FOREWORD
This Staff Instruction prescribes policies andprocedures to be used by the Republic of Indonesia'sDirectorate General of Civil Aviation for the validation,surveillance and resolution of safety issues,associated with commercial air transport operationsby an air operator from another State. It is a guidancematerial for the appropriate DAAO Inspectors in theimplementation of and is a complementary to the CASRPart 129.
The primary role in the safety oversight of any airoperator is that of the State of the Operator whichissued the Air Operator Certificate (AOC).However, each State has a responsibility to insurethat every aircraft flying over or manoeuvring within itsterritory shall comply with the rules and regulationsrelating to the flight. Because of the wide scope ofoperations involved and the many variables that can beencountered, it is impossible to anticipate allsituations; therefore the DAAO Inspector mustexercise common sense and good judgment in theapplication of these policies and procedures.
This Staff Instruction may be made available to thepublic so that they may better understand the authorityand responsibility of the DGCA.
This Staff Instruction should be used in accordance
with the applicable regulations.
Amendment of this Staff Instruction shall be approved bythe Director General of Civil Aviation.

CHAPTER I GENERAL
1.1 Directorate of Airworthiness and Aircraft Operations (DAAO)
1.1.1 General
A Foreign Air Operator whose operate an aircraft in commercial air transportoperations to and from the Republic of Indonesia shall hold Foreign Air OperatorOperations Specification issued under CASR Part 129.
1.1.2 Responsibilities
The Director of Airworthiness and Aircraft Operation (DAAO) is responsible foradministration of the process related to issuance of the Operations SpecificationValidation, establishment of the Foreign Air Operator surveillance programmeand subsequently, implementation of the programme.
1.2 Application of the Staff Instruction
1.2.1 Definitions
For the purposes of this Staff Instruction:
(a) Air Operator Certificate (AOC) - a certificate authorizing an operator tocarry out specified commercial air transport operations, issued by theState of the Operator;
(b) Lease-(1) Damp lease - is generally understood to be a wet lease of an
aircraft where the aircraft is operated under the AOC of the lessor,with the flight crew and possibly part of the cabin crew beingprovided by the lessor. Part or all of the cabin crew is provided bythe lessee.
(2) Dry lease - is understood to be the lease of an aircraft where theaircraft is operated under the AOC of the lessee. It is normally alease of an aircraft without crew, operated under the custody andthe operational and commercial control of the lessee, and usingthe lessee's airline designator code and traffic rights.
(3) Wet lease - is generally understood to be a lease of an aircraftwhere the aircraft is operated under the AOC of the lessor. It isnormally a lease of an aircraft with crew, operated under thecommercial control of the lessee and using the lessee's airlinedesignator code and traffic rights.
(c) Foreign Civil Aviation Authority (FCAA) - The CAA other than the DGCAthat represents the State of Registry or the State of the Operator.
(d) A Foreign Air Operator - any air operator that holds an AOC issued andcontrolled by a FCAA and authorized by DGCA to engaged schedule airtransportation into territory of the Republic of Indonesia
(e) Validation of AOC - a validation process for the AOC of the foreign operator,leading to the recognition of the AOC and to an authorization for operationsby issuing a Foreign Air Operator Operations Specification.
(1) Foreign Air Operator Operations Specification (FAOOS) - OperationSpecification issued by the DGCA in accordance with this CASR Part 129.

1.2.2 Applicability
The procedures and policy herein shall apply to the operations of any civilaircraft for the purpose of commercial air transport operations by any airoperator who's Air Operator Certificate is issued and controlled by a FCAA.Adherence to the guidance herein provided will enable the DAAO Inspectors toperform Foreign Air Operatorvalidation and surveillance in a uniform manner.
1.2.3 Policies and Procedures
The policies and procedures herein apply to all foreign commercial air operatorsfalling within the scope of Part 129 of the Civil Aviation Safety Regulations.Because of the broad scope of foreign air operations and the many variablesinvolved, it is not practicable to provide detailed procedures for all requirements.Therefore, the DAAO Inspectors must have a sound knowledge of theirinspection responsibilities and exercise sound judgement in applying the policyand procedures found in this Staff Instruction.
1.3 Preparation and Distribution of the Staff Instruction
This Staff Instruction is an official DGCA document, available to the public uponrequest.
1.4 Staff Instruction Revisions
Suggestions and comments for amendment of the Staff Instruction should besent to the DAAO, who is responsible for revisions of this Staff Instruction.
1.5 General Considerations
1.5.1 Civil Aviation Safety Regulations
Pursuant to the authority of Part 129 of the CASRs, a Foreign Air Operator shallnot operate an aircraft in commercial air transport operations to and from theRepublic of Indonesia contrary to the requirements of:
(a) CASR Part 129;
(b) Applicable paragraphs of Parts 91 Subpart H.
(c) The AOC and its associated Operations Specifications issued by the State ofthe Operator to the Foreign Air Operator;
(d) The Foreign Air Operator Operations Specification issued under CASR Part129; and
(e) The rules of the State of Registry of the aircraft and the State of theOperator.
1.5.2 Requirements
To recommend the issuance of a FAOOS, the DAAO Inspectors shall ensurethat:
(a) The Foreign Air Operator has been issued an Air Operator Certificate (AOC)and associated Operations Specifications by the State of the Operator inaccordance with pertinent national regulations of the State of the Operator;
(b) The AOC authorizes the air operator to conduct operations to the Republicof Indonesia as requested by the Foreign Air Operator; and
(c) The State of the Operator is capable to carry out safety oversight of theForeign Air Operator, as determined by a review of the ICAO USOAP auditreports, and/or audits from another Contracting State and/or knowledge ofthe DGCA of the safety oversight capabilities of the State of the Operator.

1.5.3 The Republic of Indonesia Air Services Agreement Requirements
(a) All Foreign Air Operators wishing to operate an air service into and out ofthe Republic of Indonesia must obtain an Air Services Agreement from theRepublic of Indonesia. This requirement is entirely separate from theprocess of obtaining a FAOOS.
(b) The Air Service Agreement should contain a safety clause addressing safetyrequirements that each party to an agreement would need to maintain andhelps to ensure that aircraft using airspace and aerodromes in anotherState are operated and maintained in accordance with ICAO Standards.On-going dialogue, as well as surveillance of air operations, would berequired to maintain the validity of such an agreement. The safety clausewas first introduced by ICAO in 2001, so Air Service Agreements finalizedprior to this date may not contain such a clause.
Note: DOC 8335, Manual of Procedures for Operations Inspections,Certification and Continued Surveillance outlines the text ofa model clause inAttachment VI-A.
(c) The Republic of Indonesia may authorize flights not contained in the AirServices Agreement on a case by case basis. Such flights would be of shortduration for special events, such as humanitarian relief, emergencyoperations, and search and rescue, and a validation of the AOC inaccordance with the procedures of this Staff Instruction may or may not berequired depending on the circumstances. Nevertheless, the DGCA willdetermine that such operations can be conducted in a safe manner, afterconducting a suitable risk assessment.

CHAPTER II VALIDATION OF AIR OPERATOR CERTIFICATE
2.1 General
(a) Pursuant to CASR Part 129, all Foreign Air Operators conductingcommercial air transport operations to and from the Republic of Indonesiashall do so under the terms and conditions of an AOC and its associatedOperations Specifications issued by the State of the Operator, and of aFAOOS, issued by the DGCA.
(b) Pursuant to Article 11 of the ICAO Convention, each Member Staterecognizes the other Contracting States' right to regulate aircraft thatoperate in their airspace. Consequently, the Foreign Air Operator mustcomply, where applicable, with the Indonesian Civil Aviation Law and theCASR's when operating within the Republic of Indonesia's territory duringits aircraft flying to and from aerodrome within the Republic of Indonesia.
(c) When evaluating an application of an operator from another State tooperate to and from its territory, the DGCA must examine both the safetyoversight capabilities and record of the State of the Operator and, ifdifferent, the State of Registry, as well as the operational procedures andpractices of the operator.
(d) In the case where working/technical arrangements have been established,validations will be granted on the basis of such an agreement rather thanunder this Staff Instruction.
(e) Where no working/technical arrangements exist, an administrative reviewof the relevant documentation as detailed below will be performed.
(f) Validation shall be granted in the absence of any significant negativefindings / major deficiencies.
(g) In the case of any significant negative findings / major deficiencies, thedocument review will be followed by additional measures as described in2.2.6 prior to issuing a validation.
2.2 Validation Process
Validation shall be conducted in accordance with process as illustrated in flowchart on Appendix A.
Validation activities shall be conducted by Sub Directorate for Standard.
2.2.1 Documentation Required
Foreign Air Operators shall be required to submit the documentation below:
(a) A completed Republic of Indonesia "Application for Issuance or Amendmentof Validation of Air Operator Certificate for Commercial Air TransportOperations by Foreign Air Operator" Application Form 129-01;
(b) A copy of Economic Authority, authorizing the specific traffic rights, issuedby the responsible Directorate within the DGCA or resulting from a bilateralair transport agreement, if required, by the Republic of Indonesia;
(c) Copies of Air Operator Certificate and its associated OperationsSpecifications;
(d) Compliance Statement with CASR 129.
(e) In case of wet-lease of aircraft, a copy of approval of FCAA of the State ofthe Operator of the lessee, with identification of the operator that exercisesoperational control on the aircraft;
(f) A copy of Insurance certificate; and

(g) Acopy of Security Programme that meets the requirements of the nationalcivil aviation security programme of the State of Operator as mandated byand is in compliance with ICAO Annex Part 17.
(h) Letter of Authorization to Agent, if for this application an Applicant usingan Agent.
2.2.2 Initial Application
(a) Applicants from a Contracting State to the Chicago Convention shall makeapplication in accordance with the application form contained in AppendixB.
(b) Application requirements for applicants from a State that is not aContracting State to the Chicago Convention will be determined on a case-by-case basis.
2.2.3 Amendment to an Existing Foreign Air Operator OperationsSpecification
Applicants requesting an amendment to an existing FAOOS (that is, a change inor addition to service, aircraft type, etc.) will be required to provide the followingdocumentation:
(a) Acompleted Republic of Indonesia"Application for Issuance or Amendmentof Validation of Air Operator Certificate for Commercial Air TransportOperations by Foreign Air Operator" Application Form 129-01;
(b) A copy of the relevant DGCA authority to operate the aircraft into theRepublic of Indonesia, if amended;
(c) In case of wet-lease of aircraft, approval of FCAA of the State of theOperator of the lessee, with identification of the operator that exercisesoperational control on the aircraft; and
(d) Copies of any amendment to the Operations Specifications relevant to theapplication and issued by the State of the Operator.
2.2.4 Review of Documentation
The DAAO Inspector shall confirm receipt of all requested documents. Normally,certificates and licences issued or rendered valid by a Contracting State to theChicago Convention will be recognized. This recognition is predicated on theunderstanding that the requirements under which the certificates and licenceswere issued or rendered valid are equal to or exceed the minimum standardsestablished by ICAO.
If there is a concern about the validity of any aspect of the collecteddocumentation and the air operator is unable to provide clarification, thisconcern is to be conveyed to the FCAA of the applicant's State of Registry orState of the Operator as applicable.
2.2.5 Evaluation of an Application by a Foreign Air Operator
(a) When evaluating a new application by a Foreign Air Operator, the DAAOInspector must examine both the safety oversight capabilities and record ofthe State of the Operator and, if different, the State of Registry. This isnecessary in order for the DGCA, in the terms of Article 33 to theConvention, to have confidence in the validity of the certificates andlicences associated with the operator, its personnel and aircraft, in theoperational capabilities of the operator and in the level of oversight appliedto the activities of the operator by the State of the Operator.

For this purpose, the DAAO Inspector can check the ICAO website, as theICAO has made available a Safety Oversight Audit (SOA) Secure Siteinternet website [httn: / /www.icaosoa.ca/soamainl to provide all ContractingStates the ability to access safety critical information collected fromContracting States during the Universal Safety Oversight Audit Programme(USOAP) audit. This secure site contains final safety oversight auditreports including the audit findings, recommendations, State's action planand comments, as well as the comments of the Safety Oversight AuditSection on a State's action plan in addition to all relevant informationderived from the Audit Findings and Differences Database (AFDD). TheSOA Secure Site is also accessible through the ICAO Flight SafetyInformation Exchange (FSIX) website fhttp; / /www.icao.int/fsixl.
(b) If required, the DGCA may request to the State of the Operator for reportsof any inspections that may have been conducted to obtain information onan operator from another State.
(c) If required, the DGCA may also request access to reports of audits of theoperator in question conducted by independent internationally recognizedaviation audit organizations and / or by other air operators, such as code-sharing partners. Such non-regulatory audits should be used inconjunction with other information such as a report from the ICAO USOAPor other inspection results to evaluate the application.
2.2.6 Additional Measures
(a) Additional measures will be taken by the DGCA if the initial reviewindicates significant deficiencies in the safety oversight system of the Stateof the Operator and, if different, the State of Registry or in the safetyperformance of the air operator.
(b) The DAAO inspector will conduct aircraft ramp inspection in accordancewith DAAO Form 129-03.
(c) The DAAO inspector may request onsite inspection to verify data, andforeign air operator facility.
(d) In the case of any significant negative findings / major deficiencies, thedocument review should be followed by discussions with the State ofthe Operator seeking resolution of such deficiencies prior to granting anapproval. This information can be supplemented, in part, by theconsideration of audits, including operator audits. The DGCA mayconsider audits performed by other States, by internationally recognizedaudit organizations or by its FCAA.
(e) The DAAO Inspectors may also request additional documentation from theair operator that could demonstrate that deficiencies have been rectified.
(f) In case of unsatisfactory additional measures to rectify significant negativefindings / major deficiencies, the application to operate by the foreignoperator shall be denied and a letter forwarded to the State of the Operatorand the State of Registry, if different, with a copy to the operator'smanagement with details of the significant findings. An air operator mayprovide additional supporting documentation or evidence.

2.3 Issuance or Amendment to a Foreign Air Operator OperationsSpecification
Pursuant to Part 129 of the CASRs, the Director General of Civil Aviation, shall,upon determination that the applicant has met all of the safety and regulatoryrequirements, issue or amend the FAOOS. The FAOOS remains valid from thedate of issue as long as the Air Operator Certificate upon which it is basedremains valid. If the State of the Operator only issues AOCs of short validityperiod (e.g. one year) or if the AOC expires or is amended soon after the initialapproval, it is incumbent on the air operator to provide the updated version ofthe AOC in a timely manner. The surveillance programme will enable theRepublic of Indonesia to confirm that the AOC remains valid.
2.4 Records Management
Files are used to maintain records associated with the FAOOS. The file is openedon the day that the FAOOS is issued and is to contain all material that supportsor justifies the granting of a FAOOS. It contains the latest validation issued tothe Foreign Air Operator, justification for the validation, and copies of allsuperseded documents. Which are:
(a) An Application for Issuance or Amendment of Validation of Air OperatorCertificate for Commercial Air Transport Operations by Foreign AirOperator, DAAO Form No. 129-01;
(b) A copy of Economic Authority;
(c) A Copies of Air Operator Certificate and its associated OperationsSpecifications issued by the State of Operator;
(d) Compliance Statement with CASR Part 129.
(e) In case of wet-lease of aircraft, a copy of approval of FCAA of the State ofthe Operator of the lessee;
(f) A copy of Insurance certificate; and
(g) A copy of Security Programme;

CHAPTER III SURVEILLANCE OF FOREIGN AIR OPERATORS
3.1 Introduction
(a) In order to maintain a FAOOS issued by the DGCA, in accordance withCASR Part 129 Subpart C, operators will be subject to appropriatesurveillance. This includes regular ramp checks and documentationreviews. In case any significant negative finding / major deficiency aredetected during this process, the DAAO Inspector shall take appropriatemeasures, to ensure significant negative findings / major deficiencies arerectified.
(b) While the State of the Operator which issued the AOC has primaryresponsibility for overseeing the safety of operations of its certificateholders, the DGCA undertakes, in accordance with Article 12 to theConvention, to ensure that every aircraft flying over or manoeuvring withinits territory shall comply with the ICAO and the Republic of Indonesiarequirements.
3.2 Inspectors
(a) All Inspectors who conduct inspections of foreign aircraft should haveexperience in inspection and surveillance of air operators. These Inspectorsmust be specifically trained and authorized to conduct such inspectionsand possess appropriate credentials identifying them as Inspectorsemployed by the DGCA.
(b) The foreign operator's ramp inspections shall be carried out in a similarmanner to the ramp inspections of the Republic of Indonesia operators,with some important differences, as the standards applied to foreignoperators are based primarily on international standards and not onnational regulations.
Inspectors shall be sufficiency fluent in both spoken and written Englishlanguage to be able to conduct the inspection. The classroom training shallalso be followed by On the Job Training. The inspector's training file shallbe annotated to indicate that the required training has been completed.
The Inspectors shall be trained and knowledgeable in the following:
(i) ICAO Convention and its Annexes 1, 6, 7, and 8;
(ii) Differences between ICAO standards and national regulations, whichmay be more detailed or restrictive;
(iii) Diplomacy, including dealing with potential language difficulties andcultural differences;
(iv) Sovereignty of foreign aircraft, which means that the inspectorauthority is limited to document, communicate and report findings,except as provided at paragraph 3.7.2 (c);
(v) Observing, recording and reporting procedures during inspections offoreign operators;
(vi) Surveillance activities which are not linked to the certification processof the operator; and
(vii) CASR Part 129.

3.3 Sharing of safety information (upon request)
The DGCA will share relevant safety findings regarding a foreign operator withother Contracting States.
3.4 Surveillance Process
Surveillance shall be conducted in accordance with process as described insubsequent paragraphs of this Chapter.
Surveillance activities shall be conducted by Sub Directorate of AircraftOperation and Sub Directorate of Maintenance. Follow Up Actions (such aspreparing letter (s) advising the operator or FCAA as appropriate of finding (s))and recording and filing/uploading record of the activities
3.5 Pre-inspection planning
(a) Inspectors should prepare for an inspection by updating themselves on anyrecent changes to the Republic of Indonesia regulations and/or ICAOSARPs with respect to operations by operators from other States.
(b) A check should be made of the authority for the operator to operate theparticular aircraft concerned.
(c) The record of the operator's history in the Republic of Indonesia should beexamined, including records of past aircraft inspections and, in particular,those of the specific aircraft concerned in the inspection to be conducted, tocheck for any outstanding actions or recurring trends that might warrantparticular attention.
(d) Ramp inspections customarily involve the aircraft and its crew, line stationoperations, servicing and maintenance and the ramp and gate areacondition and activity. Time constraints may apply only to the inspection ofthe aircraft and crew. Determination should be made of the number of
Inspectors and the specializations to be involved, the distribution of tasksand the time to be allocated to each task.
(e) Whilst the plan will include comprehensive inspections, it might not bepossible to cover all the desired elements in the time available for aparticular inspection without causing unreasonable delay to the operations.As inspections on aircraft of any one operator may be conducted atdifferent aerodromes by different Inspectors, the overall inspection plan willneed to take this into account. Some elements should be covered at everyinspection; others can be covered over a number of inspections. Thuscomprehensive records must be kept of all inspections of aircraft of aparticular operator in the DAAO database system, accessible to andupdated by the Inspectors concerned. From these records it will be possibleto plan the content of inspections so that a complete inspection of theaircraft of any one operator is undertaken over one year period for acomplete inspection cycle. All Foreign Air Operators will be inspected atleast once each year.
(f) Selection of a particular aircraft to inspect should normally be done atrandom, in a non-discriminatory manner. However, the Republic ofIndonesia Inspectors shall apply principles of risk management to identifyoperations perceived to present a higher safety risk and, as a result,conduct additional inspection activities aimed at those operations, whichcan be linked to a specific:
(i) State of the Operator;
(ii) Aircraft type;
(iii) Nature of operations;

(iv) Foreign Air Operator; or
(v) Individual aircraft,
(g) Inspectors may need to coordinate inspections with the airport authority.
3.6 Inspections
(a) Routine surveillance will be conducted on all Foreign Air Operators by theDAAO Inspectors at each international aerodrome during ramp inspections.All ramp inspections of aeroplanes will be conducted utilizing the RampInspection Worksheets contained in Attachment I, II and/or Attachment III.The ramp inspection will be chiefly concerned with the aircraft documentsand manuals, flight crew licenses, the apparent condition of the aircraft,and the presence and condition of mandatory safety equipment.
(b) Special-purpose inspections, focused on a particular air operator, may beconducted where previous inspections have indicated a high level of nonconformances to requirements. In addition, reports from air traffic services,aerodrome staff and/or incident reports may also result in a requirementfor special-purpose inspections.
(c) It is to be noted that ramp inspections of Foreign Air Operators are by theirnature on-the-spot assessments which cannot substitute or replace safetyoversight responsibilities of the State of the Operator or the State ofRegistry. Ramp inspections serve as pointers but they are not intended to,and they cannot, guarantee the airworthiness of a particular aircraft or thesafety of the operator's flight operations.
Detailed guidance on the conduct of inspections of foreign operators, aredescribed in Appendix E.
3.7 Action on Findings - Resolution of Safety Issues
3.7.1 General
(a) After a ramp inspection of a Foreign Air Operator, Inspector action resultingfrom findings will depend on the seriousness of the safety finding. Specificaction may also be needed where the State of Registry of the aircraft isdifferent from the State of the Operator.
(b) The DAAO Inspector will use the information contained in Appendix F as aguide in determining the seriousness of a finding and in the course ofaction to be taken. Should a Foreign Air Operator not resolve a majorfinding in a timely manner then the DGCA will consider revocation of theValidation to operate to the Republic of Indonesia.
3.7.2 Follow Up
(a) If there is any finding from an inspection, the air operator will be advised inwriting, and depending on the seriousness, with a copy to the appropriateFCAA of the State of the Operator and/or the State of Registry, asapplicable, advising of the safety deficiency or observation and requestingremedial action or comment as appropriate. If a response is not receivedfrom the air operator within thirty days then the FCAA should be contacteddirectly and requested to ensure that corrective action has been taken torectify the situation. (See Appendix F, for guidance regarding notificationand Appendix J, for sample letters that will be used by the DAAOInspectors.)

(b) In accordance with Article 16 of the Chicago Convention, Inspectors will notnormally cause a delay to a particular flight to complete a Ramp Inspection.Where there is insufficient time to complete a particular inspection due tothe late arrival of the aircraft or for some other reason, then anotherinspection should be planned for a subsequent flight, subject to paragraph3.7.2 (c).
(c) Delays may be unavoidable where it has been determined that the aircrafthas damage and is not airworthy. Annex 8, Part II, 3.6 allows the State toprevent a damaged foreign aircraft from resuming its flight operations onthe condition that the FCAA shall advise the State of Registry or State of theOperator as applicable. Annex 8 also requires that the State of Registry willconsider the airworthiness of the aircraft and prohibit the aircraft fromresuming flight until it is restored to an airworthy condition; or permit theaircraft to resume its flight, if considered airworthy, or permit the aircraft toconduct a non-commercial air transport operation, under prescribedlimiting conditions, to an aerodrome at which it will be restored to anairworthy condition.
Note: Where the State of Registry has entered into an 83bis agreement withthe State of the Operator then the State of Operator may substitute for theState ofRegistry.

The applicant of the FAOOS is required to submit this Compliance Statement upon application for anew or for renewal of his FAOOS and when there is an amendment to the CASR.
The applicant of the FAOOS shall observe of the level of amendment of the CASR (one way to find it isto check at the DGCA website) and amend this Compliance Statement accordingly to the latest level ofamendment of the CASR.
In column "Remarks", an Applicant could explain more about the Method of Compliance, referencingto other related evidence or explaining of reasons if a Section is Not Applicable.
The information provided by completing this Compliance Statement will be used by the DGCA'sInspectors when assessing of an application. Republic of Indonesia. For thepurpose of this part, a foreignperson is any person, not acitizen of the Republic ofIndonesia, who operates anIndonesian-registered aircraft inair transportation solely outsidethe Republic of Indonesia.
129.3Definitions
For the purpose of this Part thefollowing definitions shall apply:
(a) Foreign Civil Aviation Authority(FCAA) - The CAA other than theDGCA that represents the State ofRegistry or the State of theOperator.
(b) A Foreign Air Operator - any airoperator that holds an AOC issuedand controlled by a FCAA andauthorized by DGCA to engagedschedule air transportationintoterritory of the Republic ofIndonesia.
(c) Validation of AOC a validationprocess for the AOC of the foreignoperator, leading to the recognitionof the AOC and to an authorization
for operations by issuing ForeignAir Operator OperationSpecification.
129.5RequirementFor Validation
A Foreign Air Operator shall notperform an operation to which thisPart applies except under and inaccordance with an AOC that hasbeen validated under this Part.
129.7
Compliance(a) A Foreign Air Operator shall not
operate an aircraft in commercialair transport operations to andfrom the Republic of Indonesiacontrary to the requirements of:
(1) Civil Aviation Safety Regulations(CASR) Part 129;
(2) Applicable paragraphs of CASRParts 91 Sub Part H;
(3) The AOC and its associatedOperations Specifications issuedby the State of the Operator to itsAir Operator;
(4) The Foreign Air OperatorOperation Specification issuedunder CASR Part 129;

(5) The rules of the State of Registryof the aircraft and the State of
the Operator.
(b) Despite of paragraph (a)(5), if arequirement of this Part is morestringent than the comparablerequirement of a rule of the Stateof Registry or the State of theOperator mentioned in thatparagraph, the requirement ofthis Part applies.
(c) Each Foreign Air Operator mustkeep each of its employees andother persons used in itsoperations informed of theprovisions of its OperationsSpecifications that apply to thatemployee's or person's dutiesand responsibilities.
129.9Airworthiness
AndRegistrationCertifications
1) No foreign air operator mayoperate any aircraft to and fromthe Republic of Indonesia unlessthat aircraft carries current
registration and airworthinesscertificates issued by the state ofregistry in accordance withArticle 83 bis of the ChicagoConvention, and displays thenationality and registrationmarkings of that state.
2) No foreign air operator mayoperate a foreign aircraft to andfrom the Republic of Indonesiaexcept in accordance with thelimitations on maximum
certificated weights prescribedfor that aircraft and that
operation by the country ofmanufacture of the aircraft.
129.11Documents To
Be Carried
In addition to the requirement ofSection 91.25, a foreign air operatorshall ensure that the followingdocuments are carried on flights intoThe Republic of Indonesia—
i. A certified true copy of the airoperator certificate andassociated operationsspecifications all of which shallbe in the English language;
ii. A Copy of the Document ofOperations SpecificationsValidation;

iii. Those parts of the OperationsManual, which axe required forthe conduct of a flight and areeasily accessible to the crew onboard the aircraft on each
flight, such as the MEL; andinformation and instructions
relating to the interception ofaircraft;
iv. The current AFM approved bythe State of Registry, orequivalent document approvedby the State of Operator. TheAFM shall be updated byimplementing changes mademandatory by the State ofRegistry received from theState of Design.
129.13
FUghtCrewmemberCertificates
No person may act as a flightcrewmember unless he holds a
current certificate or license issuedby the state in which that aircraft isregistered, showing his ability toperform his duties connected withoperating that aircraft.
129.15
RadioEquipment
Subject to the applicable laws andregulations governing ownership andoperation of radio equipment, eachforeign air operator shall equip itsaircraft with such radio equipment asis necessary to properly use the airnavigation facilities, and to maintaincommunications with groundstations, along or adjacent to theirroutes in the Republic of Indonesia.

Air Traffic RulesAnd Procedures
(a) Each pilot must be familiar withthe applicable rules, thenavigational andcommunications facilities, andthe air traffic control and other
procedures, of the areas to betraversed by him within theRepublic of Indonesia.
(b) Each foreign air operator shallestablish procedures to assurethat each of its pilots has theknowledge required byparagraph (a) of this sectionand shall check the ability ofeach of its pilots to operatesafely according to applicablerules and procedures.

(c) Each foreign air operator shallconform to the practices,procedures, and otherrequirements prescribed by theDGCA for Indonesian airoperators for the areas to beoperated in

Air OperatorCertificate
(a) A Foreign Air Operator applyingto the DGCA for a Foreign AirOperator Operation Specificationunder this Part must submit an
application—(1) In a form and manner
prescribed by the DirectorGeneral; and
(2) At least 60 days before theintended date of operation.
(b) An authorized officer oremployee of the applicant,having knowledge of the mattersstated in the application, mustsign the application and certifyin writing that the statements inthe application are true. Theapplication must include a copyof the appropriate writtenauthority issued to that officer oremployee by the applicant.
(c) A foreign applicant may beissued a Foreign Air OperatorOperation Specification, if afterreview, the Director General -(1) Finds the applicant—
(i) Meets the applicablerequirements of thisPart;
(ii) Holds an economicauthority required bythe DGCA applicableto the operations tobe conducted;
(iii) Holds a valid AOCissued by the State ofthe Operator that isacceptable to theDGCA, andauthorizes the holder
to conduct those
operations into orfrom the Republic ofIndonesia territory;
(iv) Hold an InsuranceCertificate to cover its
liability to hispassenger and tothird party;

(v) In case of wet-lease of
aircraft, approval ofFCAA of the State of
the Operator of thelessee, withidentification of the
operator thatexercises operationalcontrol on the
aircraft.
(vi) Is properly andadequately equippedto conduct the
operations describedin the Foreign AirOperator OperationSpecification; and
(vii) Complies with theapplicable securityrequirements inMinister of
TransportationRegulations PM 31Year 2013 ConcerningNational Aviation
Security Program.
(2) Satisfied, that the state ofoperator continues to maintainits functions in respect ofoperations under the AOC inaccordance with the Convention
on International Civil Aviation.
(d) An application may be denied ifthe Director General finds that
the applicant does not meet anyof requirements and conditionsof paragraph (c) of this Section.
(a) Subject to provision ofparagraph (b), a Foreign AirOperator Operation Specificationremains in force as long as theAOC on which it is based
remains valid or until it is
amended, suspended, cancelled,terminated, or revoked by theDirector General or its validityaffected in any similar manner.
(b) A Foreign Air Operator OperationSpecification shall expireimmediately at the end of theninetieth (90th) day following thelast commercial air transportoperation to or from theRepublic of Indonesia to whichthe validation applies.

(c) The Director General mayamend Foreign Air OperatorOperation Specification issuedunder this Part if—
(1) The Director Generaldetermines that safety incommercial air
transportation and thepublic interest require theamendment; or
(2) The Foreign Air Operatorapplies for an amendment,and the Director General
determines that safety incommercial air
transportation and thepublic interest allows theamendment.
(d) The Director General maysuspend, cancel, terminate orrevoke any Foreign Air OperatorOperation Specification issuedunder this Part if the Director
General determines that safetyand security in commercial airtransportation and the publicinterest require the suspension,cancellation, termination orrevocation;
(e) Except as provided inparagraphs (f) and (g) of thissection, when the DirectorGeneral initiates an action to
suspend, cancel, terminate orrevoke a Foreign Air Operator'sForeign Air Operator OperationSpecification, the followingprocedure applies:

unless—
(i) The DGCA findsunder paragraph (g)of this section that
there is an emergencyrequiring immediateaction with respect tosafety in commercialair transportation; or
(ii) The Foreign AirOperator petitions forreconsideration of the
amendment,suspension,cancellation,termination or
revocation under
paragraph (e) of thissection.

SUBPART C - SURVEILLANCE OF FOREIGN AIR OPERATOR
129.25Authority ToInspect
Subject to the Convention onInternational Civil Aviation, a ForeignAir Operator shall ensure that anyperson authorized by the DGCA willbe permitted at any time, withoutprior notice, to board any aircraftwithin the Republic of Indonesiaoperated for commercial airtransportation, to inspect thedocuments and manuals required bySection 129.11 and to performinspections to ensure compliance withthese regulations.
129.27
Foreign AirOperatorResponsibility
(a) A Foreign Air Operator shall:
(1) Give any person authorizedby the DGCA access to anaircraft to conduct an
inspection and to anydocuments, manuals andrecords which are related to
flight operations andmaintenance and any otherdocuments, manuals andrecords that are required bythe Convention on
International Civil Aviation to
be carried on board; and
(2) Provide all such documents,manuals and records, whenrequested to do so by theDGCA, within a reasonableperiod of time.
(b) The pilot in command shall beresponsible for complying withrequirements mentioned inparagraph (a).
129.29Prohibition AndDetention Of
Unsafe Aircraft
Or AircraftLikely To BeOperated In AnUnsafe MannerFrom ResumingIts FUghtOperation
(a) Whenever based on theinspection conducted inaccordance with section 129.25
it has been determined that an
aircraft is unsafe or is likely tobe operated in an unsafemanner the DGCA shall preventthe aircraft from resuming itsflight operations and takereasonable steps to ensure its

continued detention as
necessary until the unsafecondition is resolved.
(b) The DGCA shall advise the Stateof Registry and the State of theOperator as applicable of theprevention or detention, in orderfor the State of Registry or theState of the Operator aware ofthe DGCA actions and take
necessary action to resolve theunsafe condition.
SUBPART D - SECURITY REQUIREMENTS
129.31AircraftSecurity
Foreign Air Operators conductingoperations under this Part mustcomply with the applicable securityrequirements in Minister ofTransportation Regulations PM 31Year 2013 Concerning NationalAviation Security Program.
SUBPART E - AIRCRAFT INCIDENT / ACCIDENT INVESTIGATION
129.33Preservation OfFUght RecorderRecordings AndProtection OfEvidences
Pursuance to CASR Part 830,following an accident or seriousincident within the Republic ofIndonesia, the Operator shall preservethe original recorded data for flightrecorders and protect other evidencesand maintain safe custody of theaircraft and its contents within themeaning of Annex 13 to theConvention on International CivilAviation until the NationalTransportation Safety Committee orthe DGCA takes custody thereof or arelease is granted.
SUBPART F - TRANSITION PERIOD
129.35Holders OfForeign AirOperatorAdditionalOperationsSpecifications

(2) The foreign operatorsubmits for review and
approval its aircraftminimum equipment listbased on the master
minimum equipment list,to the office of the
Directorate of
Airworthiness Certification
of the DGCA. The foreignoperator must show,before minimum
equipment list approvalcan be obtained, that themaintenance proceduresused under its
maintenance program areadequate to support theuse of its minimum
equipment list.

(3) For leased aircraftmaintained and operatedunder a Republic ofIndonesia operator'scontinuous airworthiness
maintenance program andDGCA-approved minimumequipment list, the foreignoperator submits theDGCA operator's approvedcontinuous airworthiness
maintenance program andapproved aircraftminimum equipment listto the DGCA office
prescribed in paragraph(b)(2) of this section forreview and evaluation. The
foreign operator mustshow that it is capable ofoperating under thelessor's approvedmaintenance program andthat it is also capable ofmeeting the maintenanceand operationalrequirements specified inthe lessor's approvedminimum equipment list.
(4) The DGCA letter ofauthorization permittingthe operator to use anapproved minimumequipment list is carriedaboard the aircraft. The
minimum equipment listand the letter ofauthorization constitute a
supplemental typecertificate for the aircraft.
(5) The approved minimumequipment list provides forthe operation of theaircraft with certain
instruments and
equipment in aninoperable condition.
(6) The aircraft recordsavailable to the pilot mustinclude an entrydescribing the inoperableinstruments and
equipment.

(7) The aircraft is operatedunder all applicableconditions and limitationscontained in the minimum
equipment list and theletter authorizing the useof the list.
(a) No person shall operate anaircraft under this part that isregistered in the Republic ofIndonesia unless it is equippedwith one or more approvedflight recorders. The flight datarecorder must record theparameters that would berequired to be recorded if theaircraft were operated underCASR Part 121 or CASR Part
135, and must be installed bythe compliance times requiredby those parts, as applicable tothe aircraft.
(b) No person shall operate anaircraft under this part unlessit is equipped with cockpit voicerecorder as provided in CASRPart 121 or CASR Part 135, asapplicable.
