The meeting of the Kankakee County Board, Kankakee County, Illinois held pursuant to the adjourned meeting of June 13, 1989, was called to order by the Chairman, Mr. Hendrix on July 11, 1989 at 10 A.M. with the following members present:

Mr. O'Connor, Mr. Huot, Mr. Thompson, Mr. Hendrix, Mr. Davis, Mr. Martin, Mr. Jensen, Mr. bertrand, Mr. Riegel, Mr. bretveld, Mr. Graves,. Mr. Piekarczyk, Mr. Greenley, Mr. Minelli, Mr. Dailey, Mr. Young, Mr. Howery, Mr. Stump, Mr. Meling (10:15 A.M.), Dr. Sergeant, Mr. Wenzelman, Rev. Rucker, Mr. Washington, Ms. Shutter, Mr. Mackin, Mr. Ryan and Mr. Breault.

Quorum Present:

Invocation: County Board Member, Duane Bertrand introduced his pastor who presented the invocation.

The minutes of the last meeting were presented to the Board and on the motion of Mr. Wenzelman and second of Mr. Dailey the reading of the minutes was waived and stand approved as recorded. Motion carried.

CLAIMS COMMITTEE REPORT:

The Claims Committee submitted a report recommending the claims be adopted for payment. A motion to adopt the claims for payment was made by Mr. Minelli and seconded by Mr. Stump. County General Claims & County Highway claims are included in this action. Motion carried on a roll call vote of 26 ayes, 0 nays. The original claims list may be found in Claims Book Exhibit "C".

COMMUNICATIONS:

A motion to approve the Department Report for the filing was made by Mr. Stump and seconded by Mr. Mackin, motion carried.

RESOLUTIONS:

1. HIGHWAY AND BRIDGE COMMITTEE

A. The Committee submitted a resolution for Board consideration with reference to award of Contract to the following low bidders on various Road Districts projects:

1. Tobey's Construction and Cartage, Inc. Pilot Road Dist Sect 87-12134-00-BR Non MFT $9,944.00

2. Wilking Trucking, Inc Yellowhead Road Dist. Sect. 89-17000-00-GM Supp #2 $12,468.30

3. Grosso Construction Co. Yellowhead Road District Sec. 89-17124-00-AS $37,723.13

A motion to adopt the resolution was made by Mr. Riegel and seconded by Mr. O'Connor. Motion carried on a roll call vote of 24 ayes, 0 nays and 1 abstained.

B. The Committee submitted a resolution for Board consideration with reference to an ordinance establishing a specified speed zone from E1300S County Highway 2 to E1400S Illinois Street with a proposed speed of 45 miles per hour.

A motion to adopt the resolution was made by Mr. Breault and seconded by Rev. Rucker. Motion carried on a roll call vote of 23 ayes and 4 nays.

C. The Committee submitted a resolution for Board consideration with reference to establishing Prevailing Wage.

A motion to adopt the resolution was made by Mr. Breault and seconded by Mr. Davis. Motion carried on a roll call vote of 26 ayes and 1 nay.

A motion was made by Mr. Martin and seconded by Mr. Jensen to alter the order of the agenda taking item 3A under Finance and Judicial and States Attorney before Item 2A under Salary, Personnel and Automation. motion carried.

3. Finance and Judicial and States Attorney Committee

A. The committee submitted a resolution for Board consideration with reference to establishing the number and salaries of Assistant States Attorney's.

A motion to adopt the resolution was made by Mr. Ryan and seconded by Mr. Graves.

DISCUSSION

Mr. Thompson: We increased the starting salary for the Assistant States Attorney to $18,000 a while back. Has Mr. Herzo advertised for a new assistant at $18,000? Also in reviewing the numbers we have approved $56,000 in proposed increase since November 30, 1989.

Mr. Hendrix: Mr. Herzog advertised and could not find any applicants acceptable at that time.

Mr. Huot: Has the Finance or States Attorney's Committee looked into what the surrounding Counties are paying?

Tom Ryan: To the best of my knowledge Mr. Herzog has been aggressive trying to Vet someone on board. Mr. Ryan submitted the matrix after looking at all the surrounding counties.

Mr. Martin: Mr. Herzog's letter of June 9th asked the First Assistant's salary to be increased to $75,000. This is ridiculous amount, we have a lot of other people walking for a lot less, the Sheriff, etc. I will not vote for anything that includes this schedule because it is way to much money.

Mr. Ryan: The only difference in the proposal now from the original is the starting salary for the Assistant. This should take care of the compensation problem forever if we do it right. This is the best we can do.

Mr. Dailey: I am not going to vote for this until all other employees are given an increase. They have already had one this year.

Mr. Meling: The employees of the County received an increase that was not extended to the Assistant States Attorney's. We have to make this adjustment because it has been behind for a long time.

Mr. Washington: We are currently negotiating with Correctional Officers and holding a tight line. We need to get the bottom end people up before we start raising these salaries.

Mr. Martin: Could we adopt the resolution without making the salary table any part of it? Then send the table back to committee for a more complete and precise program!

Mr. Huot: We have to send the whole thing back, and ask for an explanation of pay grades and pay steps.

Mr. Ryan withdrew his motion, however Mr. Graves did not agree to withdrawing his second.

Mr. Huot then made a motion that both rate schedule and resolution go back to committee for a defined explanation, it was seconded by Mr. Ryan. motion carried.

Finance and Judicial and States Attorney will hold a joint meeting July 14, 1989 at 1 p.m. to discuss this issue.

Mr. Graves feels we should vote on the resolution as it stands. After discussion he decided to withdraw his motion and let it go back to committee to be reviewed. Rev. Rucker: If those of us on this committee do not support the program, how are we going to get it through. The committee did a lot of work on this program. If this Board feels he is abusing his power to increase his people by his evaluation we can call him in.

Ms. Shutter: I was a member of the committee and there were a great number of proposals looked at in committee. I do not, however, feel the document submitted is complete.

Mr. Bretveld: We worked with the States Attorney's in December and February we went over it again. Now in July we are doing it again. I will vote along with sending it back to committee.

Mr. Dailey: In the first place these people are not working for

f a full year. I don't like the implication.

'Mr. Meling: First of all we gave complete approval through prevailing wage for a laborers' salary to be $29,000.

Mr. Hendrix stated that we will finish discussion on this issue on July 14, 1989 at 1 p.m.

A motion was made by Mr. Bretveld and seconded by Mr. Wenzelman that we make any increases retroactive to July 1, 1989. Motion carried.

3. SALARY, PERSONNEL AND AUTOMATION

A. The Committee submitted a resolution for Boards consideration with reference to adopting a Classification & Evaluation Program for employees of Kankakee County.

A motion to adopt the resolution was made by Mr. Martin and seconded by Mr. Stump. Motion was carried on a roll call vote of 27 ayes, 9 nays.

Mr. Meling: The goal was to develop some type of equity across the Board, pay step equity and evaluation program.

Mark Frechette thanked everyone who worked on this program because it gives the elected officials a tool to work from and it is a step forward for Kankakee County.

Dennis Coy concurred with Mr. Frechette's comments.

Mr. Ryan: This is an outstanding program and they work wonderfully. You can document performance, and it makes us more competitive in the private sector. The employees are also able to determine what their future holds.

4. PLANNING AND ZONING COMMITTEE

A. The Committee submitted a resolution for Boards consideration with reference to Zoning Board Case #89-6, James Krause, petitioner. The request was to rezone property from R-Residential to B-Business.

A motion to adopt the resolution was made by Mr. Jensen and seconded by Mr. Washington. Motion carried.

5. ADMINISTRATION COMMITTEE

A. The Committee submitted a resolution for Boards consideration with reference to appointments of alternates to the Zoning Board of Appeals: Dennis Norden, and William Sawyer.

A motion to adopt the resolution was made by Mr. Howery and seconded by Mr. Washington. Motion carried.

OLD BUSINESS

Mr. Huot: Planning & Zoning met to make an amendment to the Regional Pollution Control Facility Ordinance that was passed last month. Mr. Huot asked the clerk to read the amendment. A motion to adopt the Amendment was made by Mr. Thompson and seconded by M':. Bretveld. Motion carried on a roll call vote of 26 ayes, 1 abstained.

NEW BUSINESS

Chairman Mr. Hendrix announced the vacancies in County Board appointed Committees as follows:

A. One vacancy to the Private Industry Council

B. One vacancy to the Kankakee Co-operative Extension Board.

There being no further business, a motion to audit the per diem and adjourn this adjourned meeting of June 13, 1989, to August 8, 1989, at 10 a.m. in County Board Room 109, Courthouse, Kankakee, Illinois was made by Mr. Howery and seconded by Mr. Washington. AN ORDINANCE AND RESOLUTION FOR THE ESTABLISHMENT OF SPECIFIED SPEED ZONES

IT IS HEREBY DECLARED, ORDAINED AND RESOLVED by the County Board of Kankakee County, Illinois that the basic statutory vehicular speed limits established by Section 11-601 of the Illinois Vehicle Code are greater, or less, respectively, than that considered reasonable and proper on the street or highway, respectively, listed in the following Schedule for which Pembroke Township has maintenance responsibility and which is not under the jurisdiction of the Department of Transportation, State of Illinois.

BE IT FURTHER DECLARED, ORDAINED AND RESOLVED that this Board has caused to be made an engineering and traffic investigation upon the respective streets or highways listed in the Schedule; and

BE IT FURTHER DECLARED, ORDAINED AND RESOLVED that, by virtue of Section 11-604 of the above Code and subject to approval by the Department, this Board determines and declares that reasonable and proper absolute maximum speed limits upon those respective streets and highways described in the Schedule shall be as stated therein.

BE IT FURTHER DECLARED, ORDAINED AND RESOLVED that, by virtue of Section 11-604 of the above Code, the Department is hereby requested to review the supporting data and findings of the engineering and traffic investigation submitted and filed in duplicate for each proposed speed zone of each said street or highway described in the Schedule, which is included as a part of this ordinance.

BE IT FURTHER DECLARED, ORDAINED AND RESOLVED that when this Board is advised that the Department has approved the proposed maximum speed limits for the zone or zones of each said street or highway described in the Schedule, signs giving notice thereof shall be erected in conformance with the standards and specifications contained in the Illinois Manual of Uniform Traffic Control Devices for Streets and Highways.

BE IT FURTHER DECLARED, ORDAINED AND RESOLVED that this ordinance shall take effect immediately after the erection of said signs giving notice of the maximum speed limits, at the respective zone or zones on the respective street or highway described in said Schedule, for which approval by said Department shall be given.

aiikakte County, 3JUiiiot WHEREAS, the State of Illinois has enacted "An Act regulating wages of

laborers, mechanics and other workers employed in any public works by the State, county, city or any public body or any political subdivision or by any one under contract for public works," approved June 26, 1941, as amended, being Section 39s-1-12, Chapter 48, Illinois Revised Statutes, 1973, and

WHEREAS, the aforesaid Act requires that the County Board of Kankakee County investigate and ascertain the prevailing rate of wages as defined in said Act for laborers, mechanics and other workers in the locality of said County employed in performing construction of public works, for said County.

NOW THEREFORE, BE IT RESOLVED BY THE COUNTY BOARD OF KANKAKEE COUNTY:

SECTION 1: To the extent and as required by "An Act regulating wages of laborers, mechanics and other workers employed in any public works by State, county, city or any public body or any political subdivision or by any one under contract for public works," approved June 26, 1941, as amended, the general prevailing rate of wages in this locality for laborers, mechanics and other workers engaged in construction of public works coming under the jurisdiction of the County Board is hereby ascertained to be the same as the prevailing rate of wages for construction work in the Kankakee County area as determined by the Department of Labor of the State of Illinois as of June, 1989 a copy of that determination being attached hereto and incorporated herein by reference. The definition of any terms appearing in this Resolution which are also used in aforesaid Act shall be the same as in said Act.

SECTION 2: Nothing herein contained shall be construed to apply said general prevailing rate of wages as herein ascertained to any work or employment except public works construction of the County of Kankakee to the extent required by the aforesaid Act.

SECTION 3: The County Clerk shall publicly post or keep available for inspection by any interested party in the office of the County Clerk this determination of such prevailing rate of wage.

laborers, mechanics and other workers employed in any public works by the State, county, city or any public body or any political subdivision or by any one under contract for public works," approved June 26, 1941, as amended, being Section 39s-1-12, Chapter 48, Illinois Revised Statutes, 1973, and

WHEREAS, the aforesaid Act requires that the County Board of Kankakee County investigate and ascertain the prevailing rate of wages as defined in said Act for laborers, mechanics and other workers in the locality of said County employed in performing construction of public works, for said County.

NOW THEREFORE, BE IT RESOLVED BY THE COUNTY BOARD OF KANKAKEE COUNTY:

SECTION 1: To the extent and as required by "An Act regulating wages of laborers, mechanics and other workers employed in any public works by State, county, city or any public body or any political subdivision or by any one under contract for public works," approved June 26, 1941, as amended, the general prevailing rate of wages in this locality for laborers, mechanics and other workers engaged in construction of public works coming under the jurisdiction of the County Board is hereby ascertained to be the same as the prevailing rate of wages for construction work in the Kankakee County area as determined by the Department of Labor of the State of Illinois as of June, 1989 a copy of that determination being attached hereto and incorporated herein by reference. The definition of any terms appearing in this Resolution which are also used in aforesaid Act shall be the same as in said Act.

SECTION 2: Nothing herein contained shall be construed to apply said general prevailing rate of wages as herein ascertained to any work or employment except public works construction of the County of Kankakee to the extent required by the aforesaid Act.

SECTION 3: The County Clerk shall publicly post or keep available for inspection by any interested party in the office of the County Clerk this determination of such prevailing rate of wage.

WHEREAS, the State's Attorney of Kankakee County, William E.

Herzog, requires Assistant State's Attorneys to conduct the

business of the States Attorney's office, and

WHEREAS, pursuant to the provisions of the Illinois Revised

Statutes, Chapter 53, Section 18, the Kankakee County Board shall

determine the number of such Assistants, and the salaries to be

paid to such Assistants, and,

WHEREAS, for the fiscal year commencing December 1, 1988,

appropriations have been made from the General Fund of Kankakee

County, for the payment of Assistant State's Attorney salaries,

NOW, THEREFORE, BE IT RESOLVED, that the State's Attorney of

said Kankakee County be, and he is hereby authorized and

empowered to appoint nine (9) full time Assistant State's

Attorneys, and

BE IT FURTHER RESOLVED, that the salaries of the following

names Assistant State's Attorneys be, and hereby fixed at the

respective annual amounts herein set forth, and pro-rated monthly

commencing July 1, 1989 and ending November 30, 1989, for such

WHEREAS, an application for an amendment pursuant to the terms of the Kankakee County Zoning Ordinance has been filed by James Kraus in the office of the County Clerk of Kankakee County to rezone property from R, Residential, to B, Business, to locate a 17 foot by 24 foot block building with wood shingle roof and four satellite dishes to house and provide subsequent transmission of cable television service to the City of Monience and the surrounding unincorporated areas; and

WHEREAS, the Zoninq Board of Appeals has caused a public hearing after due notice to be held on said application; and

-. - WHEREAS, all matters required by law of the State

of Illinois and the Zoning Ordinance of Kankakee County to be done, have been done; and

WHEREAS, the Zoning Board of Appeals has made findings and recommended based upon those findings that said amendment be granted as requested in said application and the Planning and Zoning Committee has concurred in said recommendation; and

WHEREAS, it is in the best interest of the public and consistent with the public health, safety, economic and -general welfare, that said amendment be granted as requested.

NOW THEREFORE, be it and it is hereby ordained by the County Board of the County of Kankakee and State of Illinois as follows:

SECTION I

That the Kankakee County Zoning Ordinance is hereby amended by reclassifying from R to B, the property described in Attachment A, in the County of Kankakee, Illinois.

SECTION II

That the Zoning District Map of the County of Kankakee, Illinois, being apart of said Ordinance, shall forthwith be altered and changed to conform to this amendment.

SECTION III

That this Resolution amending the Zoning Ordinance and Map of Kankakee County, Illinois, shall be in full force and. effect upon its passage.

PASSED and adopted this day of 1988.

RE: Amendment to Regional Pollution Control Facility Resolution

WHEREAS, the Kankakee County Board adopted a resolution

entitled "Regional Pollution Control Facilities" on June 13,

1989; and,

WHEREAS, the Planning & Zoning Committee of the Kankakee

County Board met and discussed a proposed amendment to said

resolution.

NOW, THEREFORE, BE IT AND IT IS HEREBY RESOLVED that the

Planning and Zoning Committee, upon review of the fee

structure of the Regional Pollution Control Facility

Resolution, recommends the following modification to

Paragraph H.2. of Section 2. The amended paragraph shall

read, as follows:

The Planning and Zoning Committee may recommend that the County Board reduce the application fee upon petition by the applicant setting forth the reasons why a reduction or modification in fee structure is warranted. The Planning and Zoning Committee or LUSC must make a finding that the reduced or modified fee structure will not jeopardize the ability of the County to conduct a complete and impartial public hearing. The applicant will be responsible for any costs above the reduced fee. The County Board shall make the final decision as to any fee reduction or modification.
