KATA PENGANTAR
Hasil penelitian dan pengembangan yang merupakan produk dari suatu
institusi riset merupakan Kekayaan Intelektual (KI), harus dikelola sesuai
dengan peraturan yang berlaku sehingga dapat melindungi hak-hak yang
melekat. Dalam proses menghasilkan Kekayaan Intelektual tersebut, institusi
riset akan berinteraksi dengan berbagai pihak, baik lembaga pemerintah
lainnya,industri maupun institusi non pemerintah.
Kebijakan pengelolaan kekayaan intelektual diperlukan agar para
pelaksana terkait dengan KI sadar dan mengetahui hak dan kewajibannya.
Disamping itu pengelolaan KI juga memungkinkan komersialisasi hasil
litbang dan hasil inovasi sehingga para peneliti dan pelaksana penelitian
lainnya dapat memperoleh insentif sesuai dengan kebijakan dan peraturan
yang berlaku. Berdasarkan pertimbangan tersebut, Puslitbang Hutan
Tanaman sebagai suatu institusi riset menyusun Pedoman Pengelolaan
Kekayaan Intelektual (PPKI) lingkup Puslitbang Hutan Tanaman agar dapat
menjadi acuan baik bagi semua komponen yang akan menghasilkan inovasi,
teknologi dan penyedia jasa konsultasi, maupun para pengguna hasil
penelitian dan para mitra kerja.
Pedoman Pengelolaan Kekayaan Intelektual lingkup Puslitbang Hutan
Tanaman dimaksudkan untuk memberikan acuan yang jelas tentang hak dan
kewajiban bagi seluruh komponen pelaksana kegiatan penelitian; sehingga
hasil penelitian yang merupakan KI dapat dikelola dengan baik dan sesuai
peraturan perundang-undangan yang berlaku. Tujuan pengelolaan kekayaan
intelektual adalah untuk menjamin pengurusan kekayaan intelektual dapat
terkoordinir sesuai kebijakan pemerintah dan komersialisasi hasil IPTEK,
untuk optimalisasi kepentingan Puslitbang HutanTanaman dan para peneliti.
Pada akhirnya,diharapkan Pedoman Pengelolaan Kekayaan Intelektual ini
juga dapat memacu kreativitas dan inovasi dari para peneliti. Semoga
booklet ini dapat bermanfaat.

Menimbang : a. Bahwa Pusat Penelitian dan Pengembangan (Puslitbang)
Hutan Tanaman sebagai institusi riset akan menghasilkan
hasil penelitian dan pengembangan yang merupakan
Kekayaan Intelektual (KI) dan harus dikelola sesuai dengan
peraturan perundangan yang berlaku sehingga dapat
melindungi hak-hak yang melekat di dalamnya;
b. bahwa pengelolaan kekayaan intelektual diperlukan agar
para pelaksana terkait dengan KI sadar dan mengetahui hak
dan kewajibannya;
c. Berdasarkan pertimbangan tersebut, maka perlu disusun
Pedoman Pengelolaan Kekayaan Intelektual (PPKI) lingkup
Puslitbang Hutan Tanaman agar dapat menjadi acuan baik
bagi semua komponen yang akan menghasilkan inovasi,
teknologi dan penyedia jasa konsultasi, maupun para
pengguna hasil penelitian dan para mitra kerja;

d. Bahwa sehubungan dengan butir a, b dan c tersebut diatas,
dipandang perlu menetapkan Pedoman Pengelolaan
Kekayaan Intelektual lingkup Pusat Penelitian dan
Pengembangan Hutan Tanaman dengan Surat Keputusan

PERTAMA : Pedoman Pengelolaan Kekayaan Intelektual lingkup
Pusat Penelitian dan Pengembangan HutanTanaman
KEDUA : Pedoman Pengelolaan Kekayaan Intelektual lingkup
Pusat Penelitian dan Pengembangan HutanTanaman merupakan
acuan bagi Pusat Penelitian dan Pengembangan Hutan Tanaman
dalam menyelenggarakan kegiatan pengelolaan hak kekayaan
intelektual
KETIGA : Keputusan ini berlaku sejak tanggal ditetapkan dengan ketentuan
akan ditinjau dan diatur kembali sebagaimana mestinya apabila
dikemudian hari terdapat kekeliruan dalam penetapannya

II. MAKSUD DAN TUJUAN
Pusat Penelitian dan Pengembangan (Puslitbang) Hutan Tanaman
sebagai institusi riset akan menghasilkan hasil penelitian dan pengembangan
yang merupakan Kekayaan Intelektual (KI). Sebagai institusi riset, Puslitbang
Hutan Tanaman dalam proses kerjanya juga akan berinteraksi dengan
lembaga pemerintah lainnya, industri serta institusi non pemerintah.Bentuk
interaksi yang dilakukan dapat berupa konsultansi, penyusunan kontrak
penelitian, komersialisasi lisensi, inovasi dan hasil-hasil penelitian. Kekayaan
Intelektual hasil penelitian tersebut harus dikelola sesuai dengan peraturan
yang berlaku sehingga dapat melindungi hak-hak yang melekat.
Kebijakan pengelolaan kekayaan intelektual diperlukan agar para
pelaksana terkait dengan KI sadar dan mengetahui hak dan kewajibannya.
Disamping itu pengelolaan KI juga memungkinkan komersialisasi hasil
litbang dan hasil inovasi sehingga para peneliti dan pelaksana penelitian
lainnya dapat memperoleh insentif sesuai dengan kebijakan dan peraturan
yang berlaku. Berdasarkan pertimbangan tersebut, maka perlu disusun

Pedoman Pengelolaan kekayaan intelektual (PPKI) lingkup Puslitbang
Hutan Tanaman dimaksudkan untuk memberikan acuan yang jelas tentang
hak dan kewajiban bagi seluruh komponen pelaksana kegiatan penelitian,
sehingga hasil penelitian yang merupakan KI dapat dikelola dengan baik dan
sesuai peraturan perundang-undangan yang berlaku.
Tujuan pengelolaan kekayaan intelektual adalah untuk menjamin
pengurusan kekayaan intelektual dapat terkoordinir sesuai kebijakan
pemerintah dan komersialisasi hasil IPTEK, untuk optimalisasi kepentingan
Puslitbang HutanTanaman dan para peneliti.

Beberapa pengertian yang mendasari uraian tentang pengelolaan
kekayaan intelektual dapat disebutkan sebagai berikut:
I. Kekayaan intelektual adalah kekayaan yang timbul atau lahir karena
kemampuan intelektual manusia melalui daya cipta, rasa dan karsanya
yang dapat berupa karya di bidang teknologi,ilmu pengetahuan,seni dan
sastra.

2. Alih teknologi adalah pengalihan kemampuan memanfaatkan dan
menguasai ilmu pengetahuan dan teknologi antar lembaga, badan atau
orang, baik yang berada dalam lingkungan dalam negeri maupun yang
berasal dari luar negeri ke dalam negeri atau sebaliknya.
3. Penelitian adalah kegiatan yang dilakukan menurut kaidah dan metode
ilmiah secara sistematis untuk memperoleh informasi, data, dan
keterangan yang berkaitan dengan pemahaman dan pembuktian
kebenaran atau ketidakbenaran suatu asumsi dan/atau hipotesis di
bidang ilmu pengetahuan dan teknologi serta menarik kesimpulan
ilmiah bagi keperluan kemajuan ilmu pengetahuan dan teknologi.
4. Pengembangan adalah kegiatan ilmu pengetahuan dan teknologi yang
bertujuan memanfaatkan kaidah dan teori ilmu pengetahuan yang
telah terbukti kebenarannya untuk meningkatkan fungsi, manfaat, dan
aplikasi ilmu pengetahuan dan teknologi yang telah ada, atau
menghasilkan teknologi baru.
Lingkup pengelolaan kekayanan intelektual yang ada di Puslitbang
Hutan Tanaman mencakup hak yang melekat pada beberapa bentuk
kekayaan intelektual:
I. HakCipta
2. Hak Paten
3. Indikator Geografi
4. PerlindunganVarietas dan/atau JenisTanaman
a. Hak Cipta adalah hak eksklusif bagi pencipta atau penerima hak
untuk mengumumkan atau memperbanyak ciptaannya atau
memberikan izin untuk itu dengan tidak mengurangi
pembatasan-pembatasan menurut peraturan perundang-
undangan yang berlaku.
b. Pencipta adalah seorang atau beberapa orang secara bersama-
sama yang atas inspirasinya melahirkan suatu ciptaan
berdasarkan kemampuan pikiran, imajinasi, kecekatan,
keterampilan, atau keahlian yang dituangkan ke dalam bentuk
yang khas dan bersifat pribadi.
V. LINGKUP PENGELOLAAN KEKAYAAN INTELEKTUAL
5.1. Hak Cipta

c. Ciptaan adalah hasil setiap karya pencipta yang menunjukkan
keasliannya dalam lapangan ilmu pengetahuan,seni,atau sastra.
d. Pemegang Hak Cipta adalah pencipta sebagai pemilik Hak
Cipta, atau pihak yang menerima hak tersebut dari pencipta,
atau pihak lain yang menerima lebih lanjut hak dari pihak yang
menerima hak tersebut.
e. Pemegang Hak Cipta dapat melarang atau memberi kuasa
untuk:
mereproduksi karyanya ke dalam berbagai bentuk,
termasuk publikasi dalam bentuk pencetakan
melakukan perekaman atas karyanya, misal dalam bentuk
,kaset,atau
menyebarluaskan karyanya
menterjemahkan karyanya ke dalam bahasa lain atau
mengalihwujudkan, misalnya dalam bentuk buku menjadi
bentuk film
a. Paten adalah hak eksklusif yang diberikan oleh Negara kepada
Inventor atas hasil Invensinya di bidang teknologi, yang untuk
selama waktu tertentu melaksanakan sendiri Invensinya
tersebut atau memberikan persetujuannya kepada pihak lain
untuk melaksanakannya.
b. Invensi adalah ide Inventor yang dituangkan ke dalam suatu
kegiatan pemecahan masalah yang spesifik di bidang teknologi
dapat berupa produk atau proses, atau penyempurnaan dan
pengembangan produk atau proses.
c. Inventor adalah seorang yang secara sendiri atau beberapa
orang yang secara bersama-sama melaksanakan ide yang
dituangkan ke dalam kegiatan yang menghasilkan Invensi.
d. Dengan adanya perlindungan paten, suatu invensi tidak akan
dapat dibuat, digunakan, didistribusikan atau dijual secara
komersial tanpa izin pemilik paten.
e. Paten tidak sekedar merupakan hak bagi pemiliknya untuk
menggunakan invensi terkait, tetapi juga untuk menetapkan
siapa yang diperkenankan atau tidak diperkenankan

menggunakan invensi tersebut selama invensi tersebut
dilindungi.
f. Apabila paten sudah berakhir masa berlakunya, maka berakhir
pula perlindungannya dan invensi yang bersangkutan langsung
menjadi milik masyarakat (publik domain). Pemilik Paten yang
bersangkutan tidak lagi memegang hak eksklusif dan pihak lain
dapat mengeksploitasi secara komersial tanpa dikenai biaya.
Di Indonesia perlindungan terhadap Indikasi Geografi tidak diberikan
dalam bentuk Undang-undang yang khusus, tetapi tercakup dalam
UU No I5 tahun 2001 tentang Merek dalam BabVll tentang Indikasi
Geografi dan IndikasiAsal.
a. Indikasi-geografis dilindungi sebagai suatu tanda yang
menunjukkan daerah asal suatu barang, yang karena faktor
lingkungan geografis termasuk faktor alam, faktor manusia, atau
kombinasi dari kedua faktor tersebut, memberikan ciri dan
kualitas tertentu pada barang yang dihasilkan.
b. Indikasi-geografis mendapat perlindungan setelah terdaftar atas
dasar permohonan yang diajukan oleh:
I. lembaga yang mewakili masyarakat di daerah yang mem-
produksi barang yang bersangkutan,yang terdiri atas:
- pihak yang mengusahakan barang yang merupakan hasil
alam atau kekayaan alam
- produsen barang hasil pertanian;
- pembuat barang-barang kerajinan tangan atau hasil
industri;atau
- pedagang yang menjual barang tersebut;
2. lembaga yang diberi kewenangan untuk itu; atau
3. kelompok konsumen barang tersebut
c. Indikasi-geografis terdaftar mendapat perlindungan hukum yang
berlangsung selama ciri dan/atau kualitas yang menjadi dasar
bagi diberikannya perlindungan atas indikasi-geografis tersebut
masih ada.
d. Apabila sebelum atau pada saat dimohonkan pendaftaran
sebagai indikasi-geografis, suatu tanda telah dipakai dengan

itikad baik oleh pihak lain yang tidak berhak mendaftar menurut
ketentuan sebagaimana dimaksud pada butir b, pihak yang
beritikad baik tersebut tetap dapat menggunakan tanda
tersebut untuk jangka waktu 2 (dua) tahun terhitung sejak
tanda tersebut terdaftar sebagai indikasi-geografis.
a. Perlindungan varietas dan/atau jenis tanaman adalah hak yang
diberikan kepada pemulia tanaman jika varietas dan/atau jenis
tanaman yang dihasilkan merupakan suatu hal yang baru,
berbeda,seragam,stabil.
b. Dengan diberikannya hak pemulia tanaman berarti bahwa
sebelum melakukan berbagai kegiatan yang berkaitan dengan
pemuliaan varietas dan/atau jenis tanaman yang dilindungi,
diperlukan adanya ijin dari pemulia yang berkompeten atas
varietas dan/atau jenis tersebut.
c. Pengecualian diberikan bila penggunaan varietas dan/atau jenis
tanaman yang dilindungi dimaksudkan untuk memenuhi
kebutuhan sehari-hari. Varietas dan/atau jenis yang dilindungi
juga dapat diperoleh tanpa ijin pemulia yang berkompeten
untuk keperluan penelitian dan pemuliaan tanaman.
a. Penjajagan kerjasama dapat dilaksanakan oleh para pejabat
fungsional dan/atau struktural dengan mengacu peraturan.
b. Negosiasi kerjasama dilakukan oleh pejabat struktural bersama
pejabat fungsional Puslitbang HutanTanaman.
c. Kontrak atau perjanjian kerjasama difasilitasi oleh Bidang
Perencanaan Program Penelitian, dengan mengikuti peraturan
Kepala Badan Litbang Kehutanan tentang Kerjasama Badan
Penelitian dan Pengembangan Badan Kehutanan nomor
P.01/VIII/Set/2009 tanggal 21April 2009.
d. Hal-hal yang perlu diatur dalam kontrak atau perjanjian
kerjasama mencakup:

pengelolaan kekayaan intelektual yang dihasilkan, termasuk
proporsi masing-masing pihak dalam kepemilikan HKI
kejelasan status penggunaan materi tanaman yang dipunyai
pihak ketiga
materi tanaman yang diperoleh dari perjanjian transfer
a. Seluruh Hak Kekayaan Intelektual (HKI) yang diperoleh dari
kegiatan penelitian yang dilaksanakan oleh peneliti Puslitbang
HutanTanaman akan menjadi milik Puslitbang HutanTanaman.
b. HKI yang dihasilkan oleh peneliti Puslitbang Hutan Tanaman
pada waktu menjalankan tugas belajar dengan beasiswa dari
Departemen Kehutanan, kepemilikannya didasarkan pada
Perjanjian Kerjasama (MoU) antara Badan Litbang Kehutanan
dengan Perguruan Tinggi tempat peneliti yang bersangkutan
menjalankan tugas belajar.
c. HKI yang dihasilkan oleh peneliti Puslitbang Hutan Tanaman
pada waktu menjalankan tugas belajar dengan beasiswa dari
Pihak Ketiga, kepemilikannya didasarkan pada Perjanjian
Kerjasama (MoU) antara Badan Litbang Kehutanan dengan
Perguruan Tinggi tempat peneliti yang bersangkutan menjalan-
kan tugas belajar serta Pihak Ketiga yang memberi beasiswa.
d. HKI hasil penelitian bersama antara Puslitbang HutanTanaman
dengan Pihak Ketiga, kepemilikannya berdasarkan pada MoU
antara Puslitbang Hutan Tanaman dengan Pihak Ketiga yang
bersangkutan.
e. Khusus untuk butir b, c dan d, apabila pengaturan kepemilikan
kekayaan intelektual yang timbul belum diatur dalam MoU
maka diperlukan MoU baru yang mangatur hak dan kewajiban
sesuai kontribusinya.
a. Pengungkapan adalah langkah formal awal yang perlu ditempuh

proses pelayanan ke Ditjen HKI atau ke Pusat Perlindungan
VarietasTanaman (PPVT) tidak dilakukan.
Pembagian atas imbalan yang timbul dari Pengelolaan Kekayaan

FOREWORD
Intellectual Property is an important issue in the research area around
the world. Many concerns emerging from the implementation of such
research output have been addressed to this issue. As research activity
mostly could not be conducted merely by a single party /person without any
interaction, ownership of the arising intellectual property, as well as the
sharing of the rights,data,and information resulted from activity conducted
under such arrangement appear to be an essential matter. Another
problem/issue is the lack of comprehension of the people who work in
the relevant area (researchers, research managers) on the Intellectual
Property.Therefore, in regard to these reasons,management of Intellectual
Property is important.
This booklet of Guideline for Intellectual Property Management in the
Centre for Plantation Forest Research and Development is a form of our
awareness and attention on the importance of the management of
Intellectual Property in the Centre. It is proposed to give clear guidance
over the rights and obligations of all research operative components, so
that the research outputs which are Intellectual Properties can be well
managed in line with the laws and regulations.
It is hoped that this Guideline will give guidance for either all
components conducting innovations, technology and consultancy
providers, or the users of the research outputs and working partners. It is
also hoped that this Guideline will assist us to ensure the coordination of
the intellectual property affairs according to the government's policy and
the commercialization of science properties, towards the benefit of the
Centre for Plantation Forest Research and Development and also the
researchers.
At the end and in the long-term, it is hoped that this Guideline will
indirectly encourage innovations by researchers.

1. INTRODUCTION
11. GOALS AND OBJECTIVES
The Centre for Plantation Forest Research and Development as a researchinstitution will produce research outputs and development which is consideredbeing an Intellectual Property.As a research institution, the Centre will also interactwith other government institutions, industries, and also Non-GovernmentOrganizations (NGOs).The interactions can take form of consultancy, researchcontract establishment, license commercialization, innovations and other researchoutputs. Those intellectual properties must be managed according to theregulations and laws in order to protect the rights attached.
Policy on Intellectual Property is a requisite for the stakeholder to be awareof their rights and obligations. The intellectual property management will alsoallows the commercialization o f the research and development outputs as well asthe innovations so that research operatives will be able to gain incentives accordingto the rules and policies. Based on that particular consideration, therefore it isnecessary to compose an Intellectual Property Management Guideline in theCentre for Plantation Forest Research and Development in order to be guidancefor either all components conducting innovations, technology and consultancyproviders,or the users o f the research outputs and working partners.
The Guidelines for Intellectual Property Management in the Centre forPlantation Forest Research and Management were composed to provide clearguidance on the rights and obligations of all research operative components, sothat the research outputs which are Intellectual Properties can be well managed inline with the laws and regulations.
The purpose of the Intellectual Property Management is to ensure thecoordination of the intellectual property administration according to thegovernment's policy and the commercialization of science properties, for thebenefit of the Centre for Plantation Forest Research and Development as well asthe researchers.

(either in the domestic scope or as well as in the international scope) who canthen further develop and utilize the technology into new products,processes,applications,materials or services.
3. Research is an activity which is conducted systematically according toscientific principals and methods to obtain information, data, and otherfindings related to the understanding and the proving of facts on certainassumptions and hypothesis in science and technology and also to draw ascientific conclusion for the benefit of the development of science andtechnology.
4. Development is a scientific and technological activity which aims to benefitthe principals and theories of science which has been proven valid to improvethe functions, benefits, and the implementations of available science andtechnology,or to produce new technologies.
The scope of intellectual property management in the Centre forPlantation Forest Research and Development covers the rights attached to severalforms of intellectual properties:I. Copyrights2. Patent Rights3. Geographical Indications4. The Protection of Varieties/Species of Plants
a. Copyrights is a legal term describing rights given to creators for theirliterary and artistic works (including computer software).
b. Inventors are individuals or groups who together by their owninspirations created an invention based on their ability of mind,imagination, effectiveness, skill, and specialty which put together in aspecific and personal form.
c. Inventions are every outcome of creation processes which expresstheir originality in the field of science,arts,or literature.
d. The respective rights holders are the inventors as the copyrightowners, or those who receive the rights from the inventors, or others

e. The copyright holders are able to prohibit or to present the power to:Reproduce the inventions in various forms,including publicationsin the form of printingRecordings over the inventions, i.e. in the form of compact discs,cassettes,and video tapesSpreading the inventionsTranslating the inventions in other languages or to transform theinventions,i.e.in the forms o f books into films.
a. Patent is an exclusive right granted for an invention, which is aproduct or a process that provides a new way of doing something, oroffers a new technical solution to a problem. A patent providesprotection for the invention to the owner of the patent for a limitedperiod,generally 20 years.
b. Inventions are ideas of the inventors which produced in an activity ofproblem solving specifically in the field of technology which can be inthe form of products or process, or a revision and development of aproduct or process.
c. Inventors are individuals or groups that together transform theirideas into an activity which created the invention.
d. With the presence of patent protection, an invention can not bemade, used, distributed or sold commercially without the permissionfrom the respective patent owners.
e. Patent is not only rights for their owners to use the inventions related,but also to determine those who are allowed to use the inventions aslong as the inventions are still protected.
f If the patent expires, and so is the protection, and the particularinvention will soon be a public domain. The owner of thepatent will no longer hold exclusive rights and other parties canexploit the invention commercially without any charges.

In Indonesia, the protection on Geographical Indications is not given in theform of specific law/act, but is included in the Act No. 5/2001 onTrademarks in Section VII about Geographical Indications and OriginIndications.a. Geographical Indications are protected as markings to show the
origin of certain goods, which due to the geographical environmentincludes the natural factors,human factors,or a combination of both,gives certain specification and quality of the produced goods.
b. Geographical Indications will be given protection after registeredbased on the application proposed by:1. Organizations which represents the local community in the area
o f the production,which consists of:- Parties which gathers the natural goods- Farm goods producers;- Craftsmen- Merchants
2. Authorized institutions3. Customers of the goods.
c. Registered geographical indications will be given legal protection aslong as the specifications and/or the quality which is the basis for theprotection given,remains the same.
d. If before or at the moment of application, an indications has beenused on good will by other party which is not authorized to apply asexplained in point b,the good willed party can use that indicator for 2(two) years since the indications has been registered.
a. The protection of varieties and/or species of plants is the right givento plant developers if the variety and/or the species produced are anew,different,and a stable one.
b. By given the particular right, before conducting various activitiesrelated to the development of varieties and/or species of protected

plants, permission from the competent plant developers is requiredon that particular variety and/or species.
c. Exceptions are given if the use of protected varieties and/or speciesof plants is to fulfill the daily needs.Protected varieties and/or speciescan also be obtained without the developer's permission for thepurpose of research and development.
a. The assessment on the possibility of cooperation can be conductedby functional officials and/or structural officials according to the lawsand regulations.
b. The cooperation negotiation can be conducted by structural officialstogether with functional officials of the Centre for Plantation ForestResearch and Development.
c. The contract of cooperation will be facilitated by the Divisionof Research Program Planning of the Centre, in accordance with theDirector of the Centre's policy on the cooperation between forestryresearch institutions No. P. 01/VIII/Set/2009 dated 21 of April,2009.
d. Points that required to be regulated under the contract ofcooperation covers:
The management of intellectual property,including each party'sportions in the ownership of the intellectual property rightsThe status of the usage of plant materials owned by third partiesPlant materials from the material transfer agreement

a. All of the Intellectual Property Rights resulted from research activitiesconducted by the researchers of the Centre for Plantation ForestResearch and Development will be owned by the Centre forPlantation Forest Research and Development.
VI. PRINCIPLES OF MANAGEMENT
6.1. Contract of Cooperation

b. In the case that the Intellectual Property Rights resulted by theresearchers of the Centre for Plantation Forest Research andDevelopment during their study with the scholarship from theMinistry of Forestry, the ownership will be based on theMemorandum of Understanding (MoU) between the ForestryResearch and Development Agency of the Ministry of Forestry andthe attended University.
c. In the case that the Intellectual Property Rights resulted by theresearchers of the Centre for Plantation Forest Research andDevelopment during their study with the scholarship from thirdparties, the ownership will be based on the MoU between theResearch and Development Division of the Department of Forestryand the attended University and also the third party.
d. In the case that the Intellectual Property Rights resulted from thefindings of research conducted between the Centre for PlantationForest Research and Development and third parties, the ownershipwill be based on the MoU between the Centre for Plantation ForestResearch and Development and the concerning third party.
e. Particularly for point b, c, and d, if the management of intellectualproperty rights ownership has not been regulated in the MoU,then anew MoU will be required which will regulate the rights andobligations according to their contributions.
a. Disclosure is the early formal step to obtain the appropriateprotection for an intellectual property. Inventors are advised tosubmit the disclosure of the invention as early as possible.
b. Researchers are prohibited to disclose,protect or commercialize thefindings of the Centre for Plantation Forest Research andDevelopment considered being intellectual property before officiallyreport them to the Centre for Plantation Forest Research andDevelopment and until given an approval on matters related to thefinding including the authenticity of the finding.
c. The report on the finding must be able to explain the details whichcovers:

d. The disclosure report by the researcher will be submitted to theDirector of the Centre for Plantation Forest Researchand Development. Afterwards, the Director of the Centrefor Plantation Forest Research and Development will forman Intellectual Property Rights Service Team which consistsof the Division of Research Service and Evaluations of the Centre andother related experts
e. During the assessment, related information can be exposed outsidethe Centre for Plantation Forest Research and Development butmust be supported by a Secrecy Disclosure Agreement, so that thedisclosure conducted will not be categorized as a public disclosure.
a. The team is formed based on the decision by the Director of theCentre for Plantation Forest Research and Development
b. The main objective of the team is to facilitate the researchers or theteam of researchers in the process on obtaining the IntellectualProperty Rights from the Directorate-General of Intellectual PropertyRights of the Ministry of the Law and Human Rights or to register forthe plant varieties protection from the Centre of Plant VarietyProtection of the Ministry ofAgriculture

c. Conducting negotiations and agreements related to the use of theintellectual property rights obtained.
a. As soon as the Intellectual Property Rights ServiceTeam decided thatthe finding has met all of the requirements to obtain an IntellectualProperty Right, the Division of Research Program Planning mustpropose a budget for the process to obtain the intellectual propertyright,because afterwards it will be owned by the Centre for PlantationForest Research and Development.
b. Every related researcher must submit all documents to theintellectual property rights service team for further process.
c. If the team considers that the finding has not met all of therequirements, the further process to the Directorate-General ofIntellectual Property Rights or the Centre for PlantVariety Protectionwill not be preceded.
The share of rewards from the intellectual property management will beregulated as below:
a.For part-time consultancy, the proportion of the reward will be30% for the researcher and 70% for the Centre for PlantationForest Research and Development.For full-time consultancy, the proportion of the reward will be70% for the researcher and 30% for the Centre for PlantationForest Research and Development.
b.The proportion of royalty for the researcher is 50% and another 50%for the Centre for Plantation Forest Research and Development fromthe nett-income after tax and other expenses.
