Summary

On July 7, 1994, the war between the Yemen Arab Republic (North Yemen)

(1) and the

People's Democratic Republic of Yemen (South Yemen) (2)

ended. North Yemen won the

war. Since then, South Yemen has been experiencing unprecedented escalation in the

violations of human rights and international human law in what was known as South

Yemen. This report documented (176) deaths, including 10 children, and 3 women. It

covered the time period from January 1, 2013 to December 31, 2013.

In the year of 2013, the Yemeni Security and Military Forces (Y.S.M.F) and its armed

militias continued targeting the southern civilians. Y.S.M.F committed the violations of

human rights principles and rules of international humanitarian law. Which included

killings, assassinations, bombings, incursions and siege the South’s cities and villages,

destruction of the infrastructure, and collective punishment on southern civilians.

The violations against southern civilians are still escalating, especially after the start of the

Southern Peaceful Movement (Al-Hiraak al-Janoubi). The Southern Peaceful Movement

was formed on July 7, 2007. This movement demanded independence and restoration of

South State, which existed up until the union of the Yemen Arab Republic (North Yemen)

and the People's Democratic Republic of Yemen (South Yemen) in 1990.

Although the Southern Peaceful Movement commitment to the peaceful struggle by

establishing demonstrations, oratorical festivals, and peaceful gatherings. The violence has

expanded against the civilians who are protected under the international law. Yemeni

regime faced it with excessive use of force in an attempt to eliminate it. The unlawful

killings of civilians and political assassinations of the military and security increased.

Collective massacres, destruction, and displacement committed for many areas of the

South.

In December 20, 2013, the struggle of the South entered a new phase due to the launch of

a popular uprising in all regions of the south. This uprising seeks to control their own land

and natural resources. The Hadramout Tribal Alliance (1)

called for this uprising after the

murder of Sheikh Sa'ad bin Ahmed Bin Habreesh, a prominent tribal leader, and two of his

companions (Y.S.M.F). It adopted by all tribes and southern categories. Also this uprising

takes on the peaceful struggle to achieve its goals while reserving legal right to self-

defense.

We calls upon the international community, including the High Contracting Parties to the

Fourth Geneva Convention of 1949 on the protection of civilians in times of war, as well

as international organizations, to intervene to immediately stop the Yemeni violations

against the Southerners. An action should be taken to put an end to the Serious

deterioration in the human rights situation and the situation in the south.

Many of the abuses documented are serious violations of international humanitarian law

and require those responsible be held accountable. The principles of international

humanitarian law states that the parties to the conflict must at all times distinguish

between civilians and combatants. Attacks may only be directed against combatants.

Attacks must not be directed against civilians. Also, collective punishments are prohibited

under international humanitarian law in all circumstances which would also constitute a

war crime. The international and arabic community silence encourages the (Y.S.M.F) to

perpetrate more of these violations.

Recommendations to the International

Community

We emphasize that the international community’s position that South Yemen is still under

North Yemen occupation which admitted by Commander General Ali Muhsin Al-Ahmar,

the Commander of the Northwestern Military Zone (4)

. We further confirm that (Y.S.M.F)

have continued to impose collective punishment measures on South Yemen. We stress that

there is an international recognition of Yemen’s obligation to respect international human

rights instruments and the international humanitarian law, especially the Hague

Regulations concerning the Laws and Customs of War on Land and the Geneva

Conventions. Israel is bound to apply the international human rights law and the law of

war sometime reciprocally and other times in a parallel way; a way that achieves the best

protection for civilians and remedy for victims.

In light of the continued arbitrary measures and the continued aggression against civilians

in South Yemen, we call upon the international community, United Nations, the High

Contracting Parties, the Geneva Convention, and the European Union, in the context of

their natural obligation to respect and enforce the international law. We call them to

cooperate and act according to the following recommendations:

1. Call upon the international community and the United Nations to use all available

means to allow the Southern people to enjoy their right to self-determination.

2. Call upon the United Nations to provide international protection to the Southern people.

3. Call upon the High Contracting Parties to the Geneva Conventions to compel Yemen, a

High Contracting Party to the Conventions, to apply the Conventions in the occupied

South;.

4. Call upon the Parties to international human rights instruments, especially the Covenant

on Civil and Political Rights and the Covenant on Economic, Social and Cultural Rights,

to pressurize Yemen to comply with their provisions in the occupied South. We also call

them to compel it to incorporate the human rights situation in the South in its reports

submitted to the concerned committees.

5. Call upon the High Contracting Parties to the Geneva Conventions to fulfill their

obligation to ensure the application of the Conventions, including extending the scope of

their jurisdiction in order to prosecute suspected war criminals, regardless of the

nationality of the perpetrator and the place of a crime, to pave the way for prosecuting

suspected Yemeni war criminals and end the longstanding impunity they have enjoyed.

6. Calls upon the European Union to activate Article 1 of the EU-Yemen Association

Agreement, which provides that both sides must respect human rights, and the EU must

not ignore Yemeni violation and crimes against Southern civilians.

Methodology

Information contained in this report is obtained from multiple sources. The most

prominent sources are the Southern Peaceful Movement and human rights activists whom

are present in the south. The other sources are from local newspapers and websites such

as: alomanaa.net, attariq-ye.com, akhbaralyom.net, adenalghad.net, almasdaronline.com,

and other newspapers and sites that are indicated in the table attached, which includes the

number of dead (see pages 12, 25, 30, 31, 32). The facts are also collected through

interviews and meetings with families of victims.

This report is also based on the statement issued by Amnesty International " Yemen:

Authorities must rein in security forces ahead of protests” which confirms that protests in

Yemen has always been dangerous for activists, with police routinely shooting and killing

peaceful demonstrators. (5)

We are grateful to the parties and individuals who submitted observations on the content

of this report; in particular, Human Rights activists, jurists, and journalists. We also value

the efforts being made by the individuals in preparation of this report by providing the

names and pictures of deaths, and monitoring the human rights situation in the South;

especially the human rights activist Omer Awad Al-Shugri and activist in the southern

movement Waddah Ali Ahmad Alyaqoti.

We like to point out that the report may not cover all the number of martyrs and the dead,

but it reflects the realistic indication of the human rights situation in the South; which is a

continuation of the 1994 war. We call upon those who wish to participate and contribute to

I. Background

South Yemen is located in the southwest corner of the Arabian Peninsula. It extends along

the southern part of the Arabian Peninsula from Oman in the east to Bab Al Mandab in the

west. It is bordered by Saudi Arabia and North Yemen to the north, Oman to the east, and

the Indian Ocean to the south. Its total area is 337,000 sq km (130,116 sq mi). The total

estimate of the population is 4 million. South Yemen has a number of islands spreading

along the Red Sea and the Arabian Sea. The largest of these islands is Socotra, which lies

off the coast about 150 km. (6)

South Yemen gained its independence from Britain on November 30, 1967. South Yemen

established a modern civil state that was known as the People's Democratic Republic of

Yemen (P.D.R.Y). It was a member of the Arab League, the Islamic Conference, and the

United Nations. On May 22, 1990 the People's Democratic Republic of Yemen (P.D.R.Y)

and Yemen Arab Republic (Y.A.R) agreed on being peacefully united to establish a

Republic of Yemen. The (Y.A.R) regime disrupted the unite agreements, and then

declared the war against the South.

On July 7, 1994, the (Y.A.R) occupied the (P.D.R.Y); this occupation was admitted by

Commander General Ali Muhsin Al-Ahmar, the Commander of the Northwestern Military

Zone, he stated that:

“The Yemen unity was achieved on May 22, 1990. Ali Saleh

was the president at the time, and he ruled the North with

tyranny and the South by occupation”. (7)

On June 1, 1994, the United Nations Security Council adopted resolution 924 that stated, “

Calls for an immediate cease-fire; Reminds all concerned that their political differences

cannot be resolved through the use of force and urges them to return immediately to

negotiations which will permit a peaceful resolution of their differences and a restoration

of peace and stability; Requests the Secretary-General to send a fact-finding mission to the

area as soon as practicable to assess prospects for a renewed dialogue among all those

concerned”.(8)

However, The (Y.A.R) regime ignored the Security Council resolution and

continued its aggressive war against the south. They bombed the cities in the South,

especially city of Aden. Yemen Arab Republic killed and injured thousands of victims

and caused a massive destruction among civilians.

As a result of above situation, the United Nations Security Council condemned the failure

of immediate and completed halt to the shelling of the city of Aden by adopting a

resolution 931 on June 29, 1994. This resolution stated “Strongly deplores the infliction of

civilian casualties and destruction resulting from the continuing military assault on Aden;

Reiterates that political differences cannot be resolved through the use of force, deeply

regrets the failure of all concerned to resume their political dialogue and urges them to do

so immediately and without preconditions; Decides to remain actively seized of the

matter.”(9)

On July 7, 1994, Sana’a regime submitted a note to the Secretary General of the United

Nations promising to continue the national dialogue.(10)

However, Sana’a regime denied

this promise after they won the war against the South. They accused the leaders of

(P.D.R.Y) of treason and issued judgments against them. The regime also exercised acts

of an occupied state such as; discharging all the southern civil and military services,

forcibly retiring thousands of their work, looting the public institutions, allocating the

South’s lands and properties to the army commanders and senior officials, and giving

unlimited authority to the northern to loot and plunder of public and private property and

assault on the rights of southern citizens.

This sad situation created a

pile of refusal feelings by

the southern to the

armed and barbaric

irrational invasion that was

enforced by (Y.A.R)

regime. This refusal was

seen clearly in numerous

and various situation-

s before it was taking the

rural, civilized, and

vast shape in a

civil movement of denial

that was pract-iced by the south which resulted in forming the Southern Peaceful

Movement on July 7, 2007. It was seeking freedom, independence, and the right to self-

determination for the southerners. With the acquisition of this movement's organization,

the Southern Peaceful Movement extended more day after day throughtout all the six

provinces of the south: Aden, Lahj, Abyan, Shabwah, Hadhramout, and Al-Mahrah.

II. Violation of the right to life

The article III of The Universal

Declaration of Human Rights states

that, ”Everyone has the right to life,

liberty and security of person”. (11)

Article VI of the International

Covenant on Civil and Political Rights

states that,” Every human being has

the inherent right to life. This right

shall be protected by law. No one

shall be arbitrarily deprived of his

life”. (12)

However, the Yemeni

Security and Military Forces continue

to use its military capabilities such as: aircraft, tanks, and advanced mechanisms against

the southern civilians.

Since the start of the Southern Peaceful Movement (Al-Hiraak al-Janoubi) on July 7,

2007, human rights defenders have extensively documented killings of (1341) young

men,women and children perpetrated by the Yemeni Security and Military Forces

(Y.S.M.F)and its armed militias of the Sana’a regime.

Most of southerners were killed by being participants in peaceful demonstrations of the

Southern Peaceful Movement, being political activists, and during the bombing of cities

and villages of the South. However, in most cases this force was not a threat to the lives of

Sana’a regimes’ soldiers.

According to field investigations, eyewitnesses, and circumstantial evidence, the security

and military forces of Sana’a regime used excessive forces that claimed the lives of

civilians in their homes, jobs, or while walking in the streets. Children, women and elders

were a part of the southern victims. The methods of killing were as follows:

1- Killed the participants at peaceful demonstrations,

2- Killed the civilians in their homes by the indiscriminate shelling,

3- Killed the southerner at the military check points,

4- Ran over the civilian by the security forces vehicles,

5- Assassinated the southerner staff in the military and security.

III. Unlawful killings of civilians in the south by the military and security

forces of Yemen.

We found evidence that (89) civilians were killed by the Yemeni Security and

Military Forces (Y.S.M.F) between January 1, 2013 and December 31, 2013. 10 of

those were children and 3 women. In most circumstances to commit the crime, there

was no threat to the lives of soldiers. The Yemen's government justified the killing of

some civilians because they are members of al-Qaeda. For example: The Yemeni

Defense Ministry’s website published a statement immediately following the

assassination of Shaeikh Bin habreesh saying he was a member of al-Qaeda. Later,

the ministry wholly retracted its statement and apologized to tribes in Hadramout.
