Heard the learned counsel represented for the applicant. This is an

application for the grant of fresh regular permit in respect of stage carriage

KL-18-H-7189 on the route Valiyazheeckal Temple – Kayamkulam

Railway Station via Sivan Temple, Perumpally, ONK Junction KSRTC

Junction and Private Bus Stand for 5 years. KSRTC had strongly objected

that overlapping from ONK Jn to KSRTC Jn, Kayamkulam is .700 km as per

the version of PWD authorities. Hence a specific report regarding the

distance between ONK Jn to KSRTC Jn, Kayamkulam should be obtained

from the PWD authorities. Permit frequency of service by STU and other

stage carriages should also be ascertained through field officer to prove the

necessity of the fresh permit on this route. Hence adjourned.

Cherthala – Aroormukkam via Nagamkulangara- Vayalar – Manorama Jn –

Muttam church – Thekke angadi –Cherthala Pvt Bus Stand. Proposed

variation by curtailment of a portion and extension of route will affect the

present set of timings and also changes the termini and starting place. This

should be considered as a fresh permit on the basis of existing route. There

is curtailment of a certain portion of the route and extension of 7 kms.

Permit frequency of stage carriage services both (STU and private stage

carriage service) on the curtailed portion and extended portion should be

ascertained through field officer. Hence adjourned.

AC-117 on the route Valiyazheekkal Temple - Kayamkulam via

Valiyazheekkal HSS, Siva Temple, Perumpally, ONK Jn – ksrtc Jn as

Thrikunnapuzha Temple - Kayamkulam via Perumpally, KSRTC. Strong

objection raised by STU, as per their version there is adequate service on the

proposed extended portion of the route and it will result in unnecessary

clash with other services. Hence the up to date frequency of service on the

proposed extended portion is to be ascertained by field officer. Hence

application for variation of regular permit in respect of stage carriage KL-05-

P-7317 on the route Eara- Ayiramthengu via Kurichy – Chethipuzha –

Changanassery – Kavumbhagam – Mannar - Mavelikkara and Oachira as

Kottayam - Ayiramthengu by curtailing the portion from Kurichy to Eara

and extending the route from Kurichy to Kottayam. So many representations

received from Lourdes Matha Church Kottayam, Devi Vilasam N.S.S.

Karayogam Neelamperoor, New India Church of God, Vazhappally Grama

Panchayath, Kurichy Grama Panchayath and public objecting the

curtailment of the portion from Kurichy to Eara. Because there is no other

stage carriage service on this portion. KSRTC strongly objected in

connection with the violation of scheme in the notification No.G.O.(P)

8/2017/Trans dated 23.03.2017 and Notification No. G.O.(P)

42/2009/Trans dated 14.07.2009.

Frequency of service on the curtailed portion and extended portion

should be ascertained by the field officer. Hence adjourned.

Heard the learned counsel represented the applicant and other

operators including KSRTC. Perused the judgement of Hon’ble STAT in

MVAA No. 246/2018 dated 03.09.2019. This is an application for renewal of

permit in respect of stage carriage KL-31-A-23 on the route Keericadu Jetty

- Adoor via Paravoor mukku, Pullukulangara, Pulimukku, ONK Jn, KSRTC

Jn, Muncipal Jn, Kuttitheruvu, Kattanam, Charumoodu, Nooranadu,

Bhavadasan mukku DB, Pazhakulam, High school Jn, Adoor old Pvt stand

for a further period of 5 years w.e.f. 03.05.2018. The application was

rejected by RTA Alappuzha, since the route overlaps the notified scheme

more than 5% of the total route length. The permit holder preferred an

appeal petition before Hon’ble STAT and Hon’ble STAT in its order in MVAA

No.246/2018, granted an opportunity to the permit holder to submit a

modified proposal for avoiding objectionable portion of overlapping and

directed this authority to consider the modified application and pass orders

in accordance with law.

Considered the modified application on merits. Since a modified

application is filed by the permit holder, the application is considered as

fresh. This is an inter district route having a route length of 28 kms. The

proposed modified route overlaps the notified route for

a) 26 Kms form Kayamkulam to Adoor HS and 500 meters from

Parthasarathy Temple road Junction to Adoor Central Junction

(Kayamkulam – Punalur and Kayamkulam – Kulathupuzha scheme)

b) 400 meters from Kayamkulam Private bus stand Junction to

Kayamkulam Police Station Junction (Kayamkulam - Haripad (via)

Thattarambalam Scheme).

c) 350 meters from Adoor HS Junction to Adoor bye pass Junction

(Thiruvananthapuram - Thekkady (via) Changanassery scheme).

d) 270 meters from Adoor to Adoor Central Junction (Kottarakara –

Kottayam Scheme)

The scheme Kottarakkara - Kottayam is an approved scheme (ie)

complete exclusion scheme with exceptional clause. Kayamkulam - Punalur

and Kayamkulam - Kulathupuzha are approved schemes under partial

exclusion scheme category. The scheme Kayamkulam - Haripad is an

approved scheme falling under complete exclusion with exception clause.

The scheme Thiruvananthapuram - Thekkady (via) Changanassery falls

under the 31 routes mentioned in approved schemes in G O (P)

8/2017/trans dated 23.03.2017.

If there is a scheme in force with reference to the concerned route, the

authority has to adhere to the terms of the scheme. This authority has to

verify, whether there is absolute bar in the scheme against the grant of any

permit on the notified route or any portion of the route. If there is an

exception provided in the scheme, the authority has to look into the scope of

the exception. KSRTC has filed objection against the consideration of

application on the modified route. The enquiry officer has reported that

route portion from Keericadu Jetty to Kayamkulam is an interior area, hence

the curtailment of service on the above route will affect the smooth

conveyance of travelling public. Hence Secretary RTA shall conduct an

enquiry and file a detailed report with recommendation on the schemes and

its clauses on the route applied by the permit holder and place before next

RTA. Secretary RTA shall consider application for TP U/S 87 (1) (d), for

continued operation of stage carriage as provided in the order of Hon’ble

STAT. Hence adjourned.

U-3945 conducting service on the route Poochakkal - Cherthala - Vyttila via

Thavanakadavu – Thykkattussery – Thrichattukulam - Aroor Temple -

Vyttila for a further period of 5 years w.e.f. 19.01.2020. This permit was

issued prior to 14.07.2009 and is a long standing permit. Perused the file,

NOC from the financier produced. This is an inter district permit and

concurrence is not needed. The application was filed in time as per Section

81(2) of MV Act. KSRTC has raised no objection regarding the renewal. STU

has not filed any application on this route. Hence the renewal of Regular

Permit in respect of stage carriage KL-04-U-3945 conducting service on the

route Poochakkal - Cherthala - Vyttila via Thavanakadavu – Thykkattussery

5 years w.e.f. 19.01.2020 subject to the clearance of all government dues if

any.

AB 2728 conducting service on the route Cherthala – Kanichukulangara via

Kuruppankulangara - Areeparambu for a further period of 5 years w.e.f.

06.02.2020. This permit was issued on 06.02.2015 ie, after the date of

publication of the notification GO(P) No. 42/2009/Trans dtd. 14.07.2009

and GO(P) No. 08/2017/Trans dtd. 23.03.2017. Perused the file and no HPA

exists. The application was filed in time as per Section 81(2) of MV Act.

KSRTC has raised no objection regarding the renewal. STU has not filed any

application on this route. Hence the renewal of Regular Permit in respect of

stage carriage KL 08 AB 2728 conducting service on the route Cherthala –

Kanichukulangara via Kuruppankulangara - Areeparambu is granted for a

further period of 5 years w.e.f. 06.02.2020 subject to the clearance of all

government dues if any.

12.08.2019. Perused the file and no HPA exists. Hence the renewal of

Regular Permit in respect of stage carriage KL-15-6867 on the route Oachira

standing permit. Perused the file and no HPA exists. This is an inter district

permit and concurrence is not needed. The application was filed in time as

per Section 81(2) of MV Act. KSRTC has raised no objection regarding the

renewal. STU has not filed any application on this route. Hence the renewal

of Regular Permit in respect of stage carriage KL-05-AA-5625 on the route

Ayiramthengu – Thiruvalla via Oachira, Choonadu, Kattanam, Kurathicadu,

Mavelikkara, Mannar is granted for a further period of 5 years w.e.f.

AE-7121 on the route Veeyapuram – Venmony via Cyclemukku, Mannar,

Budhanoor, Chengannur, Kanjirathumoodu, Kakkanattupadi, Parachanda,

Changamala, Illathumeppuram for a further period of 5 years w.e.f.

14.05.2016. perused the Ordre of Hon’ble STAT in MVAA No. 48/2017 dtd.

28.11.2019.

Application for renewal of permit was rejected by this authority in its

meeting held on 11.11.2016 vide Item No. 77. Appeal petition was filed

before Hon’ble STAT and Hion’ble STAT in its order in MVAA No. 48/2017

directed to consider the renewal application and aplication of condonation of

delay and pass orders in accordance with law.

Considered the aplications on merits. Permits are issued in reference

to a vehicle. In this case stage carriage KL 07 AE 7121 owned by the

applicant was covered by the permit. This vehicle was dismantled on

04.02.2018. Stage Carriage KL 08 X 1575 was offered by the permit holder

for replacement. But the vehicle KL 08 X 1575 is not owned by the permit

holder and he failed to produce records of a ready vehicle in his name. An

operator, who not only defaulted the service, but also ceased to own the

vehicle for which the permit was issued, will not be entitled to a renewal of

his permit. The vehicle KL 07 AE 7121 is not in existance. Permit can be

renewed only on a ready vehicle. This permit can be treated as one under

suspended animation ie, permit without a ready vehicle which is clearly

contrary to the object and purpose of the 1988 Act and the 1989 Rules and

Judgment in W.A. Nos. 2486, 2455 and 2769 of 2015 dtd. 06.04.2016.

Hence rejected.

Bund road – Thanneermukkam - Cherthala Bus stand - Manorama

prior to 14.07.2009 and is a long standing permit. Perused the file and no

HPA exists. This is an inter district permit and concurrence is not needed.

The application was filed in time as per Section 81(2) of MV Act. KSRTC has

raised no objection regarding the renewal. STU has not filed any application

on this route. Hence the renewal of Regular Permit in respect of stage

carriage KL-02-BH-4390 conducting service on the route Kaippuzhamuttu –

Vyttila via Bund road – Thanneermukkam - Cherthala Bus stand -

Manorama Junction – Vayalar – Thuravoor - Aroor Byepass - Vytila is

granted for a further period of 5 years w.e.f. 16.08.2020 subject to the

1. Heard the learned counsel represented for the applicant. This is an

application for renewal of Regular Permit in respect of stage carriage KL-

06-D-5026 conducting service on the route Cherthala – Chellanam -

Eramalloor Via Saktheeswaram kavala - Railway station –

Kadakkarappally - Thanky church – Khandakarna temple - Pallithodu -

Thekke chellanam - Gundparambu and Ezhupunna for a further period

of 5 years w.e.f. 02.12.2015. This is an inter district route having route

length 26.5 Kms. The permit was primarily issued on 02.12.2010 ie, after

14.07.2009. As per Clause 5(c) of G.O.(P) No. 08/2017/Trans dtd.

23.03.2017, existing and operating permits in private sector as on

14.07.2009 are allowed to operate and permits will be granted to private

stage carriages on routes permitting them to overlap 5 kms or 5% of the

route length whichever is less. Secretary RTA has reported that route

overlaps the notified sector for 3.6 Kms, which is beyond the permissible

limit. This permit does not come under the saved permit category as

stipulated in GO(P) No. 8/2017/Trans dtd. 23.03.2017. The permit

cannot be renewed and hence rejected.

2. This item is remanded to Secretary RTA with direction to consider the

request and pass orders on the basis of existing provisions of Kerala

Motor Vehicles Taxation Act and Rules.

1. Heard the learned counsel represented for the applicant. This is an

application for renewal of Regular Permit in respect of stage carriage KL-

06-6548 on the route Karunagappally – Thatta via Pulliman Jn, Aramath

madam, Manappally, Pavumba, Thamarakkulam, Charumoodu, Para,

Edappon, Padanilam, Kurambala for the period from 25/1/2001 to

24/1/2006, 25/1/2006 to 24/1/2011, 25/1/2011 to 24/1/2016 and

from 25/1/2016 to 24/1/2021 for a further period of 5 years. Regular

permit expired on 24.01.2001. Application for renewal of permit was

submitted by the permit holder in time up to 24.12.2015. The application

was considered by RTA Alappuzha held on 11.07.2018 and the same was

adjourned for concurrence report form RTA Kollam and RTA

Pathanamthitta and the same has been received.

Considered the application on merits Stage Carriage KL 06/6548 is

an outdated vehicle and was under continuous G Form from 01.02.2005.

Another stage carriage was conducting service in place of stage carriage

KL 06/6548. Applicatuion for renewal of permit is to be disposed of as it

were an application for a permit. The vehicle KL 06/6548 cannot be

considered for issue or renewal of permit, as it had completed more than

20 years. The permit holder committed default of service and cannot be

considered as a successful operator. No attempt was made to operate the

vehicle KL 06 6548 on the permit granted to him. Application for renewal

refer to the registration mark of the vehicle covered by permit. Permit is

issued in the context of a vehicle and renewal of permit is sought in the

context of the vehicle. It is true that holder of the permit can get his

vehicle replaced during the currency of permit. The permit holder failed

to replace the vehicle. An application for renewal of permit without there

being a ‘ready vehicle’ with the application is not contemplated by Rule

172 of KMV Rules 1989. For the above reasons, application for renewal is

rejected.

2. The regular permit has no validity and the renewal of permit is rejected.

Replacement can be considered on a valid permit. Hence rejected.

Charummoodu Jn vide notification No.GO(ms) 157/67 Kayamkulam –

Punaloor and Kayamkulam – Kulathoopuzha scheme. On hearing KSRTC

has raised objection in this regards. Hence concurrence granted subject to

the effect of Clause 4 of Notification No. 42/2009/Trans dtd.14.07.2009 and

08/2017/Trans dtd. 23.03.2017 without prejudice to the right of the

primary authority to decide the nature of service depending on the route

length.

1. Heard the learned counsel represented the applicant. The application for

transfer of permit in respect of stage carriage KL 07 AP 3781 was

considered and allowed by RTA Alappuzha in its meeting held on

20.11.2019. Stage carriage KL 07 AP 3781 is in tax arrears and the

transfer of permit could not be effected so far. Decision of RTA has not

been complied so far. The maximum time contemplated under Rule 159

(2) of KMV Rules is over. Hence the decision of this RTA, allowing the

transfer of permit is revoked.

2. This is an application for replacement of vehicle KL 07 AP 3781, with

stage carriage KL 04 T 6363 and to transfer of permit to the name of

second applicant and proposed transferee, Sri. Bijumon.

The vehicle KL 07 AP 3781, stands Sri. Gowthaman, who is the permit

holder. Stage carriage KL 04 T 6363 stands registered in the name of Sri.

Bijumon. This application has no locus standi, since Sri. Bijumon is not the

permit holder and application for replacement of vehicle covered by a permit

can be filed by the permit holder only. Decision of RTA allowing transfer of

This is the request of Secretary, Ezhupunna Grama Panchayath for

shifting of Eramalloor Bus Stop. Perused the file, Secretary, RTA reported

that present bus stop (Eramalloor) is located at southern side of Eramalloor

signal junction is just less than 100 meters away from signal junction.

Proposed bus stop is located on a bus bay about 500 meters northern side

of the present bus stop. Changing of the bus stop from the existing place to

proposed bus bay wouldn’t cause any inconvenience to passengers.

Moreover, it would reduce the traffic block being developed near the present

bus stop as it is located near the traffic signal. Hence shifting of Eramalloor

Bus Stop is allowed.
