This year in true sense has been a newbeginning for DISHA. DISHA's project'Rehabilitation of Crime Victim' restartedwith same funding partner i.e. TATAEducation Trust this year. They aresupporting expansion of the project fromone district - Amravati to three districts -

Pune, Yavatmal and Amravati. They alsoexpressed their hopes from DISHA ofbringing structural change that can havemassive positive effect. This has assuredus of their faith in our work and we arethankful forthat!One of DISHA's activities'Victim SupportDesk at Police Station' got scaled up in sameyear into a project 'Mobile Help Desk'supported by Forbes Marshall Foundation.We are happywith this new collaborationand look forward to further progress.These expansion stints, with increasedstaff strength are demanding strongmanagement and mentoring skills. Welearnt that mentoring and inductiondoesn't end with induction training, itstarts from there! The new fresher staffhasbrought a lot ofyoung energy that is bothcreative and voracious. We are glad thatjust about this point of time I startedpursuing a' Development Management'course at SP f ain Institute of Managementand Research Mumbai. We are striving to

bring in those management principles inour work for better service delivery andlargerimpact.Year 20L7 has been special to us also for thefact that former Hon'ble Chief f ustice ofIndia, |agdish Singh Khehat, in his speech atthe 15th All India meet of the State LegalService Authorities, appealed to make2017 the year of the victims. We value hissensitivity, knowledge and determinationto reach out to victims and reciprocate thesame. With this inspiration, this yearDISHA conducted a massive gathering ofvictims with the motive to understand'Social Justice from Victim's Perspective'wherein 104 beneficiaries participated tovoice their opinion on justice delivery -

expectations versus reality, their needs ofrestoration safely and rehabilitation andshared their stories safelywith other fellowpeople with hope of 'restoring together'.We are happy with DISHA's growth,progress and increase&visibility andcommunication with people from aroundthe world. Our Programs

To achieve DISHA's vision,DISHA works on both fronts:Crime Prevention'fPre-crimeintervention) and VictimRehabilitation (Post-crimeintervention) unvaryingly.DISHA has segmented itsworkas:

I Work with people /fanilyThis is the directinterventionwith victim and dependentswith holistic approach to helpthem restore to normal life

and seek their rights and justice. Here through direct contact, needassessment of the victim/ dependent or person in risk is done and based on that following seryices areprovided:

* Socio-legal guidance (Channel: Helpdesk /Helpline/ referral to DISHA): The victim is first heardwith non-judgmental attitude andthen guided ontheirqueries regarding justice seekingprocesses, whatto expect from the system, role of different stakeholders of criminal justice system in justice delivery, andhow they will contribute to the justice delivery for victim, They are also guided about how they can getsocial, local support and specific professional services with need based referrals,

* Individual and Family Counselling: This is to give emotional, moral, social supportto the victim so as toreduce possibilities of traumatization. If the workers notice dire need, the victims are encouraged andsupported to take help of professional psychotherapist, psychiatrist.

* Legal intervention: As per Criminal Amendment Act, 2 0 13 victim of crime has entitlement for free legalaid and guidance to better understand and represent his/her side in court of law and even challenge thejudgment in the case. However this amendment has yet not received visibility and victim suffers beingdeprived of the provision, Hence DISHA has been helping people wanting better representation in thecourt of law through this service by assisting them in the case, in getting legal aid and contacts of sensitiveyet expert advocates for better representation of case in court.

* Education/Vocationalhelp to Victim/family: DISHA has observed that "ft.. "

crime incidence theeducation of children gets badly disturbed with possibilities of being irregular in school or being a drop-out. Theirprogress stunts because of manyreasons such as trauma, family's inabilityto provide financialsupport, vigilance & care, stigmatiznd treatment to the child /family by others, extreme poverty forcing tochild labor or illegal business, or crinie etc. However when they are supported to sustain in education, thepossibilities of rehabilitation increase for the whole family. Hence through this service DISHA provideseducational material, financial support, assistance to get admission in residential school, assistance withfinancial support to get adinission for a vocational course (for children and adultsJ to improve skills and

* Family Support Services: This is basically a needbased financial support provided to victim family for theiremergency needs that they are not able to pay for. Theseneeds range from support for a medical treatment arouseddue to /after crime incidence, inability to meet the endsdaily, this includes electricity, water bills, grocery, clothes,food etc. Need of seed-money to start a new livelihoodafter loss of previous livelihood / regular income, Somegenuine needs also arise after long time; even in thosecases this support is provided. This service reduces theimpact of crime on victims as their most of crisis situationcome under control with this support and help them tothink for future.

* Intervention to avail Government schemes: This isan effortto reduce impact of crime byavailing benefits ofsuitable government schemes. Maharashtra VictimCompensation Schem e2074 (formulated due to DISHA s

efforts), M ano dhairya Yoj ana, Bal- SangopanYoj ana aresome of the many schemes, thatwe recommend to victimbased ontheir needs and eligibility.

* SupportGroup: This is an effortto provide social and emotional supportand increase coping skillsin victims by gathering 10 to 2 0 victims suffering similar violence/ problems, and encouraging them toshare abouttheir experiences, their ideas of copingwiththe problem and feelingthat'theyare notalone,facing those problems, there are many others and they can support each other to get out of that problem'.

Such group-sessions are facilitated by DISHA s social workers; also some resource persons are also invitedbased on needs.

tlii:sHA_ f i;&) WorkwithSystemThis work is about sensitizing variousstakeholders of the Criminal fustice System aboutvictim's issues, their rights and role ofthe systemin victim's rehabilitation. The stakeholders areimparted knowledge about victim oriented laws,schemes, best practices for victim rehabilitationand crime prevention. There are following twoactivities under this head* Training session with Police, fudiciary, Public

Prosecutors* Sensitization & awareness programs

with Police PatilWorkonpolicyadvocacyRight from the start DISHA has taken efforts to bring policy level changes. Through its PIL, DISHAsucceeded in bringing Maharashtra Victim Compensation Schem e20'J,4 with budgetary provision. Nowthe focus is shifted on status of implementation ofthe scheme and othervictim oriented provisions. DISHAbelieves in research based policy advocacy along with networking, collaborating, lobbying for bringingpolicy level changes. Hence in the upcoming year we are planning a study on the functioning of the VictimCompensation Scheme in Mahrashtra.

Workwith CommunityThis intervention is mainly focused on crime prevention by raising awareness in different sections ofcommunity, namely children, adolescents, youth, educational institutes, women, community and its keystakeholders about the specific issues they face regarding safety: being safe and maintaining a safeenvironment. Followingare the activities underthis head.

'Safe Childhood'is a Sensitization and Awareness session for school children wherein vulnerablechildren aged B to 13 are given information about safe touch - unsafe touch, safe and unsafe behaviors ofthem and others, tips on safety and how to respond to risks, contact information for help and importanthelp-lines etc. We also make sure to make the institution staffaware abouttheir role in maintaining childsafety at institute level in accordance with the POCSO Act 20L2.

Sensitization and awareness sessions for youth called 'drsuqtqfdqt@rq{'(Steppinginto Adulthood)'. Through this activity adolescents and youth aged between L 5 to 22 inSchools, colleges, university, are made aware of the challenges they face being a youth, relationship-violence, peer pressure, lucrative traps that may pull them in risk or in crime, and how to transit smoothlyfrom this phase without indulging in r!.E

* Sensitization and Awarenesssessions for Police Patils:According to Maharashtra VillagePolice PatilAct, L967 , Police Patil isappointed atvillage level to actas aninterface between the police and thevillage. He is given powers andresponsibilities for crimeinvestigation as well as crimeprevention at village. DISHA valuesthese key stakeholders and basedon their needs empowers them tohandle disputes, difficult situationsat their village within their legalcapacity. These sessions help themto take legally informed steps ordecisions in cases of domesticviolence, POCSO, eve-teasing, care &protection of children in theirvillages.

* Display/ distribution of IEC- Informative Educative Communicative Material: These are awarenessmaterials in the form of banners, posters, useful hand-outs and stickers. The banners, posters and stickersare put on display on public places and or during DISHA s awareness sessions / public events to help peoplein risk / vulnerable conditions to seek help, either from DISHA or from key stakeholders of the criminaljustice system.

The hand-outs are designed to act as aguide for the victim / people in riskgiving detail information types of abuse,possible impacts of crime, howto seekhelp from different stakeholders in thesociety and system, important contactinformation. These hand-outs aredesigned in a way so that after readingthem, victim should be able to takeinformed decision in theirlives.

residential schools for tribal children called Aashramshala' under the jurisdiction. This Policy is known as

'JIVHALA policy', DISHA contributed in the Policy making, developing training modules for training of

irainers, and aiso in actual visits for assessment, evaluation of such institutes in Gadchiroli districtregarding their 'Child-safety' status and then providing them module & training regarding the

imptementation of the 'JIVHALA Policy' at their institute. This policy will help to ensure safety for all

children learning and living in Ashramshalas under Nagpur Tribal Development department.

Expansion in three DistrictsThe firstyear of this projectwas in the phase of expansion in three districts Amravati, Pune, Yavatmal.

the staff to make them 'fit for the job''Induction training also helped us to revisit the basic theories in Victimology& Criminology and find its

This year DISHA s Victim Support Desk at initiated at Assegaon Police Station got scaled up to all 31 ruralpolice stations in Amravati as a new project 'Mobile Help Desk'with funding support from Forbes MarshallFoundation.

'Mobile Help Desk' is an initiative that aims to empower victim and people affected by violence at the firstinterface with the Indian Criminal f ustice System [i.e. Police StationJ by providing authentic, appropriateinformation and referrals to take informed dqcisions and seek justice and rights to lead crime-impact free

'Social f ustice from Victim's Perspective'

Since inception DISHA has been voicing that victims have no platform to express their plights and demandjustice. They are not given the'rightto be heard'. So this yearwe decided to take a new step and create an'open, safe and holding' platform for the victims and be all ears to listen to them. With this idea, DISHAconductedatwo dayprogram'Social |ustice fromVictim's Perspective'on 25th and 26th February2018.Deputy Commissioner of Police Amravati Mr. Chinmay Pandit IPS, and District Woman and ChildDevelopment Officer Amravati, Mrs. Rajashri Kaulkhede with their presence added warmth to the place.They freely discussed with the victims and guided them on their issues.

This program helped us to understand their priorities in justice seeking and rehabilitation. It helped inbuilding capacities of the new staffby giving them exposure of such diverse stories in such short span oftime. This is a new and first initiative in itself which assures progress and growth further.

Ourfindings:

* Some of the victims said that the witnesses are either pressurized from the accused to turn hostile orsometimes the witnesses asked the victim to give monetary benefit to tell the truth in court of lawSpeciallyin a POCSO case wherethevictimwas eligible forbenefitof ManodhairyaYojana,the witnessesasked the victim family for half of the amountto tell the truth in the court.

x Some victims who were single parent said they are in a clutch that they have to get out of home to work toearn a living and have no trustworthysupportto lookaftertheir children. Speciallywhenthe accused isfrom the same locality, they find it very unsafe, but have no option. They said we feel like we are living onmercy of god; very helpless.

* Victims were afraid of retaliation from the accused, and said, "The accused gets bail easily and hence hasno fear of law They openly harass us and say, see! We are out again! What could you do with your Policecomplaint?"Theysaid ifthe accused gets legal protection bythe police, thenwhynotvictim is protected?We deserveprotection more than them, but are deprived of.

Success Storyi)Rescue ofagirl Child

Misha (name changedJ was a 10 year old girl living at her stepmother's house since childhood. She wasadmitted in nearby Municipal Corporation School, but her mother seemed to be too ignorant and negligenttowards her education and more importantlytowards her. As a result she used to be irregular in her schooland was timid and this was worrisome for her teacher; however the teacher did not know what could bedone aboutthat.

It happened that DISHA s session on Safe Childhood was arranged in the school and the teacher came toknow that something can be done in such case, with help of social workers if needed. So within two days ofthe session she called on DISHA s number expressing her concern towards the child. A social worker firstwent for general home-visit of the child asking her parent about her irregularity; however the scene at herhome was quite different.

Her mother was a very quarrelsome woman with her mouth full of foul language. She used to make Mishado all the chores and was harassing her a lot. She had a quarrel with the social worker too. The socialworker realized that the child is in trouble and there is some major problem with her mother and family.The social worker discussed the case with nearest police station and they agreed to help. When secondtime the social worker visited her house with a Police personnel in civil dress, her mother wasn't there andher grand-mother started cursing the social worker and Misha. Now the social worker came to policestation and submitted application to protect Misha. Ateam of Police, social worker rescued her and askedher grandmother to send the mother to the police station.

Afterawhilethewoman herself cameto the police station demandingthe girl's custodynonchalantly. Nowthe woman was taken for questioning by the police and after a while she confessed that she was a sex-worker and the girl was daughter of another sex-worker who was her friend. It was found that the girl'scustody was given by her mother to this woman for child's better future. In reality, this woman took this girland was up-keeping her so that to pull her in sex-trade at suitable age/time, This woman also had acriminal record, so looking at all these circumstances the girl was produced before Child WelfareCommittee ofAmravati and later she was admitted to Children Home Amravati. Her education is taken careof bythe committee now, and DISHA is playing role of parental supervision. A doorto a new and safe lifewith better opportunities has opened for Misha.

A twenty four year old woman - Asha (name changed) had come to Mobile help desk at police station to askfor help. Her husband was a Head constable at another police station, and was not living with her for longtime as he had illegally married another woman, That way Asha was feeling betrayed, and was facingdomestic violence. She came to the decision of getting divorce from her husband, but she also wantedpunishment to her husband and needed some source of regular income for her rehabilitation. The help-desk social workers explained her to approach Protection Officer; for 'maintenance' fregular financialsupport) from her husband and she can file charges against him for bigamous marriage. She was afraid thather husband being in Police will be able to get away with such a crime, However when she followed theprocedures, she got the 'maintenance order' and charges were filed against her husband as well.

Expand our reach-out to all the governmental training institutes in Maharashtra like Maharashtra

Police Academy, Judicial Officers Training Institute, and Human Rights Commission etc.

Increase collaboration with Maharashtra State Legal Service Authority and all DLSAs in Maharashtra

for better implementation of Victim Compensation Scheme under sec. 357 A CrPC.

Conducting State Consultation on Victim's Rights

Networking with other partners working on similar or complementing causes in the field.

Action research in the field ofVictimolosy.
