Welcome to the Town of Abingdon, Virginia Council Meeting. We appreciate your interest
and we encourage public participation in our meeting. Your comments are important to our
decision making process. Please note that there will be an opportunity during the meeting for
you to address the Council members when the Mayor declares the public comments open. We

A work session of the Abingdon Town Council was held on Thursday, June 20, 2019 at
2:30 pm in the Arthur Campbell Room in the Municipal Building.

1. Presentation regarding objective criteria pertaining to yearly non-departmental budgeting
– Ryan Henderson, Virginia Highlands Festival Board Member (VIDEO 9:43 – 26:45)
Ryan Henderson, Virginia Highlands Festival Board Member, presented information for the
Council to consider during the upcoming non-departmental budget period to include three major
points to consider:
How the organization fits into the Town’s vision;
An application process with defined rubric; and
A review process that can include a non-departmental budget commission that would make
funding recommendations to the Town Council.
Discussion ensued.
2. Discussion regarding application for a special use permit, pursuant to Section 17-3 of the
Town of Abingdon Zoning Ordinance, proposed construction of automobile repair,
reconditioning and body shop, currently zoned M-1 Industrial District, located at 550
Lowry Drive, Tax Map No. 018-20-2 – Jason Boswell, Director of Planning (VIDEO

Work Session
Tyler Vencill, Engineer, presented Council with information regarding the special use permit
application presented to the May 20, 2019 Planning Commission meeting. The application is for
a three bay truck garage for a small trucking company and truck repair. The Planning Commission
voted unanimously to approve the special use permit as submitted. Mr. Vencill stated that this
matter would be on the July 1, 2019 agenda for the Council’s consideration. Discussion ensued.
3. Discussion regarding reappointment of an additional one year term for Mayor Craig to
District Three Governmental Cooperative or alternative appointment and/or an alternate
member or an appropriate staff representative for meetings the member is unable to attend.

Mayor Craig stated that the would like to remain as the representative for the District Three
Governmental Cooperative and would like to name the Town Manager, James Morani, as the
alternate.
4. Discussion regarding Friends of Abingdon, Inc. appeal of the Certificate of
Appropriateness (COA) approved by the Planning Commission on May 20, 2019, for
Thom Crosby, CroBar LLC regarding Pal’s Sudden Service facility – Cameron Bell,
Counsel (VIDEO 32:06 – 39:47)
Cameron Bell, Counsel advised Council that staff received the Friends of Abingdon Appeal of
the Certificate of Appropriateness on June 19, 2019 regarding an outparcel located at the
Meadows. The appeal was filed regarding three provisions, including the Entrance Corridor
Overlay; special use permit; and Restrictive covenant document between Marathon and the Town.
Mr. Bell stated that the Planning Commission approved the certificate of occupancy at the May
20, 2019 meeting. Further discussion ensued. Mr. Bell stated that the procedure is the Council
will hear this as an appellate body with a standard review essentially to review the Planning
Commission’s decision to decide whether it was an arbitrary and capricious determination or not
and then make a Council determination. Mr. Bell advised Council that a notice for public hearing
was not technically required. Mayor Craig stated that he would like to hear the appeal at the July
1st meeting as the Town is perceived as not being business friendly.
5. Discussion regarding permanent establishment of Infrastructure Committee and policy
regarding appointments to said Committee. – Mayor Wayne Craig (VIDEO 39:47 –
44:17)
Matt Bolick, Director of Public Services and Construction addressed the Council regarding the
possibility of establishing an Infrastructure Advisory Committee as the present Infrastructure
Committee has met informally for over a year with some beneficial work for the Council and the
Town. Mr. Bolick recommended that a Council member and the three citizens serving remain
and appoint one additional citizens for a committee of five. Council agreed to place this matter on
the August agenda for consideration.

6. Discussion regarding retention of applications to various boards and commissions - Kim
Kingsley, Clerk (VIDEO 44:19 – 46:45)
Kim Kingsley, Clerk proposed that applications for various boards and commissions be
retained for one year and proposed language be added to the application regarding certification
and/or training for certain boards and commissions. Mayor Craig suggested that we include the
Infrastructure Advisory Commission to the application.
7. Discussion regarding donations made to the Sinking Spring Cemetery Committee - Kim
Kingsley, Clerk (VIDEO 46:47 – 47:53)
Kim Kingsley, Clerk updated Council with regard to memorial contributions to the Sinking
Spring Cemetery Committee.

Ms. Patterson stated she had nothing to report but requested a copy of the “Form Motion

Pursuant to §2.2-3711(A)(39) of the Code of Virginia, 1950, as amended, for the
discussion or consideration of information subject to the exclusion in subdivision 3 of

On motion of Mr. Webb, seconded by Mrs. Quetsch, that the Abingdon Town Council
convene in closed session pursuant to §2.2-3711(A)(39) of the Code of Virginia, 1950,
as amended, for the discussion or consideration of information subject to the
exclusion in subdivision 3 of §2.2-3705.6 related to economic development.

Director of Tourism and Lisa Quigley, Executive Director of Virginia Creeper
Trail Conservancy
Jayne Duehring, Director of Tourism read the read the Resolution honoring Wayne Miller for his
dedication to the Virginia Creeper Trail. Jayne Duehring and Lisa Quigley presented the frame
Resolution to Mr. Miller.
On motion by Ms. Patterson, seconded by Mr. Bradley, Council approved the
Resolution as read honoring Wayne Miller.

G. CONSIDERATION OF APPEAL – (VIDEO 56:55 – 1:11:45)

Pal’s Sudden Service facility filed on behalf of the Friends of Abingdon, Inc. –
Cameron Bell, Counsel
Cameron Bell, Counsel summarized the matters set forth in the appeal of the Certificate of
Appropriateness filed on behalf of the Friends of Abingdon, Inc. to include violation of Section
18-9-8 (c) 1 and Section 18-9-8 (c) 6 of the Entrance Corridor Overlay District; violation of the
Special Use Permit application and Declaration of Restrictive Covenants; and that the Planning
Commission undertook extensive reviews and evaluations for the Marathon Realty Certificate of
Appropriateness application, the Eastman Credit Union Certificate of Appropriateness and
Holiday Inn Express and Suites regarding compliance with the requirements of Article 18-9-8 (c)
1 that the material, color and general style of the buildings within a development should be
coordinated.
Mayor Craig invited a representative of the Friends of Abingdon, Inc. to make a statement.
No one spoke on behalf of the Friends of Abingdon, LLC. Mayor Craig invited Thom Crosby of
CroBar, LLC to speak. Mayor Craig invited members of the Planning Commission to speak. No
one spoke on behalf of the Planning Commission.
Cameron Bell advised Council that the idea behind an appeal is that a party applying for
the Certificate of Appropriateness or also gives an appeal right to a party aggrieved. He further
stated that the Friends of Abingdon did not appear in person apparently to provide any basis for its
standing to raise this appeal and the appeal documents did not supply any basis for how the Friends
of Abingdon were aggrieved by this decision. Mr. Bell continued with further statements and
stated that it does not appear that the Friends of Abingdon, Inc. have standing to support the appeal.
Mr. Bell added that the Town Manager received a document today from the Friends of Abingdon
of having and purporting to be an amended appeal however does not appear to be an attempt to
file the amended appeal as it was handed out in a discussion meeting with Town representatives.
Mr. Bell stated that it appears that the purported amended appeal dated July 1, 2019 is untimely
pursuant to having Zoning Ordinance Section 18-9-9 that must be filed within thirty (30) days of
the decision of the Planning Commission. Additional discussion by Mr. Bell ensued.
Council member Al Bradley stated that the Planning Commission deliberated on this matter
for quite a while and realized that the Zoning Ordinance in this regard is improperly constituted
with no guidelines from which the Planning Commission to make a reasonable decision other than
to approve the application. Mr. Bradley stated that revisions have begun to affect future
developments.
On motion by Mr. Webb, seconded by Mrs. Quetsch, Council find that Friends of
Abingdon, Inc. (“FOA”), lacks standing to make this appeal because FOA is not a
“party aggrieved” by the May 20, 2019 Planning Commission approval of the
Certificate of Appropriateness; but notwithstanding the FOA’s lack of standing and
without waiving that basis; that, Town Council affirm the May 20, 2019 Planning
Commission approval of the Certificate of Approval on the basis that the Planning
Commission approval was not arbitrary or capricious, but was made after a

substantive discussion of the Historic District Entrance Corridor Overlay District
Ordinance (“Overlay District”), a September 11, 2015 Special Use Permit which
refers to the Overlay District Ordinance and Declaration of Restrictive Covenants
and Reciprocal Access Easement Agreement (“Restrictive Covenants”). And further
that the Planning Commission decision was not arbitrary or capricious as applied to
Sections 18-9-8(c)(1), regarding coordination of the buildings in the development,
Section (C)(6), regarding trademark buildings, the Special Use Permit which refers
to the Overlay District or the Restrictive Covenants; Town Council deny the
purported Amended Appeal dated July 1, 2019, as untimely pursuant to Abingdon
Zoning Ordinance Section 18-9-9 that must be filed with the Town Manager within
thirty (30) days of the decision of the Planning Commission and also that the remedy
sought by this purported Amended Appeal is not a proper exercise of Town Council
authority sitting as an appellant body.
Ms. Patterson thanked everyone for attending and exercising right of speech and stated that
there were some issues in the past with some businesses that she felt was not friendly and fair and
would share what she could. Ms. Patterson further stated that the Council has recommended to
the Planning Commission that some Ordinances be changed so that it is fair for all businesses to
participate in building in the same way that they need to participate to be fair to every business.
Mayor Craig spoke in favor of Mr. Webb’s motion stating that Pal’s was not because of a
lot of reasons Ms. Patterson brought up, but the Council’s role is not to mess with the Planning
Commission’s business but Council’s role is to exercise oversight. Mayor Craig stated that he
viewed the action by the Town’s Planning Commission and found they discussed this matter very
thoroughly, deliberated and took everything very seriously, acting in a professional manner. Mayor
Craig stated that he supported this because it is beneficial to the Town and he does not think it
violates any ordinances and further stated that he has reviewed the Town’s Ordinances and the
Friends of Abingdon’s petition (appeal) finding no evidence whatsoever that the Planning
Commission acted in an arbitrary and capricious manner. Mayor Craig thanked the Planning
Commission for the fine job for serving.

1. Public Hearing regarding application for a special use permit, pursuant to Section 17-
3 of the Town of Abingdon Zoning Ordinance, proposed construction of automobile
repair, reconditioning and body shop, currently zoned M-1 Industrial District, located
at 550 Lowry Drive, Tax Map No. 018-20-2. - Jason Boswell, Director of Planning
Jason Boswell, Director of Planning presented Council with information for Special Use
Permit pursuant to Section 17-3 of the Town of Abingdon Zoning Ordinance and Article 13,
Section 13-2-9 of the M-1 Limited Industrial District. Mr. Boswell stated that the applicant is
requesting a 4800 square foot, 3-bay auto repair shop for a small local trucking company to be at
550 Lowry Drive. Mr. Boswell stated that the Planning Commission unanimously approved the
application at the May 20, 2019 meeting.
Mayor Craig declared the public hearing open. Hearing no comments, Mayor Craig closed
the public hearing.
On motion by Mr. Bradley, seconded by Ms. Patterson, Council recommended
that we follow the recommendations of the Planning Commission.

Mr. Bradley stated that he attended the Planning Commission and other meetings. Ms.
Patterson stated that she attended lots of meetings, ribbon cutting and a reception honoring
government employees for years of service. Mayor Craig thanked Ms. Patterson for attending
the ribbon cuttings. Mr. Webb stated that he was always busy.
James Morani, Town Manager thanked the Barter and Town staff for their hard work in
moving tonight’s meeting.

1. Presentation regarding the Washington County Courthouse (VIDEO 24:32 – 50:50)
County Administrator Jason Berry, Supervisor Phil McCall, Supervisor Eddie Copenhaver and
Clerk Alicia Rowland were present for the presentation. County Administrator Berry provided
details regarding three proposals for the Washington County Courthouse. Discussion ensued.
2. Discussion regarding installing sidewalks between Hutton Street to Cambridge Street on
Main Street – Donna Quetsch, Council Member (VIDEO 51:48 – 58:12)
Mrs. Quetsch presented the need to complete the sidewalk on Main Street in the area Hutton
Street to Cambridge Street. Discussion ensued and Council agreed that staff should pursue the
matter.
3. Discussion regarding blight on property located at Cambridge Street to Valley Drive –
Donna Quetsch, Council Member (VIDEO 58:16 – 1:00:06)

Mrs. Quetsch requested that staff investigate the area located at Cambridge Street to Valley
Drive as it blocks the view entering Cambridge Street. Matt Bolick, Director of Public Service
and Construction stated that he would inspect that area.
E. UNFINISHED BUSINESS
1. Discussion regarding Fields-Penn House stabilization – Matt Bundy, Bundy Architecture
and Engineering (VIDEO 1:00:06 – 1:04:20)
Matt Bundy provided information regarding prices currently from Remco for the micropiles
installation in the amount of $187,600 to stabilize the footings and from Walburg Constructon for
installation of the wall-washers in the amount of $39,616 to hold the walls together. Discussion
ensued.
On motion of Ms. Patterson, seconded by Mr. Bradley, that the bid from Remco in
the amount of $187,600 and the bid from Walburg Construction in the amount of
$39,616 be approved and authorize the Town Manager to sign the contract.

2. Discussion regarding proposed Ordinance to enact an Infrastructure Advisory Committee
– Cameron Bell, Counsel (VIDEO 1:04:28 – 1:08:37)
Cameron Bell, Counsel stated that previous discussion has led to a formal establishment of this
Committee with one Council member, the town manager, the Public Works Director and four
citizens to serve a four (4) year term. Discussion ensued. It was discussed that this matter would
be advertised for September 2019 meeting. Mr. Bell stated that he would also have the bylaws for
consideration.
3. Update on proposed changes to employee handbook related to workers compensation
policy – James Morani, Town Manager (VIDEO 1:08:37 – 1:12:28)
James Morani, Town Manager advised Council that there were changes made to the Town’s
workers compensation policy. Cameron Bell, Counsel stated that because of a recent Ordinance
that the Town Manager could approve these changes without Council action.

4. Updated on proposed policy changes related to credit card use by employees – James
Morani, Town Manager (VIDEO 1:12:28 – 1:14:15)
James Morani, Town Manager stated that this policy was recently discussed with Council and
that additional changes made and would be included in the operational procedure handbook for
staff.
5. Closed Session pursuant to §2.2-3711(A)(3) of the Code of Virginia, 1950, as amended,
for the purpose of discussion or consideration of the acquisition of real property for
a public use, or of the disposition of publicly held real property, where discussion in
an open meeting would adversely affect the bargaining position or negotiating

On motion of Ms. Patterson, seconded by Mr. Bradley, that the Abingdon Town
