Finance Minister NirmalaSitharaman on Monday said thedirect tax dispute resolutionscheme announced in the Budgetwould be of great help to people asit would save time and moneyspent in fighting cases.

As many as 483,000 direct taxcases worth ~9.32 trillion arelocked in various appellate forumssuch as Commissioner of IncomeTax (Appeals), Income TaxAppellate Tribunal, High Courts,Supreme Court, and DebtRecovery Tribunals.

“The scheme will give settle-ment option to all those with dis-puted tax... This will be of greathelp because people spent a lot oftime and money in settling cas-es,” Sitharaman said while mov-ing the Direct Tax Vivaad seVishwas Bill, 2020 amid a din inthe Lok Sabha.

She said the governmenthad taken measures to reducelitigation and a similar schemewas announced for indirect tax disputes.

Under the proposed scheme,taxpayers willing to settle dis-putes shall be allowed a com-plete waiver of interest andpenalty if they pay the entireamount of tax in dispute by

March 31 this year, followingwhich a 10 per cent additionaldisputed tax shall have to be paidover and above the tax liability.

Further, where arrears relateto disputed interest or penaltyonly, then 25 per cent of disputedpenalty or interest shall have tobe paid if the payment is made byMarch 31, beyond which the sameshall be enhanced to 30 per cent.

States spent 14 per cent less capital between2015 and 2018 than they had budgeted tomeet fiscal deficit targets, said a report.

“Given the increasingly higher shareof states in capital outlay of the country,it is important to note that cutback incapital outlay by states has been morethan other components of their Budget.As the actual receipts havebeen significantly lower (9per cent on average duringthe 2015-18 period), the stateshave had to cut their expen-diture in order to meet fiscaldeficit targets,” a study byDelhi-based PRS LegislativeResearch noted.

“During this period, com-mitted expenditure itemscomprising salaries, pensions,and interest payments haveformed 53 per cent of the rev-enue expenditure. These areexpenditure obligations which are diffi-cult to reduce during the year. As revenueexpenditure is less compressible, a dis-proportionate cutback is observed in cap-ital outlay,” the study added.

During the 2015-20 period, four stateshave, on average, spent more on capitaloutlay than they budgeted — Odisha (8per cent), Haryana (6 per cent),Himachal Pradesh (5 per cent) andKarnataka (2 per cent). States which end-

ed up spending significantly less thanwhat they budgeted include Jammu &Kashmir (51 per cent), Assam (51 percent) and Goa (50 per cent).

Capital outlay is the component ofthe government's expenditure whichleads to creation of assets, such as roadsand bridges, schools, and hospitals.

During the 2010-20 period, on aver-age, have spent higher on capital outlayas compared to the Centre. For instance,

in 2019-20, capital outlay ofstates and the Centre are esti-mated to be 2.8 per cent ofgross domestic product, orGDP (~5.7 trillion), and 1.8 percent of GDP (~3.8 trillion),respectively.

The size of the expendi-ture budget of states hasincreased over the yearsowing to revenue augmenta-tion by the states as well asincreased devolution fromthe Centre.

“The gap between a gov-ernment's expenditure and receipts isfunded through borrowings, which issubject to limits under the FRBM (FiscalResponsibility & Budget Management)framework. States have managed to keeprevenue deficit under control (0.1 per cent during the 2015-18 period)unlike the Centre (2.4 per cent duringthe same period). Consequently, stateshave had more funds for capital outlay,”the report said.

The spreads between corporate bonds andequivalent maturity

government bonds have comedown substantially. Althoughthis gives an impression thatthe bond market is welcomingback corporates, experts say itwould be a wrong conclusionto draw.

The spread between the 10-year AAA-rated corporateand equivalent maturity government bonds have fallento 108 basis points, from about140 basis points in October endlast year.

The drop is even sharper forthe five-year segment wherethe spread has contracted to 64basis points, from about 110basis points at the end ofOctober.

This may give an impressionthat the rate transmission theReserve Bank of India (RBI)hoped for may have happenedin the corporate bond segment,too. That would also mean thatIndian companies can raisebonds at a cheaper rate fromthe market.

But issuances in corporatebonds are actually falling,largely because non-bankingfinancial companies (NBFC)are staying away from issuingfresh papers.

This is creating its owndemand for every new

issuance. And that may explainwhy corporate bond yields arealso falling.

As prices of bonds rise, theyields fall and vice versa.

“Compression in spreadbetween G-Sec and corporatebond is largely to do withfavourable demand-supplydynamics and improvement inthe interest rate outlook.However, in the case of risk pre-mium or market liquidity, theyhaven’t improved consider-ably,” said Soumyajit Niyogi,associate director at IndiaRatings and Research.

At 6.80 per cent for a five-year maturity AAA-rated paper,Indian corporate bonds stilloffer one of the highest returnsfor a foreign investor. In caseof public sector enterprises, theyield is about 15-basis pointslower. Still, those are attractiveyields for almost risk-freereturns.

But foreigners are not majorinvestors in these markets,even as the government hasopened up more space for themin the Budget.

Mutual funds, by far, are thelargest buyers of corporate

bonds. But they are not asactive as before after the IL&FScrisis where AAA-rated bondsgot downgraded to junk in amatter of few weeks.

The lack of supply alsomakes the new issuances in thetop-rated category costlier forinvestors.

The government bondyields have also fallen after theliquidity infusion exercise bythe RBI.

For example, the 10-yeargovernment bond yields havefallen from 6.80 per cent at theend of December to 6.35 percent.

Similarly, corporate bondyields have also fallen as gen-eral liquidity improved. The 10-year AAA-rated corporate bondyield, in the same period, hasfallen from 7.86 per cent to 7.43per cent.

But both yields need notmove together, said BadrishKulhalli, head of fixed incomeat HDFC Life Insurance.

“Both the yields don’t nec-essarily move in tandem. Highspreads are often not an indi-cation of dislocation, but it’sjust normal leads and lags,”said Kulhalli.

Bond spreads shrink but no cheer

The Reserve Bank of India (RBI) onMonday said it has received ~1.71 trillionin the third long-term repo operation(LTRO) conducted for an amount of~25,000 crore.

The central bank received 66 bids inthe three-year tenor LTRO, which hasreversal date on March 1, 2023.

“The total bids that were receivedamounted to ~171,965 crore, implying abid to cover ratio (i e., the amount of bidsreceived relative to the notified amount)of 6.9,” the RBI said in a release.

As against this, the RBI allotted anamount of ~25,028 crore, with a pro-rataallotment percentage to 14.54 per cent.

The RBI will conduct another LTRO

for three-year tenor worth ~25,000 croreon March 9.

It has already conducted two LTROsfor ~25,000 crore each on February 17 andFebruary 24. In the February 17 LTRO forthree-year tenor, it received bids amount-ing to ~1.944 trillion.

In the second LTRO for one-year tenorconducted on February 24, the RBI got 52bids amounting to ~1.23 trillion.

In last month’s bi-monthly policyreview, the RBI had announced termrepurchase agreements (repos) of one-year and three-year tenors for a totalamount of ~1 trillion at the policy reporate, from the fortnight beginningFebruary 15.

LTROs are aimed at helping banks toreduce their lending rates, thereby quick-ening the monetary policy transmission.
