tn exercise of the powers conferred under sub-section (1) of Section 22 of the Maharashtra (Urban

Areas) Protection and Preservation of TreesAct, 1975 (Mah" Xl-iV of 1975), the Government of Maharashtra

hereby makes the following rules to carry out the pLlrpcses of the Act, the same having been previously

published, as required by the said sub-section {f), es follows.*

1. These rules may be ealled tlre Mat'larashtra (Urban Areas) Protection and Pi-esenvation of Trees

Rules,2009;

2. ln these rules unless the eontext otherwise required,*

(i) "Act" means the Maharaehtra {Urban Areas) Protection and Preservation of Trees Act, 1975;

(ii) "Form" means form appeneied to these rules;

(iii) "sehedule" means Sehedule appended to these rules,

(iv) "SectioR" means section of the Aet; :r(v) The words anci expressions used br.rt not eJefined herein shail have their respective meanlng

as assigned to them in the Act.

B. For being nominated as a representative cf non-crfficial organisation on the Tree Authority, the

person shali he an aetive rnernber of a Res:-offieia! organizaiien registered with the Socia! Forestry

Department of the Government; shaii have an interest in ti'ee plantaiicn, tree eonseruation, tree protection,

ete., anei shail pessess a rich experience *f at ieast ten years in the field.

- 4" With regar.ci to the canduet of meetings of the Tree Authority, the foiicwing provisions shall appiy,

namely :-:(i) in respeet of Tree Authority in a i\4unicipe! Corporation Area the Municipal Commissioner shall

be the Chairman of the Tree Authority :

Provided that, in the absenee cf Chairrnan, aR officer not below the rank of Additional Municipal

Commissioner, as is authorised by the Municipal Commissioner, by writing for the meeting may preside

overthe meeting;

(ii) in respect of other Urban l-ocalAuthorities, the Chairman as is described in the Table to slib-

section (2) of Section 3 of th* Aet strall preside over ihe meeting',

(iii) thre rneeting of the TreeA*thority shali be held at least onee in forty-five days and shall ordinarily

be held at the headquarters of the Tree Auihority :

{viii) Point of order may be raised on the spot with short notice and the decision of the Chairman inthat cases shall be final and the same shall be included in the minutes of the meeting ;

(ix) The Chairman shalldecide other relevant matters.

5. A member shall cease to be a member of the Tree Authority if,

(i) he faiis to attend three consecutive meetings of the Tree Authority, or

(ii) he ceases to be a member of the non-official organization or the Urban LocalAuthority to whichhe represents.

6. The Tree Authority shall carry out the eensus of the existing trees within the jurisdiction in Form- '4.7. The Tree Authority shall prescribe the standard specifying the tree and type of trees which each

plot of land shall have, in Form -'B'.

8. Thetrees to be planted and maintained along ivith the roads in public parks and gardens and sn thebanks of rivers or lakes or seashores or hills or public places shall be as are specified in Schedulc - L

9- An application for felling of trees shall be made in Form * 'C'and shall be submitted along with anUndertaking in Form-'D'.

10. The Tree Authority shall maintain the report of permissions granted for felling of trees in the Registerin Form -'E'.

11. lf in the opinion of the Tree Officer, the nurnber of trees in any land is not adequate, according tothe standards prescribed under section 7, the Tree Authority shail cause the notiee for plantation of treeson every owner and occupier of the plot in Form - 'F'. The owner or occupier to whom the notice in Form-'F' is served upon, shall submit the report of compliance in Form - ,G'.

12. Where any tree is fallen or destroyed by rain, fire, lightening or torrential rain, the Tree Officer mayrequire the owner or occupier of the plot to plant trees by notice in Form - 'H'.

13. ln case adoption of trees is perrnitted, the Applicant shall submit the application mentioning thedetails of the tree, type of trees, etc., trees to be adopted in Form - ,1,.

'14. The Tree Authority shall every year plant the minimum number of trees as are specified againstthe category of Tree Authorities in Schedule - ll. Such plantation shall be reflected in the Annual TreePlantation Plan of the Tree Authority and such plan shall be consistent with ten years' perspective plan.

(1) While planting the adequate number of trees as per the above norrns, care shail be taken toseiect the species suitable to the local soil strata, the climate and the space available.

(2) Water, if can be made availabie by taking bores in the very public spaces iike gardens etc., thesame shall be done on priority. Recharging of such bores or existing bores by appropriate RainWater Harvesting system, shall be provided for in the interest of proper maintenance andup-keep of such spaces.

(3) As regards road-side tree plantation, piants having deep roots shallbe preferred to sustain thenatural calamity.

(4) Though flexibility in the design of land-seape is anticipated, required number of trees as per thenorms shall be strictly adhered to.
