I have the honor to refer to the Legation ' s lett er of ~une 28 , 1944, requesting information on CEREALIA LTD., Talstrasse 83 , Zurich.

There is enclosed a copy of a credit report on this firm. From the visa files of this Consulate General it appears that Richard A. Tennenbaum was issued an immigration visa on Decembe r 16 , 1940, and apparently since that time ~akob Locher has been managing the business. It is believed further that this firm is principally occupied in importing cereals and other foodstuffs on behalf of t he Swiss government . Jakob Locher is known personally to Consul Hubbard and is a l so a friend of Vice Consul Walker of the Br itish Consulate General . As far as is known Locher i s an able and industrious manager .

About Kay 2d, 8aly Weyer first reported the proposition referred to in the Depar~ent'a telegraa 2183 to the ~oint Distribution Comaittee in Lisbon. The report was made by telephone. On ~une 8~ , I discussed the whole aatter with h1a once more. Ransoa negotiations between repreeentative 7ewiah circles in Budapest, on the one hand and GerJilans, on the other, are involved in the propoa1tlon. According to the proposition, the Germans would retrain trOIIl deporting Hungarian Jews 1n return tor the sUJil of two Jllillion dollars . Tarious other conditions were propoeed to the Germans also. The principal conditions are: no brutality, preferential treatment or woJilen, children and old people, exit peralta t or those who possess or receive emigration visas, permission to send relief into What-ever oamps were set up, no labor camps to be outside the territory ot Hungary. ~rly in Kay a first payment of 1~. or taoo,ooo, was made from Local Hungarian Jewish resources. We do not have in our possession the details of the conditions under w.nioh further illstallaents were to be paid. Authorizations to transit through Spain and Portugal should be secured also. The Germans, tor unexplained recsone, hnve refused to allow departures through Turkey e.nd Rumania;

2) There should b • made availabe to Saly Kayer here in Switzerland a substantial fund, rrom the Joint and any other sources, of at least one aillion dollars in Swiss franca. (Naturally, this would be in addition to his regular budget ror relief.) It is strongly felt by llaJer that this will serve to keep up the morale ot the Jewa rema1n.1.n.g 1n Hungary. ot oourse, such tunds will be subject to any control desired; the !unds will remain 1n 8wi tzerland and they will not be used unle as prior aubaiaaion ot proposal and specific authorization have been made.

In the oourae of the last two months, Saly Mayer has already .. nt over eoo,ooo Swiss trancs into Hungary to aeet thia tragic a!tuation .and two days ago he sent the aua ot 100,000 Swiss trance to Bratislava as well.

Tnis cabl e draft contains a short report on the various demarches undertaken on our behalf at the International Red Cross Commi ttee. You wi ll certainly be interested in reading this summary •

Simultaneousl y , I shoul d like to recal l the information Professor Burckhar dt gave to Professor Guggenheim,stati ng that negot i ations were going on favourably between the International Red Cross Committee and the Rumanian Government concerning the pas s age of 50. 000 Hungarian Jews~Rumania. As I told you already , I personally have rather doubts as to the accurateness of this information, all the more as Mr. Schwarzenberg did not know anything abou t i t. You wil l oblige me greatly in seeing to obtain any informat ion possibl e on this point .

I should like to refer to y our memorandum of

June 27 regar ding Jews in Hungary who are alleged to

obt ain permission to emigrate into Pal estine . You in

quired whether the Swiss would be prepared to issue

pr otec t ion documents or letters to such persons for

t he purpos e of preventing their deportations .

I immediately got in touch with Bisang who first

confirmed that Mr. Lutz is in charge of the Division

of Fore i gn Interests at Budapest. With r egard to the

issuance of pr otecti on documents or l etters , Bisang

said that it was a mat ter of principle, and, while he

could not make a defini te stat ement.) he thought that

the Division would nat urally be very reluctant to pro -

vide such persons wi th statements for t he following

reaeonsc

1.- Such persons are not protected by Switzerland;

2.- The Swiss Government would certainly not want t o weaken in t he eyes of t he occupying power the validi t y and correctness of any

papers issued on behal~ of properly protected persons ;

3.- The Swiss Government would certainly not want to have thousands of such letters in the hands of persons who , properly speaking, have no claim to them:

Bisang f i nally agreed that if a note were sent to

him on this subject he would be glad to take the matter

up exhaustivel y and give us a reply at the earliest

possibl e time.

I then inquired of Mr . Huddle regarding his opinion

i n t he mat t er. 1!r. Huddl e noted that he saw no serious ob-

j ection t o the issuance of letter s by the Swiss authorities

to the holders of Palestinian emigration certificates .

He also pointed out t ha t in our own experience in

oentral European countri es, Fr ance and Germany i t has been

noted that an American passport has t o be s upplemented by

something in the nature of a consul ar l etter to the local

authorities before t hey recognize the passport . Something

like the same situation may exist with re~erence to the

Palestinian emigration cer t ificates. He ~urther adds that

it does not appear t hat t here would be any particular danger

involved in the is suance of the letters, but th~ would,

ot course, be a great deal of additiona l routine work f or

the Swiss. The Swi ss, of course , oould not properly say

tbat they stood as the protecting power for the bearers of

these

these documents but a letter might be drafted which

would be effective without such a notation.

However, Mr. Huddle is of the opinion that the

British authorities and the Palestinian Committee in

Geneva would be the appropriate aeency to press the

matter with the Swiss rather than ourselves . In this

connection you might care to discuss the matter with Mr.

Lichth:!im or Mr . Riegner and talk it over with Messrs .

McKillop ~ Mayall of the British Legation to see what

they think.

Although we might support any action which the

British Legation or the Palestinian Committee might

initiate or p ropose with the approval of the British

authorities, Mr . Huddle does not see t he wisdom of our

taking the initiative in the matter since we have no

thing technically to do with the issuance , the certifica-

tion, or the transmission of the Palestinian emigration

certificates .

I agree completely with Mr. Huddle ' s opinionA and

suggestions a s set forth above and would be glad to

assist you should you care to discuss the matter with

SUBJECT: Hungarian Political and Military Developments

Reliable source states that with the temporary abandonment of the German- promoted plan to establish the single par ty system on the Nazi model in Hun~ry, the governing group has been forced to turn to the military and by extending the functions and authority of the Honved (Army) is rapidly making it the dominant factor in Hungarian administrbtion at the present j uncture particularly in the following fields:

1. Internal Security: The Gendarmerie in the rural areas and the Police in the urban centers have been mil itari zed and placed under the control of Honved officers with the secret political police bureau abolished and its f unctions given to the militarized police service of the Interior Mini str y . The former internal police administrative set- up has been replaced by new territorial districts under militar y officers somewhat on the model of the Gestapo s ystem in Germany.

2. Internal Admini stration: In addition to taking over the clvli admini stration in wi de strategic areas designated as z on es of operations, the Honved has furnished numerous active and r etired officers as heads of the county administrations to repl ace purged Kallay appointees . The authority of the pl ace commanders and the aircraft defense oftioers has been extended to include activities heretofore lett to civilian municipal officials . Retired Honved ottioers have been pl aced in key posi tions i n the national administration from cabinet officials down.

3. Anti-Jewish Measures: The Honved has mobilized Jewish men and women In auxiliary labor battalion s and removed them f rom their normal place of r e sidence. Rumeroue Jewish restrictions and disabilities have been 1apo8ed by the Honved under the national d efense l aws rather than by the civilian authorities. The a irra i d

defense administration is responsible for much of the policy followed in the relocation of non-mobilized sections of the Jewish population. Alleged Jewish saboteurs and defeatists are tried by military courts under military law.

4. Economa : The key industrial enterprises have been militarize and placed under the cont rol of military commissars. The distribution of raw materials, foodstuffs, clothing, and the assignment of labor insofar as armament and related activities are concerned have been placed in the hands of the Honved. Railway personnel has been purged and militarized officials assigned to the important oper ating posts.

These developments are cited as revealing how the Hungarian governing group is making use of the Honved t o overcome the resistance which was encountered in parl i amentary and political circles in the period following the entry of German t r oops into Hungary.

Since years I have connections, business and otherwise, with Hungary and I know there the situation pretty well . I know that the warnings of the Swedish king, Mr . Hull ' s declaration, the appeal of the Swiss Protestants , etc . etc . will achieve no results as far as the peraecuation of the Jews is concerned . There is only one thing that might help and that is : If the United Nations would send an official ultimatum, broadcasted on the radio, to the Hungarian government declaring that, if the atrocities and persecuations do not stop immediately, Hungary will be mercilessly devided and split up after the war . I am sure, E£thing else will help .

The la~ter by President Huber enum3roted the facts of anti-jewish por~ocution and deportation which are r..nown in Geneva and contained the docwncntution we had submitted . Thus tar, relatives or the latter have been nble to avoid internment because they avoided the control on foreigners. '!'hey are no lonser in possession ot Uruguayan p:usports . The SWiss Logation believeo that the Uruguayan notioDAli ty or these Jewe will be r cognized by the Hungarians. Uoreover, it is expected thllt all Jews wbo are able to prove rorei~ nationality on the basis or a request by their protecting power will be spared anti-Somltio notion. The SWiss Legation stresses its vi8r: that Jews ot Latin.Americnn origin who are able to prove their natiooollty will not be exposed to the danger or deportation. Such danger exists, however, tor all Americana atreoted by Rule 0 or the 1940 Nationality Act in tho event that the authorities of the United Statee do not decide to validate the letters or protection held by the interested persons.

As forecast 1n my reference telegr~, I called on Mr. Pilet-Golaz, the foreign ¥1n1ster, and, as directed in your telegram indicated above, conveyed an expression of appreciation and reviewed the entire problem of war refugees.

1. The Foreign Minister said that he had received from President Huber a copy of tho latter's reply to my letter of May 2 (see my telegrams 5144 and 5147 of Yay 17), that he felt any approach to the Germans along the lines indicated in your 1498 of April 29 would be resented and might jeopardize the present efforts of Intercross to furnish relief to tho persecuted, in which matter he would continue to lend all possible assistance.

2. Regarding havens of retuge~rlrefer to my letter of June 16 mantioned in I':!Y telegram 1'5955 or June 20), Mr. Pilet recalled the policy of Switzerland as previously stated respecting the acceptance of refugees who are ooming 1n continually. He referred likewise to his ettorta to obtain permission for children to oome to Switzerland fran Germany and German-ocoupicd territory. So tar these efforts had been without s uccess. He 1Dtormed me that the interested services of the Swiss

1 Government had under consideration at present a proposal to the Government of Hungary to take 5,000 children and expectant mothers . It successful, he would expect that suitable arrangements be made so that they would not remain 1n Switzerland permanently.

3 . With regard to reports of the deportation of aa.e ~00,000 1ews !rom Hungary, the Foreign Minister atated that it was difficult to know oxaotly what had ~ppened to these poor people. According to hia reports,

250,000 had been taken so tar. The Jews ca~ble or working had been moved to labor oampa and it was not known what had happened to the others. The Hungarian authorities carried out the arrest or the Jews in Hungary; they then turned them over to the Gestapo. Eighty porcent or the Hungarians, it was claimed, were opposed to this outrageous action. Many Hungarians had been r,unished beoauee they had endeavored to protect and aosist the Jews. Mr . Pilat said he had been told that there were same aoo,ooo Jews 1n Hungary.

4. The interest and concern of the Government and people or Switzerland for tho tate of the Jews in Hungary was stressed by the Foreign Minister. He gave me the following in strict contidenoe:

(a) The Federal Government is in close touch with interested Swiss Jewish organizations and is facilitating oommun1oat1ons between organizations 1n this country and Jewish organizations in Hungary. He mentioned Mr. Saly Mayer;

(b) Assistance is rendered to Interoroas and close contact is maintained. A direct appeal to Regent Horthy tram President Huber h!Js been transaitted by Mr. Pilet;

(c) A proposal to obtain permission tor 5,000 children and expectant mothers is being actively oonaidered (see paragraph 2) ; ,

Dr. Max HUBER, President of the International Red Cross Committee, has wri tten to Admiral HORTUY of Hungarr 1nv1t1ng a denial of the measures or extermination which are being taken in that count ry by the Germans.

Should the situat ion prove as horrible as reported the Interna tional Red Cross Committee would s t and ready to place at disposal !Pecial delegates, as well as food and pharmaceutical products. Moreover, the Committee would be prepared to conduct a special surveillance of the deportation of Jews up to their f inal destination.
