1. Komite Bersama akan dibentuk untuk mencapai tu}uan Memorandum Salil'l~ Pengenian il'li seca~a efektif

PASAL V~ PERLINDUNGAN HAK KEKAYAAN INTELEKTUAL

1. Para P ihak sepakat bahwa bahwa seotiap kekaya ao i ntetektua I yang rimbu I dari pelaksanaan Memo1andum Saling Pengertian ini akan bersama-sama dimiliki dan:

b. Setiap P•hak harus ber1anggung jawab atas s.egala kl.aim yang dibuat oleh Piha"k Ketiga atas kepemillkan dan k~absahan peoggunaan hak-hak k~kayaao inteloektual ljang dibawa oleh Pihak ~ersebut tlfllllk pelaks.anaan kegiatan kerjasama berdasarkan Memot.andum Saling PengeJ11an i ni.

2. Pihak ini al<an memberikan prefe:r@-n:si pertama dari kerja sama pada Pihak larn dalam M@fl"'orandum Saling Penger1ian •nL yang akan dibeba~kan. jika Pihak lain tidak dapat berpaflisipasi da1am c.ara yang saling me ng un tu ngk.a n.

PASAL \1~1 PERLINDUNGAN INFORMASI RAHASIA

1. Para P1 hak sepakat untuk mel i ndu ngi i nforma:s i rahasi a yang dapat d ia kses. dalam keraogka kerja sama Mernorandurn Saling Pengertian ini sesuai den9an hukum dan petaturan nasional yang berlaku.

2. lnformasi ra:hasia dan peralatan h.anya dapat dibenkan m8lalu• :s.aluran r~srni ataupun :saluran lain yang d1setujuj oleh Ke1ua Komite Bersama. lnformasi rahasia dan peralalan ~ersebut akall diberi labsl seauai deng.ao tingl(a~ dan dinyatakan seba~ai berikur:

PASAL VIII PEMBATASAN KEGIATAN PERSONIL

Selr•P orang yang lerikal <lengan kegiatan-lc."9ialan yang tetkail dengan Memoraooum Saling Pengertian ini tidak boleh melanggar hukum dan petaturan. Ubebasan polilik, kedaulatan. inlogrilas wilayah. dan penegakan hukum yang berJaku pada ma&ing-ma siflg Pihak.

PASAL IX ALOKASI ANGGARAN

1. Plhak tuao rumah penyelenggara pellemuon di wilayahnya akan menanggung ~eluruh biaya yang diketuarkal"' guna pe-rtemuan tersebut. Delegasi mallng-masing Pthak akan menanggung sen<liri biaya petjalanan dan akomodast ba9i yang h8clir ke pertemuan.

2 Biiiya-blaya lam <:tttlam PQ!3l<$8naan Momorandum Saling Pengert.ian ini akan diatur oleh pengaturan keu.angan yang terplsah berdasar1ctU'I kesimpulan antara kedua Pihak.

PASALX PENYELESAIAN SENGKETA

1. Set;ap petbedaan y8ng limt>ul dari atau dalam hubungannya <lengan penarairan atau pene:~apan Memorandum Salin Pengertian ini h.arus. datam kesempatan pel\ama. diserahkan kapada Komite Bersama unluk penyelesaian sec.ara damai.

2. Jika pertledaan tidak clapat diselesaikan pada tingka\ Komite Be<sama. ba1k Keclua Ke\ua Komite Bersama akan membawa masa!ah mtreka kepada masing-rnaslng Menteu Pertahanan dantatau Panglima Angkatan Sersenjata untuk penyelesai3n secara damai.

3. Oatam hal sengketa llda~ disetesaikan datam ayat 2. hal i!u akan dlselesaikan oleh Pata Plhak melalui saturan Oiptomatik

PASAL XI PERUBAHAN

1. Memorandum Saling Pengetllen im dapat diubah dengan membuat pernyataan se~a<a tertu6s atas persetujuan bersama oleh kedu a Pihak.

2. Setiap perubahan rerMdap Memorandum Safing Pengertian ini mulal bet1al<u pMa tanggal pemberrtahuan sel<anjutnya Para Pihak memberitahukan bahwa $emua persyanuan dalam ne-geri yang dipetlukan tetah dipenyhl.

PASAL XI PEMBERLAKUAN DAN PENGAKHIRAN

1. Para P;hak akan memberitahukan satu sama tain secara tettulis s,.etalah kebuluhan dalam negeri masing-masing unluk be~akunya Memorandum Saling Pengel1ian ini telah dlpenuhi. Memorandum Saling Pengertian akan mulai berlaku 30 hari sejak tanggal pemben!ahuan selanjutnya.

2 Memorandum Saing Pengertian ioi alum telap berlaku untok jangka waktu 5 (lma) lahun dan pada waklu berakhitnya dapal diperbaharui unluk foma (5) tahun berikutnya, kewali diMn!ikan oleh salah satu Pihak dengan menyan\padtan pembentahu.an tefakh1r secara tertulis kepada Pihak lainnya sekurang·kutangnya 90 {sembilan putuh) hari sebelum Pihak tersebut bermaksud mengakhin Momorandum Sartng Pengenian ini .

3. Pada saat Memorandum Saling Penger1ian ini berakhir. Para Pihak akon menenlukan langkah lebih Jaf1ut untuk s"mua proyek yang sedang be~aogsung. yang dllaksanakan datam rangka Memorandum Sa~ng Pengeoian lni berdas<~rllan kelentuan-ke!entuan dan persyatalan· persyaratan yang ditentukan secata jelas pe<syaratan dan kondisl .

Rec09nizing their common interest in poomotong oordial and friendly relatio~ anrl mutual cooperation in Ofder to promote peauo, stabilitY and p<osperity between lhe peoples of the two courttties:

Desiring to enhance and strenglhen ~ existing b•ateral relationship betwetn the ~ counlrieS through cooperative actovtUes In tile r.eld of defence in the spioit of gOOd neighbourliness. mutual trust and understanding:

Noting that the strengthening of defence cooperation woll oontribute 10 the mutually beneficial rerellons of bolh national defences;

Pursuant lo lhe prevailing laws and regulabons of the twO cour\lrie&:

ARTIClE I PURPOSE

The purpose of this Memorandum of Understanding is to p ro•ide a oommon fram!MOrk for promoting beneficial cooperation between deronoo and miftlary agencies of both Pariies

ARTiCLE II SCOPE OF COO~ERAT JON

The scope of oooperat~on of this MemQraodum of Understanding rnay include:

1. Exch~nge of Visits between Defence aod Armed Forces agencies: 2. Regul.ar Consu[talion on defence jsst_,es or common concern; 3. Cooperation between lhe two Armed Forces; 4. Educa~1on and ~raining; 5. Military Intelligence Exchange: 6. Coopera~ion •n Science and Technology in derence jndustry: 7. other areas of cooperation as mulually .agreed.

ARTICLE IV IMPLEMENTING ARRANGEMENTS

r=m the pu~pos.e of the implementation of this Memorandum of Understanding. •he operatjonal. adm•nistrative and technical matters shalf be subject to separate implementing aHangements to be wnc~uded bet\veen both Part•es.

ARTICLE V JOINT COMMJTIEE

1. A Joint Committee shalf be establish~ to effectively achieve the purpose of lh•s. Memo~andum of Understanding

2. The Meeling of the Joint Committee shatl be co-chaired by the appropriate 5-enior defence officials. from boV·1 Parties..

3. The Joint Committee shaiJ:

a. identify issues of common concern and •ntere st;

b. recommend cooperative activit1es and ptogrammes within the framework of th1s Memo~andum of Understa nd•ng;

c. ooordinale. monitor. and control tha imp•ementation of the cooperatwe­ac.h .. ·i•ies. and programmes.;

d. re\liew and evdlluate the implementa•ion of thi:s MemOJanoiJm of Understanding annually:

e_ subm1• annual repm1 to the resped1ve Defence Ministers of both Parties: and

f. settle .any drfteren.ce or divergence of v1ews on •he implementation of this Memorandum or Understanding

4. The c.ompositi-tm and the number of the members of the Join• Committee s.h:i~ll be mutually 3g~eed by both Parties. It may include experts in rimited numbers. from other minis.tnes.. departmen•:s or related institutions.

5. The Jo•nt Committee shall meet at re.ast once in two ye.ars or as and when it deems necessary tn a place mutually agreed

6. The Joint Committee may establish Working Groups as. and when it deems. necessal"y rot carrying out c.oope(a••ve act4vities. programmes. or other specific tasks. . T'he Workmg Groups. shall report to the Joint Committee.

ARTICLE VI PROTECTION OF INTELLECTUAL PROPERlY R•GHTS

1 The Parties agree !hat any intellectual proper1y at•sing under the imp1ement.ation of 1his Memorandum of Understandiog w~ll be jt~intly owned and:

a. Each Party shall be allowed to use such intellectual p~oper1y ror the purpose of maintaining, adapting and improviog •he relevant property.

b Each Party shall be ~iable fot any claim made by any third party on the ownershrp and IE!-gality or the use of the lntelleCtllol proper1y rights which is brought m by •he aforementione-d P.arty for ~he implemen•a1!on or the coope~a:tion acti...,d1es. under th 1s Memorandum of U nderslandjng

2. If either of the Party wishes to disc1os.e confidentia• data and/or mformation 1esultiog frorn the cooperation act~vities und-er this Memorandum ol Undel"s!anding to any th1rd party. the disclosing party must obtain prior cons-en• rrom the other Party berore any di5clo$we can be made.

3. In the event the intellectual prope-rty is used t>y the Party aodlor institution on behalf of U1e Government for CQmmerci al p urpos.e s. t11e other Party shall be ent1tled to obtain equitable portion of royalty.

4. Wh~mever either Par1y requires the coopefal•on of another party ou•side the Government or the Republic of Indonesia and th~ Government of the Socialist Republic of Viet Nam fof any commercial undertat<ing resulting from irUellectual property coveted by ~his Memorandum of Understanding. this Par1y will give f•rs.• preference of the cooperation ro the other Party under this Memorand urn of Understanding. which will be waived, if the other Party is unable to participate in a mutuaily beneficiat manner.

ARTICLE VII PROTECTION OF CLASSlFIEO INFORMATION

1. The Paf1ies shall pJo~ect the c~assitied mformation to whrch they may have access to wjthin the framework of lhis. M em ora nd urn of U ndersta ndjng in accordance with their nationar raws and regulations.

2. The classified information and equipment shall only be pro~ided through official channels Of other channers agreed' upon by Co-Chairs of the Joiot Comm itt~~?. These inform ati(m and equipment are to be labelled wi•h • he iodicatio n level aod State of Origin as follows:

3. Afl information and' equipment rece~ved in lhe rramework of •his Memorandum or Unden~tandiog shall not be transferred. disclosed or release-d, either directly or indirectly, on temporary or permanent basis, to third par1it~s. whether persons and entiti~s. without the poor written consent of the originating Party.

ARTICLE VIII LIMITATION OF PERSONNEL ACTIVITIES

Any persons eng a nged in a ctivit1 e-s. related to this Me mora nd urn of Understanding shall not infringe laws and regulations. political independence, sovereignty. territorial integrity and law enforcement acti~1t1e~ of fespective Parties.

ARTrCLE IX FINANCIAL A RRA NG EM E NTS

1. The Party hosting the m Beting in its te rfitory shall bear all eX'penses i nc.mred io convening such meeting. Each Dere9ation of the Parties shall be.ar its own travel and accommodation expenses in respect or its attendance to the meetings.

2. Othet expenses incurred m the implementahon of this. Memmandum or U nders.tan<i ing are subject to separate fi na nc~a I arrangement to be concluded between both Part•es.

ARTICLE X SETTLEMENT OF DISPUTES

t Any matter a~ising from this Memorandum or Understanding with respec~ to its interpretation. application or implementalion shall. in the first instance. be submitted to the Joint Committee for amicable settlement

2 In the event that the dispute is not settled at the Jo•nt Commiltee level. both Co-Chairs of the Joint Committee shall bring the matter to their ,es.pec:tive Ministers of Defence for ~mica.ble setlleme nt.

3. In th-E: evenl that the dispute is not settled under paragraph 2, tt shall be settled by the Parties through diplomatic r:hannel.

ARTICLE XI AMENDMENT

1. This Memorandum of Understanding may be amended in wrning by mutoal consent by both Parties.

2. Any amendment to this Memorandum of Understanding shall come mto force on the dale of the lasl notification of the Parties informing that all necessary domestic requirements have been comp"ed with
