30/2011: StagnationRailway - One timeClerks

of staff in Group D posts in Accounts Department on Southernrelaxation for promotion against DR quota vacancies of Accounts

Official Side advised that the Federation's demand for diversion of some existing DR quota

vacancies ofAccounts Clerk for promotion of staffofAccounts department in GP 1800 has

been examined in consultation withAccounts Dte. who have not agreed to the proposal.

Federation(NFlR) pointed out that in Accounts Deptt. the overall promotion quota is 33%o/o

whereas in other departments it is 50%. A uniform procedure should be followed by alldepartments or else quantum relaxation to be extended as demanded in this Item.

Federation also stated that the erstwhile Group 'D' Staff possessing ooGraduate"

qualification are stagnated in the recruitment Grade Pay due to inadequate promotionopportunities not only on Southern Railway but also on other Zones in AccotrntsDepartment. Federation therefore insisted that direct recruitment quota be diverted forproviding promotion opportunity to the posts of Accounts Clerk (Pay Level-2) and theavenue be also modified atpar with other departments. Federation also pointed out that thissubject is pending since over seven years, therefore separate meeting be convened at the

lpvel of FC soon, considering the fact that the career of erstwhile Group 'D' staff got ruineddue to inadequate promotion opportunities.

32/2012: Lack of career growth - Points Man category of Operating Department inthe Railways

Federation(NFlR) pointed that Points Man 'A' belonging to erstwhile <1900 Grade Pay(currently Level 2) are not being permitted, at present to take examination for promotion as

TNC (Level2). It was agreed to examine this aspect.

Federation(NFlR) further mentioned that earlier there was a category of Sr" Points Man(GP <2400) which does not exist anymore in few zones which needs to be examined.

The Federation(NFlR) also mentioned that vide letter No.E(NG)I l20l2lPMlll22 dated

15.07.2015, a proposal for change in staffing pattern in Traffic and CommercialDepartment was given on which they have already submitted their comments. Decision onsub-item 3 should be communicated.

Federation reiterated, that the Board, after consultations with Federations, had finalizedproposal for filling 16%% posts of Commercial Clerks (GP 2000) b5'promotion entirely on

merit of regular employees with 10+2 qualification of all Departments in GP 1800 and GP

1900 with minimum of 3 years service on the basis of a competitive examination. It was

also decided that those with matriculation on the date of issue of these orders will also beeligible. Federation expressed disappointment that orders have not been issued even afterlapse of three years and urged to see that orders are issued immediately.

l8l20l3: Implementation of Apex Court decision - Counting of the service renderedby Commission Bearers/Vendors absorbed in Railways for pensionary benefits - fromthe date of engagement as Commission BearersA/endors, till date of absorption inRailways - Southern Railway.

Federation stated that while Southern Railway implemented the Court direction andaccordingly the applicants have got the benefit thereof, the same should also be applied tosimilar cases of other Zonal Railways.

Official Side advised that the SLP in the Apex Court against the Hon'ble High Court/Madras judgement order dated 30.09.2013 was dismissed on technical ground i.e. delay infiling the SLP, and not on merits. As such, the ordbr is restricted to the applicants only.

Federation while disagreeing with the view of Board stated that a separate communicationwill be sent by the Federation with fulI facts for review.

512014: Technician III posts in Diesel/Electric Loco/EMU Sheds on Indian Railways -increase of promotion quota percentage - reg.

Federation(NFlR) stated that they have replied Board's correspondence on 17.07.2018which will be looked into.

Federation also insisted upon a separate meeting with MRSA{TR soon.

23/2015: Recruitment policy for induction in Group oC' (erstwhile Group 'D') postsin GP 1800+PB-1 through RRCs-review urged.

The Committee constituted for the purpose is yet to submit its report. Further action shallbe taken based on the recommendations.

Federation expressed its anguish over abnormal delay in mitigating the hardships of femaletrack maintainers and urged the Board to expedite the matter. Federation also requested tomake available, copy of the Committee's report.

38/2015: Granting promotion opportunity as JE against 25Vo IntermediateApprentice quota to those Technicians initially appointed as Technician-Ill oncompassionate ground.

53l20l5: Incorrecf formation of panel of Shunting Master in PB-l + Gp 24001- onSolapur Division of Central Railwav -

Official Side stated that instructions contained in Board's letter No.E(NG)l l2000lp}/r 214

dated 30.10.2001 have been reviewed as desired by NFIR. These instructions were issuedin consultation with both NFIR and AIRF. The panel in Solapur Division is formed basedon these instructions.

Federation contended that formation of panel of Shunting Master in GP 2400 is done fromamongst Pointsman-A, Leverman and Cabinman forming part in same seniority unit. Assuch, the panel is to be based on seniority position instead of on merit.

Ofiicial Side mentioned that Pointsman, Leverman and Cabinman are Distinct separatecategories within the same department. Even if the posts of teverman and Cabinman arephased out due to modified way of working (Panel working etc.), or these categories aremaintained in a common seniority, the concept ofAVC will not change. In this Cure, ,on.of consideration was also not restricted to 3X. SUR division's notification invitedapplications from three categories viz Leverman, Cabinman and Pointsman 'A'. Thus, ifno Leverman or Cabinman existed, or none applied from any particular category, it wouldnot change the character of the post of Shunting $aster-Il from General post to other thanGeneral post. Thus, the selection has been rightly done in the order of merit, in terms ofACS No.209, para 3 of RBE No.11312009 dated 19.06.2A09 and para 2(C) of RBENo. 1 7/20 1 4 dated 06.A2.2014.

Federation, however, insisted on their demand. It was then clarified by the Official Sidethat at this distant date if the panel is to be revised based on seniority position instead of onmerit, there is every possibility of an empanelled candidate not finding a position or therewill be change of their position in the panel. In either case, this will lead to complicationsincluding litigations. Hence, it will not be desirable to re-visit this issue at this stage.

Federation strongly disagreed with the contention of Official Side that Pointsman,Leverman and Cabinman are distinct categories. Federation also did not agree with theview of Oflicial Side with regard Shunting Jamadar/Shunting Master. Federation urgedripon the Board to consider the changed scenario i.e. single seniority staff deploy"d toperform the duties of different posts and revise the extant policy which becams outdatedfor the purpose of drawing panels in the order of seniority among those cleared selection.Federation also'argued that the extant procedure is also violative of rules and demandedreview.

Federation stated that in the case of Pharmacist category, provision exists for servingemployees possessing qualification to be considered first and requested that the saidprovision be made applicable for filling staff nurse vacancies by those staff possessingqualifi cation prescribed.

2ll20l8: Filling the vacancies of Chief Loco Inspectors - Review of extant policyfacilitating lirst opportunity to Senior Loco Pilots (Mail/Express)-reg.

Federation stated that it has discussed the subject withAlWStaff, MTR, CRB and explainedthe necessity to review. Therefore, the issue needs to be re-visited in the overall interest ofRailways and staff.

Official Side stated that in case of promotion to the post of Loco Inspectors, the candidatesare called from different categories i.e. Mail/Express Drivers, Passenger Drivers, GoodsDrivers from the same department and therefole satisfies the definition of the terms'General Posts'. The promotion to the post of Loco Inspector is, therefore, done as per theprocedure in vogue for general posts as laid down in Board's letter dated 19.06.2009.

22/2018t Absorption of Staff working in Quasi Administrative Units/ Officeserstwhile Group'D'

Federation wanted the Railway Board to appreciate that the staff of Quasi AdministrativeUnitsi Offices are not outsiders as in terms of IREM provisions, they are granted facilities.The head of the Administration (JA Grade Officer) is the controlling officer of QuasiAdministrative Units/ Offices staff working in the Railway Institutes, Co-operative Storesetc. Federation also invited Railway Board's attention to the points highlighted by NFIRthrough its letter dated 0610212016 & llll2l20l7. Federation also requested to takegxpeditious action for granting approval for screening and absorption of those QuasiAdministrative Units Staffwho are on rolls as on date.

Official side stated that joint letter of Federations has been received which will be put up.
