Rohit Solanki for grant of anticipatory bail. It is submitted that applicant

is absolutely innocent and has not committed any offence as alleged

in the FIR. It is submitted that applicant is neither the owner nor

employee of the alleged firm; his name cropped up in the FIR merely

on the basis of disclosure statement of co-accused persons and all

other co-accused persons have already been released on bail. It is

submitted that applicant undertakes to abide by any term or condition

imposed by this court while granting him anticipatory bail.

Ld. Addl. PP has vehemently opposed the bail

application arguing that applicant/accused is a part of criminal

syndicate involved in cheating gullible citizens impersonating

themselves as Google, Amazon and Apple representatives. It is

submitted that applicant/accused was active in whatsapp group

“ Money heist Janak Puri” and in other whatsapp groups, namely,

Sethi Ji Milk Zone, Kapil Group, Kashif Cables and Wire, Vishesh

Calls etc wherein crucial information were provided to the group

members i.e. the IOS call details. It is submitted that on analysis of

whatsapp chats with other accused persons, it has been revealed that

the other accused persons were providing Bitcoin details and gift card

details to the applicant/accused and he was giving directions to them.

It is submitted that applicant/accused is one of the main accused

persons who were operating and running the call centre; he is the

direct beneficiary so the trail of money is to be required to be

established; transactions in Bitcoin and gift cards were being done

and it is to be recovered and identified through applicant/accused

Rohit Solanki and laptop and mobile phones and other electronic

instruments are yet to be recovered for which custodial interrogation

of applicant/accused is very much required. Hence, his bail

application deserves to be dismissed.

The modus operandi of the alleged offence suggests

meticulous planning and deft execution. From the whatsapp chats

seized by the IO, the applicant/accused appears to be the main

kingpin behind the alleged call centre. In my considered opinion,

sustained custodial interrogation of applicant/accused seems

desirable for establishing the money trail and for unearthing the entire

conspiracy. The application is accordingly found to be bereft of any

merits and the same is accordingly dismissed.

Application is accordingly disposed off.

applicant/accused is a young boy of 21 years of age and is permanent

resident of Uttar Pradesh pursuing D. Pharma. It is submitted that the

applicant/accused has nothing to do with the alleged offence and he is

languishing in j.c since 31.05.2021. It is submitted that in order to earn

his livelihood, the applicant/accused was doing part time job in the shop

of co-accused and was not aware of any ill motives of his owner. It is

submitted that investigation qua the applicant/accused is already

complete and no fruitful purpose would be served by keeping him behind

the bars. It is submitted that main accused Dilip Kumar has already been

enlarged on bail vide order dated 01.07.2021. It is thus prayed that on

the grounds of parity, he may also be released on bail.

Ld. Addl. PP has vehemently opposed the bail application

arguing that the complainant in the instant matter got the number

9580712752 from social media who was providing life saving injections

for covid patients; he contacted on the said number who demanded

Rs.40,200/- which was deposited by the complainant in an account of

South Indian Bank but the complainant was neither provided with

injection nor his money was refunded back to him. It is submitted that

during investigation, the CAF and CDR of said mobile number was found

to be registered in the name of Sushil with mobile number 6306763579

used for customer signature and sim was purchased from Ramu

Telecom, Mobile number 8009859555 and the said mobile numbers

were found to be registered in the name of Pankaj Kumar and Rahul but

photographs in all three CAF were found to be same. It is submitted that

accused/applicant Vijay Kumar was arrested alongwith co-accused Dilip

and Kamal Kumar were arrested and eight mobile phones, one laptop,

five sim cards, one rubber stamp were recovered from their possession.

It is submitted that accused Dilip is the mastermind who runs a mobile

shop in Bhagwant Nagar, Uttar Pradesh; he used to forge the

documents/Aadhar cards of the customers for registration of alleged

mobile numbers and used the photograph of present applicant/accused

Vijay Kumar who works for accused Dilip. It is submitted that

applicant/accused has full knowledge about the forgery and got issued

the alleged sim cards and its alternate numbers by giving his consent. It

is submitted that investigation in the present case is at initial stage and if

applicant/accused is released on bail, he may hamper the fair course of

investigation.

Addl. PP for State fairly concedes that the

applicant/accused has no role in the alleged offence of cheating under

investigation in the present case. He further submits that the alleged

forgery/cheating in procuring the sim cards upon the strength of forged

and fabricated documents is an independent, distinct and separate

offence for which police is required to initiate appropriate action

seperately.

Considering the fact that the applicant/accused is admitted

to be not involved in the offence of cheating under investigation and the

co-accused has already been granted bail, applicant/accused Vijay

Kumar is admitted to bail on his furnishing bail bond in the sum of

Rs.20,000/- with two sureties each in the like amount to the satisfaction

of Ld. MM/Link MM/Duty MM.

Application is disposed off accordingly.

Needless to say that nothing observed herein shall

tantamount to an expression upon the merits of the case.

wanted in many cases. It is submitted that recovery has been planted

upon him as nothing incriminating has come on record to connect the

applicant/accused with the alleged offence. It is submitted that

investigation qua the applicant/accused is already complete and no

fruitful purpose would be served by keeping him behind the bars.

Ld. Addl. PP has vehemently opposed the bail

application arguing that applicant/accused is an active member of

Jitender @ Gogi gang; he is a habitual offender as he is previously

found to be involved in six other criminal cases and one semi

automatic pistol has been recovered from his possession. It is

submitted that if applicant is released on bail, there are chances of his

jumping the bail and he may indulge in similar activities.

It is reported by the Ld. defence counsel that the

applicant/accused has already been acquitted in three cases and he

is already on bail in remaining three cases. Perusal of the record

reveals that after 2018, the applicant/accused is not reported to be

involved in any other criminal case. Considering the period of

incarceration, the factum of recovery of the case property coupled with

the fact that all the material witnesses are police officials and the

applicant/accused is not likely to influence the course of trial, the

applicant/accused Pankaj is ordered to be released on bail on his

furnishing bail bond in the sum of Rs.50,000/- with two sureties each

in the like amount to the satisfaction of the Ld. MM/Duty MM/Link MM.

Therefore, this is not a case where the present accused had

fallen into the trap of the main conspirator and only provided account for

receiving payment. This seems to be a case where the accused is working as

on front, since there might have been an intention to create an illusion of

conversation with party and receipt of payment by another person to

prevent detection/make the investigation of the crime more difficult.

In these circumstances, the role of the accused seems to be of

co-conspirator and not of a victim.

Therefore, bail application is dismissed.

Vide order No.9871-9900/Bail & Filing/Judl./Prin.D&SJ/NDD/2021 dated30.04.2021, the undersigned has been deputed for duty today to hear and dispose of freshbail/urgent criminal applications and pending bail applications pertaining to New DelhiDistrict Sessions Division through video-conferencing mode in accordance with law.

This application u/s 438 Cr.P.C. for grant of anticipatory bail, moved on behalfof the applicants namely Parveen Kumar Soneja, Kiran Soneja and Karan Soneja, is pending.

On the last date of hearing i.e. 04.06.2021 on the submissions of Ld. Counsel for the

complainant that substantial jewellery articles worth more than Rs.3 crore and the articles given by

the applicants’ side to the complainant, have not been returned and that no locker of the applicants

has been searched. IO was directed to further thoroughly investigate the matter qua the disputed

questions of facts w.r.t the istridhan articles allegedly not recovered and the alleged threat received

by the complainant but in spite of passing of more than one month from the date of the said order,

no further investigation report on the said aspect has been filed by the IO.

From the submissions of Ld. Counsel for the complainant, it appears that the

complainant has strong grievances qua the conduct of the investigating agency for not investigating

the matter fairly and speedily. In view of the same and in view of the fact that the IO has not filed

the further status report in spite of passing of more than one month since the last aforesaid order, I

am of the considered opinion that the matter requires the personal indulgence of the Commissioner

of Police. Hence, copy of this order as well as copy of the previous order dated 04.06.2021 be sent

to the Commissioner of Police for ensuring that the fair and speedy investigation is carried out and

status report in terms of previous order is positively filed before the NDOH. In case the same is

filed, e-copies thereof be supplied to the Ld. Counsels for both sides.

Interim order to continue till NDOH. Dasti to all concerned.

Re-notify on 04.08.2021.

similar application before the Dwarka Court and was informed that the jurisdiction of the present

matter lies in this Court but later on it was got clarified from the said court that the jurisdiction of

this matter pertaining to CAW Cell, South West District, lies with the Dwarka Court only. He has

accordingly requested that the present application may be dismissed as withdrawn with liberty to

pursue the other application filed before the Dwarka Court. Ordered accordingly.
