the Constitution of India, the Governor, Himachal Pradesh, is pleased to make the Recruitment &

Promotion Rules for the post of Peon, Class-IV(Non-Gazetted)in the Department of Social Justice

and Empowerment, Himachal Pradesh as per Annexure-A attached to this notification, namely:-

1. Short title and Commencement.— (1) These Rules may be called the Himachal

Pradesh, Social Justice & Empowerment Department, Peon,Class- IV-(Non-Gazetted), Recruitment

and Promotion, rules, 2007

(2) These Rules shall come into force from the date of publication in the Rajpatra,

Himachal Pradesh.

2. Repeal & Savings.— (1) The Himachal Pradesh Social & Women’s Welfare

Department, Peon,(Class-IV-Non-Gazetted)Recruitment and Promotion rules, 1998 notified vide

this Department notification No. WLF-A(4)-9/95 dated 20.5.1998 as amended from time to time

are hereby repealed.

(2) Notwithstanding such repeal any appointment made or any thing done or any action

taken under the rules, so repealed under sub-rule(1) supra shall be deemed to have been validly

made or done or taken under these rules.

RECRUITMENT AND PROMOTION RULES FOR THE POST OF PEON

(NONGAZETTED) CLASS-IV IN THE DEPARTMENT OF SOCIAL JUSTICE &

EMPOWERMENT, HIMACHAL PRADESH.

1. Name of the Post : Peon

2. Number of posts : 153 (One hundered fifty three)

3. Classification : CLASS-IV (NON-GAZETTED)

4. Scale of pay (be given in : 2520-100-3220-110-3660-120-4140 (with a

expanded notation) start of Rs. 2620/-)

5. Whether Selection or Non- : N.A

Selection post

6. Age for direct recruitment : Between 18 and 45 years

Provided that the upper age limit for direct recruits will not be applicable to the candidates

already in service of the Government including these who have been appointed on adhoc or on

contract basis;

Provided further that if a candidate appointed on adhoc basis had become overage on the

date when he was appointed as such he shall not be eligible for any relaxation in the prescribed age

limit by virtue of his such adhoc or contract appointment;

Provided further that upper age limit is relaxable for Scheduled Castes/ Scheduled Tribes/

Other categories of persons to the extent permissible under the general or special order(s) of the

Himachal Pradesh Government;

Provided further that the employees of all the Public Sector Corporation and Autonomous

Bodies who happened to be Government servants before absorption in Public Sector

Corporations/Autonomous Bodies at the time of initial constitutions of such Corporations/

Autonomous Bodies shall be allowed age concession in direct recruitment as admissible to

Government servants. This concession will not, however, be admissible to such staff of the public

sector Corporations/ Autonomous Bodies who were/ are subsequently appointed by such

the post(s) is / are advertised for inviting applications or notified to the Employment

Exchanges or as the case may be.

(ii) Age and experience in the case of direct recruitment relaxable at the discretion of the

recruiting authority in case the candidate is otherwise well qualified.

7. Minimum Educational and other qualifications required for direct recruits :

(a) ESSENTIAL : Should be middle pass or its equivalent from recognised Board of

School Education/ Institution.

(b) DESIRABLE QUALIFICATIONS : Knowledge of customs, manner and dialects of

Himachal Pradesh and suitability for appointment in the peculiar conditions prevailing

in the Pradesh.

14. Essential requirement for direct recruitment : A candidate for appointment to any post

must be a citizen of India.

15. Selection for appointment to post by direct recruitment : Selection for appointment to

the post in the case of direct recruitment shall made on the basis of viva-voce test and if recruiting

authority as the case may be, so consider necessary or expedient by a written test or practical test,

the standard syllabus etc. of which, will be determined by the recruiting authority as the case may

be.

15 A Selection for appointment to the post by contract appointment :

(I) CONCEPT : (a) Under this policy, the appointee will be engaged on contract basis

initially for one year which may be extendable on year to year basis depending upon

their performance and work and conduct on the job. However their services may be

terminated even prior to the completion of one year period, on issuance of one month

notice or payment in lieu of the notice of one month, if available work load or their

performance does not merit their retention.

(b) The Director after obtaining the approval of the Govt. to fill up the vacant posts on

contract basis will advertise the details of vacant posts in advertise the details of

vacant posts in two leading news papers and invite applications from candidates

having prescribed qualifications and fulfillingthe other eligibility conditions as

prescribed in these rules.

(c) The selection will be made in accordance with the eligibility conditions prescribed in

these R&P Rules.

(d) Contractual employee so selected under these rules will not have any right to claim

regularization or permanent absorption in the Govt. Job.

(e) The age and qualification for the contract appointment will be as per the provisions

contained in Col.No.6 & 7 of the R & P Rules.

(II) EMOLUMENTS : The employee appointed on contract basis will be paid

consolidated contractual amount of Rs. 3930/- P.M. He will be entitled for annual increment in

contractual amount @ Rs.100/- per annum for second and third years if contract is extended beyond

one year.

(III) APPOINTING /DISCIPLINARY AUTHORITY : Director of Social Justice &

Empowerment will be appointing and disciplinary authority.

(IV) SELECTION PROCESS : The Director of Social Justice & Empowerment after

obtaining the approval of the Government to fill up the vacant post on contract basis will advertise

the details of the vacant posts in two leading Newspaper and invite the application of the eligible

candidates having qualifications and other eligibility conditions as prescribed in these Rules for this

category.

(V) COMMITTEE FOR SELECTION OF CONTRACTUAL EMPLOYEE : The

selection will be made by the Director of Social Justice & Empowerment after the approval of

selection committee as may be constituted by competent authority from time to time. The selection

will be made by conducting a written test and viva voce test of the candidates. The candidates who

will obtain 50% marks will be declared successful in written test and shall be called for viva voce

test. The selection will be on the basis of merit which will be determined on the basis of marks

obtained in written test and viva voce test. The bifurcation of marks of written test and viva voce is

as under:-

Written Test : 75 marks

Educational Qualification : 10 marks

(VI) AGREEMENT : After selection of a candidate he has to Sign an agreement as

prescribed by the Government .

(VII) TERMS AND CONDITIONS : (a)The employee appointed on contract basis will be

paid contractual amount of Rs. 3930/- P.M. with annual increase of Rs. 100/- if

contract is extended for second and third years.

(b) The service of the Contractual employee will be purely on temporary basis. The

appointment is liable to be terminated in case the performance/conduct of the contract

appointee is not found good.

(c) Contract appointment shall not confer any right to the incumbent for regularisation in

service at any stage.

(d) Contractual employee will be entitled for one day casual leave after putting one month

service. This leave will be accumulated upto one year. No. leave of any other kind is

admissible to the contractual employee. He will not be entitled for Medical

Reimbursement and LTC etc. Only maternity leave will be given as per Rules.

(e) Unauthorized absence from the office without the approval of the competent authority

shall automatically lead to the termination of the contract. Contractual employee will

not be entitled for any emoluments for the period of absence from duty.

(f) Transfer of the employee appointed on contract basis shall not be permitted in any

case.

(g) Selected candidate will have to submit a certificate of his/her fitness from a

Government/ Registered Medical Practitioner. In case of women candidates pregnancy

beyond twelve weeks will render her temporarilly unfit till the confinement is over.

The women candidate should be re-examined for fitness from an authorized medical

officer/ practitioner before joining.

(h) Contract employee shall be entitled to TA/ DA if required to go on tour in connection

with his official duties at the same rate as applicable to regular employee.

(VIII) RIGHT TO CLAIM REGULAR APPOINTMENT : The candidate engaged on

contract basis under these rules shall have no right to claim regularization/ permanent absorption in

any department of the Government at any stage.

16. Reservation : The appointment to the service shall be subject to orders regarding

reservation in the service for scheduled castes/Sch. Tribes/Other Backward Classes/ Other

categories of persons issued by the Himachal Pradesh Government from time to time.

17. Powers to Relax : Where the State Government. is of the opinion that it is necessary or

expedient to do so, it may, by order for reasons to be recorded in writing and in consultation with

the relax any of the provisions of these Rules with respect to any class or category of persons or

posts.

Annexure-‘A’

Conditions for regulating working of katha Bhatties & Katha Bhatties using IBR boilers

1. The number of traditional katha bhatties allowed to operate in H.P. shall be 40 as were

operating during 2006-07.

2. The number of katha units using boilers will be restricted to 39, which was the number

of units allowed to install baby boilers upto 31.3.2007.

3. The traditional katha bhatties will be allowed to operate at their current level of

consumption of khairwood.

4. If any traditional katha bhatti unit is found to be storing or in possession of quantity of

khair wood in excess of permissible limits, its license and permit will be cancelled without any

prejudice.

5. The baby boiler units shall upgrade their existing boilers to IBR boilers and be

brought under the purview of Indian Boiler Act, 1923 and rules made there under from time to

time. All the boilers will have to be registered with the Chief Inspector of Boilers of the State.

6. The use of term ‘baby boilers ‘ will be replaced by the term ‘IBR boilers.’

7. The modified system of katha extraction through IBR Boilers will continue to remain

seasonal. Katha will be extracted during the winter months from 1st November to 31st March only,

as is being done through the traditional Bhatti system.

8. On the basis of the production of Khairwood in the State, maximum quantity of khair

heart wood allowed to be used by boiler units will be 3750 qtls.= 5435 qtls khairwood with bark

(2534 M.G or say 2500 MG) of khair in the season. If at any time the quantity of khair heartwood

or equivalent khair wood with bark is found to be more than the permissible limit applicable at the

time of inspection, its registration will be cancelled.

9. 3 autoclaves each of maximum capacity of 3000 liters volume, will be allowed to be

installed by katha bhatties using boilers.

capacity of 40 M.T. of katha extract at a time.

12. The katha units using boilers shall be allowed installation of 2 cooling chambers fitted

with Air Conditioning system not exceeding 5 tons each.

13. The boiler operated units will be allowed to install manual cutch separator to sqeeze

out cutch. The period for extraction and drying of cutch shall extend from 1st April to 15th April.

However, no katha manufacturing will be allowed during this period.

14. There will be no commitment from the Forest Department for providing raw material

to be used for manufacture of katha by installation of boiler units.

Department, and if permission under any Act/Rules from other Department(s) is required, the same

will be the responsibility of the Bhattiwallas concerned.

16. The units will be registered by the DFO concerned as a ‘Depot’ under the provisions

of H.P. Sale of Timber Act, 1968 and Sale of Timber Rules,1969 for one year(on year to year

basis).

17. The units will also be allowed to use knife cutter to cut manufactured katha slabs into

small package able and marketable blocks.

18. All other conditions presently governing the establishment and operation of katha

Bhatties will remain unchanged.

No. FFE-B-F(7)-1/2000.— Whereas the draft amendment rules titled as the Himachal

Pradesh Forest (Sale of Timber) Rules, 2008 were published in the Rajpatra, Himachal Pradesh

(Extra Ordinary) on 4.1.2008 vide notification of even number dated 31.12.2007 in pursuance of

the provisions of Section 3 of the Himachal Pradesh Forest (Sale of Timber) Act,1968 for inviting

objections and suggestions from persons likely to be effected thereby as required under Section

3(3) of aforesaid Act, within a period of 30 days from the date of publication;

And, whereas no objection/suggestion has been received from the general public on the said

draft rules in the specified period.

Now, therefore, in exercise of the powers conferred by section 3 of the Himachal Pradesh

Forest (Sale of Timber) Act, 1968, the Governor of Himachal Pradesh is pleased to make the

following rules, namely :-

1. Short title, application and Commencement.— (1) These rules may be called the

Himachal Pradesh Forest (Sale of Timber) Amendment Rules,2008.

(2) They shall extend to the whole of Himachal Pradesh.

(3) They shall come in force from the date of publication in the Rajpatra, Himachal

Pradesh.

2. Amendment of rule 2.— In rule 2 of the Himachal Pradesh Forest (Sale of Timber)

Rules,1969 (hereinafter referred to as the said rules) after clause (ii), the following shall be added,

namely :-

“Explanation: Katha Bhatti and Katha Bhatti using IBR boiler which process

khairwood for the manufacture of katha and allied products shall be deemed to be a

depot.”

3. Amendment of rule 4.— After rule 4 of the ‘said rules’ the following shall be added,

namely :-

“The Operation of the Katha Bhatties and Katha Bhatties using IBR boilers shall be

regulated as per conditions enumerated in Annexure-A appended to these rules.”

4. Amendment of rule 9.— In the rule 9 of the said rules, after Form (ii), the following

form (iii) shall be added, namely :-

“(iii) Register of consumption of Khair-wood and katha prepared by katha bhatties

and katha bhatties using IBR boilers:-

I. Consumption of Khairwood

1. Date

2. Quantity of Khair-wood consumed.

II. End Product i.e. katha Prepared

1. Date

2. Quantity of Khair and kutch obtained.”

5. Substitution of rule 11.— For rule 11 of the said rules, the following shall be

substituted, namely :-

“No timber or processed timber (Katha etc.) shall be removed from any registered

depot until it has been marked with the registered sale hammer of the owner of the

registered depot.”

Annexure-‘A’

Conditions for regulating working of katha Bhatties & Katha Bhatties using IBR boilers

1. The number of traditional katha bhatties allowed to operate in H.P. shall be 40 as were

operating during 2006-07.

2. The number of katha units using boilers will be restricted to 39, which was the number

of units allowed to install baby boilers upto 31.3.2007.

3. The traditional katha bhatties will be allowed to operate at their current level of

consumption of khairwood.

khair wood in excess of permissible limits, its license and permit will be cancelled without any

prejudice.

5. The baby boiler units shall upgrade their existing boilers to IBR boilers and be

brought under the purview of Indian Boiler Act, 1923 and rules made there under from time to

time. All the boilers will have to be registered with the Chief Inspector of Boilers of the State.

6. The use of term ‘baby boilers ‘ will be replaced by the term ‘IBR boilers.’

7. The modified system of katha extraction through IBR Boilers will continue to remain

seasonal. Katha will be extracted during the winter months from 1st November to 31st March only,

as is being done through the traditional Bhatti system.

8. On the basis of the production of Khairwood in the State, maximum quantity of khair

heart wood allowed to be used by boiler units will be 3750 qtls.= 5435 qtls khairwood with bark

(2534 M.G or say 2500 MG) of khair in the season. If at any time the quantity of khair heartwood

or equivalent khair wood with bark is found to be more than the permissible limit applicable at the

time of inspection, its registration will be cancelled.

9. 3 autoclaves each of maximum capacity of 3000 liters volume, will be allowed to be

installed by katha bhatties using boilers.

Horticulture and Forestry, Solan, Statutes, 1987 (Forty First amendment, 2008).

(2) It shall come into force with immediate effect.

(3) The following amendment shall be made in Statute 9.27.

Amendment of Statute 9.27: The existing provision of Statute 9.27 shall stand substituted

by the following provision:

Rules for Pension-cum-Gratuity-cum-GPF in case of University employees covered under

this scheme shall be the same as adopted by the Himachal Pradesh Government, for its own

employees from time to time.
