The Oil and Gas Conservation Act________

MINARD SOUTH FROBISHER BEDS POOLMRO 69/02 PO 3. Pursuant to section 17 of The Oil and Gas

Conservation Act, the following provisions shall apply to the drillingof, and the production of oil and gas from, vertical oil wells in theMinard South Frobisher Beds Pool, effective February 1, 2002:

1 The drainage unit shall be comprised of two legal subdivisions ina Section grouped as follows:

Legal subdivisions 1 and 2; 3 and 4; 5 and 6; 7 and 8; 9and 10; 11 and 12; 13 and 14; 15 and 16.

2 Within a drainage unit, the sides of the target area shall be 100 mfrom and parallel to the corresponding sides of the odd-numberedlegal subdivision.

3 If a well is not completed within the target area, the minister mayreduce the area used as a factor in determining the maximumallowable rate of production.

4(a) For the first well drilled in each Section, the operator shallsubmit samples of the interval from the top of the Second WhiteSpecks to total depth.

(b) For all subsequent wells drilled in each Section, the operatorshall submit samples of the interval from the top of the Paleozoicstrata to total depth if such wells were intended to be drilled down toor below the top of the Bakken Formation.

5 As a minimum requirement, the operator shall run logs todetermine the resistivity, spontaneous potential, porosity and gammaray spectra from surface casing shoe to total depth for each welldrilled.

1 The requirements of Saskatchewan Environment and ResourceManagement shall be met.

COURT OF QUEEN’S BENCHAMENDMENTS

The Rules of the Court of Queen’s Bench for Saskatchewan areamended, effective the 18th day of January, 2002, in the manner setout below:

I Part 6 is amended by adding, immediately followingRule 75, the following new division:

XI: CLASS ACTIONS

Definitions76 In this Division:“Act” means The Class Actions Act;“designated judge” means the judge designated by the Chief

Justice to consider an application for certification of a class actionand appointment of a representative plaintiff.

Application of Rules77(1) The rules in this Division apply to actions and applications

brought under the Act.(2) Unless provided otherwise by the Act or by the rules in this

Division, the general procedure and practice of the court shall applyto actions and applications brought under the Act.

Style of Cause78(1) The style of cause must include the words “Brought under

The Class Actions Act” immediately below the listed parties if:(a) it is intended, at the commencement of the action, that a

certification order will be sought under the Act; or(b) in any other case, a certification order is subsequently

granted in respect of the action.(2) Where a certification order is refused in respect of the action or

the action is decertified, the words “Brought under The Class ActionsAct” shall be removed from the style of cause.

Application to the Chief Justice79 An application to the Chief Justice for the appointment of a

designated judge may be made ex parte and must be made:(a) within 30 days after the later of:

(i) the date on which the statement of defence was delivered;and

(ii) the date on which the time prescribed for delivery of thestatement of defence expires without it being delivered; or

(b) with leave of the court at any other time.

Conferences80(1) The designated judge may, on his or her initiative, order a

conference to be held respecting the conduct of the action, includingthe application for certification, at any time after his or her designation.

(2) The rules relating to pre-trial conferences shall not apply to aconference ordered pursuant to this rule, except as otherwise orderedby the designated judge.

Application by Defendant81(1) Where a defendant applies for certification of a class action

pursuant to section 5 of the Act:(a) the defendant shall apply to the Chief Justice of the court

for the designation of a judge to consider the application; and(b) the designated judge shall order a conference to be held

respecting the conduct of the action.

(2) If the court certifies two or more actions as a class action undersection 5 of the Act, the court may:

(a) order the addition, deletion or substitution of parties;(b) order the amendment of the pleadings; and(c) make any other order that it considers appropriate.

Application for Certification82(1) A Notice of Motion for Certification pursuant to

clause 4(2)(b) or section 5 of the Act shall be in Form 5D.(2) An application for a certification order pursuant to section 4 of

the Act must be supported by an affidavit of the proposedrepresentative plaintiff:

(a) deposing to the proposed representative plaintiff’swillingness to be appointed;

(b) setting out the basis of the proposed representativeplaintiff’s personal claim, where applicable, and the reason theproposed representative plaintiff believes that common issuesexist for the rest of the members of the class;

(c) setting out objective criteria for determining membershipin the proposed class, and providing the proposed representativeplaintiff’s best information on the number of members in theproposed class;

(d) setting out sufficient information to establish that theproposed representative plaintiff would fairly and adequatelyrepresent the interests of the class and is aware of theresponsibilities to be undertaken;

(e) exhibiting a plan for the class action that sets out aworkable method of:

(i) advancing the action on behalf of the class; and(ii) notifying class members of the action; and

(f) setting out sufficient information to establish that theproposed representative plaintiff does not have, on the commonissues, an interest that is in conflict with the interests of otherclass members.

(3) An application for a certification order pursuant to section 5 ofthe Act must be supported by an affidavit of the defendant applyingfor certification:

(a) setting out the reason the defendant believes that commonissues exist for the members of the proposed class;

(b) setting out objective criteria for determining membershipin the proposed class; and

(c) providing the defendant’s best information on the numberof members in the proposed class.

(4) A Notice of Motion for Certification and the supporting materialsmust be filed and a copy served on all parties to the action.

(5) Unless otherwise ordered, there must be at least 14 daysbetween:

(a) the service of a Notice of Motion for Certification andsupporting materials; and

(b) the day set for the hearing.(6) Unless otherwise ordered, a party opposing an application for

certification must:(a) file an affidavit in response; and(b) serve a copy of the affidavit on all parties to the action at

least 7 days before the day set for the hearing.(7) A party filing an affidavit under subrule (6) must provide the

party’s best information on the number of members in the proposedclass.

Amendments to pleadings83 After a certification order has been granted, a party may only

amend any pleading filed by that party with leave of the court.

Discovery84(1) Where a class member is examined for discovery pursuant to

subsection 19(2) of the Act:

(a) rule 222A does not apply to that class member; and(b) unless otherwise ordered, the evidence of that class member

may not be read into evidence at the trial of the common issues.(2) The court may:

(a) require the parties to propose which class members shouldbe discovered pursuant to subsection 19(2) of the Act;

(b) limit the purpose and scope of discovery of a class member;and

(c) determine the use that may be made of the evidenceobtained on discovery of a class member.

Notices85(1) Where an agreement respecting fees and disbursements is

summarized in the notice to class members, notice that the agreementis not enforceable unless approved by the court pursuant tosection 41 of the Act shall be included.

(2) Where a motion for settlement has been filed, or a settlementhas been approved, notice must be given by the representativeplaintiff to the class members in accordance with the provisions ofsubsections 21(3) - (5) of the Act, unless otherwise ordered.

(3) Notice under section 23 of the Act may:(a) state that common issues have been determined;(b) identify the common issues that have been determined

and explain the determinations made:(i) state that members of the class or subclass may be

entitled to individual relief;(ii) describe the steps that must be taken to establish an

individual claim; and(iii) state that failure on the part of a member of the class

or subclass to take those steps will result in the member notbeing entitled to assert an individual claim except with leaveof the court;

(c) give an address to which members of the class or subclassmay direct inquiries about the proceeding; and

(d) give any other information that the court considersappropriate.

(4) The court may order any appropriate means of giving noticepursuant to clause 21(4)(e) of the Act, including creating andmaintaining an internet site.

(5) Where the Act or these rules require notice to class members,notice shall be given to other interested parties, including counsel fora subclass, as directed by the court.

Agreements respecting fees and disbursements86(1) An application for approval of an agreement respecting fees

and disbursements must be brought after:(a) judgment on the common issues; or(b) approval of a settlement, discontinuance or abandonment

of the class action.(2) The application pursuant to subrule (1):

(a) shall be made to the judge who presided over the trial ofthe common issues, or who approved the settlement,discontinuance or abandonment, as the case may be; and

(b) shall be made on such notice to class members as isrequired by the court.

(3) Where, on an application pursuant to subrule (1), the courtdetermines that the agreement ought not to be followed, the courtmay amend the terms of the agreement.

II Clauses (a) and (b) of subrule 477(1) are repealed andthe following substituted therefor:

(a) family law proceedings, other than a family propertyaction wherein the only relief claimed is a division of familyproperty;

(b) actions under The Builders’ Lien Act; or(c) class actions.
