kargil Victory Day”, a name recommended by the civil administration which army readily accepted.

The strategic importance of Kargil was well understood by the raiders as well as the Indian Army. Its control with the enemy was affecting the Indian Army campaign in the area of Leh, which itself stood on the brink of capitulation. Advancing from the West, the gallant troops of 1/5 Royal Gorkha Rifles, part of 77 Para Brigade, reached within 6 Km of Kargil, only to be held by an enemy position across the Shingo river at Kharal. The brave and determined Gorkhas led by Capt A Kochar, Company Commander and Subedar Harka Bahadur, a Platoon

Commander swam across the icy cold waters of Shingo river and forced the enemy to withdraw towards Marol in the North (presently across the Line of Control). The Gorkhas

entered Kargil town at 0400 hours on November 23, 1948. The link up with the Leh Brigade was established on November 24, 1948 and Kargil was secured.

BASANTAR DAY

A Tribute to Brave Yodhas of Strike 1 Corps

heroic actions of valiant soldiers and gallantry awardees of Strike 1. In addition an entertainment programme and Barakhana was organised for all ranks on the eve of Basantar Day.

The ‘Basantar Day’ gets its name from the famous Battle of Basantar, which took place in 1971 at Basantar River in Shakargarh Bulge, Pakistan. The enemy had established defences along Basantar River in Jarpal area to stop our advancing troops. On December 15, 1971 our troops launched an attack on enemy defences after establishing a Bridgehead. During

the next two days, the enemy launched several counter attacks to dislodge our troops. 17 HORSE (Poona) Commanded by Lieutenant Colonel (Later Lieutenant General) Hanut Singh destroyed over 46 tanks of the enemy’s armoured brigade. Second Lieutenant Arun Khetrapal alone destroyed four tanks and got mortally injured. He was awarded the Para Vir Chakra (Posthumous) for his gallant action.

The enemy’s two infantry brigades counter attacked repeatedly to regain the lost defences. However, our three infantry regiments repulsed their efforts. Major Hoshiar Singh (Later Colonel) of 3 GRENADIERS led his company inspirationally and got seriously wounded in the battle. He was awarded the Para Vir Chakra for the act of bravery.

It was one of the greatest battles where numerically superior Pakistan forces were defeated on its soil by the Indian troops. In the battle, 54 Yodhas made the supreme sacrifice and 272 got wounded. On this day, the soldiers of Strike 1 stand in reverence to honour its martyrs and the gallant soldiers who fought the war and rededicate themselves to uphold the honour of the nation.

The Mystical Land of the Tchikodoo

As part of my military duty, I was fortunate to set foot and

explore the Democratic Republic of Congo; a journey into the mystical land of Phantom of Walikale… two imposing active volcanoes guarding the town of Goma with watchful eyes, gleaming orange, to remind of the fire within, the pristine Lake Kivu, another wondrous biosphere with more geological angst than both the towering volcanoes put together. The place mesmerised us more as we went in deeper.

We entered a crowded and rural town with narrow streets and hawkers astride the road. Goma, the provincial capital of North Kivu, the Easternmost, conflict torn province of Congo, seems to be an old lady, wrinkled with conflictand pain inflicted, more by greed and violence as by the vagaries of nature; the crooked and broken landscape destroyed by lava, so symbolic of the pain and anguish borne by the people.

It’s a bird? No it’s an airplane!! Oh its superman!! That’s the feeling

I got when I saw a weird contraption with four boys mounted on it, hurtling towards us at breakneck speed. Like the mesmerising locales, this too was a machine either from prehistoric ice age or a device from the future. For the next few hours, I crossed numerous of these mobile platforms criss-crossing the road, defying gravity and all principles of automotive engineering.

It was the proverbial Tchikodoo. I soon got an opportunity to see touch and feel the machine parked on the roadside. My curiosity was that of a young boy. It seemed like an engineering marvel. Made of wood, this was a vehicle with small wheels made of wood, a wooden plank to stand and an unusually long handle, which seemed impossible to manoeuvre. To top it all, the lava

30 Sainik Samachar January 1-15, 2016

stricken roads of Goma town, where, four wheel drive cars and SUVs would have a run for their money, it was amusing these two wheelers deftly manoeuvring the roads with ease.

Tchikodoo, seemingly is a lifeline for local traders and children and a mode of conveyance. Locally fabricated, it resembles the, commonly seen toy scooter for children, which is pushed with one foot and then moves on momentum along a slope. What is intriguing is

the size and structure of the vehicle with minimum machinery (if I dare to call it a machine). Well! Pulleys and levers, we were taught, are simple machines. It can host from one upto four persons and propel at nearly 20-30 Km/ph on practically no incline. On slopes, I daresay, they are the fastest moving vehicles on the road.

It is a mechanical marvel, and I intend taking a miniaturised version as a souvenir, considering that taking a full size prototype may draw copy right and patent related litigations.
