RESOLUTION SETTING DATE OF PUBLIC HEARINGUPON APPLICATION FOR CERTIFICATE OFPUBLIC CONVENIENCE AND NECESSITY

TO OPERATE LIMOUSINE SERVICES

WHEREAS, Section 126-62 of the Municipal Code forbids the operation of a limousineas a vehicle for hire upon the streets of Des Moines without obtaining a Certificate of PublicConvenience and Necessity; and

WHEREAS, Michael G. Marks, seeking to do business as Marks Limousine Service,Des Moines, Iowa, has fied an application with the City Traffic Engineer requesting permissionof the City Council to operate a limousine service in the City of Des Moines, which applicationis now on file in the office of the City Clerk for public review and consideration; and

WHEREAS, upon the filing of an application for a Certificate of Public Convenience andNecessity, Section 126-64 of the Municipal Code requires the City Council to fix a time andplace for a public hearing on the matter of the issuance of a certificate to operate a limousineservice; and

WHEREAS, Section 126-64 does require that written notice of the hearing be given tothe applicant and all present holders of a certificate, if any.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITYOF DES MOINES, IOWA:

1. That the Des Moines City Council shall hear the matter of the request to operate alimousine service in the City of Des Moines at the regularly scheduled City Council meeting onNovember 9,2009, in the City Council Chambers at 5: OQp.m.; and

2. That the City Clerk is directed to give written notice of the time and place of thescheduled hearing to the applicant at the following address and to all the present holders of alimousine certificate at their addresses of record.

The police department shall review each applicant's arrest and traffc records and reporthe results of the Investigation to the city counciL. Where the applicant is a corporation,the corporate offcers' records shall be Investigated; where a partership, each parter'srecords shall be Investigated .

d Sec. 126-66. Liabilty Insurance required. 'PVl"'fJ ( tlt,l.s~J )~(a) A certifcate shall not be issued or continued In effect unless and until the owner

of the limousine business furnishes to the traffc engineer for filing with the ci

clerk an insurance policy or certificate of Insurance Issued by an Insurancecompany licensed to do business In the state, providing commercil general"abilty and automobile liabilty Insurance coverage, or the equivalent thereof, forthe limousine business with minimum limits of liabilty equal to any applicablelimits required by the Code of Iowa, the United States Code, and/or Interstate .commerce commission regulation, whichever Is greater. The above coveragesand limits shall extend to the following on a per occurrence basis: The Injury ordeath of anyone person; the Injury or death of any number of persons In oneaccident; damage to propert In the care, custody and cotrol of th Insure but

excluding property of the Insured; the bodily Injury or death of others resultingfrom negligent acts of the insured while Involved In the furtherance of thelimousine business.

(b) The certificate of Insurance referred to In this section shall provide that thInsurance policy or policies have been en.dorsed to provie 30 days advancewritten no of ca, no-renwa, reduction in inan coverag orlimits and ten days written notice fot nonpaymnt by registered mall to the traffcengineer.

(c) The cancellation or other termination of any required Insurance polic shallautomatically revoke and terminate the certificate and all licnses issued for thelimosine business and the vehicles covered by such Insuranc pollcy(Ie),unless another policy(les), complying with this section; shan be provided and In

. effct at the time of such cancellation or termination. The traffc engineer shall

law enforcement officer or any ci police cadet, any driver shall present thebooking sheet, or a copy thereof, showng the name(s) of the passenger(s) beingpicked up, and If at the airport, the flight number of the arring passengr(s).

(b) Each holder shall retain and preserve all booking sheets In a safe place for atleast one month following the date of the making of the record. Booking sheetsshall be available to the chief of police or the traffc engineer.

(c) Each holder shall submit to the traffc engineer a report by January 30 of eachyear summariing the activi of the previous year. The report shall containInformation on number and types of complaints recived Including speciInforation on any dl$crlmlnatlon coplaints; number of passengers carr;

number of trips per vehicle; age, mileage and general condition of each vehicle;tenure and turnover of drivers' and other Information as required by the traffcengineer.

~.~c,lJe~ Any person owning, operating or controllng a limousine as a vehicle for hire upon the

strets of the ci or picking up any passenger for a fare wihin the corporate limits of the .city, shall first obtain a certifcate and the required annual limousin licee from the

traff engineer. The following motor vehicls are excluded from the requirements of this

article:

(1) Motor vehicles owned and operated by hotels, motels and other boarding places,us fo th pu of trin paro, wi fe or chgebetwen said hotel, motel or boarding place and the local station of acommon carrer.

(2) Ambulances and other emergency vehicles.

(3) Funeral hearses.

(4) Metrolitan Transit Auhoriy buses or other comercial vehices designed totransport 16 or more persons, Including the driver, duly licensed by thestate.

~ Sec. 126-70. LImousine drlvete license requIred.

Ever person who operates a limousine for hire upon the streets of the city shall firstobtain and shall properly display a limousine driver's licnse.

Each limousine may bear on the outside of the door or on the side glass on each sidethe name of the copany and, in addition, may bear an identifying design. If anidentifng name or design is used, the markings shall be painted or affxed by decal inletters or fiures at least 11/2 Inches In height. Any licensed vehicle shall not have a

color scheme, identifng design, monogram, or insignia that wil conflict with or Imitateany existing limousine or any offcial or emergency vehice color scheme, identifngdesign, monogram or insignia in a manner that wil mislead or deceive or defraud thepublic. .Sec. 126-81. Limousine service.

Limousine service may be undertaken by the holder of a certifcate subject to thefollowing coditions: .

AIrport means the Des MoInes International Airport located In southwest Des Moines onFleur Drive between McKinley Avenue and Army Post Road.

Aviation director means the director of the airport or an authorized representative.

Booking means an agreement between a limousine company and a passenger, orgroup of passeners, for limousine serv at a specifed time not less than one hourafter the acceptance of such agreemerit.

Booking sheet means a record prepared by a limousine copany of all chrters booked

by the copany showng the date and time the charter was booked, the date and time

of th servic, place of origin and destination, number of passengers, and the amount offare. If service Is provided at the airport, the booking sheet shall also include thename(s) of the passenger(s) being picked up and the flight number of the arringpassenger(s).

Carlifieate means a certficate of public convenlenÇ8 and necessity issued by the citycouncil authoriing the holder to conduct a limousine servic in the city.

City clerk means the cit clerk or an autoried representative.

Cotracted limousine seMce means a written agreement or contract Wlth a business,for a period of not less than 180 days duration, for limousine servce.

Finance director means th finance director of the city or an authozed representatie.

Holder means a person to whm a certcate of public convenienc and necessity hasbeen issued.

Umouslne means a motor vehicle engaged In the transportation of passengers for hireIn limousine servic.

Limousine licnse means the license granted annually to a person who holds acertifcate to conduct a limousine serv In the ci.

Umouslne servce means transporttion of passengers In 8 motor vehicle from or to anypoint In the city on 8 prearranged basis, for a minimum of one hour at an hourly rate.

Rate card means a card issued by the holder which contains th rates of fare then Inforce.

Solict means to Invite another, either by word or deed, to be a passenger in a vehiclefor hire. Such dees may Include, but are not limited to, parkng In any area whereprospectve passengrs might be found without a booking sheet listing a specicpassenger to be picked up.

Traffc Engineer means the city traffc engineer of the city or an authorizedrepresentative.
