MESSAGE
Dear Members
Season's Greetings!
Like other sciences, modern medicine is an evidence based ever
developing science having worldwide acceptance. It is changing lives of
people by effectively eradicating, controlling and fighting various old and
emerging life endangering diseases in the world.
Modern medical science in our country is also doing its best under able
guidance of our Hon'ble PM Modi Ji. Still there are many challenges
putting hurdles in development of modern medicine and if not removed
in time these may impede development and advances of Healthcare
system in our country.
India is a very old civilization which has its own indigenous medical
system. No modern medical scientists can deny role of Ayurveda and
other medical streams. But all streams have their own principles and
pharmacopeias quite different to modern medicine. Mixing these
streams will give death blow to our traditional medical system and also
damage progress, quality and effectiveness of modern medicine. The
country must allow all systems to do scientific research and develop
separately.
The covid 19 pandemic has shown the strength of modern medical
science and strong commitments and sacrifices of modern medical
professionals.
In our country, more than 1500 doctors of modern medicine have
sacrificed their lives fighting covid 19.These covid martyrs belonged both
from govt. and private sectors who never stopped their professional
works during this devastating pandemic.
We appreciate Govt. of India's scheme of compensations for covid
warriors under PM Garib Kalyan Yojna but we are very sad to see covid
martyrs from private sector not being compensated under this scheme.
We request government to remove this discrimination. All govt. and
private doctors who sacrificed their lives working in this period, did so on
the appeal of our Hon'ble PM, under requirements of the Epidemic
Disease Act and under pious professional commitments.
Modern medical professionals in the country are facing attacks not
only on their science from vested interests but are facing in security
professionally and physically. This must be stopped immediately by a
deterrent central act with a strong will and mechanism to enforce them.
Medical profession has been subjected to many unwarranted and
impractical acts & rules made by governments. As law makers you must
support IMA's proposals to central govt. for promulgation of a central
protection act against violence on medical professionals and institutions.
(Provisions of act should be included in IPC and CrPc) and amendments
in other vexing regulating acts against this profession.
The science of modern medicine needs to be regulated by democratic
will of the medical professionals of the country and the NMC act must
be amended to express this will. There cannot be any ground to deny
democratic rights of the modern medical professionals to regulate their
science and practice. We hope our law makers will seriously ponder
over it.
Even with limited medical infrastructures and numbers of medical
professionals in the country, both public and private sectors have done
its best for ailing people of India. The health budget of the country must
be brought immediately to 5 % of GDP and continue increasing in future.
We need to strengthen govt. health sector. Health should be brought in

concurrent list. There should be Pan India parity in compensations and
service conditions of medical professionals. An Indian medical service is
need of hour. All available and willing medical human resources may be
given opportunity to be appointed in govt. sector increasing medical
posts, relaxing age and other rules. Medical education should be made
affordable. CMEs and Research should be financed by govt. at all levels.
For encouraging medical professionals to work in rural areas a national
policy of incentives and amenities be declared. Role of private health
sector is also very important. They should also be encouraged and
incentivized to meet need of common people and made free from
Inspector Raj. The pricing of drugs should be made uniform and
affordable without compromising with quality.
IMA, the largest and oldest representative association of modern
medical professionals should be heard and must be given
representations in all institutions and committees relating policy and
execution of health in the country.
We hope a big breakthrough in health care in the country will come by
our efforts soon.
On behalf of IMA GSB, we congratulate Junior Doctors Association of
various Govt. Medical Colleges of Gujarat for their 10 days of successful
struggle, their unity and strength paid off and they have got Govt.
Resolution from stating 1 years of SRship equal to bond. IMA GSB & IMA
HQs New Delhi has extended their support to JDA & requested Govt. of
Gujarat to consider their demands & take necessary action. We are
thankful to Govt. of Gujarat for this amicable solution.

Dear Doctors,
National headquarters of Indian Medical Association is proudly announcing National IMA Sports Olympics under the aegis of IMA National Sports committee, which is scheduled in the last week of October 2021 at city of Nashik in Maharashtra.
Under the able leadership of our mentor Dr Ketan Desai and our guiding force Dr Ravi Wankhedkar, our National President Dr Jayalal and our Honorary Secretary General Dr Jayesh Lele have entrusted us to carry out this mega event for our esteemed members of IMA.
This Mega event includes all track and eld sports along with Racket sports and Team games like football and 20-20 cricket tournaments as well.
Our Co - Chairman Dr Aniruddha Bhandarkar has made necessary arrangements there in Nashik to get all these activities done along with swimming championship also.
All these sports activities will attract state nominations while having Intra-State / Inter- district competitions and getting champions nominated along with wild card entries at nominal individual fee, entries will also be entertained...I welcome Sports lovers to come to Nashik as the dates are Climate and Weather friendly on 27, 28, 29, 30 and 31st October 2021.

pointofdifference:-
“Whether the Complaint be dismissed OR whether the matter be
referredfortheopinionofaMedicalBoardofExperts.”
I �ind that learned Member Dr. S.M. Kantikar has dealt with each of the
aforementionedevidence/documents/materialwhichwasbroughtonrecord
asfollows:-
Allegations: ER Medical of�icer on 10.07.14 failed to identify the life-
threateningemergencyofabdominal tenderness.X–Raychesthadelevated
domeofdiaphragm–suggestiveofintra-abdominalinjuryandhaemorrhage.
WenotethattheComplainant intelligentlybroughtoutcertainfactsofthis
caseforhisownconvenience,thoughitwasnotacaseofBluntAbdominal
Trauma(BAT).TheComplainantcategoricallystatedthathissonhadactually
walkeddowntotheEmergencydepartmentwithoutuseofawheelchairor
stretcherwhichprovesthepatienthadnosevereabdominalandbackpain.
However,thex-raysrevealedmildanteriorwedgingofD11-D12vertebraeand
thereforetheEMOpromptlyreferredthepatienttotheOrthopaedicSurgeon
…Therefore,theallegationofde�iciencyinrenderingmedicalservicetothe
patient in the emergency is not sustainable, as made on surmise and
conjuncture.Inourview,thedoctorshavedone,whichtheywereexpectedto
doatthegivensituation.
Allegation:Haematocritvaluewasnotevaluatedtoevaluatethebloodloss.
ThefallinHaematocrit(Hct)andHaemoglobinfrom15.2g%to13.8g%and
12.6g% within 36 hours after admission was expected because of hemo-
dilutionoccursafteradministrationoftwolitersofIV�luidtotreatthesudden
hypotension. In the instant case the CT scan �indings suggested Adrenal
haemorrhagewhichwasjustlimitedtoAdrenalparenchymaanditwasnot
massive.Therefore,fallinHb%inanymannerdoesn’trelatetoscantyAdrenal
haemorrhage. However, subsequent haemoglobin levels were stable on
12.07.2014, despite the patient receiving large quantities of Intravenous
�luids.
Allegation:Orthopaedicsurgeonsawthepatientafter12hourson11.07.14.

like to quote a reference from the standard medical books ‘Harrison's
PrinciplesofInternalMedicine,19thEd.,Vol.2’aswellas‘Oh'sIntensive
CareManual,7thEd.’whereinstatesthat:
‘'Echocardiography has its best application in haemodynamicaliy unstable
patients,whereitcanberapidlybroughttothepatient.IfthepatienthasRV
dilationandhypokinesisintherightclinicalsetting,PEisextremelylikely...if
there is RV dilation but no visible embolus, then a CTPA scan is required
dependingonhowunstablethepatientis...''
Allegation : Bleeding Adrenal glands, but double anti coagulation was
administered.
TheComplainantallegedthatthedoctorswereinlackofmedicalknowledge
andexpertisewhileadvisinginjectionClexanetothepatientwhentherewas
intra-abdominalcontinuouslyactivebleedingfromtherupturedleftAdrenal
gland. It is apparent from themedical record that that on 11.07.2014 Dr.
PrasenjitSarkaradvisedInjectionClexaneandthepatientreceivedonlyone
doseof Inj.Clexaneat10:00p.m.on11/07/2014.Though Inj.Arixtrawas
prescribedbyDr.PrasunHalderbutwasneveradministeredtothepatient.The
further injection Clexane (LMWH-Enoxaprin) was to be given only after
con�irmationofnoabdominalcollectionbytheOppositePartyNo.2and4.As
the treating doctors had strong suspicion with provisional diagnosis of
Pulmonary Embolism needs anticoagulant therapy. Therefore, the use of
LMWHisastandardmedicalprotocol.
ObesityisanimportantindependentriskfactorforthrombosisandVTE
iscommoninobesepatients.Obesityisregardedasprothromboticstate.
LMWHhastheoreticadvantagesinobesepatientsasaresultofsuperior
subcutaneousbioavailability...However evenLMWHat standard �ixed
dosesmaynotbesuf�icienttopreviewVTEinmorbidlyobesepatient.
Thus,thedecisiontoadministerClexaneintheinstantcasewasjusti�ied
anditwasnotwrongdecisionornegligence.
ALLEGATION:7.Goldenhourwaslostandnoproperinformationwasgivento
attendees,hencecouldnotshifttohighercenters.
8. USGAbdomenwasdone3hour later after being advisedby9 amon
11.07.14.
9. CTPulmonaryAngiogramwasdone12hourslaterafterbeingadvised
Wehaveperusedallthe�ilmsandreports.Itispertinenttonotethatthepatient
was admitted in the evening on 10.07.2014, the USG, CT, MRI done on
11.07.2014,noneofthe�ilmsshowsanysignsofhaemorrhageorabdominal
�luidcollection.However,subsequentlytheCTabdomenandCTPAdoneon
12.07.2004revealedmoderateascites(around500ml),withlowHUvalues,it
was conclusively not blood. In our view it was not a Haemorrhagic /
Hypovolemicshockintheinstantcase.
AspertheComplainant’ssubmission,theCTandMRIofDorsalLumbarspine
coversonlylowerback.However,theRadiologistwhoconductedCTandMRI
scansofthedorsolumbarspinestatedinherreportandaf�idavit,thatshe
viewed the extra spinal structures around the Lumbar Spine like Intra-
AbdominalandRetroperitonealstructures.TheRadiologistasausualpractice
across the globe examine and note the incidence of extra spinal �indings.
Radiologist�iledareferencearticle‘IncidentalExtraSpinalFindingsatCT
LumbarSpineonWideFieldofViewReconstruction’byTomSutherlandet
al J.Spine,Neurosurgeon20132:4,whichcategoricallyobservedthat ''The
detectionofincidental�indingsbeyondtheregionofinterestiswellknownand
hasbeenexploredforanumberofimagingexaminations.”
Thus,inourconsideredview,iftherehadbeenanyintra-abdominalsofttissue
injury leading to collection; it would have been easily detected by the
Radiologist. We also note that it was con�irmed after discussion between
OppositePartyNo.4andtheRadiologistthattherewasnoorganinjuryor
abdominalcollection.
74.ItispertinenttonotethattheCardiologistperformedbedsideECHOinthe
night on11.07.2014showed“rightventricularfreewallhypokinesia,right
ventricularsystolicdysfunctionanddilatedpulmonaryarteryalongwithIVC
(InferiorVenaCava)of16mmwithsluggishrespiratoryvariationcombined
with hemodynamic instability, the �indings raised a very high degree of
suspicion of PE and thus patient was treated accordingly and CTPA was
plannedafterstabilization.Thus,inourview,atthatstageadviceforECHO
wasessentialnottoruleoutPEalonebutalsotoknowaboutLeftVentricle
function, to rule out Acute Myocardial Infarction, IVC measurement for
guidance of �luid therapy which is the gold standard. In our view the
Cardiologiston considering the patient’s clinical signs such as obesity, on-
goingimmobilisationandhypoxiahadcorrectlyadvisedintensivespirometry
posthaemodynamicstabilisationandruledoutpneumothoraxbyChestX-Ray.
Thus,thepatientwastreatedwiththeacceptedmedicalprotocol.Wewould

• Fromthemedicalrecordandtheaf�idavitof,Dr……itisevidentthathe
had discussion with patient's relatives in detail regarding the risk
involved in conducting CTPAand he even spoke to two independent
doctors of the complainant’s choice (Dr. ParthaSen and Dr.Paromita
Trivedi)afterwhichonlytheconsensuswastogoaheadwithCTPA.He
further spoke personally to the Radiologist and hospital authority to
conductCTPAandCTabdomen.DuringCTPA,Dr…….andDr……..were
presentinsidetheCTroomwearingleadapronsandcontinuedpatient
ventilationwithBain’scircuit.
• WefurthernotethattheCTPAwasadvisedinthenighton11.07.2014and
the series of blood and radiological investigations were done. The
patient’s family members expressed their intent to get the patient
discharged againstmedical advice (DAMA) and to shift thepatient to
Fortis Hospital in the early hours on 12.07.2014. Therefore, the ILS
Hospitalinitiatedprocessofdischargeinthenightbutrepresentativeof
FortisHospitaldidnotacceptforshiftingsuchcriticalpatient.Therefore
thepatientwasre-admittedinILSHospital,duringtheprocess,valuable
timewaswasted.Thus,duetoinitialreluctanceofpatientsideandafter
muchpersuasionthependingCTPAwasperformedintheafternoonon
12.07.2014.Thecomplainantconcealedthesefactsinhispleading.
• Allegations:.EvenafterdropinBPpropermonitoringwasnotdoneand
didnotevaluateddoingCTAbdomentoruleoutabdominalbleeding.
• 6.AllsignsofinternalhaemorrhagesuchasfallinBPraisedpulseand
abdominaltendernesswasnotconsideredduetocallousattitude.
• On11.07.2014ataround2:00p.m.thepatient’sMRIoftheDorsoLumbar
Spine was done that revealed "Acute compression collapse of D12
vertebrawithoutsigni�icantencroachmentintospinalcanal;Milddisc
degenerativediseaseatL5-S1level,mildlycompromisingbothneural
foramina,withoutsigni�icantcompressionoverexitingnerveroots.”In
addition, Dr. SarmisthaGuha noted that ''No abnormal pre or
paravertebral soft tissue seen. Minimal peri-hepatic and peri-splenic
�luidsignalseen.”
• Thereafterat3.00p.m.CTscanoftheDorsoLumberSpinewasdonebyDr.
SarmisthaGuha,whereinitrevealed“Compressioncollapseofupperend
plate of D12 vertebra without encroachment into spinal canal.'' The
presence of minimal dependent pleural effusion was also noted and
minimalfree�luidwasseenintheinfrahepaticspace.TheRadiologist,Dr.
SarmisthaGuhaalsoreportedfocaltinycalci�icationinsegmentVIofliver.
Had there been any abdominal or retroperitoneal injuries or
haemorrhage, itwould have been noted by theRadiologist especially
whenshemadetheefforttonoteevenatinycalci�icationintheliver.
Themoderateintra-abdominal�luidnotedon12.07.2014,whetheritwas
haemorrhageorascites?
• Wehaveperusedthe�ilmsofCTabdomendoneon12.07.2014showed
moderate ascites and not blood. There was only isolated localized
haemorrhageintheleftadrenalgland,whichisconsideredtobeoflittle
signi�icance by medical literature. Even this minimal left adrenal
haemorrhage,whichwasabsentonthe11.07.2014butisseenontheCT
abdomen�ilmsdoneon12.07.2014,canberationallyexplainedinthe
contextofthevascularanatomyoftheleftadrenal,shockstatefollowing
pulmonaryembolism,treatmentwithdrugslikeadrenalinetosupport
the patient's falling blood pressure and presence of renal vein
thrombosis.
Althoughtheprecisemechanismleadingtoadrenalhaemorrhageareunclear
innontraumaticcases,availableevidencehasimplicatedadrenocorticotropic
hormone (ACTH), adrenal vein spasm and thrombosis, and the normally
limitedvenousdrainageoftheadrenalinthepathogenesisofthiscondition.
Theadrenalglandhasaricharterialsupply,incontrasttoitslimitedvenous
drainage, which is critically dependent on a single vein. Furthermore, in
stressful situations, ACTH secretion increased, which stimulates adrenal
arterialblood�lowthatmayexceedthelimitedvenousdrainagecapacityofthe
organandleadtohaemorrhage.Inaddition,adrenalveinspasminducedby
highcatecholaminelevelssecretedinstressfulsituationsandbyadrenalvein
thrombosis induced by coagulopathies may lead to venous stasis and
haemorrhage.
In the instantcaseon11.07.2014patient’sCTScanofDorso lumbarSpine
revealedjustminimalfree�luidcollectionininfra-hepaticspace.The�inding
was not con�irmatory of any solid organ injury or haemorrhage in the
peritonealcavityorretroperitonealspace.Itwaslowattenuationofthefree
�luid<15 HU. The next CT Abdomen done on 12/07/2014 revealed just
localisedcollectionwith layeringofdensities (HU -63) in the leftAdrenal
gland.Itwasspeci�icallysuggestedashaemorrhage,whereasfree�luidinrest

oftheabdomenhasbeenreportedasmoderateascitesasitsattenuationwas
low(<15HU),nowhereitwasmatchingwiththehighattenuationofbloodor
ofextravasatedcontrast.Thusitwasnotactivebleeding.Thuson11.07.2014,
theintra-abdominalorretro-peritonealorleftadrenalglandhaemorrhage
wasruledout.
Thecontentionofthecomplainantthathisson'slifecouldhavebeensavedhad
hebeenreceivingblood transfusionowing to theexcessiveblood lossasa
result of alleged intra-abdominal haemorrhage is a clear indication of the
complainant's lack of knowledge in the �ield ofmedicine. The patientwas
admittedwithaHaemoglobinlevelof15.2gm%andhisHaemoglobinlevelwas
12.6gm%inthemorningof12.07.2014.Haematocritlevelwas40at1:30a.m.
on12.07.2014whichdroppedto37at5.30a.m.on12/07/2014.Itispertinent
tonotethatthepatienthadadropinHaemoglobinof17%orHaematocritof
only3(7.5%)whichinmedicalparlance,isnotsigni�icantenoughtocause
suddendeathofapatient.Asper‘TheWashingtonManualofSurgery’,6th
Ed., if it was haemorrhage, it correlates with Class II haemorrhage. The
massive�luidresuscitationisalsooneofthecausesforfallinHb%.Further,in
classIIhaemorrhagebloodtransfusionalsonotadvised.
..trauma is another potential cause of renal vein thrombosis. Complications
include pulmonary embolism, renal atrophy, and papillary necrosis. Bland
thrombus can coexist with tumour thrombus... As with venous thrombosis
elsewhere, the thrombosis is observedasa �ilingdefectduring venousphase
imaging following intravenous contrast... Recognized complications of RVT
includepulmonaryembolism...''
Allegation : Post mortem examination was not done which could have
accented thecauseofThrombus.TheComplainant furtheralleged thathis
youngsonof36yearsolddiedduetogrossmedicalnegligence
ItissurprisingtonotetheobservationmadebyDirectorateofHealthServices,
GovernmentofWestBengal,CalcuttaandthePE-8CommitteeofWBMCIon
thehospitalfornotinformingthePoliceinitiallyforanaccidentalcaseandnot
sendingthebodyforanautopsylaterandhelditas“medico-legallyanactof
negligence”.
Medico-legalAutopsy:
• Themedico-legalautopsy,whichisperformedontheinstructionsofthe
legalauthorityresponsible forthe investigationofsudden,suspicious,
homicide,suicide,obscure,unnatural,litigiousorcriminaldeaths.This
legalauthoritymaybeacoroner,amedicalexaminer,aprocurator�iscal,a
magistrate,ajudge,orthepolice,thesystemsvaryingconsiderablyfrom
countrytocountry.
Thepermissionofrelativesisnotrequired.
ClinicalAutopsy:
• Doneforacademicpurposes,researchetc.Nolegalissueinvolved(also
called hospital autopsy or pathological autopsy or consent autopsy).
Permissionofrelativesisnecessary.
Intheinstantcase,atthetimeofadmissiontoILSHospitalon10.07.2014,
the patient himself alongwith his father i.e. the Complainant gave a
historyoffallinhishouse.Theydidnotexpressanysuspiciousorany
criminalevents.Therefore,theHospitaldidnotregisterthecaseunder
MLCcategory.Asdiscussedabove,duringthecourseoftreatment,the
teamoftreatingdoctorsmadealltheirefforts,butthepatientcouldnot
survive. As itwas notMLC case, the PostMortemwas not done. The
Complainant could have lodged a police complaint to conduct Post
Mortem,ifhewouldhavesuspectedanyfoulplayornegligenceduring
treatment.Healsohadachoice forclinicalautopsywhichhe failedto
exerciseatthattime.

2. Sofarasthemeritsofthematterisconcerned,I�indthatlearnedMember,
Dr. S.M. Kantikar, who is from the Medical Profession, having vast
knowledgeandexperienceinthatarena,hadconsideredthearguments
advancedonbehalfoftheParties,variousdocuments/material,evidence
availableonrecordandhaveelaboratelydealtwiththesameinPara69to
104ofhisOrder.Iamnotrepeatingthevariousmaterialandevidence
�iledbythePartiesastheyhavebeenadequatelydealtindetailbyDr.S.M.
KantikarinhisOrder,whichhasbeenreproducedhereinabove.Iaminfull
agreementwiththe�indingsandreasonsrecordedbyDr.S.M.Kantikarin
hisOrderastowhytherewasnomedicalnegligenceinthepresentcase
andtheComplaintisliabletobedismissed.

103. The Complainant appears to be prudent; he himself could have
approached the authority or police and demanded for PM. The MCI
order/report dated 26.05.2017 was stayed by Hon’ble High Court of
CalcuttaOrderdated19.12.2017.Weareoftheconsideredviewthatthe
reportsofWBMC,MCIandWestBengalHealthDepartmentdiddiscuss
theessentialingredients/PrinciplesofMedicalNegligenceaslaiddown
bytheHon’bleSupremeCourtandotherCourts.Wearenotaccepting
suchreportswhicharedevoidofany�indingsonnegligence.Theseare
not convincing and did not conclusively attributemedical negligence
againstthetreatingdoctors.
1. TheConsumerComplaintwasheardbyDivisionBenchcomprising
of Dr. S.M. Kantikar, Presiding Member and Mr. Dinesh Singh,
Member.Dr. S.M. Kantikar, Presiding Member dismissed the
Complaintbyobservingasunder:
“The treating doctors had treated the patient as per accepted standards of
medicalpractice.Therewasnode�iciencyinservice;thehospitalprovidedallthe
necessaryinfrastructuralfacilitiesaswellasthesupportofwell-trainedmedical
staff.ThatdespiteeverysincereeffortbytheentiremedicalteamatILSHospital
treatingthepatient(deceasedIndrajitSarkar)didnotsucceedinsavinghislife.
Itwastherareanduncommonoutcomesuchasleftadrenalhaemorrhagesa
resultoftraumaticinjuryofthespine.Intheinstantcasethemedicallimitations
whicharebeyondhumancontrol.”
