REGULAR CITY COUNCIL MEETING
A Regular Session of the Wyandotte City Council was held in Council Chambers, on Monday,
September 21, 2015, and was called to order at 7:00pm, Honorable Joseph R. Peterson presiding.
The meeting began with the Pledge of Allegiance, followed by roll call.
Present: Councilpersons Fricke, Galeski, Miciura, Sabuda, Schultz and VanBoxell

Chris Calvin, 466 Sycamore, addressed Council to request that the use of cell phones, tablets,
and other non-agenda related items be less prevalent during meetings as to show respect and
attention to the presenters and citizens.

THE CITY OF WYANDOTTE ORDAINS:

There shall be raised by general tax for the fiscal year beginning October 1, 2015, and ending
September 30, 2016, to be assessed, levied, and collected by tax on all taxable real and personal
property in the City of Wyandotte, Michigan, the sum of $10,019,122. In addition to the

and Public Hearings held. The Rates were calculated in accordance with Michigan Compiled

SECTION VII -ADOPTION
This ordinance is necessary for the immediate preservation of the public peace, property, health,
safety and for the daily operation of all city departments. This ordinance shall take effect
October 1, 2015, which represents the first Thursday in October.

AN ORDINANCE ENTITLED
"AN ORDINANCE DETERMINING THE SALARY FOR THE
CITY OF WYANDOTTE ENGINEER"
THE CITY OF WYANDOTTE ORDAINS:
Section 1. City Engineer.
Commencing April 20, 2015 and expiring on April 17, 2017, the City Engineer shall
receive an annual salary in the sum of $105,622.40 (subject to adjustment as set forth below) and
an annual auto allowance of $1,000 (to cover in town city business travel expenses) and may
request mileage reimbursement for the city related business conducted outside the City of
Wyandotte at the rates as allowed by the Internal Revenue Service. The City Engineer’s salary
will be increased in the same manner as other non-union administrative city employees.
In addition, the City Engineer shall receive the following benefits:
I. The City Engineer will be enrolled in the City’s defined contribution plan at the same
level of benefits and employee contributions as other City non-union administrative officials
participating in that plan.
2. The City Engineer may elect to participate in the City’s Section 457 Deferred
Compensation Plan and/or Section 125 Cafeteria Plan, at any time during his employment.
3. The City Engineer, his spouse and dependents shall be eligible for the same insurance
benefits or other benefits and services (as outlined in Article II of the Personnel Policy
Handbook) as other City non-union administrative employees, at the same level of employee
contributions to premium.
4. At the end of employment with the City, the City Engineer will be eligible for
participation in the City’s Retiree Health Insurance Plan at the same level of benefits and retiree
contribution to premium as City non-union administrative employees hired prior to October 1,
2005.
5. City Engineer will be entitled to the same paid holidays as City non-union administrative
employees.
6. City Engineer shall earn one (1) sick day per month worked. Vacation time shall be
earned monthly in accordance with the same schedule of benefits available to other City non-
union administrativc employees.
7. City Engineer shall be eligible for three (3) personal days per calendar year.
8. City Engineer shall receive any accrued, unused vacation at the end of his employment
with the City, at his final salary.
9. City Engineer shall receive any accrued, unused sick time at the end of his employment
with the City consistent with other City non-union administrative employees which is currently
one-half (1/2) of accrued balance limited to ninety (90) days. City Engineer shall not be entitled
to compensatory time off.

The City Engineer shall execute and be subject to the employment agreement with the City of
Wyandotte.
Section 2. Repeal.
All ordinances or parts of ordinances in conflict herein are hereby repealed, only to the
extent necessary to give this ordinance full force and effect.
Section 3. Effective Date.
This Ordinance takes effect fifteen (15) days from the date of its passage and a summary
shall be published in a newspaper circulated in the City of Wyandotte within ten (10) days after
the adoption.

AN ORDINANCE ENTITLED
"AN ORDINANCE TO AMEND THE CITY OF WYANDOTTE ZONING ORDINANCE TO
REZONE THE PROPERTY KNOW AS 1102 OAK STREET FROM ONE FAMILY
RESIDENTIAL DISTRICT (RA) TO NEIGHBORHOOD BUSINESS DISTRICT (B-l)"
THE CITY OF WYANDOTTE ORDAINS:
Section 1. Rezoning of Property:
The following described property located in the City of Wyandotte, County of Wayne,
State of Michigan, and described as follows:
Lot 8, Hurst and Post’s Subdivision, Block 310, as recorded in Liber 1, Page 298, Wayne
County Records
Known as: 1102 Oak Street, Wyandotte, Michigan
be and is hereby rezoned from One Family Residential District (RA) to Neighborhood Business
District (B-l ).
Section 2. Amendment of Zoning Map.
The zoning Map of the City of Wyandotte be and is hereby amended in accordance with
the provisions of this Ordinance as set forth in Zoning Map. No. 286
Section 3. Severability.
All Ordinances or parts of Ordinances in conflict herein are hereby repealed, only to the
extent to give this Ordinance full force and effect.
Section 4. Effective Date.
This ordinance shall be published along with the notice of adoption in a newspaper
generally circulated in the City of Wyandotte within ten (10) days after adoption and shall take
effect fifteen (15) days afler its adoption or seven (7) days after publication whichever is later.
The notice of adoption shall include the text of the amendment, the effective date of the
Ordinance, and the place and time where a copy of the Ordinance may be purchased or
inspected.

RESOLVED that the communication from Gilbert E. Rose, President of The Chelsea Group,
LLC, requesting to place a tent at the entrance of the Willow Tree Store at 3000 Biddle Ave., be
approved for a period of 6 months providing said tent does not block the sidewalk, and no
merchandise will be hung from said tent.
FURTHER RESOLVED insurance policies, and hold harmless agreement to be on file with the
City of Wyandotte until April 4, 2016. The Chelsea Group LLC shall apply, and be approved for
all permits from Wayne County. This Council will evaluate said approval on April 4, 2016.

RESOLVED THAT the request from Washington Elementary School to hold its annual Literacy
Walk on Friday, October 9, 2015 and the request to close Superior Blvd. between 14th Street and
15th Street from 8:45 A.M. to 10:30 A.M. be granted pending approval of Police, Fire and
Department of Public Services.

RESOLVED by the City Council that Council CONCURS with the recommendation of the Chief
of Police and Traffic Bureau as set forth in Traffic Control Order 201504 for the installation of
“Handicap Parking Signs" in front of 1042 Lincoln, Wyandotte, MI. 48192.
AND BE IT FURTHER RESOLVED that the Department ofPublic Service be directed to install
said sign.

BE IT RESOLVED BY THE CITY COUNCIL that the Council concurs with the Chief of Police
to contract the services of DCME to remove the metal bullets from the Police Department gun
range bullet trap.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL that this expenditure will be paid
from our Equipment Maintenance Account 101-301-825-430 in the amount of $2780.00

BE IT RESOLVED BY THE CITY COUNCIL that the Council concurs with the Chief of Police
to purchase one Shield Radar Speed Display device from All Traffic Solutions which is the sole
source vendor for this system.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL that this expenditure will be paid
from our Other Equipment Account 101-301—850—540 in the amount of $4300.00.

RESOLVED by the City Council that Council hereby concurs in the recommendation of the City
Administrator and City Engineer to amend the 2015 Concrete Street Reconstruction and Alley
Repair, File #4672 contract with G. V. Cement Contracting Co. to include the 2015 Concrete
Street Reconstruction of Central Street as set forth in the Amendment To Contract for this work,
and further, authorizes the Mayor and City Clerk to sign said amendment;
FURTHER, this recommendation is consistent with the Goals and Objectives of the City of

II Catholic School Spring Fling Festival to be held at the Benjamin F. Yack Recreation Center on
May 13““ and 14‘“.
AND BE IT FURTHER RESOLVED that Council hereby authorizes the Mayor and City Clerk
to sign said contract.

Coordinator to approve the contract between the City of Wyandotte and Integrity Shows for

BE IT FURTHER RESOLVED that Integrity Shows will receive 30% of received gross
sponsorship dollars for the fair as well as $2,500 for their assistance in creating and updating the
sponsorship program. This fee will be paid from the Street Air Fair Expense Account (285-225-
925-730-860) and has been approved by the Department of Legal Affairs.

BACKGROUND: The City sold the former 333-35 1 Antoine and former 362 Hudson to Antonino Pizzo for the
construction of a new commercial building. The Agreement for this sale indicated that the City Engineer would
petition Your Honorable Body to vacation/close the easterly 31.14 feet of the eighteen (18) foot wide public alley
adjacent to this development. See enclosed drawing. This public alley is without sewer, water, electrical, or any
other utility passing over or under said alley right-of—way.
The Department of Legal Affairs has prepared the necessary resolution setting a hearing of objections to proceed
with vacating and abolishing the public alley.
STRATEGIC PLAN/GOALS: This proposed improvement is consistent with the Goals and Objectives of the
City of Wyandotte Strategic Plan in insuring that new developments will have a positive impact on the abutting
neighborhood, and promotes infrastructure improvements associated with new developments.
ACTION REQUESTED: Determine that vacating and abolishing the public alley is a necessary and beneficial
public improvement and adopt the prepared resolution setting the time and date for a public hearing.
BUDGET IMPLICATIONS & ACCOUNT NUMBER: The alleyvacation and abolishment will have no budget
implications.
IMPLEMENTATION PLAN: If approved by Council, authorize the City Clerk to give notice of the hearing of

This Agreement is contingent upon City Council approval and the following:
12. Purchaser, within twelve (12) months of Seller’s signed acceptance, is required to secure in
Concrete Permit for the construction ofa driveway on the former 333-339 Antoine (The cast 6
feet ofLot 4 and all ofLot 5 except the east 12 feet Hudson’s Subdivision) onto Antoine Street.
13. Purchaser agrees at time ofclosing to combine this property with property currently owned by
purchaser known as 1410 McKinley, Wyandotte.
l4. Purchaser is responsible for Closing Costs which includes, but not limited to Wayne County
Mapping Fee and Title Insurance Premium. Closing Fees will be due at time of closing.

This Agreement is contingent upon the following:
12. Purchaser, within 120 days of Seller’s signed acceptance, obtaining a building permit, issued by the
Engineering and Building Department for the construction ofa minimum one (1) story commercial
building, approximately 2,600 square feet with exterior to be V2 high or C-unit exterior brick as
indicated on Attachment A.
13. This Agreement is further contingent upon the Purchaser undertaking development within six (6)
months from time of closing and complete construction within one (1) year. “Undertaking
development” is defined as: the completion of the foundations and the framing ofwalls for the
construction of the building described in Paragraph 12 above. Failure to undertake development or
complete construction will results in Seller’s right to repurchase property including any
improvements for Four Thousand Six Hundred Eleven Dollars and 81/100 ($4,611.81). A Deed
Restriction will be placed on the property which will include this contingency
14. The Engineering Department will request rezoning of the property known as Former 362 Hudson
(Lot 86 Hudson’s Subdivision) from H (Industrial District) to I-2 Industrial Disnict.
15. The Engineering Department will petition the Wyandotte City Council to vacate/close the easterly

Engineering Department. Hearing Officer recommends demolition.

The Hearing was called to order at 8:30 am. by Greg Mayhew, Assistant City Engineer. The owner
or representative did not appear at the hearing.
Mr. Parker stated that he drove by the property on June 30, 2015, and nothing has been complied
with, the same conditions exist.
Mr. Mayhew stated that taxes have not been paid since Winter 2010, and there has not been any
utilities since March 201 1. Mr. Mayhew continued that it is a small lot (30x103), and the SEN is
$25,100.
Mr. Mayhew stated that a title search was performed and only Dallos Oaks and the County appeared
on it.
Mr. Mayhew stated that the garage is in bad shape, the ramp in the rear of the home is deteriorated,
and rats and other animals have been seen.
Mr. Parker stated that all property maintenance violations (attached) be completed by September 1,
2015, or the matter will be referred to City Council for demolition.

A complaint had been received by the City of Wyandotte Department of Engineering and
Building regardingthe
condition of the referenced property. A site inspection was performed March 12, 201 S,
which revealed that
there are
violations of the City of Wyandotte Property Maintenance Code as noted on the attachedProperty Maintenance letter.
A check of the records at the Wyandotte Department of Municipal Services indicates that
very
little electric
and no water
usage since August of 201 1, indicating that the property has been vacant for over six (6) months.
Due to the lack ofmaintenance of the property at 2250 7m Street as noted by the attached letter, and the lack
of
occupancy, the undersigned deems the dwelling to be unsafe and dangerous.
Please be advised of the following from the City of Wyandotte Property Maintenance Code:
Section PM-l 10 Demolition:
PM-110.1 General: The code official shall order the owner of any premises upon which is located
anystructure
which in the code official’s judgment is so old, dilapidated or has become so out of repair as to be
dangerous, unsafe

unsanitary or otherwise unfit for human habitation or occupancy, and such that it is unreasonable to
repair
the structlire
to raze and remove such structure; or if such structure is capable ofbeing made safe by repairs, to

and sanitary or to raze and remove at the owner’s option; or where there has been a cessation ofnormal

in the Department of Engineering and Building, 3200 Biddle Avenue, Wyandotte, Michigan on July 1,2015,
and whereas the property owner or other interested parties, have been given opportunity to show cause, if any
they had, why the structure at 2250 7th Street has not had all property maintenance repairs made or has been
demolishedin accordance with the City’s Property Maintenance Ordinance, and whereas the Hearing Officer
has filed a report of his findings with this Council; AND
NOW, THEREFORE BE IT RESOLVED, that this Council shall hold a public hearing in accordance with

BACKGROUND: At the Council meeting of September 21, 2015,the alley behind the Wilson Middle School
was discussed. The Engineering and Building Department has inspected this alley and found it in need of repair.
Therefore, I am recommending that a budget amendment in the amount of$ 14,604.00 to the 2015-2016 be prepared
to utilize fund balance to account number 249-450-825-462 to complete this work.
STRATEGIC PLAN/GOALS: This work is consistent with the Goals and Objectives of the City of
Wyandotte Strategic Plan in the continuing effort to enhance the quality of life for residents and the maintenance
of infrastructure.

government and education agencies. Therefore, attached please find the bid from Bell Equipment, Lake Orion,
Michigan to purchase one (1) Leaf Vac in the amount of $27,290.00 and one (1) Truck Box in the amount of
$5,993.00.

to complete the purchase of the property described herein or to incur any penalty by forfeiture of earnest money deposits
or otherwise unless the Seller has delivered in the purchaser a written statement issued by the Federal Housing Commissioner
setting forth the appraised value ofthe propeny for mortgage insurance purpose of not less than $

BACKGROUND: Herewith, please find_the Holiday Lighting Contract assembled and recommended by my
office and the DDA for the 2015 Holiday Season. We seek to contract with Grosse Ile Lawn Sprinkler, Inc to
lease holiday lights for the Downtown Area including the Clock Tower, Arbor, fountain area and all trees
along Biddle Avenue fiom Chestnut to Eurkea Road (see attached document)
Start date for the project will be October 12th 2015 (weather permitting) and completion of the installation will
be on or before October 23rd 2015(weather permitting). Take down of lights will be completed by January 15m
2016 (weather permitting).
A 50% deposit is due on October 12III 2015, 40% is due upon completion of the installation and the remaining
10% is due upon completion of take down. All material is provided by the company and company will replace
or repair any damaged or stolen material.
We are confident Grosse Ile Lawn and Sprinkler will exceed our expectations and are looking forward to
working with them.
STRATEGIC PLAN/GOALS: The City of Wyandotte hosts several quality of life events throughout the
year. These events serve to purpose the goals of the City ofWyandotte by bringing our community together with
citizen participation and supporting the local businesses and non-profit organizations.

the grass area near City Hall and close Sycamore Street from Biddle to Coastal Thai for the Tree
Lighting once again this year.

The Chief of Police is requested to apply to the Wayne County Office of Public Service for a road
closing permit; he should be designated and authorized to sign said street closing permit document
on behalf of the City ofWyandotte. Responsibility for all damage claims which may arise from the
road closing must be assumed by the City ofWyandotte. The Fire Department should also be notified
of this event to reroute emergency vehicles.

Street Block Request
Greetings:
The Wyandotte Music Boosters will host the 11th Annual Downriver Fanfare, a high
school marching band showcase on Tuesday, October 6,2015 at Roosevelt High
School. We presently have several area high school marching bands participating in
this event. We are excited this year to be able to host the Alma College Kiltie Marching
Band.
In order to accommodate the movement of the bands from their warm-up areas to the
football field, we hereby request that Maple Street between 5‘h and 7th Streets and also
5th Street from Eureka to Maple Street, be blocked so as to allow these bands easy
access to the RHS gym parking lot off Maple Street. We would also request that the
alley directly behind the auto shop of the high school be blocked from public use. The
use of the street and the alley blocking would begin at approximately 4:00 pm and end
at approximately 10:00 pm.

A meeting of the Wyandotte Recreation Commission was called to order on Thursday,
September 8, 2015 at 7:30 pm in the Harold Popp Warming Room at the Benjamin F. Yack Center.

A motion was made by Commissioner Ronco and supported by Secretary Shiels to approve the

pass.

SPECIAL ORDER:
Superintendent Lanagan addressed the following with the Commission:
. Superintendent stated the Wyandotte Warriors Hockey Association would like to place stick
racks for hockey sticks that could be removed easily if ever deemed necessary inside the
locker rooms. The four hockey stick racks would be donated by Jay Rays BBQ, a local
Wyandotte Business. Upon completion and installation of the hockey stick racks; the logo of
Jay Rays BBQ would be added for sponsorship. Commissioner DeSana motioned,
Commissioner Ronco Seconded. Motion Passed unanimously.
0 Superintendent Lanagan stated The Rotary Club of Wyandotte sent a letter asking
permission to refurbish Rotary Park in spring 2016. The tasks would be replacing swings,
adding mulch to playscape area, paint the playscape and swing poles and level the picnic
table. Superintendent stated that the Recreation Department would supply the material and
the Rotary Club would provide the labor to update Rotary Park.
0 Superintendent Lanagan stated the dog park has not opened as of September 8, 2015.
The drinking fountain and dog wash station are still on order, however the benches, waste
stations and picnic tables have all been installed. The magnetic locks for the fences will not
be installed until remaining items are delivered and park is completed.
0 Superintendent Lanagan stated Terry Martin, the Outdoor Maintenance Supervisor is on a
leave of absence and is scheduled to return to work the first week of October 2015.
There being no further business to discuss, a motion was made by Commissioner Ronco and
supported by Secretary Shieis to adjourn the meeting at 7:50 pm.

Motion by Member Benson to approve. Member Walker supported motion. All Members voted
in favor.
REVIEW OF PROPOSED WALL SIGNS, PROJECTING SIGNS AND ELEVATIONS
AT 2954 BIDDLE AVENUE:
The application as submitted by Wright Signs (Applicant) and Total Health Foods (Owner) for
the property at 2954 Biddle, Wyandotte, Michigan has been reviewed and approved for as
submitted, pending Wayne County Permit and sealed drawings.
OTHER BUSINESS:
Sign approval of 128 Sycamore (m-3162 Biddle Avenue). Motion by Member Kowalewski to
receive and place on file. Benson seconded motion.

The proposed wall signs, projecting signs and elevation as submitted by Wright
Signs (Applicant) and Total Health Foods (Owner) for the property at 2954
Biddle Avenue, Wyandotte, Michigan has been reviewed and approved as
submitted pending Wayne County Permit and sealed drawings by the Design
Review Committee on September 22, 2015.

RESOLVED that the City Administrator requests a closed session for an employee evaluation
and to consider discipline of an employee who has requested the hearing be closed. This is in
accordance with Section 15.268a ofPA 267 of 1976.
THEREFORE, BE IT RESOLVED that this Body will meet in closed session immediately
following the regularly scheduled Council meeting for the above-stated purpose only.
