Govt's Trade Margin Cap Proposal To Dent India's CapacityTo Produce Affordable Drugs

The government's proposed move to cap trade margin of non scheduled drugs will hamper the

business prospects of many pharmaceutical Micro, Small and Medium Enterprises (MSMEs) and

hence will be of no benefit to the end consumer. This in turn will have an adverse impact on Indian

pharma industry’s capacity to produce affordable drugs. There are around 8,000 pharma MSME

units in the country. The Department of Pharmaceuticals (DoP) proposal to put trade margin cap

on non scheduled drugs at 30 per cent will lead to pharma MSMEs to print MRP only 30 per cent

higher than the ex-factory price. Such low margins will therefore deter marketers and retailers

from selling low priced products of MSMEs. Hence this seems to be disastrous for MSME growth

in the country and not actually a price control measure. The proposed move is worse than the

Drug Price Control Order (DPCO) 1995 which is widely considered to be a retrograde step despite

100 per cent Maximum Allowable Post Manufacturing Expenses (MAPE), said Jagdeep Singh,

secretary general of Punjab Drugs Manufacturers Association (PDMA) in a letter to DoP secre-

tary Dr P D Vaghela. Singh stated that many manufacturers, especially in the erstwhile tax holi-

day states, can add only up to 10 to 20 per cent to their material cost and invoice the products

due to stiff competition. For instance, the material cost of ceftriaxone injection 1gm is Rs. 11 and

invoicing is done at Rs. 13. The MRP under proposed trade margins shall be Rs. 4 which includes

margins for promoter, distributor and retailer. Due to this, Singh further said that no promoter

could possibly promote it and no retailer would sell this product for a paltry profit of Rs. 2 because

when the same drug from big pharma is sold in retail at Rs. 60 under DPCO 2013 and the retail-

er makes a trade margin of Rs. 10. In fact, when MRPs vary to such a large extent, the lower

priced drug is also considered fake. This will be an additional reason why nobody will sell the drug

made by MSMEs. The government is certainly not out to promote spurious drug by closing down

all such units who not only have huge capacities but also have huge loans to repay, he further

said. He pointed out that capping of trade margins will not only affect the buisness of 50 lakh peo-

ple involved in the promotion and distribution of medicines in the country but also entire 8,000

pharma MSMEs in India. All this will benefit big pharma units which have dedicated marketing set

up as they invoice the product at approximately 70 per cent of MRP. It is an open secret that doc-

tors demand amount equal to a quarter of the value of drug for prescription medicines especially

when produced by MSMEs. High trade margins also go into the pockets of doctors. Similarly,

retailers make a killing when they dispense branded generics from big companies. Due to profi-

teering by doctors at the point of care, it certainly can not be the obvious reason to close down

MSMEs by a selective policy change which allows different MRPs to big drug manufacturers and

different MRP to MSMEs, said PDMA secretary general. Not only are MSMEs backbone of any

economy due to their employment generation potential, they have also been supporting govern-

ment programmes like Jan Aushadhi for affordable drugs which big pharmaceutical units didn’t

comply with, he added. The letter explains that post DPCO 1995, first line antibiotics like tetracy-

cline and clotrimazole and anti asthmatics like aminophylline vanished from the market because

retailers were unwilling to stock and sell them owing to low trade margins.’They were replaced by

more effective third/fourth generation antibiotics, which being out of price control, were more

expensive and hence offered better trade margins. The letter also links the subsequent increased

use of third/fourth generation antibiotics to the misuse and increasing anti-microbial resistance.

The consumer was not only “fleeced but was put at high risk,’ stated the letter.

To Become Self-Sufficient In Bulk-Drugs And DrugIntermediates:

ExpertsIt is high time for government of

India and for the healthcare man-

agement authorities in the country

thought about a strong remedial

measure for the pharmaceutical

manufacturing industry to survive

any possible crisis that may occur

because of the grim situation that

China, a dependent source of bulk

drugs for India, confronts today.

India is highly depending on China

for 75% requirement of bulk-drugs

and drug intermediates, and also

highly depending on fermentation

based drugs. If import of fermenta-

tion based drugs is halted, produc-

tion and availability of antibiotics will

come to a standstill. So, India

should consider all ways to manu-

facture the country’s requirement

for all APIs without leaving a

chance to depend on any foreign

country. The situation created by

the outbreak of coronavirus infec-

tion in China (COVID-19) teaches

that lesson, according to industry

leaders and policy experts. The

Indian pharmaceutical sector needs

to be self-reliant and self-sufficient

in the production and availability of

all kinds of formulations as well as

all categories of bulk drugs and

drug-intermediates. Today the

whole world depends on China for

import of active pharmaceutical

ingredients (APIs). Once that coun-

try stops its foreign sale of drug

intermediates, domestic production

of many drugs may be halted in

every country, observes Dr. PV

Appaji, pharma industry policy

(Pharmexcil). According to him,

about 75% of API requirements for

drug manufacturing are coming

from China alone. It includes most-

ly bulk drugs and drug intermedi-

ates for making all essential drugs.

Moreover, India is extremely

dependent on China for fermenta-

tion based drugs. Pencilin, amoxi-

cillin, azithromycin,

cephalosporin..etc are imported

from China. “We have sufficient

technology to manufacture all these

APIs. About 25 years ago, five com-

panies in India started manufactur-

ing fermentation based drugs for

local requirements. But soon China

reduced the prices of their products

and accordingly Indian companies

could not withstand the situation.

Very soon they had to close down

their factories because of no gov-

ernment support. If government

protects the manufacturers, they

will produce all the required APIs

here. 6-Aminopenicillanic acid (6-

APA) and 7-aminocephalosporanic

acid (7-ACA) are important interme-

diates for manufacturing antibiotics.

These are produced from penicillin

and cephalosporin which are

imported to India in intermediate

forms. If their supplies are stopped,

the situation will affect the produc-

tion of antibiotics in India. Same will

be the situation in those countries

which are depending on China

India should take steps with the

industry to manufacture sufficient

quantity of bulk drugs needed in the

country. “This is a short term crisis

as we feel now, but industry has an

inventory of raw materials for next

two months. If the crisis continues

for a long term and supplies are not

coming from China, the situation

will hit Indian pharma sector”, he

said. He, however, said the govern-

ment has already started discus-

sion with industry leaders for esca-

lating production of bulk drugs. If

proper support is given to Indian

industry, 50% of the requirement

can be made in India and gradually

the dependence on China on APIs

can be reduced. According to SV

IDMA, all the companies have a

stock of APIs for next two months

and the situation in China has start-

ed improving. The factories there

have reopened after their holiday

due to China New Year. Corona

infection has affected in the city of

Wuhan only. But he said govern-

ment has called industry leaders for

discussion about API production.

present the situation created due to

COVID-19 has not impacted sup-

plies to India from China. But there

is a slight increase in the prices of

some products imported from
