In this regard, it is reiterated that instant seniority as on 01-04-2013 has been revised in compliance to Hon’ble Delhi High Court order dated 17-09-2019, titled Dr. Tarkeshwar Parsad Vs UOI & Ors. In order to observe the law of natural justice, the draft revised seniority list has been duly circulated to all stakeholders and the affected Medical Officers thereby, vide ADG (Medical) CAPFs, NSG & AR OM No. E-32012/ADG (Med)/R-DPC/L-1/20-390 dated 24.02.2021. 2. That, as far as the plea of revising the instant seniority list as on 01-04-2013 retrospectively is concerned, the office of ADG (Medical) CAPFs, NSG & AR has re-visited the same on the basis of BSF UO No. 17/Med/CC (C)TP/ 2020/418 dated 11 Jan 2021, wherein BSF in compliance of ibid court order dated 17-09-2019 has refixed the seniority list while constituting a duly competent board of officer followed by a speaking order dated 11.01.2021. Hence, there are no substantial facts to mention here that the said seniority has been revised without

addition to the creation of a sense of insecurity in the minds of the Government Servants there would also be administrative complications and difficulties. Satisfactory service conditions postulate that there should be no sense of uncertainty amongst the Government servants create by the writ petitions filed after several years. A Government servant who is appointed to any post ordinarily should at least after a period of 3 or 4 years of his appointment be allowed to attend to the duties attached to his post peacefully and without any sense of insecurity. (d) As per the seniority list of 01 April 2013, I was placed at Serial no. 28 while Dr. Tarkeshwar Prasad was placed at Serial No. 51, twenty three numbers below my seniority, while as per the revised seniority list circulated by office of the ADG (Med) CAPFs, NSG & AR vide ibid OM I am still placed at serial No. 28 while Dr. Tarkeshwar Prasad is placed at 19 (a). Though it appears visually that I have not lost any seniority since I am placed at serial No.28, but is reality I am pushed one number below at position 29 and also being superseded by Dr. Tarkeshwar Prasad, since the board of officers was detailed by office of the ADG (Medical) CAPFs, NSG & AR to revise the seniority list, they shuld have fixed seniority of Dr. Tarkeshwar Prasad at Serial No.19 instead of Serial no. 19 (a) and accordingly my seniority at Serial No. 29, if the rules permit and necessary justification is communicated to all

BSF 3 Dr. Subrata Chakraborty 22 Officer through his representation requested

following:- (a) Officer requested that since 25 June 1998, Dr. Tarkeshwar Prasad, DIG (Med) have been mentioned junior to me in the BSF Gradation list. The seniority list of BSF have been published from time to time and Dr. Tarkeshwar Prasad have been shown as junior to me in the above gradation list. The officer never objected to this position in the gradation list. The compliance of the Writ Petition WP ( C) 1131/2018 as per Court order dated 17.09.2019, will adversely affect the service condition of me and other then CMOs (SG) by altering our seniority and will put us in disadvantageous position. The acceptance of the Court Order by the Department, will place me in an adverse position as mentioned in the revised seniority list circulated with this letter.

1. In this regard, it is reiterated that instant seniority as on 01-04-2013 has been revised in compliance to Hon’ble Delhi High Court order dated 17-09-2019, titled Dr. Tarkeshwar Parsad Vs UOI & Ors. (b) It is submitted that, the proposed revision of seniority list will disturb long standing seniority which is in existence for more than a decade. The Courts in several cases, has made it clear that once seniority has been fixed and remain in existence for a reasonable period, should not be disturbed. This action of revision of seniority will harm innocent parties like the undersigned. (c ) In view of above the settled legal position that emerges in service matters, the question of seniority should not be reopened, after a lapse of reasonable period because that results in disturbing the settled position, which is not justifiable. (d) In this instant court order dated 17.09.2019 and course case, the undersigned was not impleaded as co-respondent in the writ petition. The 21 affected than CMO (SG), were necessary parties, as their interests are directly affected by revision of seniority list. The prejudice caused by non impleadment is clearly adverse to the undersigned and other affected then CMOs (SG), as seniority rights of the CMOs (SG) will be affected. As inter-se-seniority, being a civil right requires determination in their presence and thus the writ petition in Hon’ble High Court of Delhi is defective. Also such claim for seniority at a belated stage, disturbs the vested rights of many other persons, regarding seniority, rank and promotion which have accrued to these CMO (SG) during the intervening period and challenge

That, in reference to the directions of Hon’ble Apex Court dated 01-03-2021, titled Subrata Chakraborty Vs Tarkeshwar Prasad and Ors is concerned, the office of ADG (Medical) CAPFs, NSG & AR have no concerned about the same. 5. That, it is made clear that there is no laxity in the part of the office of ADG (Medical) CAPFs, NSG & AR on this instant matter. Hence, the

Several promotions have been made on the basis of this list which cannot be reversed and officers of other medical cadre will also be affected. During creation of common medical cadre, Dr. Tarkeshwar Prasad was alerted to the procedure of creation of the seniority list in 2004

I was promoted t the rank of CMO (SG) on 05/04/2002 vide CRPF order no. P.VII-1/2003. At that time, Dr. Tarkeshwar Prasad was junior to me. After common gradation list was prepared it was circulated amongst all medical officers of CAPFs for raising observations regarding their inter-se-seniority. Subsequently also revised gradation list was re-circulate. It was pertinent to mention that undersigned does not have any knowledge about any representation made by Dr. Tarkeshwar Prasad, nor any action taken on that. (b) In this connection, I like to submit that Supreme Court in its judgement ruled several times that long standing seniority list cannot be changed.

No comments received from CRPF HQrs

1In this regard, it is reiterated that instant seniority as on 01-04-2013 has been revised in compliance to Hon’ble Delhi High Court order dated 17-09-2019, titled Dr. Tarkeshwar Parsad Vs UOI & Ors. 6. The list was circulated to all concerned for information and inviting objections, if any. But to my utter surprise, this list was upto and as on dated 01.07.2005 but my name was missing from the list, though, I was promoted as CMO (SG) on dated 19-03-2004. The list was circulated to me on dated 31.08.2005. 7. I represented against the combined seniority list several times but no reply has been received. Due to discrepancy in above seniority list, many junior Medical Officers of other Forces have been kept above me in seniority list. It may kindly be noted that how a medical officer who NEVER EXISTTED IN FORCE AT THE TIME WHEN I WAS ALREADY IN FORCE AND JOINED THE FORCE LATER THAN ME, CAN BE PUT ABOVE ME IN COMBINED SENIORITY LIST as happened with me as many Medical officers who are from BSF, ITBP and BSF who joined in their forces later than me, earned their promotion later than me can be put above me in combined seniority list. This logic should be given due consideration while rectifying the anomaly of latest gradation list. 8. It is pertinent to mention here that this anomaly occurred due to erroneously placing of Dr. V Srilaxmi, IRLA No.2052 who joined CRPF on 21-03-1983 (Much senior to me) and promoted to the rank of CMO (SG) only on 05/04/2005 (much later than me) due to supersession on some ground above our

batchmate Dr. Mrs Ranjita Kar leading to supersession of all of our batch mates below her. Dr. V. Srilakshmi can not be placed above a CMO (SG) who has earned her promotion on 05/01/2004. If this anomaly is corrected and Dr. V Srilaxmi be placed at her appropriate level as per her promotion date, I will be placed above all those BSF, ITBP, SSB Medical officers who joined later than me but has been placed above me in seniority list. The superseded officer can’t be placed above a officer who earned his/her promotion before the superseded officer. 9. In view of above, it is requested that Combined Gradation list of MO’s in the rank of CMO (NFSG) & above of CAPFs may kindly be re-fixed so that my seniority is restored at appropriate level i.e at Sl No.78 below the name of Dr. A K Mahapatra as per combined seniority/gradation list of MOs after restoring the seniority of my senior most batchmate Dr.(Mrs) Ranjita kar at serial number 73 i.e below Dr. P Mitra of SSB and above Dr. Promod Kumar of BSF. 10. But till date no reply has been sent to me (Copy of my representation enclosed as Annexure-V). 7. Thereafter, several times, updated gradation lists were circulated and I represented every time. But not reply. The only reply which I received was on my representation dated 08.01.2018. Vide U.O No. E.32011/ADG (Med)/Seniority/2018/82 dated 16.01.2018. The reply given to me was totally incorrect, arbitrary, irrelevant and against the instructions on subject as enumerated ante. My seniority and date of my promotion as CMO (SG) was totally ignored and CMO (SG) Junior to me and promoted as CMO (SG) after me were made senior to me. This is an injustice to me and therefore, I represent once

again to get my legitimate seniority as CMO (SG) in the combined seniority list of CMO (SG) of CAPF. My submission is as under :- a) I Dr. Ranjeeta Kar, CMO (SG) was appointed in CRPF as MO on dated 05.01.1990 and promoted as SMO on dated 05.01.1994, from SMO to CMO (OG) on dated 05.01.2000 and CMO (SG) on dated 05.01.2004. b) In the year 2004, Medical set up in CAPFs, was restructured vide MHA letter No. 11.27012/93-PF-III dated 02.09.2004 and it was decided that at the level of DIG and above, the promotions will be common to all forces based on combined gradation list of Medical Officers. c) Therefore, in order to prepare common eligibility lists of rank of CMO (SG) [Which is feeder cadre to rank of DIG (Medical)] and above, a Committee was constituted in MHA. The Committee prepared the draft common eligibility lists based on the principle enumerated in para 5 ante. d) The list was circulated to all concerned, for information and inviting objections, if any. To my utter surprise, though this list was prepared as on dated 01.07.2005, but my name was not there in the list though I was promoted as CMO (SG) on dated 05.01.2004. The list was circulated to me on dated 31.08.2005. I immediately sent my representation dated 14.09.2005, to the DG CRPF and all concerned but to no avail. e) Since, then I am continuously representing, but most of the times, the representations remained unanswered. The only

reply, given to me was on dated 16.01.2018. The reply was given to me on my representation dated 08.01.2018 to the ADG (Medical) CAPF, against the seniority assigned to me in the Draft revised seniority list as on dated 01.04.2017. The reply by the ADG (Med) is enclosed as Annexure-VI. f) It is submitted that in this list as on dated 01.04.2013 as per MHA’s instructions on preparation of combined gradation/seniority list of CMO (SG) and above, in CAPF, my seniority should be placed at Sl No. 73 and not at 94, as I was promoted to the rank of CMO (SG) grade pay Rs. 8700/- on dated 05.01.2004, below SI No. 72, Dr. P. Mitra, CMO (SG) of SSB, who was promoted as CMO (SG) grade pay Rs. 8700/- on dated 01.01.2004. Dr. Pramod Kumar CMO (SG) of BSF placed at Sl No. 73 of the list, was promoted as CMO (SG) grade pay Rs. 8700/-on dated 09.05.2004. This was totally against the instructions issued by MHA and enumerated in para 5 ante. He was promoted as CMO (SG) after four months and four days of my promotion i.e. dated 05.01.2004. I am senior to him and should be placed above him in the said list at Sl No. 73. g) Further, the duration of regular service of Dr. Pramod Kumar, CMO )SG) of BSF in CMO (SG) rank is less than me. So, instead of SI No. 94, I, Dr. Ranjeeta Kar, CMO (SG), CRPF should have been placed at SI No. 73 as per my date of promotion to CMO (SG) rank in grad pay Rs. 8700/- wef. 05.01.2004.

8. The copies of the representation submitted by me on dated 17.06.2009 and 03.12.2009 are also enclosed for reference as Annexure-VII & VIII. 9. Therefore, in the said revised draft seniority list dated 01.04.2013 of CMO (SG) of CAPFs, and circulated now, my name has been placed at Sl. No. 94 which is grave injustice to me and against the rules on the subject. On the one hand, Dr. P. Mitra, CMO (SG), SSB has been given seniority above me and placed at SI. No. 72, he was enlisted in SSB on date 31.01.1990 and I was enlisted in CRPF on dated 05.01.1990, on the plea that Dr. P. Mitra was promoted on dated 01.01.2004. On the other hand, again in the said list all CMO’s (SG) from SI. No. 73 (Dr. Pramod Kumar of BSF to SI No. 93 Dr. (Smt) V. Srilaxmi of CRPF, have been promoted to the rank of CMO (SG) much after my promotion, but given seniority above me. Similarly, CMO (SG) of the said list SlNo. 75 to 92 (Dr. R. D. Gari, CMO (SG), SSB to Dr. Ghanshyam Das, CMO (SG), BSF] are not only promoted as CMO (SG) after me, but junior to me in service also, i.e. their date of entry as MO is much after me. The seniority cannot be denied to me on both the grounds. The seniority assigned to me is totally incorrect and against the rules. It may kindly be noted that how a Medical Officer who never existed in the Forces, at the time when I was already in the

Force and joined the Force later than me, promoted as CMO (SG) after me, can be put above me in the seniority list. 10. I, therefore, request you to kindly do justice and my seniority be restored as CMO (SG) in the above combined gradation list of CAPF, dated 01.04.2013 at Sl No. 73 i.e. above Dr. Pramod Kumar, CMO (SG) of BSF, whose date of promotion is dated 09.05.2004, whereas mine is dated 05.01.2004.

In reference to Digcent (Pers) Dte, signal No. G.III. 1/2021-Pers.MOs dated 01/03/2021, I want to submit and apprise your good self of the fact that I have been wrongly placed at revised draft seniority list of CMO (SG) (issued on 01.04.2013) (Appendix-B) at SL. NO 97. Instead my correct seniority placement is at SL No. 76 after our batch senior most CMO (SG)’s correct seniority placement at Sl. No. 73, just below P. Mitra CMO (SG) of SSB, who is at Sl. No. 72.

3. In this regard, I want to mention that Dr. V. Srilaxmi CMO (SG) madam, IRLA 2052, DOE-21/03/1983, her name was called for CMO (OG) to CMO (SG) DPC vide Digcent (Pers) sig No. P.VII-1/04-CRC-MOs date 08/05/2004 ( Appendix-C) subject to SHAPE 1. In this regard, our batch DPC orders from CMO(OG) to CMO (SG) were issued vide Digcent (Pers) Dte. Signal No. P.VII-1/2004-CRC (MOs) DATED 16/11/2004 (Appendix-D) in which Dr. V. Srilaxmi CMO (OG) to CMO (SG) name along with the name of Dr. P.C. Tripathi, CMO (OG) to CMO (SG), IRLA-2150,DOE 31/12/1983 was also called for. As per Digcent (Pers) Dte Signal No. P.VII. 1/20040CRC(MOs) dated 03/05/2005 (Appendix-E) our batch (Senior most MOs was promoted to the rank of CMO (NFSG) on 05/01/2004) and Dr. P.C. Tripathi (Date of promotion- 05/04/2004), promotion was approved by Competent authority but the name of Dr. V. Srilaxmi, was not there in this approved list. 4. Sir, Dr. V. Srilaxmi madam was promoted as CMO (SG) on 05/04/2005 (although no signal or promotion orders are available regarding this ) and as per the CRPF, CMO (SG) Gradation list dated 01/01/2007 (Appendix-F), She was placed at Sr No. 66 and Dr P.C. ,Tripathy sir at Sl No. 67 (with the remarks DPC-05). In the same gradation list, I was placed at Sl No. 73 even though my date of promotion to CMO (SG) Gradation list dated 01/01/2009 (Appendix-G), Dr. Srilaxmi with date of promotion as CMO(SG)

on 05/04/2005 was placed Sl No. 47 where as Dr. P.C. Tripathy, CMo(SG0 (with revised date of promotion 05/04/2005 was placed Sl No. 47 where as Dr. P.C. Tripathy, CMO (SG0 (with revised date of promotion 05/04/2002) seniority was refixed at Sl No. 48 in G/list of CMo(SG) of CRPF as on 01/01/2009 (Appendix-G) thus maintaining inter se seniority among CRPF CMO (SG) Rank medical officer and resultantly he was placed at Sl No. 01 whereas Dr. V. Srilaxmi being senior to him was still placed at Sl No. 20 followed by my place at Sl No. 24. As per Digcent (Pers) Dte Signal No. O.II. 2764/90-Pers MOs dated 16/02/2010 (Appendix-I) clearly mentioned that ‘ However, on promotion they will continue to maintain their original Inter- Se-Seniority of the lower grade except when they are not promoted/supersede” Thus it was contradictory in reference to DIG (Pers) signal No. O.II.2764/90-Pers MOs dated 16/02/2010 (Appendix-I). 5. In combined Eligibility/Gradation list of CMO (NFSG)/Specialist Grade-I as on 01.04.2013 (Appendix-B) , Dr. P.C. Tripathy CMO (SG) is placed at Sl No. 1 with DOP to CMO (SG) rank as 5-April-2002 (previously it was 05/04/04 before refixing his seniority) where as Dr. V. Srilaxmi madam was still placed at Sl No. 93 despite the fact that as per rule once the officer resumes SHAPE-1 , his or her seniority is restored back and thus resultantly madam should have been placed before Dr. P.C. Tripathy CMO

(SG), she being senior to him but madam’s seniority not restored her placing at Sl No. 93 in CAPF CMO(SG) combined gradation list dated 01.04.2013 (Appendix-B) above our batch effected our seniority and still effecting out batach seniority in the combined CAPF CMO(SG) Gradation list very badly. Dr. V. Srilaxmi madam belongs to very senior batch of CRPF as her date of enlistment in CRPF is 21/03/1983 but she is being considered as the senior most CMO (SG) with DOP to CMO (SG) as 5-April-05 of our batch as per ADG (Medical), CAPFs, NSG & AR vide their letter No. 1/06/ADG (Med) CAPFs/Combine Gradation list/374 dated 12/03/2012 (Appendix-J) with the remarks “ Enblock/inter-se seniority maintained by Force CRPF”, which is not at all correct, resultantly many CMO(SG) rank CAPF medical officers who are junior to our batch are placed above Dr. Ranjita Kar, CMO (SG) (senior most Medical Officer of 1989 batch of CRPF ) with date of enlishment in CRPF 05/01/1990 and date of promotion to CMo (SG) rank as on 05/01/2004 (with remark DPC-05). 6. Sir, I have represented for the restoration of my seniority many times in past also and the last representation dated 09/10/2020 (Appendix-K) in regard to CAPF, CMO (SG) list issued by ADG (Medical) dated 24/09/2020 but no reply received till dated and the two replies received by me by the department regarding Seniority issued against my representation date and the two

Signal No. O.II. 2764/90-Pers MOs dated 16/02/2010, the reply to my representation dated 11/01/2010 it is mentioned that “ In the instant case, both the DRs quoted by Dr (Mrs) Sushma Sharma are senior to her, Found fit to be promoted to the Grade of CMO (SG) wef 05/04/2002 (Earlier then her promotion) But it is not clear that why Dr. V. Srilaxmi is placed at abaove Dr. Ranjit Kar, CMO (SG) and not above Dr. P.C. Tripathy, CMO(SG). At same places date of promotion of Dr. V. Srilaxmi, madam’s in the rank of CMO(SG) mentioned as 05/04/2005 as Appendix-G & 05/04/2002 as per Appendix-I. 7. Sir, I humbly request and submit your good self to intervene to restore our batch seniority by placing Dr. Ranjita kar, CMO (SG), being senior most in our batch at Sl No. 73 just below Dr. P. Mitra of SSB at Sl No. 72 whose DOP as CMO (SG) is on 01/Jan/04 and placing me in the CAPF CMO (SG) gradation list at Sl No. 76 after my 3 senior batch mates in the revised draft seniority list of CMO (SG) (issued on 01.04.2013 vide MHA letter dated 13.02.2014) after inclusion of the name of Dr. Tarkeshwar Prasad, subsequent to revision of his seniority in the rank of CMO (SG) wef 05.04.2002. 8. 98 Officer humbly submit that, sir, I have strong objections to me being placed at Sl no.37 of the above gradation list, as I have been promoted to the rank of CMO (SG) on 21/11/2004, whereas many doctors junior to me , those who have been promoted much latter to the feeder grade, i.e the grade of CMO (SG), have been placed above me. How can those who had not even joined govt service, when I was serving in CRPF & those promoted later than me, to the feeder grade, be above me, in contravention of all instructions & guidelines of DoP&T & MHA, GOI, on the subject. (b) I have joinded as MO on 21-11-1990 & confirmed in service on 21/11/1992, promoted as SMO on 21/11/1994, promoted as CMO (OG) on 21/11/2000 & promoted as CMO (SG) on 21/11/2004. (c) As per the above instructions & guidelines, issued by DOPT vide OM No. 20011/1/2008-Estt- (D) dated 11th Nov 2011 (Annexure-I & I (a) & please read with MHA GOI UO No.- 45024/02/2005-Pers-II dated 18th February 2005 (Annexure-II & II (a). (d) Para2.2 of above order of DoPT on matters on seniority of promotes, says that, when eligibility list is to be resorted to, then in such cases, proper eligibility list of candidates should be prepared from various feeder grades, with regard to the inter –se-seniority of the candidates. That , the representation dated 04-03-2021 of the officer has been examined thoroughly and it has been revealed that the seniority of officer has not been affected after revision of the seniority as on 01.04.2013. 2. Moreover, the contention of officer for placing him below Dr. P Mitra and above Dr. Pramod Kumar is concerned, it is made clear that the seniority of officer has already been fixed as per the inter-se-seniority provided by CRPF HQrs. Hence, the representation dated 04-03-2021 of Dr. A K Mahapatra, CMO (SG), 4th Bn CRPF is hereby considered and rejected being devoid of merit.

controlling authority (MHA) for combined eligibility list, as the candidates are from various feeder grades. Broad particulars are as under be kept in view while preparing a combined gradation list:- 1. Date of completion of the qualifying service prescribed in the relevant recruitment rules in the feeder grade for promotion. 2. If the aforesaid date is same, then the date of completion of qualifying service in the feeder grade. 3. Inter-se-seniority from each feeder grade will be maintained. (e) Therefore, in order to prepare the common eligibility list of the rank of CMO (SG), which is the feeder grade to the rank of DIG (Med) & above, MHA appointed committee has set the following principles to prepare the combined gradation list:- (i) To prepare eligibility list for promotion, the duration of regular service in the present grade (CMO/SG), i.e the date of promotion to this grade (CMO/SG) has been taken into account, as provided in para-3 (8) (ii) (a) to (d) & 9 of Gazette Notification No. A/12019/1790-CHS-V, Vol-II, GOI, dtd 8th October, 1996 for promotion to higher floating posts of CHS from various specialist/non specialist sub cadres. (ii) If the length of service in the present grade is same, the date of promotion to the immediate lower grade is to be the deciding factor & so on. (iii) If the date of service in all lower grades are same, the date of joining have to be taken into account & that is also same, the date of birth is to

be the deciding factor. (f) Since the very first combined gradation list has been prepared, the above guidelines & instructions of DoP&T & MHA has been regularly flouted & violated. Several times, I have represented, which has not been listened to. (g) The basic fault & injustice found in this list is that, the date of promotion to the feeder grade (CMO/SG) has not been made the main criteria, as is required to be, as per existing instructions. So a peculiar situation has arisen, where juniors those who had not even joined in govt service, when I was in service, have been placed above me in the combined gradation list, instead of being placed below me. (h) Therefore Sir, I earnestly request you to kindly revise the combined gradation list as per instruction & guidelines of DoP&T & MHA & justice may kindly be dispensed to me by placing me above all juniors, those who have been promoted to the grade of CMO (SG), after me, that is after 21/11/2004 please.
