The Klb.t awd Datlea of Behaal Di- rectory, and or tbe Children's r"ar-cat- s Apoloxlea Illegal. Brief mention was made a few days aince of an opinion delivered by Judge J. O. Pierce, of tbe Shelby county circuit court, on tbe powers and authority o( school directors over the conduct of pupils and expulsion of such pupils from tbe schools. Judee Pierce clearly lays down tbe law on the subject, in the opinion (riven below, which will be of in- terest to all school d. rectors throughout the State. The demand often made by school directors that an apolocy tor past misconduct shall be made by the puil or by the parents of the child is treated by Judge Pierce as somewhat ridiculous, and, as he expressed it, is going too far. The case was argued in court by Mr. W. M. Randalph for the relator or piaiutiff, aud by Messrs. Taylor and Car-ro- il for thi; defendants: la the Circuit Court of Shelby county, State of Ten- nessee, tz rtl-- 3. A. M Daniel vs. York, Ward and Merrill, School Directors, District No. 2, applica- tion for a mandamus to restore two children to the public schools. First Tbe 111 feeling that has attended tbe diffi- culties which resulted In this litigation U sincerely deprecated by tbe court. It la tbe duty ot tbe parties to ptocetd with the matter, so far as any other su-p- a may become necessary, without cr prejudice on either side. The defenaant as coui.ty officers, are to be treated with ail reap ct by their fellow-elllz-n- s In all matters wherein ihey are called on to discbarge ofU cial duties; and they are of couise expected to dis- charge all such duties to so Impartial and dignified mauner as to command respect. HMCund l be deleudants as school directors will be allowed to proceed with the regulation of the school, and to exercise ineir own aiscreiion herein, except BO Iar as u may appear ciearij to the court that they have carried or are likriy to carry the exercises of suen discretion to an un- reasonable aud Improper extent. Thlrd-- As to the mauner lu which the school dl rectors shall invest gie any charges that may be preferred against school children, the court will not limit their discretion. They may act upon such evi dence as Is satlsiactory to themselves; they may take evioeuce 1 1 such manner aud under such circum stances as they see rropei; aud they will be Inter- fered with br the court only In case they have acted upon no evidence at all or upon evidence clearly In- sufficient. Fouith The court holds that the school directors at d the teacher may control the actions and conduct of school children, outside of and away from tbe cnoolroom,l(i all m Alters which concern tbe discip- line, welfaie. gooj oruer and peace ot the school, but not lu'ther; and they may exclude children whose severally vulgar or Improper con duct or lauguage outside tbe school show tuat they are not nt ooiuiianions lor me otner scholars. I bee eberuiitn vs. Cuail. stown. 8 Cuahing 160. aud San ders i beaver, 32 Vermont, 114. Filth The c urt Is saiistlod, as to the case ot tbe younger son ot tue relator, that tbe defendants In expelling the boy acted upon sufficient evidence and w in sufficient cause. Tbe boy is evident y an unm Inmate of a public school; and until he reforms, or good assurances are given ot his future better con- duct, the defendants will be Justified In excluding him from tne scnooi; auu, as to tuts cntia, toe case win be left by the court eullrely to tbe discretion of the defendants. oixin as to tne older son of relator, the proof shows some Instances of bid conduct, such as were sufficient to authorize his suspension tioin school, or bis expulsion for a time. He may be restored If the relator wlil undertake to restrain him In the future, and to co-- o wrate with the school authorities In re quiring hliu to properly conduct blmselt hereafter; and as the relator in open court states mat ue con- siders tbis to be his duty, and promises so to do, this bvy may now be restored to tbe school. It Is proper to sa, however, tuat tbe defendants should Closely scutlnlze bis conduct, an l promptly remove bim if be again makes nimseir onenotve, or so conducts himself as to make him an unlit Companion to the other school children. Seventh lu tbts case the requirement by the di rectors of an apology for the pant misconduct of the children Is deemed unnecess.try. They cannot re quire a parent to apologise for a child s misconduct. xne naren t is to some extent responsiDie ior suen mif- - cotiduct; but they fbould assume that he Is himlf offended and grieved by such misconduct. At night the music of the cotton com- press is ail the sound you hear. The nihilists, now that they use dyna- mite, should be called annihilists. Tbe digging of sewer ditches progresses throuxbout tue city in a lively manner. The lodges of Knights of Honor in this city sre increasing rapidly m membership, Hopefield claims to be the banner town in Arkansas in subscribing to the Irish relief fund. The scarlet fever season is passing away, and the new cisaa are rapidly falling on in numbers. The ovet flow wave is the coming danger, Lower bottom planters had better look out for stock. The sunny weather of yesterday induced hundreds of ladies to appear on the streets and go shopping. The usual number of marriage-license- s were issued by tne county court clerk yester aay, and cuuny to colored people. The merchants are doing a heavy busi ness at present. The past business seasons never kept up so weil as hail the present. The probability is that before tbe next cotton crop a mammoth cotton-she- d will be erected in Memphis, so as to keep the staple out of the wet. Alter datk lest evening, and up to one o'clock this morning, bat one arrest was roadti by tha police, and tuat was for d. and d dtuuk end disorderly. At the Memphis club hail, last night, an elegant masquerade ball was given by the members. There was a large attendaLce and all the ailair, was gotten up in elegant style. The ravers are putting down rock on Madison street at the east end. The work is finished ud to near Fourth street. Between second and Main, oa Madison, work is al ready progressing. Is it Arkansas or Arkansaw ? is the con nundrum ovir the river. Oa this side At kansaw has been carried by a large majority over Arkansas, and it cancot be counted cut by a returning board. Sixteen arrests were made by the police yesterday eight of them tor doing business without a license, lour tor violating oeaun ordinance, three tor drunkenness, and one, George Wiliiamr, for larceny. It is (xoected that Judge Horrigan, ot the criminal court, will deliver his opinion on the motion made and argued several days since to quash the indictments found against J. A. Anderson as public ad minis trator. Men with money seeking a safe invest- ment will do well to attend the sale of the Mitchell "Camp Marks" lands on Saturday next. It is only a question of time when lands, like rai.road stocks and other less sub stautial property, will feel the business boom, t, out near the Hernando road, the citizens will meet to organize for the pro- tection of lite and property against robbers and burglars. Daring the yellow-feve- r last vear a similar organization in the suburbs bad a moot beneficial effect upon law-brea- k' erg. The sale of seats for the John M'Cul lough engagement at the Theater next week is alreadv verv large. Reserved seats are be- in? secured for every night of tbe week and for the Saturday matinee. Those who desire to have good seats had better apply in time. Five little stone-cutte- rs are whacking away on marble for the customhouse build- ing. It would take them about one thousand voara ta finish the stone necessary for that purpose. U i.l-8- the United States looks into tbe matter the nresent feneration will be long in the grave before the customhouse is finished. About twelve o'clock last night two hackmen at the Monroe street stand, near Main, engaged in a rough ht of a moat interesting character for about two minutes. They were separated by the other hackmeo, and co arrests were made. The matter wai amicably adjusted over a few glasses of beer. Last eveninc the cotton-storehou- se of Thomas Fox, 152 Front street. Exchange building, was entered by thieves, who nfled several cotton-bag- s and carried off three large bags of cotton. The theft was discov- ered, but the thiet escaped. A negro was ar- rested on suspicion by tbe police, and it is believed that he knows something ot the robbery. The residents or Drooertv-owrJer- a on Ynce street have already subscribed six thousand dollars of the twelve thousand nec- essary to raise, so that the Taxing-Distri- ct government will appropriate the remainder required to pave tbe street iiom Main out to the Charleston railroad track. The pilfering and depredations by tramps, sneak-thieve- s and burglars ia the suburb of tbe city, outside the limits of the Taxing- - District, have become intolerable to the resi dents of such localities. JEFFERSON DAVIS ON THE "TRAMP" QDESTION. Jackson Clarion: Hon. Francis A. Wo'ff. of Tippah, kindly placed at cur disposal the following letter to him from Davis, upon a subject that has engaged tbe attention of tbe legislature. It was not written for publication, but contains nothing that need be held from tbe public. Mr. Wolff, it will be remembered, was one of the immortal First Mississippi regiment who fol- lowed the fortunes of Mr. Davis and made the fame in the war in which it played so conspicuous and glorious a part: BaAtrvoiR, February 19, 1880. Eon. Francis A. Wolff: Fhik.sd I have read your remarks on the proposition to amend Ibe article in the code by strik- ing out tbe word "tramp" and subst tuttng that of "vagrant." I was not only pleased with your speech, but I concur with you entirety as tUe propriety ot your proposed amendment. Tbe word "tramp" has now a temporary significance, admitted to be express- ive, as all slang Is for ibe tune being and among those by whom It Is accepted. But one does not look tor siaug In a leg '1 statute, and, with all cue defer- ence. It does not seem to me It ought there be found. Your on tbe other hand. Is a good Eng- lish word with a fixed meaning, and the use of It struck at one of tbe great political and social evils of our time vagrancy. You and I, In our soldier days, "tramped" over valley and mountain, and Mississippi seemed to think our steps bad been In the path of her honor and glory, and that waa a part of your adventurous life to which tou tailed to allude In telling and some- times brilliant speech to the legislature. Whenever one of the old Mississippi regiment does something beautiful or great. It fills my heart with a Joy few niner inwgs c ana give, wnn coraiai regal a ana beat wishes, I am yours faithfully. Brief mention was made a few days ainceof an opinion delivered by Judge J. O.Pierce, of tbe Shelby county circuit court, ontbe powers and authority o( school directorsover the conduct of pupils and expulsion ofsuch pupils from tbe schools. Judee Pierceclearly lays down tbe law on the subject, inthe opinion (riven below, which will be of in-

terest to all school d. rectors throughout theState. The demand often made by schooldirectors that an apolocy tor past misconductshall be made by the puil or by the parentsof the child is treated by Judge Pierce assomewhat ridiculous, and, as he expressed it,is going too far. The case was argued incourt by Mr. W. M. Randalph for the relatoror piaiutiff, aud by Messrs. Taylor and Car-ro- il

The defenaant as coui.ty officers, are to betreated with ail reap ct by their fellow-elllz-n- s In allmatters wherein ihey are called on to discbarge ofUcial duties; and they are of couise expected to dis-charge all such duties to so Impartial and dignified

be allowed to proceed with the regulation of theschool, and to exercise ineir own aiscreiionherein, except BO Iar as u may appear ciearij

to the court that they have carried or are likriyto carry the exercises of suen discretion to an un-reasonable aud Improper extent.

Thlrd-- As to the mauner lu which the school dlrectors shall invest gie any charges that may bepreferred against school children, the court will notlimit their discretion. They may act upon such evidence as Is satlsiactory to themselves; they may takeevioeuce 1 1 such manner aud under such circumstances as they see rropei; aud they will be Inter-fered with br the court only In case they have actedupon no evidence at all or upon evidence clearly In-

Tbe boy is evident y an unmInmate of a public school; and until he reforms, orgood assurances are given ot his future better con-duct, the defendants will be Justified In excludinghim from tne scnooi; auu, as to tuts cntia, toe casewin be left by the court eullrely to tbe discretion ofthe defendants.

oixin as to tne older son of relator, the proofshows some Instances of bid conduct, such as weresufficient to authorize his suspension tioin school, orbis expulsion for a time. He may be restored If therelator wlil undertake to restrain him In the future, and to co-- o wrate with the school authorities In requiring hliu to properly conduct blmselt hereafter;and as the relator in open court states mat ue con-siders tbis to be his duty, and promises so to do, thisbvy may now be restored to tbe school. It Is properto sa, however, tuat tbe defendants should Closelyscutlnlze bis conduct, an l promptly remove bim ifbe again makes nimseir onenotve, or so conductshimself as to make him an unlit Companion to theother school children.

report of the sub committee of thehouse military committee does not recommend a reduction in the line of tbe army, butwill make very charges the personnel of the officers. Tbere beprovisions in tbe bill tor supernumeraryofficers, the number of each will bedesignated, and lower officers in excessof number it is now proposed (o musterout of the service, making it optional forthem to resign a year s pay. Eng,llsh Pasts and .Feathers.The London correspondent of the New

York 1'ribune gives an elaborate and exceed-ingly interesting account of the ceremoniesat tbe opening of parliament. The mostsuggestive patagraph, however, is the con-

ceding cue:ceremony was over. Parliament had been

opened by the In person. 1 throngup. As we passed I met a member ot

of much distinction, who remaked, "It's acoin ft rt to think what a Jolly smash we shallsome day of this Japanese mummery."

A hundred years sgo such remark fromsuch a person have been made thebasis ot a cbarce treason. Duty yearsago it certainly would have been condemnedas fl it disloyalty. Twenty-fiv- e years it

hae been considered an exceptionalcase of very bad taste. Now it willprovoke a passing comment.

LETT KB FROM HON. JEFFERSON DAVIS ONTHE "TRAMP" QDESTION.

Jackson Clarion: Hon. Francis A. Wo'ff.of Tippah, kindly placed at cur disposalthe following letter to him from

Davis, upon a subject that has engagedtbe attention of tbe legislature. It was notwritten for publication, but contains nothingthat need be held from tbe public. Mr.Wolff, it will be remembered, was one of theimmortal First Mississippi regiment who fol-

lowed the fortunes of Mr. Davis and madethe fame in the war in which itplayed so conspicuous and glorious a part:

BaAtrvoiR, February 19, 1880.Eon. Francis A. Wolff:

Fhik.sd I have read your remarks on theproposition to amend Ibe article in the code by strik-ing out tbe word "tramp" and subst tuttng that of"vagrant." I was not only pleased with your speech, but I concur with you entirety as tUe propriety otyour proposed amendment. Tbe word "tramp" hasnow a temporary significance, admitted to be express-ive, as all slang Is for ibe tune being and amongthose by whom It Is accepted. But one does not looktor siaug In a leg '1 statute, and, with all cue defer-ence. It does not seem to me It ought there be found.Your on tbe other hand. Is a good Eng-lish word with a fixed meaning, and the use of Itstruck at one of tbe great political and social evilsof our time vagrancy. You and I, In oursoldier days, "tramped" over valley and mountain, and Mississippi seemed to think our steps badbeen In the path of her honor and glory, and thatwaa a part of your adventurous life to which tou

tailed to allude In telling and some-times brilliant speech to the legislature. Wheneverone of the old Mississippi regiment does somethingbeautiful or great. It fills my heart with a Joy fewniner inwgs c ana give, wnn coraiai regal a anabeat wishes, I am yours faithfully.
